right now many people are seeing rain and high winds. >> veronica johnson has our fast forecast from storm center 4. >> rain, high winds, and possibly tornadoes. at least theational weather service shortly after 3:00. issued tornado warnings. that was for two different areas. one down to the south there around anne arundel county. and as well as prince george's county and calvert county. let's go back to the radar here. you can see those -- cells moved off to the east and northeast out over the water. anwhile, there's been more cells up across western portions of our area. around allegany county, maryland, morgan county and west virginia and washington county and maryland. so there we are for those that are to the east out over the open water now. and dissipating. mane while, the ones that were -- we were watching up to western maryland have moved up into pennsylvania but there is another area that we are watching along i-64, charlottesville. this moving northeastward could

be hitting areas of western orange county and spotsylvania. and we are not out woods by any means. i think there is a possible bill of more tornado warnings through the afternoon and evening here. so this is the one area we are watching. let's take a look at chopper 4 now up over the bay bridge. chopper 4 up live now. you can see as we look off into the distance, the cells eastward again heading away from our area. as we take it back to the maps here, remember should any severe weather pop up in your area, in the line of any of these storms, and you are caught outside, seek shelter inside and get away from windows indoors and stay safe. now we are not under a severe thunderstorm watch for even a tornado watch. but further north, those locations up around eastern pennsylvania, northern new jersey, new york state, there is a severe thunderstorm watch up until 8:00 p.m. those showers that have been filling in and storms popping, we will see more of that up until about 11:00 p.m. or

midnight. of course, it has been humid around here. we will talk more about the heat and the storms coming up in just a few minutes. barbara? >> okay, veronica. sounds like a night we have to get home eas nkiol iew tvinv breaking news involvi the ng shooting at the u.s. holocaust museum last month. a short time ago a federal grand jury here in washington returned a seven-count indictment against the alleged gunman, james von brunn. the indictment charges von brunn with first-degree murder in the deaths museum guard stephen johns and includes hate crime charges and gun violations and some of the charge could make him eligible for the death penalty. von brunn was shot in the face by other guards and has been in the hospital since the incident. >> we are following another big story this evening. she has been found guilty. banita jacks has been found guilty of murdering her four daughters. a judge handed down the decision earlier today. pat collins was in the courtroom as the verdict was read. pat? >> reporter: jim, banita jacks is 34 years old. e conviction today means she

could spend the rest of her until life in jail. banita jacks, guilty. four counts of felony murder. guilty. three counts o first-degree murder. guilty, four counts of cruelty to children. banita jacks, guilty of torturing and murdering her four daughters in the home on sixth street southeast. >> what happened to those children, torture and maltreatment. they were atrocities inflicted upon four small children. her own children. >> reporter: the verdict came in after two days of deliberations by judge frederick weisberg. it took its toll. when it was over, the judge just buried his head in his hands. this could be one of the most grizzly cases of murder in the history of washington crime.

january 9, 2008 the bodies of banita jacks' four daughters found inside their house in southeast. the girls, ages 5, 6, 11 and 16, dead for months. their bodies in a state of decomposition. now coming up at 5:00, thoughts from the defense attorney on what happened here in the courthouse. i will see you at 5:00. jim, back to you. >> all right. pat collins. pat, thank you. police released the identity of a man who was killed in a police involved shooting in germantown overnight. now investigators are trying to figure out the details that led to his death. montgomery county police say 39-year-old ilio fernandez was killed after two officers went to his apartment complex in the 12200 block of eagles nest court. they were responding to a 911 hang-up. someone reported hearing shots fired shortly after that. fire crews were sent to the scene where they found the officers trying to resuscitate

fernandez. fernandez was pronounced dead at the scene. a gun and knife were found near his body and investigators are mott trying to -- now trying to figure out who exactly opened fire. first and why and we will have the latest on the investigation coming up on "news4 at 5:00." when swine flu vaccines are handed out this fall, there won't be enough for everyone right away. so today federal health experts came up with a list of people who suldet them first. kristen dahlgren has the story. >> reporter: when h1n1 vaccines are like i available this fall, the cdc has at-risk groups targeted for the front of the line. pregnant women, health care workers, people from 6 months to 24 years old, caregivers for infants under 6 months, and adults 24 to 64 with medical conditions that would put them at a high risk for complications. all groups now affected more frequently and severely than the general population. >> they will look at those populations in which the --

which the virus has been most active. where is it causing the most damage. >> reporter: the government hopes the first doses are available for those groups by october. though doctors recognize the fact that the recommendations may have to be refined as they see exactly how much vaccine can actually be manufactured by then. >> everybody has been working day and night, as i like to say the lights are on in the laboratories at night. making this vaccine and evaluating it. >> reporter: today painful reminder that the you will mate goal is to get protection to everybody. she lost her son and daughter, 19 and 26, this month. >> never dreamed that this would happen. >> reporter: one family's heartbreak a warning to all, the outbreak continues, even as researchers scramble to get out lifesaving vaccines. doctors were also quick to point out that h1n1 is not the only flu threat this year. there's still also the regular seasonal flu vaccine which should be readily available to everyone. and maybe more important than

ever to get this year with two flu strains taking aim. in atlanta, kristen dahlgren, news4. the virus may have hit the u.s. senate, four senate pages apparently have symptoms similar to swine flu. and have been quarantined as a precaution. the senate physician says it could be the swine flu but doctors say that they don't plan to test them for the virus because the results wouldn't alter the treatment plan already in place. we are told two of the pages are improving now and could go back to work this week. pages are typically high school students who primarily serve as messengers for lawmakers. currently there are 50 pages now serving up on the hill. there is a move on capitol hill right now to make texting while driving illegal in every state. right now 14 states in the district of columbia passed no texting and in their driving laws. a group of democratic senators introduced new legislation today that would require all states to ban the practice. if states don't comply they risk

losing their highway funds. the proposal follows a series of studies that show the dangers when drivers take their eyes off the roads as they text. a sleepy trucker causes some problems for commuters. >> a local honor for every day heroes. >> here are some of the other stories making news in our area today. >> a tanker crash on the beltway caused a traffic nightmare during the morning commute. the three vehicles crash in fairfax county and sent one person to the hop and left traffic backed up in alexandria to prince george's county. >> i was coming from maryland. and when i got like off the bridge, it was so backed up i just took route 1. it is ridiculous. >> the crash happened just before 7:00 by the exit for eisenhower avenue. a truck driver, driving westbound, on the beltway, veered into the emergency shoulder and hit a car parked for repairs and tow truck. a tractor trailer flipped and caught on fire and 29-year-old

fell asleep behind the wheel and escaped with minor injuries. >> one man is dead after a stabbing during an attempted robbery in waldorf, maryland. it happened last nature around 10:00 on nike drive. police tell us two men were standing outside when two other men approached them and demanded money. officers say it looks like the victims put up a fight and that's when one of them was stabbed. 30-year-old paramesa and gutierrez was taken the hospital where he later died. so far police have not made any arrests. today the gym at washington's hospital burn unit got a new name to go with its new look. the newly renovated rehab gym was dedicated to every day heroes. it will now be called the firefighters burn rehabilitation gym. that's to honor the firefighters that helped raise money for the renovations. it raised more than $100,000 to upgrade the gym. the burn center at washington hospital center is the region's

only adult burn treatment facility. closing bell just rang on wall street. preliminary numbers show stocks slipping a bit today. the dow will lose about 23 points. the nasdaq is down about 7 points. the new york stock exchange closed about 48 points lower. two internet giants joined forces hoping to change the way we surf the net. microsoft reached a ten-year deal with yahoo to create an internet searc partnership. microsoft is the world's largest software maker. yeah into was the internet's second largest search engine p p the main goal of the deal is to help the companies better compete with google and boost profits sbhi $500 million. with new internet ads. the deal is expected to close early next year. we are just getting started here on "news4 at 4:00." the l.a. coroners talking about michael jackson's autopsy results today. we will have the latest. plus what one woman tweeted that got her sued. dirty beaches. where you may mott want to take your family this summer.

vacationers may be exposing themselves to the risk of serious illness. a new report out found that beach pollution remains a very big problem.

here's brian mooar with more on that story. >> reporter: it is the height of vacation season. and the beaches are packed. >> swimmers and with sunbathers. and sometimes also with human and animal waste. >> reporter: the natural resources defense council released this 19th annual report on america's beaches. and it is not a pretty picture. >> nationwide 7% of beach water samples are so contaminated with human or animal waste that they are not safe for swimming. >> reporter: much of the pollution is caused by rain runoff and there has been zero improvement over the past three years. mean something beach did-goers are risking illnesses ranging from a rash to hepatitis. the nrdc raided 200 of the most popular beaches. among the best -- >> delaware, new hampshire, and virginia. with alaska, north carolina and hawaii right behind them. >> reporter: some didn't fare nearly as well. >> most contaminated last year

were louisiana, ohio, indiana, and illinois. >> reporter: though the great lakes had some of the worse rated beaches, the nrdc says chicago is a shining example. >> we test our beaches five time as week or more if necessary and notify the public of those results as soon as possible. >> reporter: but in the tough economic times, some communities are cutting back on testing. meaning a day at the beach might not be the good clean fun it once seemed. the good news, tougher standards are on the way but the bad news is states won't have to adopt them for another four years. in washington, i'm brian mooar, news4. here is another sign of the economic times. americans are not taking cruises as often as they used to. the number of cruise ships to set sail from the u.s. ports in 2008 declined nearly 2% compared to the year before. that's the first such decline in ten years. however, the total number worldwide remains steady.

nasa is busy making sure the shuttle "endeavour" is ready to come back to earth. the astronauts are inspecting the thermal protection system. making sure space junk didn't do any damage to the heat shield. this morning, they used a laser tip bam to check the shuttle's wings and nose for damage. the shuttle and its crews of seven left the international space station yesterday after spending two weeks making repairs to the station. the "endeavour" is set to land in florida friday morning. veronica, looking for some nasty weather later tonight. >> kind of indeed. we have already seen it here. early part of the day. early afternoon. day with the severe thunderstorm. sometimes we get the hail and winds. today is one of those days where we have the possibility of tornadoes. at least we had warnings already. but no reports of any sightings. there are reports isolated of damage through the area. there's a look at the lightning

heading out of our area. but there is another cell right around i-64, producing lightning. this around the louisa area. this is the next cell i'm watching. up around areas of western maryland and around washington county. around allegany counsel pit. we had a tornado warning in effect earlier. then there were also some around prince george's county. calvert county and anne arundel county. those cells have now dissipated. moving further to the east. there around st. mary's county, earlier that one cell possibly producing some hail. but further east of the area. here is the one cell i'm watching now because it is moving east-northeastward and into areas around orange county and perhaps southwestern spotsylvania county in the next few minutes. it could possibly, possibly, turn into some real rough weather here with possible rotation. we have wis out of the southwest and at the surface and

winds out of the west alot of. a day with the possibility of location around the area. meanwhile, take a look at the high winds. norfolk, virginia, 54 miles per hour. half inch of rain there. temperature is 72. over a third of an inch of rain and huntingtown, maryland. with winds there just at 13 miles per hour. so for the next couple of hours here, up until at least about 8:00, 9:00 p.m., we could see high winds. and possible rotation still with some of the cells that come through here. today we stayed socked in with the clouds and mainly east of i-95, enough breaks in that cloud cover. enough heating and instability and, again, the rough weather that we have seen already in parts. 84 degrees, the current temperate now. look at the dew point temperature at 69. 70, awfully summerlike. the weather us is testimony still west of our area. so for the next couple of days, this system will be meandering around the area. we are going to have more heat coming our way to tomorrow. so up until about 10:00, 11:00 p.m. the possibility of some

thunderstorms, strong thunderstorms, in the area. we are going to see things quieting down and for early part of the day tomorrow, we are going to start with some murky conditions again and some low clouds throughout the area and partly sunny day, though. and we will be heating up to about 90 to 93 degrees across the area. then even more heat coming our way for friday. and friday i think will be the next time we could see some storms coming through. but any of the storms that we have here, this evening, could be producing some real heavy rain as well and like that one cell that i'm watching now down south, could be producing quite a bit of lightning as well. let's take a look at your reorst ftalas tecor fshi suorvitalas tec for fhis evening. which you can expect temperatures dropping from the low 80s to the upper 70s. meanwhile, by tomorrow morning, we will be startingorff o on th ide again. ofbi ngri nditions of clearing. 68 to 73 degrees. and again, it is going to be plenty hot tomorrow in the upper

her four daughters bodies were found in her southeast home last january. prosecutors believed they had been dead for seven months. a government panel now says people most at risk should be the first groups vaccinated against the swine flu this fall. the list includes pregnant women, health care workers, and children six months ander. >> it is already illegal to send text messages while driving in 14 states. and the district. now there is a new move to require all states to ban texting while driving or face the loss of federal highway money. a group of democratic senators unveiled the plan today. now to the latest on the michael jackson case. the focus of the questions continues to be centered on the singer's personal fist zbligs the official autopsy should help to provide some new answers. but the results may be delayed. here's jay gray. >> reporter: we haven't seen much of dr. conrad murray since the death of michael jackson. but yesterday, the tmz cameras

got a glimpse of the personal physician walking ouide of his las vegas home just after police and federal agents spent three hours inside. >> searched the home, offices, his storage facilities, all in an attempt to find evidence linking him to this. >> reporter: it is clear the doctor and the sedative appropria propofol, are at the center of the investigation. >> issued propofol. what kind of medical files did he keep? all of this evidence is relevant to the prosecution to show that dr. murray was reckless in treating mr. jackson. >> reporter: law enforcement sources tell nbc news that dr. murray administered propofol the morning of jackson's death. his lawyer continues to insist that murray is cooperating with thenvestigation and did nothing wrong. he released this statement late yesterday. dr. murray was present during the search of his home and sisted the officers seizing cell phones and a computer hard drive. but the most important

information in this case could come from toxicology results. part of an autopsy report that the los angeles coroner now says may not be released until sometime next week. initially those results were expected this week. coroner's officials will not discuss why there is a del nay releasing the final autopsy report. in los angeles, jay gray, news4. a grizzly murder has prompted a search for a newborn baby in massachusetts. a 23-year-old pregnant woman was discovered dead in her apartment with her fetus cut from her womb on monday. this happened in worcester. the woman's landlord made the discovery after noticing a foul smell coming from the apartment. the ordery was wrapped in bedding inde o a closet. police say she was killed several days earlier. the woman had a restraining order against her boyfriend whom police questioned in the murder. they are now focusing on finding the baby who authorities say could still be alive. we now learned that north

carolina man accused of masterminding an international terror plot grew up right here in the d.c. area. daniel patrick boyd attended t.c. williams high school in alexandria, 23 years ago. federal authorities arrested him in raleigh monday along with two of his sons and four other men. they are accused of planning to rry out what's described as violent jihad on u.s. targets overseas. and investigators are still searching for an eighth suspect who belonged to the group. barbara? >> twitter is supposed to connect to you the world and let everyone know what you are thinking. but as one chicago woman learned when the people you are talking about find out about it, it could turn to a lal mess. alex perez has the story. >> reporter: levi morales says he can understand why one of his neighbors was upset over an overnight leak at their apartment building at 4242 north sheridan. >> mold growing in my room. my carpet on my walls. >> reporter: morales says the company did clean up the mess.

amanda says the mold in her apartment was never cleaned u and took her frustration to twitter where she posted 'tweet saying who said sleeping in a moldy apartment was bad for you? because of that message, horizon realty is now suing her for $50 thousand saying she defamed their reputation. her neighbors are not so sure she did anything wrong. >> i never thought that like, just complaining about something like it would go that far. >> twitter falls under the first amendment. >> reporter: the explosion of social networking sites like twitter, it is creating lots of new work and even some complications for attorneys. >> when a tweet like a blog or posting injures someone, their business or individual reputation, that's where the law comes in. >> reporter: the claims are called baseless and said they sued for the tweet only after she sued them claiming the company violated the landlord/tenant ordinance.

now in a new building bonnet didn't answer the door for comment this evening. although her twitter page was public, she had 17 followers, meaning that's the number of people who were notified when she wrote the tweet about horizon realty. >> i think the ironic part is that the publicity they are going to get from this is going hurt them probably much worse than the 17 followers on the twitter account. >> alex perez reporting. bonnen's twitter account has been deactivated. we have a tornado warning right now. let's head up to the storm center and veronica johnson for the latest. >> yes. spotsylvania county now until 5:15. it is a tornado warning. this is the cell that i have been watching and watching over the last couple of minutes. yes, they did issue that. national weather service for spotsylvania county. right now that cell is just ten miles southwest of the belmont area moving northeast ward. so the locations in the path of this possible tornado would be

areas like blue ridge shores, ribbon area, as well as bells crossroad, glenora, logan area as well as brook road, spotsylvania and blades corner as well as the gate wood area. again, this just a couple of minutes ago. radar indicated some possible rotations. this is up with of those days we have that taking place in t atmosphere. winds coming in at different directs as you change height. so that is until 5:15. spotsylvania county. a tornado warning and just ten miles south and west of the belmont area. so the locations, again, along the track of this storm as it heads northeast ward really much of spotsylvania county. and bells crossroad area, glenora, logan area, and post oak, glades corner and the gate wood area. so if you hear the high winds coming up, you want to get inside and stay safe, stay away from the windows and doors. of course, i will keep you

another tornado warning in effect. this onemportant spotsylvania county until 5:15. we have seen these already this afternoon. portions of the southeastern ar area. up north, too. now this cell, national weather service just warned on, southeast of orange area. so pretty much all of spotsylvania county warns for possible tornado until 5:15 if this cell moves northeastward at 35 miles per hour. so let's zoom in on this cell. tighter so you can see the neighborhoods that will be affected. that's around blue ridge shores area and as it heads northeast at 35, it will be affecting areas around logan or around

lenora and post oak, blades corner and even spotsylvania. down the line. within the next couple of minutes. so if you are in the path of this storm, you want to take cover, immediately stay safe and stay inse and if you have someone outside bring them inside now. let's take a look at the rest of the forecast, too. we will get you back over to that tornado warning in just a minute here. 86 degrees, the temperature, across the area. we are likely to see some more strong thunderstorm cells this evening. up until about 9:00 p.m., possibly even 11:00 p.m. before things start dissipating. we will start the day tomorrow quite warm. 72. expect a hot one tomorrow at 92. should be quiet without thunderstorms. but friday we will have more thunderstorms firing. we will have the heat around here, high 90s. as far as the weekend goes, one of those half weekends, hot weather for saturday, 85 with more storms coming in late on sunday. but again, back to the cell we are watching. spotsylvania county under a tornado warning until 5:15 as

the cell heads northeastward at 35 miles per hour. affecting the areas of the bells crossroad, logan area, and brockroad, blades corner, spots vein yeah, gatewood within the next couple of minutes. go ahead and zoom out a little bit here so that you can see that much of the rest of the area is quiet. now we are not under a severe thunderstorm watch. we are not even under a tornado watch. but warnings, we have had a handful of them for possible tornadoes and possible rotations based on what we are seeing on radar. earlier today, up across western maryland, the authorities did report trees and utility polls down around the area of green ridge forest area in western maryland. the old town area, and didn't get any reports of that one cell was down around calvert and st. mary's county. but earlier did look like on radar at least it was possiy producing some hail. so just some general rain showers across the rest of the viewing area here. there is a lot more down to the

5:00." i'm pat lawson muse. for wendy rieger. >> i'm jim handily and we begin tonight with a tornado warning in effect right now for parts of our area. let's head up to bob ryan and she is in the storm center. >> spotsylvania county for you folks into spotsylvania still in effect until 5:15. there you can see the nasty storm which in -- these moving along at 20 miles per hour following other nasty storms into southern maryland. let me zoom right down to that and that area that's in red is the area that's still under a tornado warning until 5:15. until 5:15. i will draw a track bus for folks in the western-southwestern parts of spotsylvania county you are in the clear now. here are some of the smaller spots that are in the threat cash in the area of mchenry, post oak and we will zoom way down right into the local area. this storm has had a history of rotation. i want to emphasize that so far is, so far we have seen no reports, eether from southern maryland, southern anne arundel county or northern calvert county wherere
