southwest wind. >> perfect fall day it sound like. >> taking in a little bit of fall color this weekend. parishioners are remember a historic chapel after fire ripped through the channel. it started on the campus of the virginia theological seminary after 4:00 yesterday afternoon. now worshippers, students and faculty are sharing preliminaries. jackie bensen reports. >> reporter: by night fall firefighters were still spreading water on the smoldering remains of the chapel at the virginia theological seminary in alexandria. agents from the federal bureau of alcohol, tobacco and firearms is helpingo investigate. >> there was fire from every window. >> reporter: firefighters encountered difficulties because

of the age of the 12year-old structure. old-fashioned lime mortar started to soften under the high pressure stream of water creating a danger of collapse. roof shingles popped and exploded. the chapel is the heartf the seminary. >> there are countless people who stood in that pulpit, preached ordained, married, baptized. i was ordained as a priest in that chapel. i was installed as the dean and president of that chapel. >> reporter: horfied current andormer students watched. >> i worshipped there at noon. my class of '97 gave one of the windows. it's our chapel and it's gone. the church is still here because we're all still standinghere. so we're the church. it's just something that we love

is gone. >> reporter: jackie bensen, "news4 today." >> d.c. will be looking for a new fire chief come january. the chief announced he'll resign and not be part of the vincent gray administration. he led the department since march of 2007. he's worked in fire rescue jobs for the past 35years. it's the latest shakeup in the department as the city begins s transition from fenty administration. police chief cathy lanier said she would like to stay on. gray will likely reappoint her. after five days the jury is now set for the chandra levy murder trial and there are some strict rules in place for those 12 jurors. the 12 member panel as well as the four alternates were told they could not use social media when dcussing the case. one potential juror was dismissed after theefense

complained about the jurorsing be be social media. opening arguments are expected to start on monday. meanwhile a former student who shot and killed a frostburg university basketball player has pleaded guilty to manslaughter. he originally claimed self-defense. but he changed his plea after the jury sent a note indicating it was having trouble reaching a decision. he agreed to a possible maximum sentence of eight years in prison. if you live in maryland, you can cast your ballot this morning. early voting is now under w in maryland. it started yesterday. can you vote between now and october 28th from 10:00 a.m. until 8:00 p.m. except for tomorrow five vong centers open in opation county. foet at the upper marlboro community center, the bowie

the ne 70 mile-per-hour speed limit will be on i-66, 95 south of fredericksburg and interstate 81. but as jane watrel tells us it comes with a warning. >> reporter: by the end of the year drivers on this stretch south of fredericksburg on i-95 will see the speed go up from 65 to 70. it's part of a plan to help rural virginians to get their destination safer and quicker. >> if you make it 70 they will do at least 80. so you got to factor that in too. >> i don't think it's a bad idea. i guess it's the person behind the vehicle. >> reporter: the speed limit changes were made after experts analyzed rural highways. deciding 860 miles in the state could handle the increase.

but what drivers may not know say authorities is if they get caught going just 11 miles over the posted 70 mile-per-hour speed limit they could face a reckless driving citation. a criminal offense. >> reckless driving is a class one misdeamnor in virginia. which means that it's punishable by a $2,500 fine or -- and/or one year in jail. >> rorter: i-95 rest stop one truck driver said he won't drive any faster. he owns a fleet of semis and says faster speeds means more chances for actions. >> for trucks 65 miles per hour is safe enough. reporter: veteran law enforcement officials agree. >> probably 90% of the fatal accidents that i've been involved in reconstructing the primary cause of that accident was speed. >> reporter: the speed limit increase is being rolled out in

phases. no wds yet when parts of i-66 and i-95 will see the changes. in prince william county, jane watrel, "news4 today." a major traffic alert for i-66 westbound 66 is closed at 267 for work on the dulles metro project. the overnight work should be wrapped up by the top of the next hour, but 66 will close again at 11:00 tonight and remain closed until 8:00 tomorrow morning. all traffic success diverted on to 267. if you have to get back on to 66 get off at 123 towar tysons corner andurn right on to 495 south towards richmond you'll be able to rejoin 66 from there. if you're not from this area good luck with that one. you may also need to plan some extra time if you plan to ride metro this weekend. there could be sigficant delaysn the red and green delays because of platform repaimpbs and track work.

some off the wall characters. but there's no actor in this late role. canadian refugee. they are seeking asylum north of the border. quaid's wife said eight of his friends have been murdered in recent years and they fear for their lives. the couple was arrested in vancouver this week after police found they had warrants in california. woman who witnessed the arrest said it was definitely a strange scene. >> i thought he was another one of the policemenecause he's standing there talk. >> the quaids are free on bond until another hearing sometime next week. a 19-year-old california boogie boarder died after a rare shark attic. witnesses say there was no are warning as the massive shark pulled the surfer beneath the waves. kristen dahlgren reports. >> reporter: it was just before 9:00 a.m. 19-year-old lucas ransom was

boogie boarding in the surf along santa barbara county when a frien saw him go under water. >>aw his friend go under water, came up, something was wrong, noticed that he had been attacked by a shark. >> reporter: his friend witnesses pulled him to shore but it was too late. >> fire personnel responded and pronounced him dead at the scene. the boogie board was also recovered which had a large bite tan out it. >> reporter: this is that boogie board. the bite more than a foot wide. shark expert steve bla. >> this was a big shark. to inflict this kind of a wound it was probably great white. they are not very common in california. >> reporter: experts say there's a greater chance of being hit by lightning. there's onlyeen about a dozen fatal shark attacks in california since the 1920s. >> didn't know sharks were up here. >> reporter: officials are still trying to determine eactly what

firefighters are on the scene of a three alarm fire in prince george's county. this fire is in a three sry building along the 3300 bck of curtis drive in suitland. no word on the extentf damage or if anyone is in that building. we'll bring you more updates as soon as they become available. let's check in with veronica johnson because it was a nice night to sleep with the windows open. >> slept with my socks on last night. we're talking about some patchy frost around the area. when the sun comes up we're expecting lots of sunshine. we'll beat back those chilly temperatures and hit about 70 degrees today. it is going to be a very good da and a fantastic weekend. in fact, which i'm told the marine corps marathon is next weekend and it's the army 10 mimer that takes place.

real life story for a popular haunted house and this drama could play out in the courtroom. good morning, welcome to "news4 today." i'm kimberly suiters on this saturday, october 23, 2010. the news is just ahead but first let' check in with meteorologist veronica johnson. she joins us live in the studio for a look at this great looking forecast. >> it is. my fingers are sti a little nippy here from this morning just walking in but we're talk a really gd stretch of weather for us. in ter of if you like it mild. last week i had the week off. it wasn't so mild for me because i really like it hot. but we do have toet through a chilly morning first. in fact we have patchy frost across the county. howard, montgery, loudoun shade in blue. freeze warnings for the shenandoah valley. we're starting out this morning

some ten degrees lower than we were yesterday, in the 30s, mid-30s and low 30s in manassas and warrenton. a high today of 70 degrees. lot was sunshine. i can't tell you how fantastic today is going to be tomorrow even milder. >> wow. okay. thanks. more now on that breaking news we'veeen following out of operation county. three people are hurt we just learned including firefighter. one person isunaccounted for after a fire tore through an apartment building. this is in suitland. the three-alarm fire broke out in the 3300 block of curtis drive. officials say one firefighter suffered minor injuries, two other people are also hurt. one of them suffered from smoke inhalation. there's no word yet on who that ssing person is or what even caused the fire. we're going to have much more on this breaking news as soon as it becomes available. hall seen with around the corner.

in olney, maryland one haunted attraction is facing a ghoulish lawsuit over its name. john trippen has that story. >> reporter: it's haunting season so the lfman and the rest of thereatures of the night have come out. by the sound of the screams they are doing their job. >> it was pretty scary. you got guys hiding where you least expect it. and girls will scream as lou as they possibly can. >> reporter: since 2002 the olney boys and girls sports association has run this pyro technic event called fields of screams. but now a for profit company for pennsylvania is suing this halloween spectacle claiming it had the name field of screams first. >> there's about 26 or so different field of screams across the country and, aga, this isn't who owned it first,

wherever they may have started. it's who owned it first in marynd. >> reporter: according to court documents, field of screams in lancaster, pennsylvania had the name trade marked when it started back in 1993. it's claiming the olney haunting attraction will cause confusion and suing for $75,000. in a statement sent to ne 4 the field of screams in pennsylvania said quote we're not asking the olney bgc to close their ent or prevent them from pforming fundraising activies we're asking them not use our name. but the olney bgc says they decided not to change the name because the fan loyalty here in the region and because pennsylvania field of screams is two ours away they don't believe there's a confusion. >> we'll fight this to the end. i don't think they assumed we would stand u for ourselves. >> reporter: it's not worried about the legal fees because it

here. we're the church. it's just something we love is gone. >> the bureau of alcohol, tobacco and firearms is helping investigate the cause of the fire. prince george's county police have more information about the shooting of charles smith a former basketball star. they fou a large amount cognitive cane while searching smith's home yesterday. they found evidence of a gambling operation. smith was shot in his bowie home thursdaynd police believe he knew his attacker. there have been no arrests. smith is recovering in a hospital after undergoing surgery yesterday. he was a star guard at georgetown in the late 1980s and played for the boston celtics in the nba. earlier this year the website wikileaks released thousands of documents on the war in afghanistan and ready to release another 400,000 secret documents this time the war in

iraq. the report said it deals with civilian death, detainee abuse and iron's involvement. the u.s. government is leaning on the founder of the site not to release the papers but he said it's necsary to shed light on what's really goi on overseas. two months ago former nasa administrator sean o'keefe was in a terrifying plane crash that killed fiveeople including senator ted strengthens. for the first time since that crash o'keefe talks about his story of survival. ann curry has the exclusive nbc interview. >> reporter: former senar ted stevens, lobbyist friends and other fishing guests took off in the cloudy skies among the eight passengers w former nasa chief and secretary of the navy sean o'keefe a long time friend of legendary stevens and o'keefe's 19-year-old son kevin. 15 minutes into the flight the

cabin was quiet. >> and then with no notice, no evasive maneuver, nothing, no turbulence, just impact. >> reporter: the plane had crashed into a mountain. >> abrupt massive stop. no other motion at all. >> reporter: sounds? >> next to nothing. >> reporter: o'keefe blacked out, coming to in a state of hazy confusion. >> i spend the first few minutes spitting out teeth. >> reporter: he was bee wildered. >> you're looking where you think your son is and he's not there. >> right. >> reporter: o'keefe started to shout kevin's name but count get up. >> erything from my knees down was pinned down. >> reporter: then the magnitude of the disaster set in. among the casualties, o'keefe frnd ted stevens. >> i felt for his pulse. i realized my friend had passed

way. >> reporter: sean had to hold on to find out if his son was still alive. >> your son was your will at that moment? >> reporter: anxious minutes would pass before o'keefe would learn his son had survived. ann curry, nbc news, ashburn, viinia. a discover after a bird strike at dulles. the bird was a bald eagle and it survived the collision. the eeg headline a broken wing but amazingly was otherwise okay. the eagle is being treated at a wildlife facility. there was no damage to the pne which contied on to orlando. and there's no complaining about this airline food. lufthansa has teamed up with chefs from the ritz-carlton.
