a man allegedly armed with a machete barricaded himself in a silver spring house following what police called a domestic dispute. it happened around 9:30 this morning on haywood drive. after a 30-minute stand-off, police been in and arrested vun-year-old jose castillo. police say he threatened his 23-year-old daughter-in-law and her 6-month-old child with the knife. no one was hurt. it is a supreme court case that pits the right to grieve privately against the right to say what you want no matter how offensive. tonight the father of a fallen marine is askinghe highest court in the than to reinstate a $5 million verdict against members of aundamentalist church. nbc ns justice correspondent pete williams is live outside the supreme court. pete, the argument justices have to look at is when doesree speech give way to a person's ght to privacy? what did we hear on the matter

today? >> reporter: i think anyone who thought is case would produce a ringing endorsement of the first amendment would have been surprised by the argument. there were clearly justice who's were very bothered by the behavior at this funeral. justice ruth bader ginsberg whom you would normally think standing up on the side of the first amendment said this was exploiting a family's grief. that was the kind of comment. so you had at least three or four justices who were clearly trying to find some way to allow this lawsuit to revive. and no one on the other side saying, no no, matter what. the lawsuits like the suld never be permitted. so it would father justices are at least willing to give it a try. to try come up with some kindf rule. the hard part is how do you do that? one answer might be to say this was a private funeral. in the past, the court has allowed outrageous, offensive, hurtful statements against public figures. in fact the member of the

westboro baptist church from kansas tried to say that the father of the marine had become a public figure by talking about his family's sacrifice. that didn't go over very well with the supreme court. that may be the answer. they'll say when you have a hurtful speech targeted against a private individual, then you can have these kinds of lawsuits and the first amendme is no shield. >> the marine's family says the group wrote a hateful poem about his family on their website. that be us in this case? >> reporter: well, it was one of the reasons why the jury in maryland awarded the verdict. because of this quite offensive statement on the internet. that was part of the case. my guess is the clort say we'll set that aside. that has nothing to do with the funeral. the father of the marine said that was part yf this was so traumatic. he said it was so traumatic.

now what is strange is that location is the garage entrance to the embassy of spain and it is literally crowded with security cameras. more than a half dozen of them. it is t clear whether the security cameras captured any images of this attack. because of the location's proximity to george washington university, there is a concern. is the victim a gw student? the university has not issued any type of alert to students which would it normally do student was a victim. the suspect is described as being about 5'8" or 5'9", weigng between 135 and 145 pounds with short dark hair. they say he was dressed in a black jacket and blue jeans and may have spoken to the victim in spanish. again, the victim told police, she did not know her attacker. back to you. >> all right. jackie bensen. thank you. there was heavy police presence at a funeral. jamal coates was murder last
