welcome to news 4 midday. i'm barbara harrison. it's friday, october 15, 2010. we begin with breaking news. a man beaten to death this morning. now five employees at a u street corridor bar are charged with his death. it happened at the intersection of 9th and u street early tis morning. tracee wilkins is live with at they've learned. good morning. >> reporr: good morning. we've been here since early this morning watching this unfold throughout the morning and now new details about what happened here last night. it all started here at the d.c. nine club that broken window there to the right is a major part of what happened here this evening. this is what we know, according to police and sources. and also an employee who works here. an employee told us early in the evening a drunk patron smashed a window who was inside the bar. while they were trying to clean that mess up after hours another man kept coming back and forth to the bar looking to get inside and get a drink. they say that the last time he came back, he had two bricks in

his hand and threw them through the window here knocking out what little bit of the window was left. after that happened the employees tell me that five employees inside of the bar chased that man down the block and an employee says they held the vandal down while calling police for help. well, something happened. something went wrong because that man later died from blunt trauma at the hospital according to police. hear now from the employees. >> you kn, one was just kind of pressing him down, the other guy was restraining his hand. i did not see a single person punch or kick anybody. the gentleman was awake. he was alive. he was being subdued but in n i no violent way. if you talk to the other people they have in custody you would know at a drop of the hat none of them have that in them. and, you kno this is all just -- it's beyond ridiculous.

>> reporter: that employee also was a witness to everything that haened lt night. now, while police have yet to confirm this information, council member jim graham who is the council member for this area says tt some of those men who were in custody, the employees here at dc9 are facing homicide charges. i'm tracee wilkins live in northwest. back to you. thank you. one man is dead this morning after being struck by a car in northern virginia. police say he was crossing dumfries road in dumfries as he was walking towards a busy commuter lot. megan mcgrath joins us from dumfries this morning with details of that. good morning. >> reporter: good morning, barbara. just a short time ago police opened all of the lanes on dumfries road, the southbound lanes had been closed for hours since this accident hpened very early this morning. it was right around 6:30 in the morning. still dark. there were a lot of commuters that were here coming to this commuter lot. one of those commuters actually

cross ee eed dumfries road to g something to eat and come back. the dumfries road commuter lot is a busy spot many people park across the road to the mcdonald's and return to the lot to either get in the slug line or catch the bus. police say a 38-year-old man was doing just that. but as he crossed back over dumfries road he was struck and killed inner loop the pedestrian was crossing from mcdonald's to the commuter lot here on dumfries road. a vehicle, a dodge ram struck the pedestrian as he was crossing the road. the victim is a 38-year-old male. he was pronounced at the scene. >> reporter: john reed was headed to work and saw it happen. >> he was crossing agast the commuter light. heard a screech. he hit the pedestrian on the side. like real quick. i don't think the vehicle saw

him. >> reporter: commuters say mcdonald's is a popular spot but no crosswalk or stoplight to help pedestrians ma it across dumfries road safely. folks who use the slug line say thateeds to change. >> there needs to be a crosswalk or a light of some sort because this has always been dangerous. i've tried to cross it before and you can never time it right in any direction. it's really ary. so sad. >> reporter: the driver of that pickupruck did remain on the scene. he's noteen charged. police are also looking for the driver of a white box truck that was in the area. they think perhaps that driver may have also struck e pederian but may not have been aware of it. they would like to talk to that driver. again, someone who was in the area at e time of 6:30 in a white box truck right in fro of mcdonald's on dumfries road. we know he's 38-year-old. he lives in prince william county.

barbara, back to you. two be traffic alerts this morning. d.c. has cancelled schuled cotruction work on the chain brge. that means the chain bridge that connects d.c. and arlington will remain open this weekend. different story however out in tysons corner route 123 chain bridge road will be shut down beginning tonight at the beltway. that's so crews can take down the old beway bridges that cross over chain bridge road. traffic will be rerouted to route 7. expect delays out of that area. road is expected to reop by monday morning's rush hour. metro riders will be dealing with a lot of delays once again this weekend. track work i being performed on four of the five lines. on the orange line trains will be single tracking between vienna and west falls church station. yellow line trains will single track between l'enfant plaza and on the green line between nape

and ana costia and on red shady grove and twin brook. members of metro board finance committee areleaning tords keeping the price at $5 a piece. the group originally suggested reducing the price of the card to 2.50 a piece but that was based onthe assumption that metro only pays 2.50 for each card which isn't the case. the company actually apparently pays $3.40 per card. also metro is worried about users buying the card not putting anything on the card and essentially cheating the system because riders can currently exit while having a negative balance. metro officials estimate they could lose $1 million a month under that scenario. let's take a look outside right now. what a beautiful friday we have right now. 64 degrees. feels like fa out there. tom has the forecast for today and the weekend.

hey, tom. notice the foliage along the banks of the potomac river. still mostly green there. but we're beginning to see some colors certainly to our west and north. some individual tees are showing some beautiful color arnd the region. we're still a ways from peak color. it's near 60 in washington and nearby suburbs and prince george's, arlington, fairfax and montgomery counties. right now around southern maryland, chesapeake bay, virginia, tide water in the low 60s. further nort and west temperatures reached the upper 50s to0 degrees. these are the latest wind gusts. we've had gusts to near 30 miles per hour on the eastern shore. generally had gusts around 20 miles per hour around the metro area but it will increase as we get into the afternoon. championship morning in the mountains of west virginia where there's go color. their temperatures are in the mid-40s. wind coming from a developing deepening area of low pressure near the gulf of maine that is affecting the weather al the way down this far away with some

blou blustery winds. rain is heading into the southern shenandoah valley. and for the rest of the afternoon partly sunny small chance of an isolated shower. blustery wind is the big story. we'll have highs reaching the mid-60s. likes it will stay blustery into the weekend. new today upset parents finally got the chance to speak their minds about a controversial test given to some middle school students in the district. last week students at hardy middle school in northwest d.c. took a health survey that contained some questions about sexual knowledge. the school says it sent an opt-out letter home with the stents but that letter went out the same day the test was given. concerned parents were invited to attend a meeting on the issue you thismorning at the school. there's no word on what action, if any, is going to be taken. the be fbi is getting

involved after letters containing white powderhowed up at two d.c. public schools. the first letter arrived at bancroft elementary school on wednesday a second letter at adams school on thursday. both schools are in northwest washington. police say preliminary tests of both letters showed the powder was not harmful. shortly after police arrived, police sent a robocall to for parents let them know about the situation. parents believe the school handled the situation properly. >> sounds like the police and fire and fbi and hazmat people were here at the drop of a hat and werell over trying assess what the problem was and then figure out what to do about releasing people to move around freely again. >> fbi is involved in a similar situation in texas. suspicious letters full of white powder was sent to 17 schools in houston. our time right now 10 minutes after 11:00. coming up what the president is saying about don't-ask,

maryland. the two gubernatorial candidates faced off in their second debate yesterday hosted b "the washington post." currents governor martin o'malley and former governor bob ehrlich tailored issues to montgomery and prince george's county. the two had differences on one route of transportation for those commuting into the washington region. >> pell will use rapidbus. it will be popular. not everybod as you know in this community is for flight rail alternative. we have a philosophical difference. >> this is theict of a lot of engineering studies. all of the local preferences from prince george's county, from montgomery county, county executive mike liggett was for the purple le to be light rail. >> this was the last televised debate between o'malley and ehrlich. the two will meet for a radio debate next friday. new today 48 million retirees and disabled americans will go a second straight year without a cost of living increase in their social security benefits. the announcement came in correlation with the release of

inflation numbers for september. analysts say consumer prices are still lowerhan they were two years ago. this is the second year benefits wen't automatically adjusted since the process started in 19. this morning president obama is promising that don't-ask, don't-tell will end while he's in office. speaking before a group of young people the president said you should not have to lie about who you are in order to serve in the military. the repeal of the law, however, will n happen overnight. the justice department filed a appeal of the california judge's ruling to stop the ban immediately. instead president obama wants congss to overturn the law. gay activists hope that something that will happen soon. we need finality. whether it's through the courts or president obama's leadership with the senate that we'll get finality this year and don't-ask, don't-tell will go away. >> since don't-ask, don't-tell became law legal experts say some 14,000 gay service members

of weeks away. right now 62 at national airport. october so fa finally getting a surplus of rain thanks to yesterday's inch and a quarter that fell at national airport. now we're about 0.6 of an inch. we have reports of good color in the mountains of west virginia and western maryland. not quite peak there but likely over the next four or five days. this is a good weekend to see some nice autumn color in western maryland, westvirginia. peak color in northern pennsylvania. upstate new york and northern new england far northern new england is now past peakand many of the leaves have come down off the trees there thanks to that big storm that's whipping that region now with strong winds. we're feeling a little bit of theffects here. we got a northwesterly flow. prince george's county and mog and arlington and fairfax upper 50s to near 60. gusts to around 25 miles per hour. at ronald reagan washington national airport on the eastern

shore we've had gusts of up to nearly 30 miles per hour in a few locations. for theost part gusts have been around 25 to around 30 miles per hour. it's going to stay that way. temperatures out in the mountains are chilly. just in the 40s right now. and over the last several hours we had this big storm system continuing to deepen ov new england. continuing to develop and as a result it's going to just really get to be quite a powerful storm and we're close enough to get wind whip. upper level diurbance is triggering showers in west virginia. also a band of showers developing northern pennsylvania. that may hold together and make its way down here. just a small chance of that. one of the great spectacles we n see in our size is the aurora borealis. northern lights seminar will talk all about the you a error ra on this coming monday in the evening at the smithsonian national museum of theamerican indian, 6:45 to 9:00.

lastnight's 30 rock is getting raef reviews today. the cast of the hit nbc show performed not one but two live episode last night. the first aired on the east coast, then the west coassaw the second. producers say the week leading up to it was hectic with several rehearsals but it paid off last night with no major hiccups. one of the greatest quarterbacks of all time travels through fedex field as the skins ce off against the colts on sunday night football. the skins are coming off a thrilling overtime win over the green bay packers where they gave up more than 400 yards of total offense yet still won the game. the colts prolific offense promises to be a much tougher challenge for washington's defense. the skins defense certainly know they are facing one of the

police are investigating a deadly pedestrian accident in prince william county. officers say a man was struck by a car and killed as he tried to

cross dumfries road in dumfries near a popular commuter lot. the driver of the vehicle that struck the man did remain on the scene. also right now we're following breaking news out of northwest washington. a man was beaten to death this morning. five employees at a u street corner bar are charged with his death. it happened at the intersection of 9th and u streets in northwest d.c. tracee wilkins has been on the scene l morning and joins us live with the latest for us now. >> reporter: good morning. as you said, we have been here all morning long and watched what's happened here change over and over again. the bottom line is now five of those employees who work here for dc9 are facing charges and are being held in connection to what happened to this man last night. it centered around the windows here actually at the dc9 bar and club. we're told by an employee that early in the evening a drunk patron sparked the wdow out

and while they were trying to make repairs a second man comes back and forth to the bar. he said he believed he also was inxicated. he said that the last time the man showed up at the bar he came with two bricks in his hands and threw them through the window, breaking what was left of it. now he says that five of the employees inside chased this man down the block and he said that they were holding the vandal down while calling police and waiting for help but something went wng and this man later died at the hospital from blunt trauma. now those five employees who were down there holding that man down are now in custody at the d.c. police department and are being questioned and held in connection to what happened here. the investigation is continuing. but you have tw sides of this story. police are trying to figure out how this man ended up with blunt trauma, a wound that killed him and the people here that bar who were thinkinwhen this man left thecene he was living, he breathing, he got put into a police car, they thought he was taken away in custody and then

iturnsut later at the hospital he died. the investigation is continuing. we're expecting a press conference to start shortly from chief lanier. tracee wilkins live in northwest. back to you. home bound, some of the chilean miners he left the hospital for home. doctors say all 33 have no major health problems. more can be released from the hospital today. now gins the task of adjusting to life outside the mine. this was elaine reyes joining us now live to tell us more what's going on with those miners. >> their moments have been followed by the world for two months now and now above ground the spotlight on the miners is becoming laser hot. all 33 mine gathered for a group photo inside hospital where doctors evaluated them. outside, though, cwds and cameras from all over the world waited to capture a glimpse including some teenage girls waiting to see a new teen idol.

19-year-old jimmy sanchez the youngest miner quickly becoming a teen star in chile. there's been talk of book and movie als. the group says theywill do something but only all together. and, they are asking to be paid for their story, a figure inthe millions. as far as their imdiate futures, they just want some time with their loved ones. >> i think they are more anxious to get out of the hospital than they were from the mine. >> amazingly doctors say no one in the group is suffering from shock, despite being stuck underground for two months. the chilean government will monitor the miners for the next few months for emotional and psychological scars. barbara, back to you. and let's talk a little bit about the weather now as we're going into a weekend that looks like it will a pretty nice one. >> many have plans for outdoor activities. looks like the weather will cooperate. as i mentioned before a lot of big high school football games tonight and the wind may play a

victs. do you think they are strong enough? what are the laws that problem text them? >> there's a range of them. i mean, you know, the regular assault in some instances murder unfortunately, or lawshat we use in domestic violence cases. there's stalking in some of the protectiverder laws that have been strengthened. my sense is that really prosecutors, police officers and judges really have to do more to make sure we don't get sort of des desen decen decen desensiti ziced. in addition to that i think you know an expanded network of support services and better funding for the services we have now would be critical.

>> speaking of funding, you presented a check of $5,000 to the prince george's hospital sexual abuse center. how are you hoping that will be useled? >> it will be used for educational purposes and verizon provided the money initially. we just put the two of them together to make sure they got there. but isolation is a huge issue. verizon has done an outstanding job over the years of providing used cell phones to people who need them so they are not isolated and can call for assistance if needed. >> what about the crime victims fund r? i thought it would be fun but it's a fund run. >> we do that every year too. that's for -- it does hel domestic violence survivors but proudly speaking it helps victims across the board. maybe they need services. people come out obviously to support the funding for it but also to support victims of crime

. the whe house joins the fight against breast cancer, october is breast cancer awareness month. for one night onlythe white house turned pinking last night and drew some big crowds to see it. president obama made the announcement earlier in the day via twitter. october is breast cancer awareness month and today we sit down with a fertility expert to talk about options for women who are fighting breast cancer who still want to become moms. some may have already had children. some are first time hopeful moms. you say the options have definitely increased in the last

18 to 24 months? >> options have definitely increased. i just want to say i'm so passionate about this topic because i've helped so many women who have heard that drastic cancer diagnosis build options for treatment intoheir plans before and after cancer treaent. and some of these options include egg banking, freezing their own eggs so they can use after cancer treatment. maybe freezing embryos before they start treatment so they can use those for transfer after trtment. surrogacy, egg donation. with so many options it's so important to be educated upfront before you start cancer treatment. >> when a woman gets this diagnosis of breast cancer, although it may be in the back of her mind, is there anybody there? are doctors generally there to say to them but, since you're the age to have childr or you haven't had children yet, here are some of your options. is this something women generally have to think about themselves? >> that's an excellent question.

a recent study showed less than 25% of doctors talk about option. the onus is on the cancer patient to empower herself with education, information and questions, specific questions to ask her doctor so that she can increase her opportunities for possibilities before and after treatment. >> well, i'm just wondering how much time does a person have? i'm sure that when a woman gets a breast cancer diagnosis the very first thing she wants to do is to get rid of that cancer. so how much time does she have then to organize treatment to be able to remove eggs oro remove a fertilized egg to be saved as you were talking about by freezing? >> right. and that really depends on her individual situation. but the most critical question that a cancer victim can ask their doctor at that time is how much time can i delay treatment

this morning happening at the intersection of 9th and u streetnorthwest. a press conference is about to gin. >> around 2:30 and was denied entry. as it was closing time for the club. he was denied entry he returned to the club and threw a rock or brick or something through the club window. at that time management employees, employees and associates of the club chased mr. mohammad, chased him down the block, tackled him and assaulted him severely. as a result of that assault mr. mohammad was later pronounced dead at howard university hospital. at this time, there are five suspects that are in custody and are now charged with murder two. those five suspects are 20-year-old darrell carter, 22-year-old reginald phillips, 28-year-old he van prowler, 46-year-old william byler and 5-year-old arthur dalcoa.
