evy suburb mid to high 40s. 46 in manassas. near 70 for a high today. the blue devils are in town to take on the terrapins. great weather for college football tonight. new today d.c. police are investigating an overnight murder. officers tell us they found a man dead near the intersection of 54th and dick be streets in northeast. police say this happened after :30 this morning. so far word if detectives have a motive or suspect in custody. starting this month it's illegal to hold yourcell phone up to your ear with while driving in maryland. one family hopes the new law will save another family from

family to go through what we've gone through. if ts law does that then it's a success. >> reporter: the couple was on their way to a car show when the accident happened. rhonda is to discussion on healing but hopes this new law brings awareness that cell phones can be deadly distractions behind the wheel. >> we want to move on and not dwell on things and start living again. so we're ging to do the best we can. >> reporter: darcy spencer, "news4 today." police in fairfax county are on the look out r a burglar that has been breaking into homes at a prolific read. the crime spree has been all over the county and the suspect has been stealing everything he can get his hads on. according to police almost all the homes the suspect are targeting, lar, very few exterior lights. he's taking advantage of people leaving a patio door unlocked or

garage door open. some county residents are taking extra precautions while police say their advice is simple,ock up at night. >> at my wife's urging i changed the timing settings. >> pleas lock your doors and windows of your homes and this would include your garage doors. make sure you have your doors and windows locked before you go to bed. >> turn that alarm on if you have one. to add the problem the burglar has stolen two guns and they urge homeowners not confront him. maryland police are investigating an incident at an annapolis high school where a female student said she was sexual assaulted by a fellow classmate on school grounds. police were called yesterday at about 12:30. they said she knows the boy who assaulted her but no arrests have been made. big news from the largest

bank in america. bank of america is halting foreclosures in 23 states. they will stop foreclosing on homes becaus they acknowledged they rushed foreclosure. federal regators have contacted five other banks and ask them to check their foreclosures. president obama looking for a permanent replacement to be his chief of stuff. yesterday rahm emanuel resigned from that position so he can run for mayor for chicago. >> mr. president, i thought i was tough but as someone who saw firsthand how close our nation me to the brink and what you had to do to put america back on track i want to thank you for being the toughest leader any country could ask for in t toughest times any president has ever faced.

>> the president's top senate staffer pete rouse will serve as chief of staff. elena kagan took her oath for the supreme court. the new term begins on monday. six months of dui arrests in the district are in jeopardy because of inaccurate machines. a lawyer said the chief toxicologist didn't approve those device until last month. all those charged with dui could see those charges dropped. pat collins has the story. all the people that pled guilty or were found guilty of dwi based these scores were wrgfully convicted every single one of them since march of this yea

>> reporter: this is an experienced defense lawyer, a specialist in dwi cases. he says hundreds of recent dwi arrests made by d.c. police are flawed because of procedural errors. >> what's shock they allowed forms that were clearly false to be signed, to be submitted as evidence when they knew that it wasn't true. >> reporter: last march d.c. police began using a device called an intoximeter to determine the blood alcohol level of drivers suspected of dwi. when the cases were taken to superior court thedwi numbers were accompanied b this paragraph, it says i certify that the samples analyzed above were taken according to guidelines set forth by the district of columbia toxicologist, the equipment approv was approved by the

chief toxicologist. that's the way these cases were brought to court. last march, april, may, june, july and august. the problem is the chief toxicolost didn't approve this equipment until september. peter nichols the attorney general for the strict says the dwi casesfor the last six months will be reviewed. some charges may be dropped. some may be reduced. he promised to be fair and accurate. d.c. police say their machines are accurate. it's the procedure that was the problem. >> there's absolutely no issues with the integrity through reliability or accuracy of the instruments. >> the problem is? >> protocol. >> reporter: some history. from march 2008 until march 2010 police had calibration problems

with the intoxily zempb r the equipment they used then f dwi arrests. since then 300 dwi convictions are in question. >> heads up if you plan to use the metro this week. expect delays and not just on one line. metro is doing track work and repairing platforms too. expect half hour dela on green and yellow lines and the red line between shady grove and twin brook. add about 20 minutes to your friendship you're traveling wean the new york avenue and rhode island stations. all these stations should be back to their normal schedules by monday morning. metro is opened an hour early to accommodate thousands at the national mall for the one nation rally. expect crowded trains between staid-armory and pentagon. ramy organizers paid metro for

u.s. officials have apologized for conducting medical experiments that exposed guatemala prisoners to sexually transmitted diseases. u.s. scientists secretly injected 700 people with the germs that cause syphllis a gonorrhea. the experiments were designed to study the effects of sexually transmitted diseases. arlington health officials said a person had measles and there's a risk you could be kpoe. the infected person was on terminal c back on thursday september 23rd from 8:45 in the morning until 12:30 in the afternoon. measles is highly contagious. early symptoms include a high fever,unny nose, watery eyes

and rash. call the arlington public health department at 703-228-2358. it's been almost five months since the murder of university of virginia lacrosse player yeardley love. her death is being used to educate students about domestic violence. they are kicking off domestic violence month by urging stunts to speak up. >> reporter: the death of yeardley love shook up university of virginia's campus back in may. even more shocking to uva students that her former boyfriend was charged with her murder. allegations also surfaced that there were previous incidents of domestic abuse that went unreported. many wonder if someone had spoken up about the red flags of use, love would still be alive

today? the red flag campaign which has spread to over 100 college campuses across the country hopes toring awareness to the problem and prevent t tragedy from happening again. >> what's this for? >> reporter: to kick off domestic violence awareness month students at howard university spoke out about the importance ever ending the abuse. >> we can change t lives of some of the students. >> reporter: these red flags have to serve as more than just a wake up call. it's one thing for studes to know domestic abuse exists it's another to speak up and save a friend. >> what we're understanding now is tt women in the age range of 16 to 34, women are being impacted by domestic violence. >> reporter: this senior says he knows friends who are part of that statistic. >> how far said anything to the authorities or anyone about it? >> no. i probably should have.

to me seems like an issue that person needs to solve themselves. >> reporter: they hope to get the message out that domeic abuse will only comeo an end if people have the courage to report it. flooding from our most recent round of rain is having lasting effects in some areas. one problem right now is in maryland st. mary's county. the smell of diesel fuel. people in a nearby mobile home parked escaped rising waters in the middle of the night. you can see extensive flooding from the morning after. the community is back with a major cleanup project because of the storm. >> water was up above that. it's been going down. probably two feet. >> you see any damage or just got to let it dry out? >> well, i hope it didn't dony

damage. >> st. mary's county cancelled classes yesterday because of the flooding. the high standing water made it impossib for buss to make their round. all activities at the school will go on as planned this weekend and school will be back in session on monday. i know there's a little rain in the forecast. >> a little bit of rain. but we've been focused on our sunny saturday. showers may be here before the weekend is through. i'll give you all the details coming up in just a few more minutes.

yep. time to dust off the scare crow and witch hats. october just started but a lot of people have the end of the nth on their minds. halloween can be big business this year especially after scary sales last year because of the economy. the national retail federation expects the erage person to spend about $66 on candy, costumes and decoration. that's 18% more than lt year. consumer experts predict the most popular costumes will include buzz light year, harry potter characters and lady gaga. >> that's painng with a broad brush. >> whatever you want to do. >> high heels, glitter and some sort of crazy wig and call yourself lady gaga. not you personally. >> i try to avoid the high els. >> you're going to be scare crow. >> i hear it's big around here. >> it is. it's a great holiday. a lot of fun. we have to wait and see if the weather will cooperate.

first a look at our forecast this morning, meteorologist chuck bell is keepg an eye on the calendar and the weather. >> that's right. i'm notwithstandinging this whole situation from here at the desk. a nice cool start outside. beautiful weath. feels like october again after a crazy september with a 99 degree day a week ago and 4 1/2 inches of rain on thursday. we're ready to say good-bye to september and hello to october. we can't take it any more we're leaving th joint going somewhere else. shame on tm. they left just in the anybody of time. beautiful weather today. temperatures in the 40s in the suburbs. nice crisp cool october start. 47 in fairfax this morning. 57 in annapolis. 55 down in st. mary's county where they are still wringing out from all the rain. 13 inches of rainn st. mary's county this week. unbelievable. our forecast for today everybody gets to enjoy that great october sunshine. highs up near 70 degrees. the seminoles of florida playing

the cavaliers at the university of virginia. kickoff is at noon. 66 degrees at kickoff time. northwest winds. take heart, i was at the oklahoma-florida state game. more college forecast. e-mail your team request who is playing, where they are playing. we'll get on as many forecasts as we can. new today d.c. police are investigating anvernight murder. officers tell us they found a man dead near the intersection of 54th and dick streets. this happened just after 12:30 this morning. detectives didn't say what may have led to the shooting or if they have anyone in custody. you can no longer hold your cell phone and tk while driving on the road in maryland. the state's cell phone ban started yesterday. drivers can still use a hand-held cell phone at a

stoplight, though. once your car starts moving you need to use a hands-free device or hangup. maryland cell phone ban is a secondary offense which means police can only write a ticket for that if you've been pulled over for some other offense. first time you're caught is a $40 fine. then $100 for repeat offenders. also maryland added tougher penalties foronvicted sex offenders including a mandatory 15 year sentence for the most serious offenders. certain crimes make gang members eligible for stronger penalties. maryland also has new fines for people who make false help claims. the state estimates this law can help recover $20 million in medicaid. police in fairfax county are looking for a burglar who has broken into a staggering 87 homes in the past two months. the crime spree has been all over the county. the suspect has taken anything key get his hands on.

jackie bensen has the story. >> reporter: almost all of the homesargeted by the prolific bular have one thing in common. they sit on fairly large suburban lots. matt decided to increase exterior lighting near his home after learning four houses in his fairfax neighborhood were hit last night including one on his street. >> at my wife's urging i changed the timer setting on the gate lights so we have the entire night covered. >> reporter: fairfax county police say increasing home security is a good idea. given the fact that the bularies seem to be crim of opportunity committed in the overnight hours. the suspect is most likely driving around. he sees open garage door or finds an unlocked sliding door and in seconds is in and out with a purse or wallet that was left in plain sight on the kitchen counter >> please lock your doors and windows of your home and that

includes your garage doors. have your doors and winws locked before you go to bed. >> reporter: a map created by investigators shows the tally of crimes committed by the same suspect is mind-boggling. >> we put a significant number of resoues into this investigation, and i would not want to divulge what those resources are. obviously to help us with our efforts to apprehend the suspect. but i want to assure residents we're definitely patrolling the area and we're out there. >> reporter: jackie bensen, "news4 today." a fire that killed one person in northwest d.c. earlier this week may have been intentnally set. the blaze broke out early wednesday morning on the busy 16th street corridor in p columbia heights. one man died after jumping from his sixth floor apartment. officials say they are talking to several people of interest. >> we began to eliminate every single accidental cause and that will lead us to one area. we're not quiteeady to make

that jump yet but speculation would say most likely it's going to be some type of set fire. >> investigators say a mattress on the fifth floor may have been the source of thefire. tens of thousands of americans who were close to losing their homes remember getting unexpected good news this morning. three of the biggest mortgage lenders in the country have stopped evicktions and sales involving foreclosures. they admitted that thousands of documents may have been improperly processed. peter alexander has more now from los angeles. looks like we're having some trouble that tape. right now we'll move on. six months worth of dui arrests in the district are in jeopardy because of inaccurate machines. d.c. police used a device known as the intometer. that device has been used since march. but a lawyer says the district's

>> i don't want to end up on street. >> reporter: one i seven borrowers are behind their are mortgage. bank of america joined jpmorgan chase and gmac in suspendeding foreclosure evicktions across 23 states. the move is raising questions whether banks were cutting coers. one employee acknowledged she approved 8,000 foreclosures a month. in a sworn deposition a gmac employee admitted signing off on 10,000 case as month. critics refer to that process is robosigning where it's impossible for any one person to review so many documents. this attorney said his client is among those who lost his home. >> i feel the time isow to stop this. >> reporter: all three lenders say they are reviewing their procedures. both gmac and chase say none.

two of the country's bigger airlines has finished their merger to create the world's largest airline. united and ctinental finished the paper work yesterday. they are trading under the ual symbol. travellers won't notice any difference. many areas around the washington region are still drying out from flooding. eck out what people in annapolis had to deal with. thursday's torrential rains left many major roads closed. authorities lift evacuation odds for homes that were sitting near the dam. high water created problems for drivers in northern virginia. parts of sbroinls road in vienna had a foot-and-a-half of standing water yesterday morning. at one point the height of the rain was impassable. once the water receded authorities opened the road so
