governor tim kaine says he doesn't anticipate a stay of execution for john allen muhammad. and michael vick was in washington today, we'll tell you why. and some heavy traffic for the u2 concert. we'll check it out. a not guilty ple for the man accused in what's being called the most sophisticated terror plot since 9/11. >> najibullah zazi today entered a plea in a new york courtroom. prosecutors say he was involved in an international conspiracy to build bomb foss an attack on new york city. michelle franzen has our report. >> reporter: under heavy security, najibullah zazi appeared in court.

the afghan immigrant did not speak at the oceeding. his lawyer entered a plea of not guilty for his client. >> i'd like to stop this return to judgment. what i've seen so far, does not amount to a conspiracy. >> reporter: authorities suspect at least three other people are involved in the plot and worked with zazi to stockpile the chemicals, but so far tre are no additional arrests. zazi lift in new york for a decade before moving to denver this january where he worked as an airport shuttle driver. prosecutors allege he traveled to pack stage for training on how to make explosives. investigator say this summer, zazi shown on this surveillance went to denver beauty supply stores, buying gallons of chemica chemicals, investigators say he also chick into the suburban denver hotel and used the stove to practice mixing the

ingredien ingredients. in the days leading up to the 9/11 anniversary, he rented a car and drove from denver to new york city. terrorism analysts call it the most sophisticated plot since 9/11. >> he was within weeks perhaps of launching his operation. >> reporter: as prosecutors work to build their case, they're scrambling to find the bulk chemicals, the key evidence that could help make or break the case against zazi. >> the judge ordered him held without bail. hits next court hearing is scheduled for december 3rd. today tim kaine says he does not anticipate a stay of execution for convicted d.c.-area sniper john allen muhammad. governor cain says he's not yet received a petition seeking klemmancy muhammad is scheduled to be executed on november sew for the slaying of dean meyers in prince william counties.

he was one of ten people shot to death during a three-week rampage. in october 2002, a crime spree that stretched from suburban maryland to central virginia. there was a powerful earthquake on the floor of the pacific ocean that triggered a tsunami today. it hit about 120 miles southwest of american samoa. shortly after that, a five-foot tsunami swept into pago pago. there are reports that at least one village there was wiped out. fears of a tsunami had sent many coastal residents running for higher ground. the tsunami warning is now in fect for much of the south pa sink ocean, including new zealand, fiji, and french policy neeshia. hawaii is under a tsunami watch. emergencies si centers have been opened there. in the debate over health care reform, a defeat for the so-called public option. liberal democrats failed in their bid to include a government-run insurance option to sweeping health care

noncombatants, and they were they were members of the u.s. navy seabees. >> a filipino marine was also killed in that attack. there are about 600 military personnel in the philippines, most working with the philippine armed force in counterterrorist operations. on thursday there will be some new laws for motoristness maryland. those laws are designed to change peel's habits by issuing fines for speeding in work zones and for texting behind the wheel. >> reporter: drivers who speed through maryland stays construction work zones are in for a surprise come thursday. it will send a ticket to the offender's home. motorists are less than enthused. >> i hate speeding, i hate them with a passion, i don't like

speeding, either, but speed cameras are a nuisance. probably just a hidden tax more than anything else. >> reporter: but officials say they work. speedams are already in effect in month gop roy, where they made a huge impact. >> accidents, pedestrian accidents and overall speed on the road are down. it's been a positive effect. >> a new law banning texting while driving will be much more costly. >> enforcing the new ban will be tricky, because under the new law you're allowed to read your blackberry or ipod, however, it's against the law to physically text. >> people look at map sdrekds or look at a blush or something for an address to a house. it will be difficult to enforce, but it's an important law t go on the books. >> reporter: they hope it would force drivers to keep both hands on the wheel. >> it's scary to ink that someone is driving and texting.

athletes and city officials from chicago were in denmark lobbying the international olympic committee to bring the games to the windy cy. the group arrived today. the cop. >> we're glad you're here, and we know we can deliver a spectacular president obama and his wife will join the team on friday, the same day they'll choose a host city. one year ago today, the dow jones industrial average suffered its biggest one-day drop of all time. today there are signs every economic recoveries, including encouraging numbers of home prices, but that has not been enough to boost consumer confidence yet.

leanne gregg has our report. >> reporter: september 29th, 2008, the dow plumb mets after congress rejected a multibillion bank bailout plan. now one year later, mixed signs of reporter for the third month in a row, prices rose according to the kay shiller home price index of 20 major cities. we haven't seen that in years. >> but not in cities like las vegas. where home prices are down. in the detroit area, reeling from layoffs, and in seattle, one of the last areas to enter the downturn, prices have yesterday to hit bottom.

plo jected higher unemployment rates, worries about job security and declining incomes helped push the index down in september by more than a point. the present situation index, which measures consumers' assessment also declined close to three points. despite some positive housing numbers, confidence considering a leading indicator of spendic is raising concerns about the upcoming holiday shopping season and the duration of the downturn. leanne gregg, nbc news. the dow is down 47 points, and the new york stock exchange loss about 12. u.s. supreme court justice posed for an official photo this morning.

the first group. are back in new york after spending three years in maryland. more than 200 humps of steel were taken back to new york this morning. a three-your study is being done on that steel at the national institute for standards and technology. the stl was taken to the new york port authority. michael vick was in d.c. today, vick returned to professional football this year after spenting almost two yea in prison for his part. tracy has more. >> reporter: jim, this is basically kind of like a scared straight for animal cruelty.

he's gone. happy the hippo has left the national zoo. the 28-year-old nile hip pot muss was transported to the milwaukee county zoo in wisconsin yesterday. his move will pair him with two female hippos named patty and puddles for possible breeding. national zoo staff moved himo make room for a new elephant exhibit. he had shared the habitat, but the new exhibit will only be able to accommodate the elephants. it's scheduled to open in 2011. happy was born at the national zoo on january 4th, 1981. we hope he's going to be happy with his new girl friends and his new home.

here we are in washington. you can see how they're lined up. up and over the mountains to our west. it forms clouds and thin nks, the waves move on, and then there are the blank spots in between. you can see waves from space, too. boy, was it chilly around the lakers. 46 degrees up and around the lakes, and it's still 46 degrees. spots like sault ste. marie, the pattern is the reason we have the air up and over the mountains. there's nothing going on here for doppler. there are some more nasty showers, and a lot of rain to our north. buffalo yesterday had almost four inches of rain, and there are more rain showers and almost snowflakes at the adirondacks on into the white mountains of new hampshire. look at mt. washington. 36 degrees right now. batavia has had another inch of rain.

only six named storms this season. here's what's going on over the next few days. a little wave in the atmosphere. that's a developing storm for some of the high spots for colorado. we, on the other hand, will still say keep this same pattern in and around us, continue to go come in northwesterly winds up to our north. there will be some passing showers. then as we get later into the week by thursday, high pressure in on us, so i think we'll see some milder air, but also lighter winds. tomorrow morning, bundle up, in the low 50s in town, and 40s for you folks out in the suburbs. then tomorrow during the

now we take a look at some of the stories making headlines tonight. >> the man accused in an alleged terror plot pleaded not guilty in a federal courthouse in brooklyn today. prosecutors say that najibullah zazi was involved in a conspiracy to attack new york's transit system with homemade bombs. zazi is being held without bail. a powerful kuwait triggered a tsunami. at least one village was wiped t reportedly. the magnitude 8.0 quake struck about 120 miles southwest of the south pacific island. tsunami warnings and watching are in effect for much of the area. nfl quarter bike michael vick was here in washington today speaking at a humane society event. vick brought his anti-dogfighting message to the covenant baptist church in

southwest d.c. he's been working with the humane society of the u.s. since his release from prison. he was convicted of running a dogfighting ring. coming up, we'll report on an elephant ramp an. it happened in india. there could be heavy traffic around the u2 concert. and we'll tell you about a 500-rat diamond discovered in africa. starting soon, metro will be keeping a closer watch on passengers. the transit agency has gotten a homeland security fund totalling more than $78 million. the agency will spend a good portion of that money on surveillance cameras. chris gordon reports. >> reporter: you may have noticed surveillance cameras at metro rail stations, on platforms keeping an eye on passengers, but metro has no cameras on its trains. the new grant from the department of homeland security will allowetro to equip all of its traincars with cameras,

supplement the surveillance at its stations, and installed cameras on every metro bus, currently only half of its fleet is equipped with cameras. the homeland security money will allow metro to monitor all of its buses and trains, to manage crowds and crime. >> i think that's a good idea, because you never know who's in there, and you always want someone to keep a lookou for you when you're in the trains, even in the stations, because anything could happen. >> obviously london has done it, and when london first staw"8jñ a lot of people had fears about it. now that they have it in place, it's a model followed around the world by a lot of cities. >> reporter: metro hopes the cameras will allow them to observe any suspicious activity and share it live real time in transit officers. there are handheld devicesnd laptop computers. >> certain the officers in their scout cars, their police cars, they have mobile data terminals

that have some capability to retrieve images and see things that are happening. we hopefully link that up to the scout cars to see as a testing and evaluation. hopefully we'll develop a system for our foot patrol officers as well. >> metro will install them at ventilation shafts, will build gates at the end of platforms to prevent anyone from climbing into the tunnel. the homeland security money will also be used to add 25 transit police officers, three bomb-detecting dogs, and a 20-member anterrorism team. chris gordon, news 4. metro says the homeland security grants will help fight terrorism and crime. the transit agency plans to ask for more federal funds next year. >> there are new details in the murder of a man found in a school parking loss in prince georges county. authorities found the victim outside the ascension lutheran school yesterday morning in

landover schools. 6 sources tell news 4 the man was missing most of his clothes, and that his feet had been burned in an apparent act of torture. investigators have not been able to identify the victim yet. they're hoping that the medical examiner's report will give them enough information to help them close this case. a 31-year-old man is still in critical condition after he was shot yesterday by a montgomery county police officer. police say the officer fired off two rounds after the man charged and attacked him outside a house in darntown maryland. no charges have been filed against defright as. the officer involved has been on the force for two years now, he's on paid leave during this investigation. the d.c. council heard public opinions today on a proposal that would make it illegal to sell individual cigars in the city. the proposed bill would ban the sales of single cigars or cigar products that might be used for smoking marijuana. cigar shop owners say this would

unfairly punish those that smoke cigars legally. there' no timetable on whether there's likely to be a vote. hundreds of students in the district today made a plea to keep their teachers. about 200 students at the duke ellington school of the arts in northwest d.c. walked out during a lunch today torotest the expected cuts. the superintendent announced she is forced to cut $40 million frommed budget, including teachers and school staff positions throughout the city. >> we need our teachers her and we need our education. no teachers, no education. >> reporter: the thought of losing any of those teachers? >> it hurts me very much. >> reporter: a spokes american in michelle reed's office says they still don't know the number they'll have to let go. they say an announcement will be made on thursday. >> lots of excitement at fedex

field. u2 is getting ready to take the stage. the timing of the concerts means commuters very to make changes in their drive home. >> reporter: at fedex field, it looks more like a weekend skins game than a tuesday afternoon, but in half an hour, music, not football, will be played here, 80,000 people are expected to watch u2 in concert. >> big fan. at 14, i went and saw it arena that used to be here the unforgettable fire tour, and i haven't missed a u2 concert. last month many had trouble getting here because of traffic and parking problems. that caused many or part to miss all of the bad show, prompting an apology. >> i was supposed to get -- i was stuck and i didn't make it. it was like 9:30.

were some clouds around before. since early this afternoon, they have pretty much dissipated. right now outside it's a nice evening out there. if you're out a about, take a look toward the southeast sky, the moon is coming up now, but within a couple hours you'll be able to see it nice and bright, but today just below and to the right is the planet jupiter with four moons, too. heading out to school tomorrow morning, it will be a chilly morning, as low as the mid 40s in some of the cooler suburbs. next seven days i think we'll be seeing a mixture of clouds and sunshine, maybe some showers to start off the weekend. right now a 40% chance. sunday looks great, back to you. >> thanks, bob. government troops in the west after kaj nation of guinea are accused of killing people at a pro-democracy demonstration. it happened yesterday. thousands of people attended a rally at a local soccer stium.

they say they want to be free of the military junta that took control last year. suddenly soldiers entered the stadium and opened fire on the crowd. government officials say 50 people were killed. the after kaj union is threatening to impose sanctions if that country is not returne to civilian rule. several other members of the international community are considering options also. there's a scandal in iran between police and store owners who have mannequins without head scarves. they're cracking down in a campaign against western cultural influences. they also say when mannequins have ahood scarf, many customers won't enter their store. the islamic republic of iran is very conservative and women are required to wear head scarves in

'electric asked me to friend him. >> he did, on facebook? >> are you serious? he said that recently the team drove 40 miles away to go play paintball. the people there noticed them and recognized him immediately, and he said that's an example of how much this team has grown in the popularity that is really stored in this city. in hockey, you don't know really what you have as far as a team until you see them on the ice, but based on what the team has shown in preseason, the additions they added could make this team extremely competition.

they dropped the puck on the regular season thursday night. players are ready to pick up right where they left off. that fact plus last year's defense, the capitals are the team. it was media day, a day that they all seem to enjoy. some old faces, new faces, and they feel good. the capitals were on the ice this morning. there's alex. he had just friended you, by the way. this team is so excited after making it all the way as far as they did. it's only left them hungrier to perform this season. their popularity has soared, and now is the time to capitalize. >> those windows, when you're a hockey team, don't open very often, so you have to take advantage of it. so we're looking forward to hopefully getting off on the right foot. there's great fans here, and whether it be baseball, otball, hockey, soccer, or

the flu has shut down an entire school district near houston, texas.

all eight campuses in the huntsville independent school district will remain closed until thursday. school officials say 15% were absent yesterday and 10% were out sick. authorities say they'll scrub down all schools before they reopen. texas is one of 26 states where flu activity is now widespread. the swine flu vaccine is on its way to doctors and clinics across the country. the manufacturer says its first shipment went out today, two weeks ahead of schedule, but there's growing concern from parents and even health care workers about getting the shot. still government officials are warning you shouldn't avoid it. >> it killed my baby. >> reporter: 14-year-old chloe lindsey died from the h1n1 virus. now her mother is urging parents to get their children vaccinated. >> i can't fathom this could happen to me, and i don't want it to happen to anybody else.
