captions paid for by nbc-universal television good morning. welcome to "today" on a monday morning. i'm matt lauer. >> and i'm meredith vieira. matt, welcome back. >> good to be back. >> wish we had better news to report this morning. >> so many stories over the last several days just stop you in your tracks. this morning investigators are returning to the scene of the worst air disaster in new york city in about eight years. >> as hundreds of spectators watched in horror, nine people were killed on saturday when a single engine plane with three people on-board crashed into a helicopter carrying five italian tourists. the latest on the search and the investigation into just what happened to both of those aircraft. also ahead, the latest on another tragic accident here in new york. that deadly wrong-way crash. eight people died when a 36-year-old mother, diane

schuler, her minivan filled with children drove nearly two miles on a busy parkway before slamming into an suv. police say she was both drunk and high but her husband does not believe it. this morning family members of two of the victim inside the suv are speaking out. they say those claims that alcohol and drugs were not responsible only make things worse. an exclusive interview with them coming up in just a couple of minutes. then also kate gosselin on life since her marriage to jon ended. how is she holding up? how are the kids handling things and what does her future hold? she's with us to talk about it all in just a bit. we begin with the latest on that traj igs collision between a small plane and a helicopter over the hudson river in new york. nbc's ff rossen is at the scene. jeff, good morning. >> reporter: good morning, matt. just to give you an idea how violent this impact was, the airplane and the helicopter landed in different sections of the hudson. this weekend police divers found the chopper and pulled it up. you'll see in a moment how

mangled it was. this morning we've confirmed they believe they found the airplane. the problem is it is in deep, deep water, about 50 feet down tough to get to. divers are getting back in this morning. it was that bad when crews plucked the helicopter from the hudson late sunday. some of the victims were still inside. officials say they didn't stand a chance. there were no survivors. nine people killed, their bodies were pulled to the surface in a morbid search that continues. in these chilling pictures obtained by fox news, you can see the moment of impact. the wing of the airplane was ripped right off, sending it into a nose dive. the helicopter broke apart in mid-air in a puff of smoke. jeremy clark was at the controls of the chopper. a fellow helicopter tour pilot on the ground saw the plane coming and tried to warn his friend over the radio. he spoke exclusively with wnbc. >> i said, jeremy, you have an airplane, he's off to your back right side. i said i don't know if he's

going to pass off to your back side, behind you, to your left or what. it was really just a matter of three or four seconds and there was -- i saw the impact. i'm pretty sure he heard me. i didn't get a reply because after i made clear a radio call as i could to warn him, it was just too quick. it was so quick. he was being overtaken by the other aircraft. >> reporter: we are learning more about the mid-air collision and how to happened. this single engine piper took off from new jersey's teterboro airport and flew south down the hudson toward new york city. moments later, the sightseeing helicopter took off from manhattan's west side. sources close to the investigation tell nbc news the plane may have been in a climbing right turn when it hit the helicopter. >> the main cabin did a nose dive into the hudson. when i'm watching the bodies being pulled from the river, it's very sad to know that i was watching them die. >> reporter: on-board the chopper, five italian tourists,

including this 16-year-old boy and his father. aboard this small plane, a family from pennsylvania, another 16-year-old, doug altman, his father and his uncle. the collision happened in a controversial corridor just feet from nhattan. aircraft below 1,100 feet don't even have to speak with flight controllers. it's "see and be seen." this is what can happen when there is a blind spot. tragic consequences. in january of 2009, during the miracle on the hudson when that us airways jet landed in the almost exact same spot in the hudson, wateraxis and private boats rushed to the scene to try to help save people. the same thing happened here except this time there was no one on the water to save. >> very sad. jeff rossen, thank you. the chairman of the national transportation safety brothe sc. debbie, good morning to you. as jeff just reported, divers believe they have found the plane but it is in very deep te how confident are you that you

ca retrieve the aircraft and what information do you hope it will yield? >> well, i would have to say that we've been very appreciative of the work that's been done by the divers in this investigation. they're very successful in pulling up the majority of the helicopter yesterday. they think they've had some positive hits from that sonar on the skin of the aircraft. theye going to have to confirm that today and hopefully pull it up. we'd like to examine the aircraft. clearly that's going to be a critical piece of the investigation. >> what do you hope to find by examining the aircraft? >> well, i think we've already seen some very good pictures that have been provided by citizens. if there is any other surveillance video out there, we'd be interested in that. but we'll look at the structural integrity of the aircraft, if we can see any impact marks, location where they might have had that initial impact. that will be helpful for us to document that. clearly, we want to prevent something like this from

happening again, so we're seeking to learn from this accident. >> chairwoman, when i first heard about this accident on saturday, my reaction was typical of many. i wondered on a crystal clear day how these two aircraft could not have seen each other. >> well, that's exactly why we're here. we know thathere are about 11 mid-air accidents every year in the united states. over the past ten years, we've seen 158 fatalities. so mid-air accidents do occur. what we want to try to figure out is how to prevent them, whether it's through increased ability to see other aircraft, make them more visible, better communications, better procedures or protocols, all of thatas yet to be determined. we're going to have to let the facts of this accident tell us what happened, and then we can make appropriate recommendations. >> i know that the board has been concerned about safety oversight, the lack of it. you've expressed concern in the past. the faa has seen recommendations issued by the board but chosen to not adopt them.

are you hoping that this will spur the faa to finally take some action when it comes to safety oversight in this area? >> well, the safety board has long been concerned about oversight activities. this part of the industry, part 135 operations, whether it's air tours, or ems, emergency medical service operations, or news gathering operations, there are many challenges and risks posed by different parts of the industry, and all of the parts of the industry, whether it's commercial, passenger carrying planes, or medical operations, or sightseeing, they all need the same level of scrutiny from the faa and oversight. >> you sound very diplomatic. don't mean to put you on the spot but are you frustrated none of these recommendations have been dealt with by the faa, have been approved by the faa? >> well, the good news is that 80% of our recommendations do get closed in a positive manner.

but we have about 400 recommendations right now that remain open to the faa. we would definitely like to see action on those. we believe that they would prevent additional acdents. >> debbie hirschman, thank you so much for your time this morning. good luck with the investigation. >> thank you. let us get the rest of the morning's headlines now from ann who's standing by at the news desk. ann, good morning. good morning, everybody. also in the news this morning, the president this morning is in mexico where he'll be meeting with the leaders of canada and mexico nicknamed the three amigo summit. swine flu, trade and drugs are the big topics. nbc's white house correspondent savannah guthrie is in guadalajara this morning. savannah, what's the president want from these talks? >> reporter: this is a meeting that's all about getting cooperation between the u.s. been canada and mexico. one of the big issues here of course is the swine flu. this fall it is expected to make a big comeback and the three leaders want to make sure they have a coordinated response so there is not a lot of panic and

a coordinated public health message. they're also concerned that the swine through not obstruct trade or travel at a time when all three economies are struggling. there is also a dispute over mexican trucks, whether they should be allowed to travel into the u.s. another dispute over about $100 million of funding from the u.s. to mexico to help fight the drug war. a lot of contentious issues on the agenda here. >> savannah, thank you so much. house speaker nancy pelosi and majority leader steny hoyer are speaking out against what they describe as an ugly campaign to misrepresent health care reform and disrupt public meetings on the subject. recently loud protests have erupted at town hall meetings where members of congress and cabinet members have been angrily shouted down. in an opinion piece this morning in "usa today," pelosi and hoyer say drowning out american views is un-american. that's how we failed at this task for decades. a series of bombings in iraq this morning killed nearly 40

people. near mosul, two truck bombs exploded nearly simultaneously killing at least 25 people. gas prices jumped 16 cents a gallon over the last two weeks. today aaa puts the average price for regular gas at $2.65 a gallon. overseas markets are mostly lower this morning. that's where wall street's cnbc's melissa francis is at the new york stock exchange where i understand gm and ebay are making financial news. >> reporter: that's right. they're teaming up to sell new cars online. gm has previously sold used cars online but now 225 dealers in california are participating in this trial. there is a toolen the website that will let you figure out if your used car qualifies for the cash for clunkers program. when you buy a car, you go to the dealer to pick it up. meanwhile, markets are up four weeks in a row. all major indices up 15% in that time. we want to see if the run will continue. the fed kicks off a two-day meeting tomorrow. most expect them to keep interest rates steady. >> thank you so much. two devastating typhoons are now pounding parts of asia.

so far in japan, china and taiwan, at least 14 people have been killed and hundreds more unaccounted for. in southern taiwan, people evacuated a hotel just in time. look at this. it collapsed into a river after its foundation was weakened by heavy rain. it is now 7:11. now back to matt and meredith and a special guest. >> special guest. stephanie abram is here. >> al roker's partner in crime at the weather channel. al's taking the day off. you have to work though. >> i know, but that's all right. we're not going to see a typhoon like that hitting hawai hawaii do have a tropical storm typhoon, tropical storm, typhoon, same thing, different name. this is remarkable. check this out. we don't expect to see conditions like this when tropical storm felicia heads to hawaii, which it will do. right now just a tropical storm. it will stay at that strength. the good news with this is we need the rain in hawaii. so there is a little bit of good news out of this it looks like

members of the bastardi family. >> police say before the wlek 36-year-old diane schuler was both drunk and high but her husband refuses to believe that insisting something else caused the accident. with 36-year-old diane schuler, a suburban long island mother, hiding a secret addiction? >> i go to bed every night knowing my heart is clear. >> reporter: daniel schuler says no way. he insists his wife was stone-cold sober before she drove on new york's taconic parkway in the wrong direction. >> she is not an alcoholic. something medical had to have happened. >> reporter: toxicology results tell another story. >> diane shul her a blood alcohol content of .19%. the legal limit for intoxication in new york state is .08%. >> reporter: that's the equivalent of ten shots of vodka. >> around that level of alcohol you also start to get what's called tunnel vision where your perception is changed. >> reporter: police discovered a

broken sbsolut bottle in her mini van. what's more, test results show she was high, too, after apparently mixing booze and marijuana. >> this is not a woman who would jeopardize five children. >> reporter: but the pieces seemingly don't add up. schuler was heading home to long island from a family camping trip late last month. she was driving a minivan filled with young children. two of her own, and three nieces. they left around 9:30 a.m. stopping at mcdonald's about an hour later. and then, that part's a mystery. a few hours later at 1:02 p.m. schuler called her brother and said she felt diz oriented. shortly thereafter though, she got on the highway anyway and drove nearly two miles in the wrong direction before slamming head-on into another vehicle. a horrific tragedy leaving a string of deaths. schuler herself, four of the young kids in her van.

in the other car, guy bastardi, known as the santa claus to his family. his father michael, a doting grandfather of ten. and a close family friend. their car was hit as they headed to a weekly event -- a family pasta dinner. diane schuler's 5-year-old son brian was the only person in her minivan to survive and he is still recovering from the accident. matt? >> ann, thank you very much. roseanne guzzo and margaret are the surviving daughters of the bastardis. good morning to all of you. ladies, our condolences. we're so sorry. thank you for joining us. how did you hear about the accident? >> well, i had been waiting for my father and my brother to come to my house for dinner. i kept calling my sister because they're always on time. >> that was sunday night, traditional pasta dinner? >> right. i kept calling margie and their

cell phone. then my sister -- tell them what you heard. >> my son works where my brother was the general manager. one of the tow truck drivers came in and said, "call your mom. it looks like your uncle's car." >> was in an accident. >> right. so he called me and then i called my sister and we started -- my brother-in-law saw the car on tv, said it looked like my brother's car. then we started calling the hospitals and everything. and from us calling the houses, the state police had gone in to my dad's house, saw my number on the caller i.d. and he cled my house. that's how we found out. >> initially this story made headlines because of the sheer loss of life, the tragedy of this. and then more headlines after that, that test results had shown that the woman driving this car diane schuler had twice the legal limit of alcohol in her blood, and apparently was high as well. can you just give me a sense of your response when that element of the story surfaced?

>> we were -- it was almost like we were getting the news for the first time. you know, if you think of an accident, you may say, well, you know, this was an accident. but after hearing that, it didn't have to happen. we were very angry and upset. this didn't have to happen. you know? she had a choic a and she made choice and this is what happens when you drink and you do drugs and you get behind the wheel of a car. >> yet her husband says she was hat,rf tet aecas wt, trft she was a great wife and mother, that she would have never done this. how do you respond to that? how do these -- those two statements -- or that statement, how does it correspond to what you've now learned? >> you know what? i don't believe everything we hear from the schuler family. when he says about his heart is clear? my heart is bken at night. okay? i lost my father and my brother, my family is devastated by this. but i feel like if he's going to -- he's in denial. because somehow, somewhere along

the line, you have to know somebody can drink like that. i mean my sister and i can't drink like that. >> it was revealed that daniel schuler himselfad been arrested for dwi back in 1995 after being seen driving erratically. you would think they would be even more vigilant or more aware of the dangers. >> right. >> we still can't believe that she could get into the car with the kids. >> your dad was the rock of the family. i know that's how he's been described. your brother, guy, the santa claus, did kind things for a lot of people. i know you've been receiving condolences from all around the untry. >> yes. especially people who -- they lost their loved ones through the same kind of tragedy, somebody who's drinking and driving. i mean you hear about it, but until you go through it, it is really something that i hope that they come up with new rules or new guidelines or something.

and for moms, if they're going to drink, or think about it, you're going in the car with your children. >> i understand a flower arrangement came at the funeral and it was just signed "the public." >> yeah, from "the public." >> irving, is there some sort of civil action that's going to be filed? >> well, right now it is a little bit premature because the accident -- i shouldn't say the accident -- the killing took place fairly recently. and there's a lot of investigations that have to be completed. and we don't want to be irresponsible and just rushing to file an action. but you can rest assured that we'll do everything necessary to protect the rights of my clients. i know the bastardi family for a number of years, and a wonderful family. i happened to have made out a will for the father who was killed just a month ago. he said, well, i hope i don't have to use this for the next 20 years. and that's life. you know? it's one of those things.

godfather to jackson's three children, says he could be paris' biological father. he spoke to a british tabloid "news of the world." >> paris has blue eyes and fare complexion, high cheek bones. it's been commented many times how similar harriett and paris are. >> reporter: lester, who says he's consulting with lawyers, maintains he has concerns about the well being of all of michael's children. >> i dearly want to remain in contact with those kids. i feel now this is the only way that i can ensure that. >> reporter: last week, a judge awarded custody of the children to michael's mother katherine. but not before a surprise appearance by the lawyer for jackson's dermatologist, arnie klein. klein, who' bnee rumored to be the biological of michael's two oldest children, says he wants to be consulted about their health and education. last week michael's brother jermaine disputed the rumor. >> you can look at the kids and tell that they're michael's kids. >> none of the people that i'm

aware of have any legal standing to assert any kind of claim of being a parent of these children. neither alleged surrogate mothers, nor sperm donor fathers. >> reporter: questions about the paternity of jackson's children come as his estate rushes to close business deals that would generate millions. the estate is valued at between $500 million and $2 billion, but it's estimated that because of jackson's lavish lifestyle, he died deeply in debt. last week, a judge green-lighted the sale of jermaine's rendition of "smile" on itunes and cleared the way for a batch of deals that will fill store shelves with michael jackson merchandise. and today the judge will review the $60 million deal with columbia pictures to bri the rehearsal footage from jackson's concert tour to the big screen. that could help ease a lot of that debt. >> george lewis, thank you very much. coming up, our live exclusive interview with kate

transpired. >> reporter: jon and kate have tried to keep some sense of normalcy, even spending fourth of july as a family. >> they love it here. this is their house. we bought this house for them, not for us. >> i will remain here as well during my portion of having them. jon will also come here when it is his days and we will flip-flop that way. >> reporter: last week tlc began airing new episodes again, and many wondered how the separation would be handled. >> it is kind of strange that we're remodeling our kitchen in the middle of our separation and but it's something that we already planned beforehand. >> reporter: but how will all this change affect the kids? >> many times every day it oc r occurred to me this was minus jon. it was a constant thought on my mind and while the kids had a great time, they mentioned it numerous times that they wished daddy could have been here. >> oh, no!

we have to start over! >> reporter: to you nor life, and the show must go on. >> i'm in this new age of if i've never grilled before, i'm going to grill. if i've never camped before, i'm going to camp. it might take me a while, but i can figure out. i can do things that i have never done before. >> kate gosselin, good morning. >> good morning. >> the last time we sat down here in may there were rumors, speculation about your marriage. so much has changed since then. you announced your separation in june. filed for divorce, both of you. now you were in this hiatus basically figuring out your lives from this point on. how are you doing? >> i am as well as can be expected. thank you. i'm determined to hang in there. what life hands me i'm going to do and deal with. and my focus still, as i've always said, as i will always say, is the health and well being of my children as well as myself. >> after the separation you told

"people" magazine on a good day, i feel relief. on a bad day, i feel failure. what are you feeling these ys? >> a lot of -- it's just life handing me unexpected things and i do -- i wake up and i feel a lot of failure. this is not what any mother sets out for for her children. this does not feel like the best for them. it's necessary. it has to take place and i think that i've turned the focus on myself and in looking ahead and then in retrospect, i want my children to see a mother who is committed to her children, who is determined, who has integrity, perseverance, and

never gives us. i want my children to see that everything i've done for them is out of love. >> i notice that you still have on your wedding ring. why is that, kate? >> for them. sorry. >> that's okay. >> i don't want to upset them. i'm being as very real and as honest as i need to be, i don't want to shock them. i've walk slowly through this with them. thank you. i've been asked questions, i've answered them. >> do they understand that you and jon are separated and what that means and that you've -- >> they do. we've had to go over it a few times. kara came to me a few weeks ago. >> kara's one of the twins, older daughters. >> turning 9. she said, "b you said it would

be difficult but turn out happy." when we sat them down and talked to them, i told her the announcement was something that was going to be hard but it was going to turn out okay. and she took "okay" to mean as i guess that we were going to be -- jon and i were going to be okay in the end. and so i've done it gently and -- i feel like that is the best thing for them, to walk slowly through it. and they -- she agreed when i discussed it with her, there's more peace in the house. it's happier in that way. and -- >> because there was fighting before? >> there was. and clearly his goals are not my goals and so we just needed to work that out. >> so you're not keeping the ring on at all because you hold out any hope about you and jon. >> no. i think it's very clear that we are two different people at this point with two different sets of

goals. and i am wearing the ring -- well, because it's been there for ten years, and just because the kids still see it, they've seen it their whole lives and they know that that's my married to daddy ring. when the time is right, i will take it off. i've done a trial of a day here or there. >> feel strange to you to do that? >> yes. >> yeah. >> and it's very gradual. i just want all of this to be very gradual so that i can -- my goal is to preserve them in the most healthy way possible. >> kate, let's talk a little bit about the time line. when you announced your separation, it was june 22nd. but recently jon said in an interview that you were the one who gave up on the marriage last october, that you're the one who said "i am done." is that true? >> no. clearly we both have are completely different takes on what happened between us. but i feel like the details of

that, for the sake of my kids, need to remain private. >> can you share with us at all when you realized that the marriage was over, that it was just not going to work? >> there was a time line. i think that we both realized mutually that our goals were different, that our hopes and dreams had become different. and it just -- it was very mutual. >> by the time there were all those rumors swirling about about jon with other women, when i sat down with you in may had jon already moved out of the house at that time, kate? >> to be very honest, i don't remember. there's so much going on. just so much going on. i honestly don't remember at what point that took place. i knew that for many months

prior to that he was not home a lot. so i don't know kind of was a gradual thing. i don't know like the date that it occurred. >> as opposed to one day he just disappeared and moved someplace else. >> no. right. right. right. so -- >> and now we are hearing from him that he has started up a relationship in may with this young woman haley glassman, 22 years old, the daughter of the doctor that came to you, helped you out with the tummy tuck after you gave birth top sextuplets. when did you first hear about that? were you shocked hat the revelation he had started seeing her in may? >> i was shocked but those things, to be very honest, don't affect me directly at this point. >> it's got to be hurtful. >> well, it is hurtful. to be very honest, the most hurtful part is when his decisions directly affect our children. that's the hardest part for me.

>> in what sense? when you say his decisions directly affect the kids? >> well, i feel like they're his decisions. they might not be ones that i would make. >> so if it had been your choice then, kate, this never would have happened? >> gosh, who can go back and change? obviously ideally, parents stay married. you know, i go back very often to our vow renewal in hawaii. i think very often of it. in that moment, i meant those vows and there was no option for us other than to be together. so much changed. >> you know that marriage is a two-way street, divorce is a two-way street. what role do you think you played, if any, in what happened? >> nobody's perfect. i was not perfect. nobody's perfect in a marriage.

now in connection with this case, seven charged with two counts of murder. last thursday night, a person of interest in the murders of bud and melanie billings was taken into custody on grand theft charges. and now that person of interest, henry"cab" tice speaks out for the first time. these images were captured by the sophisticated security system mounted outside and inside a nine-bedroom house. the home invasion in progress, a double murder about to occur. the victims a husband and wife. melanie and bud billings were the locally celebrated paints of 17 children, 13 of them adopted, many with a variety of disabilities and special needs. >> authorities say at least three people entered the family's -- >> reporter: and within an hour of the murders, one name has come up again and again as someone who must know something. henry "cab" tice. he was not only a former business associate of bud billings, but they had a bitter

"these three did not have a guide or translator with them, he said. that's how i think they ventured into iran by mistake." but the americans were all seasons travelers. sarah and shane both extensive travelers in the middle east, yemen and ethiopia. iran has hinted the americans could be spies sent by the united states to stir unrest. they say not to expect any high-profile clinton-like intervention because iran would never allow it.

with us exclusively from boca raton, florida, along with his attorneys jason brody and josh friedman. gentlemen, good morning to all of you. michael, let me start with you. there is so much i want to talk to you about. but start with the knock on the door, your home. you answer the door and the police are there and they say, "we have evidence that your wife has hired someone or tried to hire someone to kill you." what was your reaction? >> well, let me tell you, matt, it took -- it really hasn't sunk in even today. but getting wakened at the door with a banging like that, m whole front neighborhood was surrounded with officers. i didn't even know what to say. they kind of just shuffled me around as if i wasn a fog. but i knew your wife has tried to kill you, you need to get out of the house now and come with us. >> do you think -- did they show you or let you hear any evidence at ha particular moment, michael, just to convince you? >> when i got down to the police

station, the tapes were played for me and i heard my wife very clearly. >> and actually, a little later when they took her into custody, you -- no, when they were questioning her, when she still believed you were dead, you got to watch that questioning. didn't you? >> yes, i did. >> what was that like to be a fly on the wall? >> well, it was very uncomfortable to see it. you know? i had to see it for myself. i'm very grateful for the boynton beach police department for doing what they did, even involving me in that. it just helped me with the whole thing. like i said, everybody says, you know, how lucky you are to be where you at. it honestly hasn't sunk in yet. i still don't get what's really happened. it's just a very strange situation. >> the morning that this was to happen, michael, and she gets up early to go to the gym, i'm sure you played the hours prior to that over in your mind a

thousand times. was she particularly nervous? was she agitated? did she behave differently as she was leaving to allegedly form an alibi during your murder? >> not at all. not at all, matt. actually, i was told as she was walking out the door she was going to bring starbucks coffee home. i mean it was a pretty normal scene. nothing at all. nothing ever would have made me think that what happened could have happened. never. >> you've been married for six months. i think you only knew each other for about a year. can you describe the relationship? was it volatile? did you guys have severe ups and downs? >> matt, let me tell you, we hit it off. me and my wife actually got along so well, we were together 24/7. i mean we had the same routine to go to the gym at 5:00, we would come home and literally, you may laugh at this, we would watch the "today" show together.

that was part of our routine. my mother's day was usually friday night, her family maybe we'd do sunday dinner with her mom. we did everything together. just normal activities. friday night we hit the early movie. just silly things. i mean -- always together, always -- you know. >> michael, i need to bring a couple of things up. you have yourself faced some legal issues in the past. you spent a couple years in prison for grand theft and organized fraud. at the face value, these two things seem completely unconnected. do you see any connection between the troubles you had in the past and what your wife tried to do this time? >> matt, let me just jump in there. there is no connection between the two whatsoever. >> nothing whatsoever. it's really more of a coincidence than anything else? >> absolutely. >> and we understand that dahlia's now been released on $25,000 bond, under house arrest. she's not far from where you're living, michael.

>> where do we start? every morning i wake up and it is a new rumor. first of all, there is no condo. there is no apartment. there was never any looking for one. nobody looked for one, bought one, inquired about one. >> there's rumor that you bought a condo in maryland for your time when jon is with the kids. >> correct. there are two things with that. i live at home with my kids. that's where i belong, that's where i will stay. number two, just to show you how crazy these rumors are, that got started -- i had lunch in maryland with our head of securities wife who i'm very good friends with. and the next thing i know the story was written that i was buying a condo there. i had to call her actually and ask her, how we went from lunch to a condo. she told me there were condos above where we were having lunch. i still have never seen these condos. >> so when you're not with the kids, where are you then? >> to be very honest, i'm in hiding from the paparazzi. >> you're not going to say where

you are. >> no. >> you're hidden. >> i'm reachable via cell phone. >> you mentioned head of security. there were rumors about you and the head of security. >> there is no affair, never has been an affair. we are very, very good friends with him, his wife and family. they're a huge source of support for me and the kids. he's been part of our production team since the very beginning since we had security issues. he's one of our rotating security people. it's just another crazy rumor. it sells tabloids. >> there have been people who have made allegations about you as a mom and rather cruel comments about your mothering skills. among them, your brother and your sister-in-law. how do you reand the to that? >> that's probably one of the most hurtful things in all of this. when family turns on you and makes up lies and makes allegations and makes tens of thousands of dollars doing it.

you have to understand this has become a business for them where they travel and speak online or speak on live tv shows, even reputable ones with their allegations. it is a huge source of income for them to do this. there's no words how hurtful that is. y brother you'd had a strained relationship with? >> this is a brother i was very, very close to and became jealous and decided they were going to take their fame and go elsewhere and make money essentially off of my children. >> how are your kids doing through all of this? >> my kids are wonderful, amazing, healthy, normal developing kids. anyone who meets them, they are best friends within five minutes. i've said it before and i'll say it again, my kids brighten people's lives. it is so neat to have people walk into our house and watch the fall-in-love process,

because they are so genuine, they're so bright, intelligent, happy, fun. >> but do you worry at some point they're going to see maybe old copies of the show and reruns or whatever it is and see the stress that was in their family and -- >> i don't worry. this is our fe. it's the most real reality show you will see. essentially their they are home videos for them. it is their favorite show to watch. they watch mommy and daddy. and i hope that through all of it they will see love. i don't want them to see the sacrifices we made. i don't want them to focus on that. i want them to see that each one of them was loved and wanted and cared for in the best ability that we possibly could. >> you've said that you do this show because this is the way that you guys make a living and it is financially ruktive. but given everything that's

happened, ever regret it? ever wish, enough already? >> i feel like in everybody's life you make sacrifices. everybody has to work. everybody has a job. ours is a very unique job. it's taught us many things, it's given our kids many opportunities they would not have otherwise had. they each have a substantial college fund. they will all go to college. i have made sure of that. and so i don't live my life in regret. i typically tend to look forward, not backward. and i still feel like this is a good thing. it's healthy. and the kids would agree. re even though youwo a t separated and your husband is now -- your ex, soon to be, has moved on? you still feel like it is okay? >> those decisions don't affect me. i feel like if you're asking if this was an end result of the show, a product of the show? i feel like it would have happened anyway. camera's on, camera's off.

health, five thangs could be ruining your teeth. dr. nancy rosen is a dentist here in new york city. when you think of things that ruin teeth, you think of dark colored liquids like coffee, tea, soda. >> color that is nothing to do with it. what's damaging our teeth are sugars and acids. >> start with the five things. this shocked me, i think of red wine is the problem. but again color doesn't matter. >> white wine. a recent study out says the acids in the white wine could make the enamel of our teeth more porous and actually absorb color. you definitely need to be careful with the acids and white wine. >> acids followed by the red wine, the white wine is stained because of what the white wine did. >> little kids, milk. >> milk is great and we need it in our diet. but parents beware. you don't want to give your child a bottle of milk and go to sleep. milk is getting all over their teeth. the sugars in the milk, bacteria

in there, in their mouth could eat at the sugar and it could rot their teeth. be very, very careful. >> it can cause serious tooth decay. >> true of nursing as well? if you let a baby fall asleep on your breast? >> breast feeding moms need to be aware, too. >> up next, cough syrup. it is when and how you take it that is the problem. >> cough syrup contains sugar and acids. most people take these things right before they go to bed and after they have brushed their teeth. they're going to bed with all this sticky, gooey stuff on their teeth and it is sort of gross. >> it just sits there all night. >> sits there all night long. tooth decay. >> lemonade. i would assume you're talking acid again? >> double whammy. acid and sugar. be very careful. lemons are very, very acidic. i see so many people just taking lemon wedges sticking them in their mouth, they are bathing their teeth in acid. lemonade is probably one of the worst things someone can drink.

>> water with a lot of lemons would be better? >> better because there is less sugar but you're making the water much more acidic. >> little did i know barbies can be very damaging to your teeth. >> if you are a swimmer -- barbie swims more than six hours a week in a chemically treated pool. you are at risk for something called swimmer's calculus which is a very unusual brown stain that can form on the front of your teeth. >> the little bit of water you might get in your mouth? >> yes. you're swimming for more than six hours. the chemicals reacting with the saliva can cause this stain. >> this is a problem. what's possible solutions? >> for water, get regular cleanings. wear an air-tight mask guard. the most important thing if you're going to have any type of acid, you don't want to brush your teeth immediately after. you want to wait at least 30 minutes before you brush your teeth. >> why is that? >> you will be brushing your teeth actually with the acid. you're actually embedding more acid into your teeth. wait the 30 minutes, let your

greatly improve the curb appeal of your property. do it yourself expert and "today" contributor lou manfredini is here. we'll talk about things right now. yes, you can get afessional to do these. right? >> but i am being inundated with e-mails, people saying i want it try this myself, how hard is it? i give a little advice. >> some are simple. you have your lawn outside. a brown spot, you might have a dog that might have caused it. female dogs kill the grass. male dogs kill the bushes. you scratch this surface. any of this dead grass that you pull up. there is a lot of smarter seed out there that will helpou a lot. scots has one. these are coated now. take a look closely as i put this on here. they have -- sprinkle this on. notice how the seed is infused with fertilizer and a little peat mix right there.

but what happens with the seed is, the birds can see it. you're going to cover that with a little peat moss. peat moss will help keep it moist. >> are you going to water this spot on the lawn more than the rest of the lawn? >> give it a little shot. do it every three days or so. keep traffic off thereof and it is going to come back to life. >> but a different color than the rest of your lawn, isn't it? >> not going to be yellow. it could be brighter green. >> you've got some marks in your siding, small damage areas in the wood siding. you don't replace the whole piece. you can actually patch that. >> you can get away with it using wood putty. this is latex-based. by elmer's. i have two part ones that are more durable and technically structural. once you scrape away the loose -- >> what if it is wet? >> let it dry. this goes in a lot like if you patch a wall. but what you'll do is overbuild it just sligly, and then let that dry. >> overbuild it because you're

going to sand it? >> you're going to sand it down. it will get hard. spot prime it, then repaint. >> if it is a bigger spot of damage, under what sish do you replace the whole piece of siding? >> if it's really rotted or there are several pieces, nobody has extra siding. find an area of the house that's behind the bushes or on the back side of the garage. work the siding off to pull this piece away, and then nail it in place. but when you go to use nails, these are galvanized nails that you want to use on the outside so they don't bleed once you repaint it. another carpenter's trick, before you put these nails in. hit the end of the nail just a little bit to blunt the end. that keeps the siding from splitting when you go in. >> good tip. over here you have a little mold and mildew on your house. you like this product. >> i love this product. i'm not a guy that likes to cut corners. but for men out there where our wives will say go out and do something about this, all you got to do is spray it.

wet and forget. it comes down from australia. they've been using it on top of the sydney operahouse for 20 years. mix it with water in a pump sprayer. they have a sense of humor about following the directions to make sure that you follow it. you spray this on the area where you have mildew and mold. if it's real, really harsh, you may need to do a little scrubbing. brick work, siding, canvas, any exterior surface, it starts to react with the sun and the rain and will eliminate it. >> it's done. >> it has a residual -- >> is it expense sniff. >> a gallon is $30. but it is a concentrate. >> you broke a pane of glass in a window. i think this is more complicated. >> jack throwing a baseball yet? >> yes. >> broken windows. once you have the frames, you run to the hardware store, measure the frame. tight measurement, minus an eighth of an inch. take the pane of glass -- get that at the hardware store.

drop that inside. that's our frame. here's our window. this is a push pin. you can do this. >> go ahead. >> the pus pins gin side to hold the glass in place. take a putty knife and drive it in there. that is what actually holds the glass. the glazing compound is another putty. this edge that they made for me is a little tall for this particular knife, but you're creating this smooth finish. one thing i do, lick your thumb, get that wet so you get a nice clean finish. you just keep coming along adding this putty. you trim this off around the whole edge. this will eventually harden, now you replaced the glass. this mix at the hardware store may call . >> you call a professional, these cost you hundreds of dollars. >> everybody here is probably $500. you're doing this yourself for less than $50.

new york's tacic parkway in the wrong direction. >> she's not an alcoholic. something medically had to have happened. >> reporter: toxicology results tell another story. >> diane schuler had a blood alcohol content of .19%. the legal limit for intoxication in new york state is .08%. >> reporter: that's the equivalent of ten shots of vodka. >> around that level of alcohol you also start to get what's called tunnel vision where your perception is changed. >> reporter: police discovered a broken absolut bottle in your mini van and test results showed she was high, too, after apparently mixing booze and marijuana. >> this is not a woman who would jeopardize five children. >> reporter: but the pieces seem ily don't add up. schuler was heading home to long island from a family camping trip late last month. driving a minivan filled with young children. two of her own and three nieces. they left around 9:30 a.m.,

stopping at mcdonald's about an hour later, and then that part's a mystery. a few hours later at 1:02 p.m. schuler called her brother and said she felt disoriented. shortly thereafter, though, she got on the highway anyway and drove nearly two miles in the wrong direction before slamming head-on into another vehicle. a horrific tragedy leaving a string of deaths, schuler herself, four of the young kids in her van. in the other car, guy baardi, known as the santa claus to his family. his father, michael, a doting grandfather of ten, and a close family friend. their car was hit as they headed to a weekly event, a family pasta dinner. diane schuler's 5-year-old son brian was the only person in her minivan who survived and he is still recovering from the accident. >> ann, thanks for reporting on this story. earlier this morning, matt sat down with the sisters roseann

the state police had gone into my dad's house, saw my number on the caller i.d. and he called my house. that's how we found out. >> initially this story made headlines because of the sheer loss of life, the tragedy of this. and then more headlines after that, that test results had shown that the woman driving this car diane schuler had twice the legal limit of alcohol in her blood and apparently was high as well. can you just give me a sense of your response when that element of this story surfaced? >> we were -- it was almost like we were getting the news for the first time. if you think of an accident, you may say, well, you know, this was an accident. but after hearing that, it didn't have to happen. we were very angry and upset. i mean this didn't have to happen. you know? she had a choiceg. and she made choice and this is what happens when you drink and you do drugs and you get behd the wheel of a car. >> yet her husband says she was

perfect, that she was a great wife and mother, that she would have never done this. how do you respond to that? how do those two statements -- or that statement, how does it koes correspond to what you've now learned? >> you know what? i don't believe everything we hear from the schuler family. when he says about his heart is clear? my heart is broken at night. okay? i lost my father and my brother. my family is devastated by this. but i feel like if he's going to -- he's in denial. because somehow somewhere along the line you have to know somebody can drink like that. my sister and i can't drink like that. >> it was revealed that daniel schuler himself had been arrested for dwi back in 1995 after being seen driving erratically. you would think they would be even more vigilant or more aware of the dangers. >> right. we just still can't believe that she could get into the car with the kids.

>> how do you do that though? i really think if you look at the rise in social media, it really indicates that so many people are so lonely and so what would be your recommendation in terms of how to get started, in terms of now that the kids are leaving the house, really fill your life with good friends? >> one recommendation is think of something you've always wanted to do, like take a dance class. invite some friends to go with you because it gives you the courage to try new things. don't hold back on things you've been wanting to do like join that book club. friends make us happy. having one happy friend scientists show not only make me happier, it makes my own network happier. give yourself permission to say i am going to join the book club, go out to dinner, take time to do things that make me happy with peal people who make me happy and you'll grow old naturally. >> you'll find friends doing things you want to do as well. be a friend, have a friend. courtney smith, a friend to us all, with some good advice.

this morning in "today's kitchen," a recipe for the world famous 21 burger with the $30 price tag. it is not your average burger. executive chef of the 21 pub is here to share with us the secret to making this burger at home. why is this such a special burger? >> the burger's been around for a numbeof years but this has probably been around for five years. what's important is the meat we use. top ground, chuck, dry-aged 21-day dry aged beef. this is what you would eat -- this is corn-fed. this is going to give the burger all its flavor, make it special. let's add that to the bowl.

we wrap up this monday with more of "today" and the induction of into the "joy fit club." >> after her second child christa early weighed in at 229 pounds when a photo she came across led her to lose 101 pounds. before we introduce you to christa, let's take a look at her story. >> my name is christa early. i'm a wife and mother of t from knoxville, tennessee. growing up i was average size and i never worried about my health. but as i got older my weight increased gradually. i was a full-time mom with no time to exercise and i ate all of my meals on the go.

i worried about the example i was setting for my children but i lacked the desire to change. at 36 i weigh 229 pounds and wore a size 18. my weight prevented me from activities i loved and instead, i spent my time indoors watching television and snacks. in 2007, a photo was taken of me on the beach and i was devastated with how much weight i'd put on. that's when i decided that i needed to lose more than a few pounds. i needed to lose 100. i turned to l.a. weight loss which taught me portion control and how to carefully plan out my meals. i also started exercising, walking in the morning before the kids were awake or running after work with a friend. my family, my friends and my faith were my support system and with their help i kept the weight off for over a year. i have achieved a lifestyle change of good eating habits that i am proud to pass down to my children. >> we are here with "today" nutritionist and leader of the joy pack -- ♪ leader of the pack
