into the ocean. the federal government may have to take the lead in order to cap that massive leak. good afternoon, everybody. >> bp is now saying it will be wednesday before its next attempt to cap the well in the gulf of mexico. today, a congressional delegation headed by interior secretary ken salazar and homeland security secretary janet uaret napolitano is visite area. >> meanwhile, bp says the oil company shares everyone's frustrations with its failure to plug the leak. a fleet of ships is moving into the still zone now. robotic submersibles are preparing for a top kill, which has been pushed back to wednesday now. that will be day 36 since the well collapse and would be the first attempt to stop the leak. >> they will be held accountable.

these tiny fishing communities. time is running out. >> we don't have 24 or 48 hours. >> reporter: most argue the response isn't moving nearly fast enough. >> bp engineers have their sights set on starting the top kill wednesday morning and say we should know by wednesday night if it seals the well. jay gray, nbc news, venice, louisiana. >> the crude has now entered currents that will carry it up the atlantic ocean and up the east coast. today a university of maryland researcher, however, said barring a hurricane or strong storm, maryland, delaware, and virginia beaches should be safe from the oil. atlantic currents are expected to keep most of it out at sea. it's predicted that the worst thing mid-atlantic beachgoers will likely encounter would be a few sandy tar balls. the eruption activity in ice land's volcano is slowing today. as of yesterday, the volcano has only been producing steam. no more magma, no more ash like the massive cloud tham shut down

air traffic in europe for six days back in april. meteorologists say it's too soon to say whether the volcanic eruption is over, but for now they say it's quiet. >> this afternoon, police say road rage led to a shooting on the baltimore-washington parkway. this happened last night just south of route 198 in laurel. the parkway was shut down for several hours. investigators say it all appeared to stem from a fender bender. >> the 911 call came in just before 11:30 last night. reports of gun fire on the baltimore washington parkway. inside a car were two men. one had been shot in the arm and shoulder. according to police, the shooting happened a few miles away on a different stretch of the parkway. that's where investigators found several shell casings. >> we were looking far crime scene, because we didn't find anything at the scene of that car that would indicate where

the shooting took place. one of our canine handlers walked about two miles with his dog that's trained to do article searchers and did locate evidence about a mile and a half from the scene. >> the southbound lane was shut down for several hours but reopened in time for the morning rush hour. motorists who use the b.w. parkway find it disturbing. >> it could have been anybody. it could have escalated. it could have been an escalated multicar pile-up because of it. and people are not thinking of the consequences of their selfish actions. >> it does worry me. it's concerning, especially when it happens in your area. it's kind of scare prip. >> it's scary. it's a shock, an absolute shock. >> police believe the shooting suspect was a passenger in a dark colored suv. they're asking anybody who may have seen that vehicle to give them a call.

>> police in fairfax counties are stepping up their efforts to find two ikillers in the death f two homeowners. they want to know anything about who killed jose rosales at mansion in centreville. the suspects broke in last monday morning. he stopped the suspects from gets into the house but lost his life in the process. police tell us the men escaped in an older white pickup truck. investigators say this truck is a vital clue. >> some witnesses described someone getting in the back of the pickup truck and covering themselves up with a tarp. certainly, that's not a normal behavior to see something like that. >> police say this morning's exercise was productive. so far, though, no arrests having made. >> a stafford county man is facing charges today in connection with an incident that led to the lockdown of five schools.

it all started just after 8:30 when police were called about a suspicious man in the vicinity of parkridge elementary. the caller told police the man had a gun. police locked down park ridge and four other schools in the area to carry out their search. police say when they finally found the man, he attacked one of the officers, breaking the officer's ankle. they didn't find a weapon. the man identified as reginald lat latsen is now facing assault charges. >> the evidence discovered was revealed in court today. juan was found dead in t-- wone found dead in the home of a friend. joe price was glaring at staring one of his roommates dylan ward while police were on the scene. the officer testified that their whispering made him suspicious. pat collins will have much more on this story tonight live on

news 4 at 5:00. >> a credit card scam is cheating customers out of tense of thousands of dollars. three servers at the cheesecake factory in friendship heights are accused of this scam. federal authorities say they stole credit card numbers from patrons using a skimming device. about $117,000 in fraudulent charges were wracked up on those stolen cards between 2008 and 2009. court documents name former cheesecake factory server nicole ward as the ringleader in the scheme. chris gordon will have more on this story in a live report coming up tonight on news 4 at 5:00. >> live look outside right now. >> and if you get an e-mail from a friend saying they saw you at starbucks, beware. that could be part of a new scam that's going around. the appear in boxes and pretend to be from somebody you know. the sender even addresses you by name. and then you get invited to look at pictures of yourself.

but when you click on the link, it actually takes you to objectionable sites, or even charges your bank account. tech experts advise you not to click on any links that you're not sure of. that's good advice any day. >> well, now here is a safe sight. cloudy and on the cool side for most of this monday. >> not a bad way to start the work week. i stuck my head outdoors and saw just a sliver of sun. >> depends on where you are. there's bigger sliver in some places and smaller slivers in others. no doubt about it. plenty of clouds are the rule. and a couple of showers over on the eastern shore, heading westbound. you folk in annapolis on the western shore of the bay may get some sprinkles. there are a couple now, these are going to be coming over the chesapeake bay bridge. so there will be an isolated little shower or two, but by and large, most of the rain is going to stay away from pups one or two showers, generally moving off from east to west.

i don't have him no more. >> reporter: grieving coal miner clay mullins wore his siblings' memory and the rest of the miners who died in april. they testified to congress that safety rules were broken to keep coal production high. >> this place is a ticking time bomb. >> miners at upper big branch felt they could not report unsafe kpns. >> reporter: when government inspectors showed up, miners say they got tipped off. >> to make sure everything was right and if it wasn't, fix it before the inspector got there. >> miner says when inspectors were not there, critical ventilation rules were violated. >> this came from the president of the company. we said that's against the law. >> reporter: the deadly april blast was blamed on bad ventilation. >> 29 men are now dead. >> called before congress last week, the chairman of massey energy that owns the mine admitted his fatality rate is

high. >> once you add the 29 in, it's a bad record. i feel terrible about it. i don't know yet what happened. >> reporter: lawmakers say what happened was weak oversight and law breaking. i'm steve handlesman, nbc news, capitol hill. >> now, some capitol hill observers pointed out similarities to the oil spill in the gulf. both involved big company, a disaster, federal oversight and yes, finger pointing. >> a legal blow for the national football league today. today, the u.s. supreme court ruled that when it comes to selling nfl merchandise, the nfl cannot be the soul negotiator for every one of its 32-separately owned teams. the case involves a lawsuit by an illinois apparel company. they lost ability to sell nfl caps and other apear rel when the league struck a deal with reebok. american needle claimed the deal essentially stifled competition and violated u.s. antitrust

laws. the apparel case now goes back to district court for further examination. there was a big meeting at the white house about the military's controversial don't ask-don't tell policy. gay rights activists, lawmakers and officials met to best decide how to speed up repeal of the ban on openly gay men and women on the military. law makers are expected to introduce legislation this week that will end the policy this year. however you can even if congress approves the repeal. it would take several years before gays and lesbians could serve openly while the pentagon writes new policies on the matter. stay right there, we're just getting started. lindsay lohan goes before a judge today. >> up next at 4:15, a change in lifestyle for the actress. and the new fashion accessory she's now spofrting on the streets of los angeles. plus, the duchess of york apologizing after being caught on tape trying to sell access to her ex-husband. >> hen the truth about a gluten free diet and whether or not the

she was in the hot seat after she missed a mandatory court hearing last week when she said she was stuck in france without her passport. leanne gregg has the latest. after missing a hearing last week prompting a judge to issue a bench warrant for her arrest, actress lindsay lohan appeared in court late before an unsympathetic judge. the judge ordered lohan not to consume alcohol or drugs, to wear a device that measures presence of the alcohol in her body, to attend alcohol classes one a week and submit to random alcohol testing in california. no room for negotiations as lohan's attorney asks for revisions in the terms, including to allow the actress to leave the state to work on a film in texas. >> she needs to submit to random drug testing here, not in texas. >> reporter: the hearing low han missed last week was related to her 2007 no contest plea to

driving under the influence. she had been in france and claimed someone had stolen her passport. after obtaining temporary documents, lohan returned to los angeles late saturday and was caught on tape trying to evade cam perhaps the 23-year-old actress was considered one of the hollywood's most talented young stars, but attention for her movie career has taken a backseat to her partying antics. her troubles are not over. another hearing is set for early july son whether lohan violated her terms of probation. leanne gregg, news 4. now, lohan told internet tabloid "hollywood tv" that despite claims she was out partying in cannes, she was actually there to promote her new film. she added that photos displaying her near what appears to be cocaine were taken in a fan's room. rocker and reality tv star bret michaels says he's not 100% healthy yet, but he's looking forward to getting back on the road and performing.

he's the newest winter of the celebrity apprentice. he appeared live on the last night's performance. his appearance had been questioned when he was hospitalized. michaels spoke about his plan this morning on the "today show." >> i don't know that i'm ready yet and i'm going to take it in baby step preponderates i'm going to do a show and see how it goes. >> michaels won $500,000 for the charity of his choice, the american diabetes association. >> ray la hood launched this year's click it or ticket effort today. la hood says 84% of drivers nationwide wear their seat belts. that's an all-time high, folks. but the public safety campaign aims to reach the 45 million americans who are not buckling up. this year's initiative reaches across the media platforms and

>> good news for drivers as memorial day weekend approaches. currently, the national average is $2.79 in d.c., the price is $2.9. in maryland, sgas going for about $2.83 per gallon. and across virginia, gas is averaging about $2.69 per gallon. so that is some relief. >> yeah, that is. >> i would agree. >> so is seeing the sun peeking through those cumulus clouds out there. >> good for you, naming that cloud type. look at that. a-plus for you in the science department. >> i learned that in eighth grade. >> and you remembered it. >> yes, i did. >> werp taught a lot in eighth grade. it's all gone.

puffy cumulus clouds out there. not generating much in the way of rainfall across the area, but there are a coup of sprinkles coming westbound. under the breaks of sunshine, our temperature has picked up to 77 degrees now at national airport. a fairly light wind out of the northeast at 3 miles an hour. only 1/100th of an inch of rainfall. temperatures in the 60s along the coastline. 70s for us, just out back to our west, though. temperatures well be up into the 80s. that bubble of warm air will come our way as we get towards wednesday. doppler, no rain around here. you can see light little popcorn showers, drifting westbound across the eastern shore. they will be making it over the bay here. you folks right alongside the chesapeake bay may have showers over the next hour or two. some of them may live long enough to bring a passing rain shower through the washington area. once the sun goes down, those showers will not live very long at all. high pressure building down the

coast from new england. as a result, we've got a east to nearly wind flow. that's keeping the temperatures fairly cool. that's keeping the cloud cover in place as well. that will gradually begin to break down. as this area breaks down to the north and west. eventually we'll lose that easterly component. that will allow for a little more sunshine. not so much tomorrow, but as we get into wednesday and thursday, our weather will finally begin to rapidly improve. so for the rest of this evening, generally cloudy skies. one or two lonely little showers between now and 9:00 this evening, waking up tomorrow morning. plenty of fog around the area. patchy and dense in some locations by sun rise. upper 50s and low 60s. then tomorrow, more sunshine than today. once we burn the fog layer off in the morning. highs tomorrow, mid to upper 70s. the all-important seven-day forecast. then a nice little warming trend.

welcome back. some of the big story wes ear following for you this half-hour. police say road rage led to a shooting on the baltimore washington parkway. it happened just south of route 198 in laurel, maryland. investigators tell us a passenger riding in a dark suv shot and wounded the driver of another vehicle after the twoe were involved in a fender bender. today investigators stopped cars in the centreville area asking if anybody knew anything about who killed jose rosalez a week ago at a mansion on compton road in centreville. he was working inside the home when the suspects broke in last monday. police say the men escaped in an

older wiet pickup truck. the first police on the scene of the robert wone murder trial testified today in the case of three men accused of covering up the crime. wone is the washington lawyer found stabbed to death back in august of 2006. an evidence technician told the court that he found no evidence of a break-in at that home. and three servers at the cheeseca cheesecake factory at chevy chase friendship height are accused in a credit card scam. they stole credit card numbers from patrons using a skimming device. about $117,000 in fraudulent charges were wracked up between 2008 and 2009. >> it has britains shaking their heads. a new video surfaced that app r appears to show duchess sarah ferguson exchanging money for access to her ex-husband prince andrew. buckingham palace denice the

prince has anything to do with this. the duchess of york fell right. >> reporter: fergie sells access to her ex-husband prince andrew, queen elizabeth's second son, for nearly $750,000. not knowing the man posing as a businessman is actually a reporter for "news of the world." >> essentially saying her ex-husband, prince andrew, who let's not forget is up for rent. >> the palace categorically denies that he had any idea his ex-wife was involved in the ordeal. it's true my financial situation is under stress.

however, that's no excuse for a serious lapse in judgment and i am very sorry. the duke of york was not aware or involved in any of the discussions. prince andrew and fergie have described themselves as the happiest divorced couple in the world. many believe that amicable agreement could come to an abrupt end. now ferguson and prince andrew divorced in 1996. that same year that prince charles and diana parted ways. there's been a state of emergency declared in parts of jamaica. masked torched a police station and traded gunfire with security forces. the gunmen were reportedly defending a reputed drug lord, identified as christopher coke. u.s. authorities are reportedly searching coke.

sound of sporadic gun fire rang out. >> monica beresford-redmond was found beaten to death in cancun six weeks ago. the police have called her husband a suspect but never charged him in the case. his attorney says he's back in the u.s. meanwhile, family members of the victim are outrage there have been no arrests. >> we begged that all the requests made by the family to the mexican authorities be granted immediately. we cannot wait anymore. >> it's now up to mexican authorities to decide whether to charge beresford-redmond for murder and bring him back for court. just five months after actress brettittany murphy was

found dead in her home, her husband had died. he may have had a heart attack also in the los angeles home. he and his wife shared the home with murphy's mother. he was outspoken about his grief after murphy's death, saying he had lost his best friend and soul mate. murphy died last december of pneumonia. police in florida say a teenage girl was savagely beaten over text messages and for the first time we're learning the content of those messages. 15-year-old wayne treacy is charged with beating and kicking josie ratley so severely, she must learn to walk and talk all over again. treacy's father is in prison and his older brother committed suicide. rat d ratley called him a rapist because he likes a 13-year-old

girl. she said just go visit your dead brother. >> that just really tipped me off. i don't know, i couldn't get the feeling to subside. >> he rode his bike three miles and stomped and kicked josie ratley nearly to death. his attorney says the teenage boy just snapped because of everything he'd been through. >> today, hundreds of mourners gathered to remember an arkansas police officer killed during a traffic stop. sergeant brandon putart was shot down by a 16-year-old and a father in his call. the suspects also shot and killed another officer. about an hour later, police tracked down both suspects and a shootout ensued. both suspects were killed. two officers were wounded. just ahead on news 4 at 4:00

good news on the home front today, sales for april were higher than expected. sales of previously owned homes were up 7.6%, according to the national association of realtors. that's nearly two points higher than expected. the numbers are the best in five months. thanks in part to federal tax credits, offered to first-time home buyers, and homeowners looking to upgrade. first-time buyers were offered up to $8,000 if they signed their contracts by april 30. upgrades were eligible for up to $6,500. airlines are adding an additional fee for many summer flights. airlines are sur charging passengers up to $30 for each one-day domestic flight. it's covered in the cost of the
