the trooper was injured. the woman driving the brn car injured. both medivacked to hospitals nearby. according to state police, everyone involved i the incident remained on the scene. investigators areinterviewing witnesses and examining the wreckage t try to determine how this all came about. i'm pat collins, news4, prince william county. to our second bi story this evening, the breaking news in laurel, maryland. investigators are on the scene of a deadly fire on brooklyn bridge road. you can see the ash ains on the hole. firefighters tell us one person was killed. the victim's name is not being released yet. the cause of the blaze is still under investigation. also breaking in prince william county, firefighters are trying to rescue a worker who fell into a trench in the lake ridge area of the county. it is happening on ridge view

court near old bridge road. fire officials tell us the man is trapped in waist deep mud inside the trench. medics are monitoring him while rescuers try shore up the trench so they can get him out of there safely. a teenager accused of trying to rob an armored car is in the hospital. police say he was shot by one of the guards. it happened outside the shoe city store on brentwood road in northeast washington. police say the suspect tried to make off with a bag of money from the store but was shot in the leg by one of the guards. he collapsed about 50 feet away and was taken to a hospital for treatment. the pus driver killed in last week's crash died of a heart attack, not from the crash. 66-year-old joseph claybaugh jr. passed out while he was driving. thbus rolled 45 feet down an embank. before it crashed on the 270

spur in bethesda. several passenger were ht but they're expected to be fie. ople around the area are cleaning up once again after our latest round of rain. the satuted ground and some strong wind gusts today met oblems for older oriseased trees. power lines were damaged when this tree in brookville, maryland, fell down. the wood chippers were busy in arlingtonvirginia. this was the scene on south frederick street where workers cleaned up because of a tree that fell onop of parked cars this morning. none was injured. the cars weren't badly damaged. there weren't any injuries when a giant tree came down in northwest d.c. this happened around noon in the 5400lock of nebraska avenue. the tree just missed a car. fell across the street, causing that street to be closed for a while. what's next? chief meet meat doug kammerer is here to tell us. >> things will be calming down just a little bit, saying goodbye to the rain. at least the heavy rain. we're starting to see things

there. bundle up. now to the ra travel alert issued by the state department. thousands of americans living or traveling in europe are advid to take additional security precautions. so far, most people seemto be taking the flert stride. news4's megan mcgrath spoke to travelers at dulles. >> reporter: the travel warning is rather general. it does not mention specific targets or even countries. but americans traveling to europe are being asked to use caution. especially when visiting spots known to attract foreign tourists. at dulle international airport, everything appears normal. travelers board planes. nothing unusual in the terminal. passengers flying out of dulles though are aware of the warning but are not concerned enough to change their itinerary. >> what are the change that will happen? minor. not going to let them rule me. >> i figure it will come upon me

kans -- encouraging peopl to cancel their plans. another student was attacked over the weekend but unlike the other robberies, this one happened oncampus. detectives say it was 4: in the morning on sunday when three men jumped a student who was just walking between two dorms. he w thrown to the ground in his wallet and cellhones stolen. the university police say from now on, 911 calls would go directly to them instead of the prince george's county police. they are warning students, avoid going out between the hours of two and 4:00 in the morning. rising red ink is forcing district laerds to ill pose an immediate hiring and spending freeze. the incoming mayor vinnt gray asked mayor fenty to start this week saying it could be the start of a serious budget cut. tom joins us with that. >> reporter: the freeze is just a band-aid. the city's different is it is nearly $200 million.

serious cuts in spending are expected in the cong weeks. the ongoing national economic slump has sharply cut into re new fro sales and income tax. from commercial real estate. a slow-down in property values and the city has spent much of its savings it is quite different from this year. >> reporter: jack evans joined the democratic minee for mayor vincent gray monday. gray said he had asked mayor fenty to impose the hiring and spending freeze right away. >> this will gve us an immediate effort. an immediate action to be able to start to get a handle on this. it will stop spending which could be runaway as we move into the fiscal year. >> reporter: gray who will be formally elected november 2 said it is just the first step in what could be a tough budget cutting session in the next few weeks and into thor in a future. >> we certainly in light of where we are this stage, we not only cut to the bone.

a virginia state trooper was injured on u-95 in the wood bridge area. he was tanning to an accident along the side of the road when another vehicle hit his car.

jimmy carters back on his feet after spending a couple days in the hospital with a viral infection. >> the former president and his wife weren d.c. today building and rehbing hmes for habitat for humanity. the carters have been building homes for more than 27 years. >> we ve i think a life changing experience. not only for the homeowners who for the first time in their lives, have a dent place they can own themselves.

a fast forward through headlines. police are investigating y another robbery. now the criminals are getting brazen enough to strike on campus. the latest poll happened early yestery morning. a student's wallet and cell phone were taken as the student walked between dorms. police are warning to avoid being out between the hours of 2:00 and 4:00 in the morning. a d.c. person was shot. the robbery happened outside the shoe city store on brtwood road northeast this afternoon. the suspect was taken to the hospital. former president jimmy carter and his wife joined hureds of volunteers for world

habitat day i the district this morning. the former president's first appearance after spending two days in the hospital with a viral infectio habitat for humanity is building six home and repairing six others. in the ivy city section of d.c. now let's fast forward to the weather. cloudy and cool. the good news, the clouds have moved out of t area so fairly dry conditions. look at all the cloudiness out there. low clouds continue to linger across the city. winds out of the northwest at 12 miles per hour. a little breezy and that make it feel even cooler. digital doppler over the last couple hours showing that rain still few showers up there along i-9 that's really about it. maybe a drop here or there. but again, don't expect much. look at the lows. 48 in the city. 40 out there toward frederick. down toward fredericksburg, temperature at 43 degrees. temperatures will warm up a little bit, at least into the lower 60s.

that's the coolest we've been since may. overhe weekend work the veteran jrnalists were busted in their georgetown house on marijuana charges. >> police arrested cbs hward d his wife after someone reported the couple was growing pot in their backyard. darcy spencer spoke with the neighbors who say they were surprised to hear what was going on. >> reporter: police stay bust came after a tip from a neighbor. they found pot plants several feet hey. >> it is a quiet neighborhood in georgetown. police stay two prominent journalists living in this rowhouse with the blue door we growing marijuana in their backyard. cbs radio news washington bureau manager howard and his wife were charged with possession with intent to distribute marijuana. police say they have recovered floorly a dozen plants from the backyard saturday night.

reonsible drug policy. he said there are disparities for marijuana laws across the country and it should be taxed. >> we've tried it their way for 40 years and it hasn't worked. in this situation, yet another example of a ruined life. it didn't have to be a ruined life. it is against the law but it is a law that doesn't make sense. >> reporter: the journalists were released on their own recognizance after a brief court aparance saturday evening. they're schedule to be back in court for a preliminary hearing. cbs news declined to comment on the case or his stat with us the company. a washington, d.c. community finds itself on an unsavo list. l street southeast near national stadium in the navy yards is ninth on the list of the most dangerous neighborhoods in the country. the ranking were done by the west site neighborhood scout dpokt predicts 240 crimes happen in that neighborhood every year and your chances ofba becoming

victim, one in nine. they say this area has experience ad lot of redevelopment recently and the survey likely used some outdated statistics. meanwhile the most dangerous neighbor in the country, according to the site, is in chicago. the u.s. supreme court opened a new term today with justice elena kagan taking her place on the bench for the first time since her confirmation in august. pete williams is outside the court with more on that. and a look at some of the key cases on the docket. so the justices began the new term by throwing out hundreds of cases today. one was an appeal from 9/11 victims. what was the issue? >> reporter: they were upset about the way the city has gathered material from ground zero. from what was left ter the 9/11 attacks. and taken them offsite to sort through, to find any mementos of those who died and other human

remains. they say the city has still not handled that material properly. they've been in litigation the city foruite a while and they did not like what that in th lower courts. they came to the supreme court. as you say, the supreme court declined to take up that case. >> confirmed back in agust again, is one of the new faces on the court shelf recused herself from several cases today. why? wh if there is a tie? how is she expect to influence the court? >> reporter: well, she is probably going to take herself off about a third of the cases that the supreme court hears this term. they'll probably hear between 75 and 80 cases shelf has already said she won't take part in 24. there are more yet to come so it will probably work out to about athird. the reason is she said she doesn't want to have anything to do with any cases that she handled when she was a solicitor general in the justice department for 14 months. if there is a tie, and of course with her off, that leaves eight justices and the possibility of a 4-4 tie. then basically, it is as though nothing ever happened. the lower court ruling remain

intact and there is no real valley to you what the court did. so the tie means nothing. that means could it come back in a year or so and then she could take part. all the recusal covers is e actual case. "a" suing got b. if the issue is immigration, same second marriage, it is not the issue. its the actual case. in a year or so this will all sort out. >> coming up on wednesday, we have a free speech case that has to do with a protest at a maryland funeral. they're going to be deciding on that or hearing that case on wednesday. >> yeah. this is one of the most prominent cases of the term. a group of people in to peek a, kansas, that protest at the funerals of service members. they claim that the dead in iraq and afghanistan had a dmi combat are god's wrath for the nation's acceptance of gay rights. they came to the funeral of lance corporal snide here died in iraq with signs that said god

hates soldiers, thank god for dead soldiers. the father was so outraged that he sued and won the verdict. but the court of virginia overturned it and said no, that protest as repugnant as it was, is protected speech under the first amendment. the supreme court will have to decide if that right. >> nbc' pete williams at the u.s. supreme court. thank you. bed bugs have been spotted in one of d.c.'s most secured federal buildings. they said bugs have invade one of its offices inhe ronald reagan building downtown. exterminators were dmaul to treat the office over the weekend. there were no signs of bed bugs reported anywhere else in the building. a number of other high profile places have fallen prey to bed bug infestations recently. they can be difficult to get rid of but they are not known to

carry diseases. we are only four week away from election day in maryland. both candidates for governor are out gatheri votes, current governor martin o'malley kicked off a campaign tour. with a focus on getting the youth vote. the republican callenger and former governor bob ehrlich was making his pitch to the small business owners who have en struggling. >>oter turnout in prince george's could be critical. voter turnout in montgomery and voter turnout throughout our state. >> the election will go down one way or the other. i think we'll win the race. >> reporter: expert say african-american 54th turnout could be the deciding factor in this race. o'malley will continue his tour of 25 other counties and ehrlich's campaign plans to visit its strongholdsn the eastern shore as well as visits to prince george's and montgomery counties. theinstallment to prevent
