appearance today and pleaded guilty. he also issued the statement of apology to the community and to the driver of the car he struck. this is where former alexandria police chief dey baker will spend the next five days in a cell in the arlington county jail. baker stayed out of public view as he came to court and pleaded guilty to the dwi charge facing him. baker's attorney says the former chief rejected any notion of fighting the charge. >> i think that the way dave sees this is that he supposed to be a role model and is supposed to be an example. he made a mistake. and he should pay the appropriate price for it. you know, as a lawyer, you think that -- only need to pay the price if the government can prove you did it. but he chose not to put him through that. >> reporter: with nearly 40 years of law enforcement experience, baker had been a highly respected chief in alexandria. but his career began to unravel the night of july 25th when he

struck another car on his ramp to i-66. baker's blood alcohol level was .19. more than twice the legal limit. the though and supporters urged him to stay on as chief three days later city leaders announced baker resigned taking early retirement. now his guilty plea puts the criminal case behind him and while he didn't speak to reporters baker issued a statement apologizing to alexandria residents and the itiver of the other car. es baker --wr >> he's somebody who feels he made a mistake and sfeels thefr price the legislature paid for and he will pay it and then go on with his life. >> reporter: alexandria residents we spoke with said they respect the decision to plead guilty. >> number one, hay shoed shows

he is accountable by resigning. you know. that says a lot right there. >> i think he handled it pretty bell it is refreshing is mebody would take responsibility for the fact that they made a mistake. >> reporter: now because he's a former law enforcement official baker will be treateded as a high-risk inmate in the detention center and will be separated from the general population. in addition to the five-day sentence he faces a $300 fine and a loss of his driving privileges for up to a year. reporting live from arlington, julie carey. ba to you. >> julie, thank you. police are searching for the driver responsible in a deadly hit-and- mn ngthni torn iheishe district. it was in thou sstea washington on stanton road in suitland parkway. a man was killed and police are asking for the public's help. megan mcgrath reports. >> reporter: supt land parkway closed in both directions early this morning. lying on the side of the road, the body of a pedestrian. he was struck and killed around 2:30 in the morning. the driver kept going. the police say the man was

crossing suitland parkway at the intersection with stanton road when the car slammed into him. >> at this time we don't know the -- whether he's crossing against the signal or not. that's part of the investigation. he was struck in the cross walk by a vehicle and he suffered blunt force trauma, thrown 120 feet. the vehicle struck him and has not been identified andid not stop. >> reporter: orange spray paint marks the spot where the victim landed and it is quite a ways down from the intersection. people familiar with the neighborhood say it is sad but not surprising. they say cars often fly down the straight stretch of the parkway. >> people are flying. it is a major thruway into d.c. so people are constantly flying and even in the off hours, it is almost like a speedway. >> reporter: suitland parkway reopened in time for the morning rush hour but police are still lookg for the driver who fled the scene. the car involved is described as small and either black or dark blue. it likely has headlight and front-end damage, maybe a

cracked windshield. the car may also have a damaged or missing passenger side mirror. police say the pedestrian was not carrying any identification when the accident happened. so they are still trying to figure out exactly who he is and believe he is roughly in his 60s. in the district, mestgrws >> good evening. bob ryan, storm center 4. nice summery day out there. august, you can see some fair weather clouds. we have the light easterly wind. and the really -- nothing on doppler. we don't see any showers, thundershowers firing up. tempe washington, 85. zunt 64. that's okay. better than 74. our temperature is down to the south, 80s, too. warm, dry evening. i think a lot of sunshine coming up for the weekend. especially heading out around the bay. i will tell you where there will be rain showers. and the tropics are still -- finally starting to heat up. nothing to worry about.

full weekend forecast when i join you in a couple of minutes. >> we will see you then. olympian michael phelps is thtokhtftonig b aereing involved in a car accident in baltimore last night. phelps' black cadillac escalade was going through an intersection when it was struck by a honda accord. the driver of the accord ran a red light. she was taken to a hospital but not seriously hurt. neither phelps nor his two passengers were injured. police say that alcohol was not a factor in the crash. he's suiting up with a new team. another sport superstar is stealing the headlines tonight. >> we are talking about michael vick returning to the nfl as a philadelphia eagle. dan hellie joins us now with more on what this means and vick is talking now. >> yes. turnout at the eagles practice facility, largest in years. nearly 100 media members and two dozen cameras soft spoken and remorsef remorseful. michael vick talking about his return to the nfl. vick is back in theame after serving 18 months in federal

prison for his involvement in dog fighting. the eagles say there will be no third chances for vick. if he screws up, he's gone. and animal rights groups already set billboards by the stadium blasting the signing of vick and the headline in today's philadelphia paper -- hide your dogs. as for vick he was saying all the right things. >> i was wrong for what i did. everything that happened at that point in time in my life was wrong. and, you know, unnecessary and, you know, to this day, i can't understand why i was involved in such pointless activity. and why did i risk so much at the pinnacle of my career and i was naive to a lot of things. but i figure if i can, you know, help more animals than i hurt, then, you know, i'm contributing, i'm doing my part. >> i know some people who will not agree. but on the other hand, i think the majority will and, fortunately in this country, we

it was green graduation day in the district. grads of the green job corps training class got diplomas ceremony in southeast. they received training to prepare them for the millions of green jobs created by president obama's economic stimulus package. >> green means opportunity. there are going to be millions of jobs in this country to weather-ize buildings, to pull up solo panels and to retrofit homes. and for the first time in history, we have gentlem from the community, our community, that are the first ones to be trained in that's new skills. >> the services are expected to save millions of dollars in energy costs in the d.c. metro area. in less than an hour, the doors will close for good over the

department of motor vehicles service center at brentwood. some neighbors long complain about the overcrowding there. with the closure northeast will become the only quadrant in the city without a service center. residents there can use the other three service centers or they can conduct driver or vehicle business online. after making steady gains over the past month, the markets retreated some this week. joining us now live to put it all in perspective, cnbc's scott cohen. live at cnbc's headquarters. markets had been doing well but a series of reports this week seem to sour the mood on the street. a new report today shows consumer sentiment is down. what is driving the poor outlook? >> that was the key, jim. that brought us down today and snap ad four-week winning streak was the consumer confidence index from the university of michigan and it is closely watched and it is interestin people generally have a pretty decent outlook for the economy. when you ask them about their own personal finances in the survey, a lot of them said that their finances had deteriorated, people losing their jobs and

people losing their homes. so people are still being affected by this and so as everything goes in this recovery, it is -- takes a while to sort itself out and filter through the economy. >> consumer prices were flat this month raising new concerns about deflation. so do analysts think that that is likely to haen? ? well, deflation would be a pretty drastic scenario. what they are more -- what they are more concerned about or were more concerned about was the prospect for inflation with the big budget deficits and so on. this seems to suggest that inflation is under control for now. so that should be somewhat of a positive for the economy but if the inflation rate is not going up and cost of live sing not going up, people on fixed incomes and social security benefits and that type of thing will not get cost of living increases so that hurts. >> and gas prices fell last month. but they had been inching up in august. are these higher prices having any impact on the economy? >> it is the reverse of that. the gas prices have been going up in large part because

economic outlook and economic numbers and in places like europe aretally stronger than expected. that was boosting prices a little bit. we saw crude oil prices drop $3 a barrel today. that's coming down. that's a reflection of the expectation that demand on the u.s. will be weaker. so we seem to be -- in okay shape as far as that goes. those prices are very much sensitive to the perception about demand inhe u.s. >> have a great weekend. cnbc's scott cohen. we appreciate it. are we going to having a great weekend? >> we are. nice summery weekend. i don't know what you have planned. >> big plans. >> outside right now, you know, we had some day this week that were real searing sundays, summertime. it is too hot. it is too humid. then some folks like the heat. okay, it is too cool. ly.is too ch it is just about right. our temperature outside now -- in the mid 80s. and tt's certainly a lot better than 97 that we had. i went back in the record boo looking at -- we keep all the records here. last real rainy day, weekend

day, that we he h was back in the beginning of may. when we had almost an inch of rain. high was 61. better than that now. 85 degrees. we have been in this dry pattern. our temperature here in the 80s. there is a 90. miami, got friends there. even dallas, 88 degrees. mott bad for the big d. the dew points when we get these dew points in the low to mid 60s that's all right. here is what has been going on. remember that weather front that's sort of pushed to our south. it has been sitting off the coast and that's where it wl be. later on, next week, there could be -- have to keep an eye over the gulf stream and water is so warm there could be a little bit of a tropical circulation trying to develop it next week. meanwhile, along that front, boy, while we missed any rains here because we have been on the west and northwest side of any little areas, low pressure, we have the rains continuing and down in the outer banks. if you are heading down to the outer banks, think you will be seeing one of the few spots with on and off rain showers. even in towards virginia beach there are rain showers. and meanwhile, in and around us,

there's live doppler. nothing going on. look at the amount of rain. north carolina. this month, over ten inches in the last couple of days. eastern parts of north carolina. another inch of rain, ocean city. and a little bit of rain yesterday. today 83 degrees. and i think if you are heading out for the beaches, great weekend coming up also. thereill be that's little areas of low pressure off the coast. they will keep united states under a general easter lynn wind. so as a result, temperatures will be staying reasonable. and also, out of the beaches, there will be an onshore breeze to keep it cool out there. 80 to 85 degrees for your evening. and some clouds overnight with that ocean moisture that we have with that easter lynn wind. there could be patchy fog. and especially as it creeps over the mountains, towards the blue ridge. tomorrow morning, starting out around 70 degrees with pksz, a lot of sunshine. and tomorrow afternoon. really, i think, a delightful afternoon. warm. still comfortable humidity with the dew points into the low to mid -- low 60s.

surrounding former presidential candidate john edwards is in the spotlight again. he was expected to make a statement today regarding reports that he fathered a child with his mistress. but edwards' lawyer told reporters his client will not speak on the maer. last year edwards admitted he had an affair with rielle hunter. he has denied he's the father of her 18-month-old daughter, a grand jury is investigating whether edwards used campaign money to pay hunter to keep quiet. a smart fearless leader who stood up for the voiceless. that's how family and friends remembered eunice kennedy shriver. a funeral for the sister of former president john f. kennedy was held in hyannis port, massachusetts, today. the private service was at the st. francis xavier catholic church. family members, including daughter maria shriver, served as pallbearers. eunice shriver is probably best known for founding the special olympics, participants in those games also took part in the funeral. this weekend marks the 40th anniversary of the pivotal

welcome back to our second half hour of "news4 at 5:00." i'm wendy rieger. >> coming up in this half hour, metro shake-up. the transit agency takes action. plus dog flu fears put local pet adoptions on hold. a beer toss lands a baseball fan in some trouble with the law. but first, our top story at 5:30. a career move for a controversial judge who flattened a driver's tires. >> today the boss of that judge out in charles county, the judge who admitted to flattening the woman's tires, is speaking out. judge robert nalley says he flattened the court employee's tires after she parked in his parking space outside the courthouse. now he is facing sanctions and more punishment could be headed his way. tracee wilkins joins us with more. >> reporter: circuit court judges are the only judges who have the power to administer the death penalty in the state of

for the aging metro system. are you worried at all that it is losing its luster? >> of course. any time there is a period -- you know, from time to time things happen. you know, create the -- this kind of problem and certainly on the level of perception everyone involved has to be concerned. >> reporter: on the wamu radio program friday -- >> today we will be talking about metro's problems with wamata board member. >> reporter: arlington county's chris zimmerman, member of the board, gave an unqualified endorsement of metro general manager john catoe. in the midst of all the system's troubles. >> those who know him throughout the industry where he has been prominent leader for decades now generally regard john catoe as it. not the best among the very best general managers in transit that this country has. >> reporter: he earns $300,000 a year. he is in the last six months of a three-year contract. zimmerman says the board should

act to re-sign him. >> my view personal sly very strongly that we are fortunate to have mr. catoe. there are many other agencies that would wish they have. >> reporter: several transit officials have dismissed two online petitions to fire catoe saying there are fewer than a few hundred signatures out of the daily relationship of 1.1 million people. >> i think online petitions are generally worth the paper they are written on. you know, this joins the pantheon of petitions that includes the one for reanimating buffy the vampire slayer. >> some riders complained metro has not reacted aggressively enough to improve train service. they say that routine announcements for commuters to add 30 minutes to their planned travel time are chasing riders away. a dog flu outbreak is shutting down adoptions at the fairfax county animal shelter. two cases of canine influenza have been confirmed there. another 29 animals may have been

exposed. shelter officials say that the strain is not contagious in humans. and that they are taking every precaution to keep it from spreading to other dogs. >> we are going to definitely be on a quarantine here for at least probably would more weeks just to be safe so that we don't further infect any other animals in the community. >> respiratory problems in dogs such as coughing or wheezing could be possible. take your dog to the vet immediately if you suspect a problem. pet owners are advised to stay away from places where many dogs tend to gather. let's get a check on the forecast now. the weekend is upon us. nays one today, bob. >> it is a nice one. if you like today, i think you will really like the weekend. we do have that light easterly breeze but with it also it does bring in some cleaner air. so as a result look at sunday. can't see the washington monument from our perch here. there it is. and the natiol cathedral, too. nice day and on doppler, there's really not anything going on. lot of things going on this

president obama's out west today and pushing his plan for health care rerm. he held a town hall meeting in montana this afternoon and will hold another one in colorado tomorrow. >> the reform debate has sparked noisy exchanges between supporters and opponents. "meet the press" moderator david gregory joins us now with more and a preview of "meet the press" this sunday morning. we have all seen these anyry outbursts. are they having an impact?

>> they are having an impact on the debate. the white house feels the need to hit back to try to win the argument on some of these points to push back against the things clearly not true. you know, lot of the talk about the death panel this week and so forth not part of the bill. one of the things that may be in trouble here is the idea of bipartisanship on this issue. i think democrats and some i talked to today are getting closer to a point where they say let's just get this done with the democratic vote. one of the reasons you saw the president ou west, he's also trying to stiffen the spine of some of those more conservative democrats whom he needs. >> is it working? his town hall meetings seem to be fairly civilized compared to work we have seen earlier. >> it was certainly different. certainly different. he got tough questions. but only a couple. they were civilized questions. so it is just a different character of these debates and you know, who knows who is beingation tracted to these town halls from some of the others we have seen. there's -- coordination and there's an effort to not manufacture the anger but to

coordinate the anger. it does not mean there's not a real concern out there about what's going on. >> it did. it was effective and didn't they take the whole -- the death end of life consultation, took that out. >> they did take that out. again, it is an issue of whether the white house has control over the debate. the president has not said he is for any one plan. and until he does that, you know, there's a lot of room to whack away at things that are being considered. that's one of the problems the white house has. >> is it going to get done? can this get done in the next few weeks? >> it is -- still distinctly possible that there is some kind of compromise this emerge it is democrats have the votes and they have gotten more sway than they had in 1993 to get something done. it is still going to be difficult but i think the president is keeping himself in the position where h can compromise and still claim some kind of victory if he can maintain that support among democrats. >> we know next weekend the first family heads up to mart martha's vineyard for a pricey vacation. with unemployment so high and so many americans struggling, is

in news4 your health, promise in the fight against cancer. researchers in massachusetts developed a technique to screen for drugs that attack cancer stem cells but leave healthy cells alone. cancer stem cells are difficult to locate andre often resistant tow standard treatment. but experiments with a drug were effective in attacking stem cells of breast cancer. mice were treated with the drug. and it slowed the growth of

tumors. but the drug has never been tested in people. there can soon be a new drug to treat osteoporosis. women are the most common sufferers of the disease that causes bones to become fragile. fda committee recommended that done as twice a year treatment would work but did not fully recommend it for prevention in at-risk women. the fda also voted against approving the drug for patients for the breast or prostate cancer. treatment of those diseases can cause reduced bone mass. seasonal effective disorder. it is usually something we talk about in the cold winter months. now doctors are finding skyrocketing temperatures could be sd something people into depression. keith garvin has more on this. >> reporter: for many shorters days and longer nights it is enough to bring on the winter blues. but for some, that hot summer sun might be triggering seasonal effective disorder ao known as s.a.d. >> it hasn't nearly had the
