charges have been reduced against five bar employees initially arrested for murder. now there are two very different stories about just what kild ali mohammed. those five men accused in the beating death of mohammed were original charged with murder. now the charges have been changed to aggravated assault. that's because so far the coroner's office has not found evidence to back up the murder charges. the men were arraigned today and derrick ward was there.

mohammed and throw him to the ground and he saw the others kick and stomp the victim. the same witness said that william speeler stopped once police approached and then attempted to flag down an officer. another witness was less clear on the role played by the defendantsn the incident. >> anyone who knows phil speeler would quickly understand that he's incapable of hurting anyone. >> they were there at that time and there was also a witness. so that's what we depend on. we just want justice. >> reporter: this club remains closed until further notice. and the five defendants whose case actually began with a broken window, they'll be due back in court on november th. in the district, derrick ward, news 4. the coroner's office says autopsy results are still pending but the victim ace external injuries did not appear severe enough for a conclusion on the cause of death. an arundel county officials go to pick up an elderly woman's dead body only to discover she's

actually alive. back on october 1 rz, police were called to ruth johnson's home. neighbors had not seen her in four days and officers found her motionless on the bathroom floor. she wasn'treathing. three hours later, though, when they went to take her body away, someone noticed her moving her arm. she was rushed to a hospital and released two day ago. d.c. wate crews are working on that large water main break near the national maltha happened just after 10:00 last night near the intersection of ninth street and constitution avenue. constitution has been closed ever since between ninth and 12th streets. the pipe has been in the system since the 1920s. d.c. water says it will work through the weekend to get that main fixed by rush hour monday. be kind to others. it's a good rule to live by, right? but is it a rule that can actually be enforced?

proposal to hold cabbies accountable for being polite is up for debate in front of the city council right now. there are strong opinions on both sides of this. darcy spencer is livthere this evening. >> reporter: t public hearing has been going on for the last four hours now. they've already heard from 40 different people on this issue. you know, there'san old saying that you can't legislate good behavior. that's exactly what they're trying to do here in alexandria. the city of alexandria already has rules on the books requiring cab drivers to be courteous to their passengers. but now some city officials want to take it a step further and force cabbies to be nice to everyone wle they're on duty. >> what if they propose is simply to extend the requirement for courteous conduct beyond just the passenger but also the general public and members of city staff. >> reporter: violation of the rules could have sences suspended or lose their authority to krif a cab in the

city. and there's a cost for not being courteous. a fine of $25 to$100. >> if they cannot conduct themselves in that manner, they shouldn't be licensed. they shouldn't be authorized to serve the public in the manner that they are. >> many cabbies are not happy with the proposed rules. some say it's unfair to regulate their behavior and not address how ey're treated by the public. randy stevens says his encount we are a woman over a parking space fought the rule change. >> i wasn't rude itially. but it wasn't until she became rude that i became rude. so in term of them trying to brd brush paint the issues, they don't want to look at what the public does to us as cab drivers. >> reporter: the mayor also has some concerns about the proposed regulations. he wants to make sure cabbies aren't being picked on unfairly. >> i just don't want to see someone go down a slope that affects one industry and a tax industry that is not fair and
