we begin with breaking news out of election why where the police chief just resign. >> chief david baker september his letter of resignation a short time ago and comes a few days after he was arrested on drunk driving charges. news4's julie carey slooif in alexandria with more on this developing story. julie? >> reporter: it is a letter of retirement, the chief dave baker's attorney delivered to city, city manager, an hour ago. the chief's dision to retire rather than fight to keep his job came as the city manager was conducting an invernal investigation with the chief's fate to be expected by week's end and internal investigation now rendered mute by the chief's retirement. the chief dave baker a few hours ago, sent a letter to the more than 400 officers and civilian members of the department that he headed since 2006. and worked for for nearly two decades. addressed to my friends, it reads, it is with a great deal of humility and remorse i announce my retirement from

tleks wra police department. baker's career began to unravel saturday night. that's when he was arrested in arlington county after an accident on the ramp lead toypg 66. he was in a city-owned vehicle and he was charged with dwi. his blood alcohol level .19. more than twice the legal limit. baker also failed all four sobriety tests given to him on the scene and was immediately placed on administrative leave. baker decided to submit his resignation rather than positive -- retirement, rather, rather than fighting for his job because retiring would be in the city's best interests. his court case on the drunk driving charges is pending. but a hearing that was scheduled for tomorrow has now been postponed until mid august. coming up on "news4 at 5:00," we will have much more, including

comments from chief baker's attorney and from city officials and the deputy chief, earl cook, has been named acting chief and he was named that sunday and he remains in that position. reporting live from alexandria, julie carey, back to you. >> thanks, julie. to the late nest the michael jackson investigation toy. policeontinue to focus on his personal physician. today for the second time in less than a week, investigators descended on dr. conrad murray's property. looking for evidence of any crime. there are also new details out this afternoon about the singer's behavior in the days just before his death. here's jay gray. >> as investigators gathered at hisas vegas office, officers also visited dr. conrad murray's home in this gated community near the vegas strip. >> looking for document. >> the search similar to one at murray's clinic and storage facility in houston late last week. >> this d.a.'s office in los angeles doesn't want another o.j. moment. they are working very hard

behind the scenes to make sure that before they even bring the charges, they have all the evidence. because they have gotten burned before. >> reporter: according to court documents, charge could include manslaughter. police sources tell nbc news murray did administer the powerful sedative propofol the morning jackson died. >> it certainly would indicate that diprivan/propofol is a primary drug here involved in the death. it doesn't say that the drug by and of itself caused the death. >> reporter: dr. murray's lawyer continues to insist his client has done nothing wrong and issued a statement which is said in part -- we will not be commenting on rumors, innuendo or unnamed sources. things to shake out when the facts are made known and i'm sure that will happen here as well. there's apparently now a public picture being revealed of jackson's private life in the days before his death. according to published reports, the pop star demanded that the temperature in his bedroom remain very hot, stifling,

according to some, with gas fireplaces and heating system set to their highest levels. the living quarters were said to be a mess with clothes scattered everywhere and dozen of handwritten messages on post-it notes stuck to the walls. all pieces of a confusing puzzle investigators have been working on since his death. of course, the biggest piece of that puzzle is the autopsy report with toxicology results which should be released sometime this week. in los angeles, jay gray, news4. relatives of the virginia tech shootingasking the state t investigation into the mass 32 people died in the 2007 rampage. a state commission investigated issued a report four months after the shooting. however, a group of parents now believe that the findings are incomplete now that some new evidence have surfaced. last week we learned that missing mental health records of the student's gunman had been

found in his counselor's home. cho committed suicide after ening fire on the blacksburg campus. interesting discovery after fire destroyed a popular prince george's county club overnight. the blaze broke out at the knights of columbus hall just after 2:00 this morning. the cause of the fire is still under investigation this afternoon and now that investigation is taking a turn. megan mcgrath has the report. >> reporter: fire crews knocked down flare-ups on the roof while down below members of the knights of columbus discussed what to do next. burn manor hall which hosted countless social events over the years is in ruins. gutted by an early morning fire. >> totally burned down. >> reporter: the lodge, community landmark, has been at the encenter of legal rangeling. it was sold in foreclosure but according to a lawyer representing the chapter the validity of that sale is being challenged in court. kenneth holmes is a member of the knights of columbus and says a new generation of members had

recently taken the reigns and turned to plan things around but the fire put things on definite hold. >> we are rein the rebuilding phase. we were trying to get into the community and so forth and as the knights of columbus. you know, and -- just a shock. >> reporter: the lodge often is raented out as a venue of events like a popular go-go knight. an off-duty sheriff's deputy was seriously injured while working security at an event. according to the fire department the utilities had been cut to the building and sources say that there was no electricity or gas, that the facility was running off a generator. as the fire department wrapped up their investigation this morning, a tow truck could be seen taking two cars from the property. according to the fire department, the vehicles are listed as stolen. the building was empty at the time the fire broke out. no word on what caused the blaze. in oxen hill, maig making a

mcgrath, news4. he was just 20. bryce gillies dispyred during a backpacking trip to the grand canyon. his body was discovered saturday by center much party and he died from dehydration. his father said his son began the trip july 17th and didn't hear from him. his father also says it seems their son got lost in and ran out of water in the extreme heat. the trip was to celebrate his 20th birthday. the latest in a judge's pants lawsuit. fears of an explosion at union station. >> four other stories making headlines in the washington area today. >> maryland senator barbara mikulski is recovering from surge roy her broken ankle this weekend. a spokesperson for the senator says she is expected to make a full recovery. she broke her ankle in three places when leaving church in baltimore. in a statement mikulski says she wants everyone to be able to receive the same type of health care she's got. another law sue by the

so-called pants judge has been ordered thrown out of court now. this time former d.c. judge roy pearson lost his wrongful termination case. he is the man that sued the owners after dry-cleaning shop for $54 million after they st his favorite pair of pants. pearson claims the district used the fact that he wasvillefied in the media to dismiss him from his post as an administrative judge. the judicial commission did not cite the pants lawsuit as the reason for firing pearson. they there was a strong basis for the firing. reports of an explosion caused brief scare at union station this afternoon. d.c. fire and ems units responded to the calls good a large explosion just before noon. the calls also reported a plume of black smoke in the area around union station. it turned out to be a false alarm. there's no evidence of an explosion at the station and crews trace the reports back to an area where maintenance work was taking place on north capitol street. if you plan to pick someone

up at bwi thurgood marshall airport it will cost you. you used to be able to park for free for 30 minutes while helping friends and family get and you on of the terminal. now that first half hour will cost you $2. an air important spokesperson says that there is still a cell phone lock for drivers waiting for someone to arrive. they say the new parking charge will help the airport raise money during the tough economy. severe weather in north carolina may be to blame for the death of a virginia man. investigators tell us 49-year-old matthew gloem of woodbridge, virginia, was jogging along the beacher in kill devil hills when struck by lightning. authorities found his body last tonight. there is word he was staying with family in the area. the cause of death has not officially been determined but officials say that they are pretty sure he was hit by lightning that swept through that area yesterday. there are a few clouds moving in over us. will they keep us cool?

by 11:00. turning mostly cloudy and we will see more clouds moving in overnight. it is going to be humid tomorrow. a little cooler a we could have some of that hottest air, highest temperatures coming up before the week is over. we will talk more about that in a few minutes. back to you. >> allright. thanks, veronica. judge sonia sotomayor is closer to becoming the first hispanic justice on the u.s. supreme court. today the senate judiciary committee voted to approve her nomination. the vote was 13-6. every democrat on the committee as well as one republican gave her the okay. the approval means the nomination heads to the full senate for a vote next week. we are just getting started on "news4 at 4:00" when it comes to the h1n1 virus or swine flu, healthy women pregnant have been particularly impacted. we will hear how that is impacting plans for vaccinations. in economy, will it be a buyer's market for back-to-school shoppers? we will find out if there are any deals to be had. many are considering loans

while the school kids enjoy their summer break, parents are counting their pennies. in a survey, four out of five americans say the economy will affect their back-for-school spending and that has some retailers a little worried. michelle franzen has our story. >> reporter: school hasn't even started yet. and already there are the tests. but this time, retailers are cramming for the pass or fail grades. back-to-school shop sing the

second largest time of the year for retail sales. right behind the holiday period. but the fragile economy could erase any profits. especially for clothing and department stores. >> the economy rolled over a year, year and a half ago. we have been in a fashion recession so to speak for up to three years. >> reporter: we tail sales for clothing and electronics have been off the past few months and unemployment continues to climb. the national retame federation estimates consumers will spend on average $550 on back-to-school items, $50 less than last year. >> just getting what's on the list and nothing else. i'm still shopping at same places. not buying as much. >> reporter: retailers are taking note of the frugal mindset. discount stores and office supply chains are slashing prices and focusing ads on the basics. >> savings on everything for back to school. >> reporr: a new concern for retailers selling big ticket items. college students who will be living at home up 20% in the

past two years. >> the retailers that were expected to be affected by that are the ones selling home furnishings and home decor because when you are living with mom and dad you don't need silverware, microwave extra long sheets. >> reporter: new rules for back-to-school shopping and a crash course on how retail sales could stack up and heading into the holiday season. michelle franzen, news4. here are the final closing numbers from wall street on tuesday. the dow lost 11 points but remains above the 9000 level. the nasdaq gained seven points the day and the new york stock exchange closed 36 points lower. there is new concern today about the financial problems that more seniors are suddenly facing. older americans are racking up credit card debt faster than any other e group. low and middle-income consumers aged 6 5 and older carry more than $10,000 in credit card debt last year. that's up 26% from 2005.

consumers are using credit cards for necessities, more than half of the households say medical c debt load. bank of america is planning a major pullback. the ceo says he will be slashing the bank's branches by 10% as the word from "the wall street journal" today bank of america spent the past 20 years expanding from coast to coast. now it says more customers are using online banking. bank of america has taken $45 billion in bailout money. it acquired untrywide financial group last summer and merrill lynch in january. pat? >> the increasing cost of a college education. many students and parents depend on loans to pay for college these days but there are some things to keep in mind before you aume all of that debt. cnbc's carmen wong ulrich more on "nbc news insider report."

>> reporter: parents of grads and everyone in between to pay for a degree are faced with student loans. july 1, the payment program went in a effect which covers all federal student loans and cap it is monthly loan payments to 15% of your discretionary income, up to 25 years. after which your loans are forgiven. even with the new plan in place student loans are in serious debts that don't disappear. even in bankruptcy. what's the tipping point form student loans? when do they go from investing in a future to an anchor dragging you down? before you take on more student loan debt or thinking go to graduate school is the answer to a sour job market do math. how much would you have to make a year or a month to be able to pay the minimum? is it realistic you be able to get a job that can cover the loans? and parents, please do not take on too much student loan debt yourself. a lot less time to pay off the loans and you need to make sure your retirement is secure first. i'm carmen wong ulrich, cnbc. tonight at 7:00 on "nbc

headed for home after undocking from the international space station. it was an emotional good-bye for the "endeavour" crew and stronts current living onboard the station. the two groups have been working together for 11 days now making a lot of improvements up there. the crew leaves behind a newly installed porch and experiments for the new japanese lab. space station is now 83% complete. there were a few problems up there including a broken toilet and air conditioning system. we remember that. but the shuttle is expected to land in florida on friday. >> that's priority. getting that toilet figures. >> lot of high fives. >> bangladesh. this is record rainfall for the area. this is what they had to deal with today getting around. some of the city's heaviest rain ever on record. 11.5 inches of rain in just a six-hour period. i p 60 years, that's the biggs rainfall for that part of the city.

manslaughter. it is the second time in less than a week that authorities have targeted murray's property. >> fire investigators and n prince george's county are trying to figure out what sparked a blaze that destroyed the knights of columbus hall in oxon hill. the blaze broke out at 2:00 this morning. the home was home to a popular go-go club. according to a new survey four out of five americans say the economy will affect their back-to-school shopping this year. consumers are expected to spend on average $550 on back-to-school items this summer. $50 less than they spent last year. the retailers, meanwhile, responding to deep discounts to lure shoppers. clinical trials to test the n2h1 vaccine are scheduled to begin next week. tomorrow experts will get togethering to discuss who should be vac sin eight first. >> kristen dahlgren explains now expected mothers will likely be given top priority.

>> reporter: young healthy women succumbing to the n2h1 because of one factor -- they are pregnant. also more than 300 deaths in the u.s. associated with the swine flu. at least 15 victims were pregnant. like this woman in illinois who passed away in may. >> she couldn't get enoh oxygen in her blood. she could not breathe enough. even though she was strong and always healthy and strong. >> if a pregnant woman becomes ill with influenza pregnant women have rates of complications of influenza, hospitalization, pneumonia, even death. >> reporter: it is expected that pregnant women will be high on the list to get the swine flu vaccine when it becomes available. possibly in october. >> there won't be enough for everyone. we will have to prioritize. some people will be asked to go first in line and someill be asked to hold back. >> reporter:he h1n1 virus is not fonl flu strain that will circulate this winter. most doctors recommend pregnant

women get the seasonal flu vaccine. which is in production now. kristen dahlgren, news4. we have an update on that group of local high school students quarantined in china because of the swine flu. they have all been released now except one. and we are told that some of the students will return to the states on thursday. the others will continue their tour. meanwhile a group of oregon students has been quarantined by chinese authorities for a second time. they were released last week. then quarantined again today. and after tests on three of the teens came back positive for the h1n1 virus. the students arrived in china two weeks ago and the group could be quarantined until friday which means they will likely miss their scheduled flight home. police were out in force today looking for big riggs that shouldn't be on our roads. officers found plenty of them on route 1 near ft. belvoir. officers pulled over 23 trucks and put 22 of them out of service for violations such aspha asphalty brakes and bad steering. who truck drivers were cited

with violations and can no longer be behind the wheel. police tell us they plan to conduct more of these investigations in the future and hope truck drivers will get the message that they need to keep their riggs in good shape. most drivers would never think to drink and drive. but some of those same drivers admit they do text and drive which turns out can be even deadlier. michelle kosinski explains why. >> reporter: some are keld texting while driving or trying to drive. and we have seen the crashes. caused by those little messages that surely could have waited this texas bus driver was textation way right before this. no one was hurt. unlike this california train disaster in which the driver had been texting a 25 people died. several studies have shown that

reaction time and steering control while drivers were tapping suffered more than when they were actually drunk. but now the latest study by virginia tech of truck drivers over 18 months showed their risk of a crash was 23 times higher while texting. because it kept their eyes off the road longer than any other distraction. 14 states in the district of columbia have now banned texting while driving. yet a new survey of drivers by aaa reveals while almost all of them see texting as just as scare don't the roads as drunk driving, more than one-fifth still do it anyway. >> those people that admitted to text or e-mailing while they drive, eight ouftd ten those individuals said they knew it was dangerous. that's outrageous to me. >> reporter: the teen texters were caught on tape by their cameras even though they knew there were cameras in their cars. "the new york times" snapped

there. for the nearly 9,000 americans waiting for a heart transplant, there's often only a small chance of getting a newhart. but now the newest version of the artificial heart is giving heart failure patients more time to live and more time to enjoy life. eun yang has the story. >> i passed out. i mean, i was out and i was going. it took eight firemen to bring me back. i think that mard the real steep decline because from that point i just felt like, you know, my life was over. >> reporter: it was last october when doctors told freddie moore he probably would die if he didn't get a heart transplant soon. the 60-year-old virginia man spent the last 23 years suffering from cardiomyopathy, congenital disease that cause it is heart to slowly stop working. >> feels pretty bad. i was so far gone, i guess in the morning. i take a shower. i would dry off and tried to get dressed. i was so worn out hi to go back

to bed for a couple of hours just to get enough energy to go downstairs. >> reporter: doctors didn't think he had enough time to wait for a newhart. the next best option, a new kind of heart pump. >> really what this does, we can take over all the pumping functions or assistant the heart if it only has some of it pumping function left. >> rorter: that can give heart failure patients as many as five extra years to live. the device is attached to the heart and runs on rechargeable batteries connected through the abdomen. they supply enough power for the palm top last about four hours. >> the majority of patients that are get thing in this country currently remain as a bridge to trance plant. even though the potential here is for this pump to last many, many years. >> reporter: inova fairfax hospital heart transplant specialist says the new device approved by the fda earlier this year is much smaller than the older heart pumps. so they can be used by more people. the older pump was too big to fit into many women and smaller men.
