crews are rushing this morning to repair a large water main that burst overnight near the national mall. this break happened just after 10:00 near the intersection of 9th street and constitution avenue. constitution has since been shut down between 9th and 12th streets. derrick ward is on the scene about how repairs will not only affect traffic. i understand tourists may have to take a pass at the smithsonian? >> indeed, some of them are. they will for a little while. i want you to take a look at t scene. right between main justice and the musm of natural history. and, of course, this is some information you'll need to know because this happened last night and it's regarding a 24 inch water main. no constitution avenue remains closed between 9th and 12th in the street have a lane closure at10th street between penn and constituti. as we said, the smithsonian

institution and justice department areaffected me. joining me is the general manager of d.c. water. you're telling me -- what kind of work is going on out there now. >> w had a 24 inch water main break right here at 10th and constitution. big water line. we had to get the water off first which is for the most part so we can dig down. before we dig in the street we want to make sure where every utity lines is. we don't want top get that wrong because you don't want to dig down and make a mistake. at the moment we're digging test holes see where in fact the break will be so we can build. we'll go down, find the hole in the pipe and fix it. >> you expect that this work will continue through the better part of today and possibly into tomorrow. >> yes. we'll be out here today. the easier part of the project is fixing thepipe. we won't know for sure unl we get in the street. there's been so much water with

a water main of this size undermines the street itself. we'll have to do a lot of reconstruction of the roadway. the reason why it's blocked off, the water may have undermine the road. it's unlikely but we don't want the risk of something cave in. we're taking the safe step to make sure we have no additional damage >> you're expecting to be done by monday. >> we're determined to have this done and finished by the time rush hour hits monday morning. i hope before that. it's hard to estimate it until we get the street up and see what happened. every break is different. different place in the pipe it is a turn or a t. we'll know wh we get down there. once we get in we'll get it fixed and get the street back opened. you guys will be busy this weekend. as we said the museum of natural history and hanes justice are affected. they have no water pressure. they are closed at least until the duration of this water pressure they have.

>> reporter: by emergency order of police chief cathy lanier the dc9 club was closed down. the 96 hour closur comes after a man who threw a brick into a winw was chased and beaten by bar workers. early friday. that man, ali mohammadater died. >> it's a small place. everybody is a regular. just really kind of unfortunate that this had to happen. >> reporter: lanier said five dc9 workers including a part ner is charged in the savage beating. she called it a virginia savage beating. >> there are severe injuries not consistent with being tackled. >> was he beaten? >> yes. >> was he kicked? >> yes. >> to death? >> yes. >> reporr: now there are questions about whether the men will face murder charges when they appear in court on turday. sources tell news 4 the medical examiner could not confirm that mohammad died as a result of the beating. >> he didn't deserve to die.

they say the case is penng. we don't know what is going on. no one is telling us the answer. >> reporter: mohammad's relatives tell news 4 they are too searching for answers. >> just go the medical examiner's office. they told me that it's still an ongoing investigation. so i want to know what was cause of ali, 27 years old. young boy. he's killed. >> reporter: all five of those suspects remain in custody. they are due in court some time today for a first aparance. a friend of one of those suspects tells me he's a student at howard university studying physics. in northwest, darcy spencer, "news4 today." people who use a busy commuter lot in northern virginia are calling for more safety after a pedestrian was hit and killed. prince william county police say a man was trying to cross the

dumfries roa commuter lot when a pickup truck him. even died at the scene. he worked for a contractor that was actually doing safety improvements in the area. some say the location can be dangerous for walkers and those behind the wheel. >> several accidents. several accidents. accidents with car i haven't seen any pedestrian accidents but several cars. even my own son was involved in an accident trying to cross over. >> police say they are looking for a white box truck that was also involved in this accident. that driver may not have known they hit theman. that incident in incident dumfries is one of several incidents where destrians were hit this week. montgomery police captain paul starks joined us earlier this morning to discuss pedestrian safety. he said distracons by drivers and people walking often contribute to accidents. >> some folks, two most common errors are where pedestrians

will cross in the middle of the block or cross when the indicator is telling them not walk. but what goes deeper than that, some folks are on the cell phones or even talkinwith a friend who is walking with them. once they hit the street, they are in a danger zone. they got to be engaged in crossing the lanes that theare crossing and be aware of what ey are doing. >> captain starks said drivers know to take out their ipods and put down their cell phones but pedestrians need tfollow the same safety rules. two mog police officers have been placed on administrative leave after a man died whil in custody. police were called to an apartment building in white oak, maryland on report of a man acting suspiciously. when they found they found a 65-year-old man standing in the stairwell. when they tried to get him to leave he put up a fight. they. er sayed him and tased him. family members said he was diagnosed with schizophr. hmpsc

gay troops might want to keep their private lives a little bit commonwealth a little bit longer. ere's a legal uncertain environment in the military right no the obama administration is trying to appeal a california judge's troulg overturn the n't-ask, don't-tell polic since gays were banned from serving openly in 1993 legal experts say some 14,000 service members have been kicked out of the military. this morning a warning for parents about a product that's becoming more popular with teens. it's called k2. one child in leesburg, virginia

has overdosed on the mix of herbs. the product is called spice. it's labeled asncense but contains a synthetic form of marijuana and teenagers found they can get a high by smoking it. authorities say the national poison krol center reported 1500 overdoses in the fir nine months of this year. in california is ready to vote on a measure that would legalize marijuana. attorney general eric holder said it doesn't matter. even if prop 19 legalized possession of an ounce of pot for people over the age of 21 federal law enforcement officials will still arrest people who are found with marijuana. holler's declation contradict'sreside obama's decisiono no longer prosecute patients or disspend sears in states where marijuana has been legalized. you kno there are all sorts of bizarre laws on the books all over the country and on there might be one in virginia. a potential new law in alexandria would make it illegal

for taxi drivers to be rude to customers. john trippen politely tells us about how cabbies might have to mind their ps and qs. >> who want as rude cab driver? >> reporter: that's what the city of alexandria is thinking and on saturday it will propose a new ordinance that will make it illegal for a cab driver to be rude to a customer. >> cab drivers sometimes don't gi the necessaryime to help people, especially those who are not from the d.c. ar. >> reporter: if this prosal passes it would be illegal for cab drivers to be rude to city officials or anyone on the street. >> i would be supportive of that. i think it's a good thing. because some rude drivers that abuse customers i'm losing my business. i don't want to lose my business. reporter: some think this is going too far. >> rude is something that's difficult to define. i don't ow that it's something we should seriousllook at or spend any time or money on. >> reporter: taxi drivers are taking this seriously beuse under the proposal any driver

the one that's taking place in norman later on. >> here we go. is it windy in norman? thanks. traveling near the national mall this morning could cause a few headaches and tourists may find one famous museum caused. this is back of a water main break by constitution and 9th avenue. derrick ward is on the mall this morning for us with more on how these repai are going now and being the impact it could have through the weekend. >> reporter: you know this break happened at about 10:00 p.m. last night. and what you have is a 24 inch main that went at about 10:00 p.m. and caused the closing of constitution avenue between 9th and 12th street and you have lane closure on 10th street between penn and constitution. it's affeing the water pressure in the department of justice. if you have compromised water

pressure and you have a compromised sprinkler system. we talked to a researcher, he was headed down here and was told he could not get into the museum of natural history. you know, i h him with the question about the crumbling infrastructure. he's a man of science but his answer was substantial. >> don' see the crumbling infrastructure. i've driven all over this country and i've seen entire rural towns disappearing and this place looks pret nice. it's going to be back. at least it's not february and i'm not freezing. >> and work is expected to continue here through the better part of today possibly into tomorrow as well. but they say they definitely are working towards a target of having this work cometed before the monday morning rush. whathey got to do, that road bed and surface has been compromised so there will be some resurfacing and digging going on. they will be working through the

a pickup truck hit him. the 38-year-old died at the scene. he worked for a contract josh that was doing safety improvements in the area. police say they are looking for a white box truck also involved in that accident. that driver may not have known he hit someone. early voting begins in one stat with a hot race in decion 2010. people in nevada can head to the polls this morning. two days ago senate majority leader har reid and sharon angle faced off in their one and only debate. analysts expect half of nevada's baots to come from early voting. and president obamis hitting the road this weekend to campaign for fellow democrats. he'll leave this for a rally in boston for massachusetts governor paick. yesterday in delaware the president campaigned for senate nominee chris coons who has a large polling lead over republican christine o'donnell. the first lady willoin the president tomorrow as they speak at fends in cleveland and at a

together to make sure that black colleges and universities could stay open. the mission is pretty much the same today except it's expanded beyond that. >> you've got hundreds of colleges and universities that you work with? >> absolutely. we have 39 member colleges and universities which are all historically black college and universities. we help them with operating support, providing them with resources for building the capacity of their schools, their library, their infrastructure, their strategic management. but we also serve students and we have students who a attending more than 900 colleges and universities based on over 45scholarships that we have. >> it's not just black students as the name years ago may have led people to believe. >> absolutely. we have wonderful program called the gates millennium scholar program which kicks off

a minority serving field for us where we're not only serving african-american students but hispanic students, native indian students, pacific students. that has turned over to some of our other scholarships. >> in last few yearsthe need to generate money toerve those students and the universities has increased as people aren't able to give in the same way as maybe they did in years past which is why you're having this walk on october 30th. >> absolutely. so many students have suffered with the recession. parents have been laid off from jobs. they lost their homes. and students who traditionally did not come to us now need to support that uncf. >> what's the plan for saturday october 30th? you want folks to sign up in advance? >> we want them to sign up in advance. theyan come to our website and go to the washington, d.c. walk. and we want them to bring their families, their friends, their
