property crimes over in the community. police want to stress that they now know that this incident is not related to those property crimes. tomorrow night at 6:30 p.m. there's a community meeting over there, and police are answering lots of questions. >> that was tracy wilkins reporting from prince georges county. we have breaking news out of montgomery county this evening. police are investigating a shooting in the 1400 block of indian run drive in german town. they responded around k this afternoon. officers discovered a victim who has not been identified. that victim was shot mults pell times. police have no suspects at this hour. stay with news 4 as this story developed. a former intern for jim gram went on trial today for a shooting outside a metro station. devin black was an intern in graham's office as part of the summer jobs program. black and another teen were taking metro home for

text while driving in construction zones, and what's worse, most have no intentions of stopping. as jane reports, law enforcement officials are vowing to crack down. >> tens of thousands of drivers sending text messages with other motorists trying to stay out of the way. >> the traffic is obviously distracted. they're not keeping up with traffic. they may move a little bit from side to side. ey don't look like they have the full attention. >> reporter: the distracted driving has become especially in the beltway construction zones. over the 1,000 drivers surveyed over half said they texted while they drive, doubling the chance of getting in a crash. >> that's over 117,000 drivers a day out here that are texting

and talking on the cell phones while they're driving, and driving through a work zone. >> reporter: to make matters worse texting while drivers is banned in virginia, yet people do it anyway, sometimes right under the nose of officers. >> the young man, he had both hands on top of the steering wheel with his blackberry and his friends were going to town. he's trying to drive the car like this, and the car is all over in the lane as he's trying to keep it in the middle of road. >> officials are launching a new campaign to made motorists aware of the dangers of distracted driving in a construction zone. police promise stepped-up enforcement, treating texting drivers no different than drunks. >> when a vehicle is making those maneuvers within thelane, swerving, braking inappropriately, something is going on nsinside the vehicle. >> getting drivers to hang up on the roads won't be easy. the most disturbing part of the study is that 95% of the drivers

who text know their behavior is dangerous dubut do it anyway. >> now texting while driving is banned in the district and virginia. on thursday a new state law in maryland makes texting behind the wheel illegal there. commuter connections program has been in operation for more than ten years now, but last year marked its busiest year ever. commuters can get up to four free rides home a year in the event of emergencies. the metropolitan washington council of government sponsors the program and hopes to reduce traffic by encouraging more people to carpool or use public transit. if the ride is approved, they send the taxi to the person's workplace or arranges for a rental car. the average ride costs about $65, but it's free to the commuter with the exception of tips or fuel fees. > the debate over the new national fuel economy standards is about to get louder.

a 60-day public comment period is getng under way. so far both environmentalists and big industry are applauding plan. president obama wants automaker to up-average to 35.35 miles per gallon by 2016. that's eight years sooner. for american automaker you can be more competitive in the global market but critics worry about the cost. a small startup car company is getting a lot of money from the feds as well as high profile investigat. fiskar automotive is producing the karma, a new low emission hybrid car. they green lighted production with a $530 million loan. al gore invested some money in the car and has already preordered his. if you want to get your hands on the karma, get ready for sticker shock. it's estimated to cost $90,000. >> wow. but you save long, long, long term, i guess. >> right. there are a lot of hybrids out there.

showers to the eastern shore. you folks in the upper eastern shore, there are one or two rumbles with this line when it came through montgomery county to the north side. there's been really strong storms up in new york state, rochester, binghamton is getting nasty storms right now. earlier the winds gusted to almost 30 miles per hour. about a quarter of an inch of rain when that line came through. cumberland is seeing winds gusting to 42 miles per hour. the temperature still out west into the 70s, but not overnight tonight. there's that area of low pressure which will slowly drift to the north and behind it some very strong winds continue to come in on west to northwesterly winds through thursday. temperatures tomorrow only in the high 60s to about 70. by tomorrow morning we'll be into the 50s. clearing skies, breezy, cooler. by later on this evening skies are clearing. we got the moon out there, a few days away from being full near the bright object that's there tonight. if you see it 9:00, 10:00, or

counts of capital murder. for the husband and father the decision brings some leaf in the wake of incredible loss. >> this has been very dficult nine and a half months. obviously having this moment weighing over us for all that time has made it that much more difficult. just very relieved, very pleased that the justice system worked for us. >> reporter: the bodies of 19-year-old james smith and his 39-year-old mother jean was discovered six days before christmas last year. a younger sibling, connor made the tragic discovery when he arrived home from school that day. testimony revealed for the first time exactly how the two were killed. james, a jmu student home from college of napping on the couch. he was shot between the eyes. jean smith was shot in her ear as she tried to make a phone call for help. prosecutors used that evidence to bolster the case. he loaded the gun he found there

and shot both victims with premeditation so they couldn't identify him. >> of course, the mom came home. she was naturally upset, and she ran up to use the fan to call 911. he shot her in the ear while she was attempting to make that call. >> now, sentencing in this case is september for february 5th, but because he was 17 at the time of the killings he cannot receive the death penalty. he'll receive life in prison without parole. a look at his written confession in the case. back to you now. >> julie, thank you. the man charged with killing a skurecurity guard at the u.s. holocaust museum this summer could be one step closer to trial. he's been moved from the d.c. jail to a federal prison in north carolina. he'll be evaluated by doctors to determine if he's fit to stand trial. prosecutors argue that while he's physically frail, he's

still a danger to society because he has, quote, nothing to lose. we have breaking news right now out of montgomery county. a shooting involving a county police officer and a teenager outside a home in the darnstown area. jackie benson is live on the scene with details. jackie. >> reporter: at this point police have not confirmed the age of the victim. what we can tell is the very unusual situation, a man shot by police after driving into another man's driveway. here in the darnstown area, i'm joined by lucille bouwer a spokesperson for montgomery county police. tems what happened this afternoon as this car drove up, this very long driveway here. >> the call came in originally to police for a suspicious situation or possibly a traffic accident. the homeowner sees an unknown man in his driveway with an unknown vehicle. he comes out to investigate. when the officer arrives, witness statements tell us that the subject charged the officer,

public bathroom. the shops at the penmar shopping center reaped this afternoon, but work crews investigate a serious gas leak there. >> the leak began on sunday and forced the evacuation of the entire strip mall. >> may, day, mayday. >> you remember back in may a leak at this same mall caused a massive explosionhat injured nine firefighters. that blast was caught on camera, and one of the fire engine's dash cam. they say the most recent leak could have had the same results. megan mcgraph has more. >> reporter: work crews dig holes in the parking lotd looking for the source of the leak. other workers go into marshall's to take air readings. the store and 12 others in the shopping center were evacuated sunday after a leak caused a dangerous buildup of gas inside some shops. it is the second time in four months that it's happened.

>> i got it. >> reporter: in another incident last may, a gas leak caused this massive explosion at the other end the strip mall. nine firefighters were hurt by the flying debris. she owns the liquor store here. he opened up for business this morning, but admits he's a little concerned. >> it worries me a little bit, yeah. i've got to be here. >> there was no explosion in sunday's indent, but it was a close call. fire officials found atmospheric readings of 3.5% inside some stores. a blast is possible when the reading reaches 4%. some wonder if the gasolines leading to the building should be replaced. >> everything wears out in time. nothing lasts forever. it has to be done. >> reporter: marshall's, petco and america's best eye glasses didn't open this morning.

u2 fans are getting ready for tomorrow night's concert and so are crews at fedex field. they're setting up a stage in the middle of the field for the 360 tour. tuesday night's show starting at 11:00. people can expect large crowds. they plan to keep the morgan boulevard station open an hour later for concert-goers. if you're driving, the parking lot is open although noon, but the stadium won't open until

5:00 p.m. they're encouraging people to carpool. well, if you have driven around the southwest waterfront, it is impossible to miss the new arena stage and the grand statement it's making as it grows out of the ground. the $125 million center will bring in productions from all over the nation, and serve as a community for theater fans. with just one year to go now, we got an exclusive peek today as the excitement builds. they're setting the stage in dramatic fashion, a glass roof supported by 18 giant columns dividing the curtain of glass walls that overlook the southwest waterfront. it's designed to pull people in and businesses in to an area poised to take off.
