robert wone was murdered, for a while it was sergeant patrick who was the ranking officer at that house on swan street. when he got to the house, sergeant patrick said he saw all three defendants dressed in white robes. at the time, he said we treated them like victims, not suspects. sergeant patrick says he saw victor zaborsky sitting on a couch crying. every time dylan ward would try to say something, joe price would glare at him and ward would stop talking. they were whispering, and those glares made me suspicious said sergeant patrick. later, i told a homicide detective about it. august 2006, 32-year-old robert wone, stabbed to death as he was spending the night at his home on swan street. no one has been charged in that murder, but the three house mates who live there have been charged with trying to cover up

the crime. defense attorneys say it was a robbe robbery, that an intruder came into an open backdoor and murdered robert wone. evidence tech curtis lancaster says police spent about three weeks looking for clues on swan street. he said he found no evidence of a break-in. no sign of a ransacking. nothing broken, nothing taken. >> now, in the three weeks that police worked that house on swan street, they removed u traps from the bathroom, the washer and drier, parts of the staircase, wood molding. they even took out pieces of the wall. they took them away and tested them for blood stains or evidence the blood had been wiped away. they found nothing. wendy, back to you. >> pat collins, thank you, pat. police in fairfax county tonight are stepping up efforts

to find two killers involved in a deadly invasion at a mansion. today, investigators stopped cars in the centreville area, asking if anyone knew anything about the gunn who killed jose rosalez a week ago today. he stopped suspects from get into the house, but he lost his life in the process. so far, no arrests have been made. a maryland state trooper manages to chase a suspect down with just one good leg. trooper first class jeremy tindall stopped the car for speeding. he noticed the driver was acting suspiciously. he ordered him out of the car. that's when police tell us a plastic bag used for drugs fell out of the driver's pant leg. he took off running.

tindall started chasing the suspect but felt something pop in his left leg. he kept going, managed to grab the suspect and make an arrest, broken leg and all. chuck bell is in the storm center. >> troop climbed into the mid and high 70s. here's a check of doppler radar. there are some very light little popcorn showers off the eastern shore. they're coming out over the bay. so you folks from annapolis northbound towards severin and the inner harbor of baltimore might get a stray shower.

which is owned by massey energy. one of the witnesses today is a miner whose sun was killed. he accused officials of sending out alerts whenever the mine safety inspectors rooifed on the property, and he urged lawmakers to set penalties for that kind of behavior. nbc's tom costello with more on the hearing. hi, tom. >> reporter: good afternoon. in fact, several former employees and urnt current empl said the same thing. they would quickly scramble and fix things that were not proper. we heard emotional testimony as well from family members that were still grieving several weeks after this terrible disaster that killed 29 people. the worst mine disaster in 40 years. interestingly, they have still

not gotten into the mine. investigator says the air inside the mine is still too poisonous. they can't get in. they're hoping to get in the wednesday after memorial day. but investigators came here, congressional investigators came here because they wanted to hear exactly what the family members had to say and they also wanted to hear what the miners had to say about the state of the mine and about massey energy's overall record. wendy, so many different employees pointed the finger at massey and said they were running an unsafe operation. at the end of the hearing, the chairman of the hearing warned mat see if they tried to retaliate against any of these witnesses they will face severe punishment, that the witnesses are given congressional safety, if you will, a congressional immunity. and they warned them against any retaliation against these employees. back to you. >> how longer is this going to go on? are they going to hear on massey?

>> this was a one-day hearing. but the ceo of massey was on the hill last week and he denied unsafe mines despite the fact that 53 people have died over ten years. he said they operate a safe, safe mine system, and they do not put profits ahead of safety. >> thank you, tom. rescuers are scrambling to clean and save animals threatened by the oil disaster in the gulf. this is the bird rescue center trying to remove sludge from a pelican. 32 birds have come into the center covered in oil. they expect to see many, many more. oil has now pushed into two major pelican nesting colonies in louisiana's wet lands. some eggs were too contaminated, too. today interior secretary ken salazar slammed british petroleum for missing deadlines on sealing that broken well that continues to release all that oil. he was part of a del grags from

washington that toured the gulf today. jay gray is live with the latest. i understand you've got some breaking news about the environmental protection agency now? >> hey there, jim. the lead administrator for the epa, lisa jackson, also on the ground here in the region and just announced within the last few minutes that she is insisting that bp cut back on the chemical disbersmentes they have been using to try to break up the oil on the surface of the gulf and the oil that's underneath. they've been applying it at the leak site. she wants it cut back 50% to 75% because she's not satisfied that bp has done enough research to find a less toxic replacement. she says she understands it's been effective at some point now, but the long-term results of using such a volume of chemicals in the water is not known, especially for the marine life and the water shelf here. so she's again insisting that bp reduce the use of chemical

>> i don't want to age prematurely. >> reporter: in its fourth annual sunscreen report, the d.c.-based environmental working group says it doesn't matter if you're trying to prevent skin cancer or wrinkles. there are not a whole lot of products out there that are both safe and effective. >> we were very disappointed in this year's crop of sun screens. >> senior scientist jane hul han says of the 500 products they review, they only recommend 9. that's just 8%. one big factor, new government research linking vitamin a to increased risk of skin cancer. the food and drug administration has been studying the safety of vitamin a since manufacturers started adding it to thousands of cosmetic products including sun screens. when you put it on the skin and sunlight hits it, this data shows it may speed up the growth of skin tumors and legions.

>> that was based on lab tests in animals and hasn't been finalized yet. beau hul han says's very concerning, because vitamin a is now used in 41% of sunscreens. another concern was over a common active ingredient, oxynbenzone. >> it's a toxic. it's the most common sun screen ingredie ingredient. it's a potential hormone disrupt tor. >> while poor grades were given to a lot of sun screen, there are some ways to find safe and effective products. first, make sure you're getting broad spectrum protection. that means it will protect against uvb and uva rays of the sun. also look for products that have safe chemicals. things like zinc and titanium. >> seek shade, plan your time in

here's your check of doppler radar. you can see there are a couple of light little showers now over the eastern shore. they're coming westbound. the chesapeake bay bridge is right here. these are going to be coming over the bap glenn bernie, annapolis, also down towards calvert beach. high pressure to our north, low pressure to our south is combining to keep a cool and relatively moist easterly wind around here. that will keep clouds and the risk of fog. breaks of sunshine from time to time. another chance for a little fog, first thing on wednesday morning, but eventually that big bubble of warmer air out to our west is going to send a shot of

at home, someone could be tracking kbroup. >> and taxpayers footing the bill to have bodyguards who get paid $90,000 each. welcome back, everybody to our second half-hour. a statue of three soldiers has been a popular part of the vietnam veteran's memorial. but beginning tomorrow, the statue will be closed to the public for nearly two months for restorati restoration. that means it will only be partially visible during the weekend's memorial day celebrations. >> the statue repair is starting tomorrow. >> you can see over time that this statue is showing its age. the beautiful patina has been scrubbed abap. >> the memorial wall has drawn tens of millions of tourists since it opened in 1982. the three soldiers statue was added after concerns that the

chris gordon with the latest. >> the corporate offices put out a statement apologizing to customers for any inconvenience or concern, saying the parties responsible no longer work at the restaurant. >> federal authorities say the credit card scam occurred here on wisconsin avenue in friendship heights. some customers who handed over a credit card to pay their bill had the numbers copied from its magnetic strip and allegedly used to make more than $117,000 in fraudulent charges. news has made some customers cautious. >> did you eat at the cheesecake factory? >> yes pop. >> did you pay by credit card? >> no. >> because i used cash today. >> why? >> because of what's going on. i didn't want my credit card information being taken.
