gunned down on holbrook street northeast. he was walking down thestreet th a friend. they were kidding each other back and forth. they ran across three guys, those guys think those joking words were meant for them. shots are fired. the friend is wounded, joseph hit four times. he falls dead to the ground. >> basically over nothing. >> what you make of that? >> it hurts. it reallyhurts. it really really hurts. but as a father, we just have to move on and say what the lord's got now. so i'm happy for that part. >> i've been through it all now. and this right here, i don't think i could take any more. and my father is ripped apart. >> reporter: joseph had been in some arguments, but it's unclear as towhether last night's shooting may be linked to that.

they don't care what the situation is. in som areas, they really want to help us get out of it, and better situation. >> police have also taken over several escort websites. the man accused of plotting to bomb metro stations went to court today to face charges. farouk ahmed of ashburn, virginia pleaded not guilty. he's facing charges he conspired with men he believed were with al indicate de, but were actually members of an fbi sting operation. ahmed requested a trial by jury, but waived his right to a speedy trial. hitrial is scheduled for next april. he was born in pakistan, court documents released during the hearing reveal that among the items thorities seized were a pistol, a shotgun and a couple rifles. no one can explain what appears to have been a mystery missile spotte shooting across the skies of southern california overnight. it appears the object was launched just north of catalina

island. u.s. military officials say they're looking into a video that appears to show an object shooting across the sky and leaving a big vapor trail. u.s. northern command says it was not a foreignmissile launch, but they're not ruling out an amateur launch. missile tests are common off sohern california. normally they would require notification. officials say whatever it was, they -- it did not pose a threat. a week after election day, e of the closest congressional races in the country finally has been decided. republican keith fimian today conceded in northern virginia's 11th district race. that means jerry connolly has won a second term in congress. >> reporter: when the votes were canvassed last week, connolly's lead grew. keith fimian annoced he will

not pursue a recount. connolly was back on the job today saying he survived the worst election for democrats in years. >> there were four competitive races in virginia. only one waseft standing. and you're looking at him. >> reporter: connolly's first public remarks came after keith fimian issued a statement conceding defeat. thoughtitled to a taxpayer recount fimian concluded it would not have changed the outcome. though he came close, fimian doomed his candidacy late in the campaign. that's when he said the virginia tech killings may have been avoided if students had been packing heat. he later explained he meant to say security guards. but the damage was done. >> i think the gun and the ads ainst him were decisive. anecdotally i heard so many

people say they were willing to vote for any generic republica to send a message against the democrats. when they heard about that statement people said, he's just not a mainstream republican. >> connolly's narrow victory willot change the way he works in his district when the 112th congress begins. >> i voted for the health care ll. i will not support and i will vigorously resist any attempt to repeal it. >> if connolly wants a third term, he'll need to win back some district voters. >> he has to broaden his appeal. i think jerry connolly was blessed with a flawed opponent in this election cycle. if you had some mainstream generic republican on the ballot against him. that person most likely would have won. >> congressman connolly also addressed his recent health scare today.

the blood clot found in an artery has been treated and his heart is fully functioning, he has no lasting problems. he also told him his doct said to get some rest. after this grueling campaign, i don't doubt it. >> i don't see that happening, though. >> no, he'll be right back at it. here is the current count for the midterm election one week ago. seven races still undecided. republicans have won 239 st notice house. democrats have held on to 189 seats. in the senate meanwhile, the latest count is 51 seats for the democrats. two independent and 46 republican seats with one race still undecided in the senate. that's alaska where they're still counting the write-in votes. both parties are scrambling to rebuild and be ready for new battles when the new term begins in january. right now the power struggles are with the parties. steve handlesman joins us from capitol hill with the latest on that. up here in the house in the

struggling. she looks like a lock to be re-elected top democrat, minority leader. >> even though moderate blue dog democrats like jim mathisen of utah are apauled. >> when you have that kind of election result, we need to listen to people and change things up. >> reporter: half of the 54 house blue dog democrats were defeated as voters moved to the right. ironically leaving pelosi's leading house democrat as a liberal. >> i have a more progrsive caucus. they want me to keep fighting. they want me to keep unified so can win back the house. >> reporter: democrat steny hoyer the top democrat in the eaker is kind of in the middle ideologically, not close to pelosi. was close, sometimes for the blue dogs. now he's in the middle of a

fight, because since democrats lost the majority, they lose the speakership. that means they only have two top jobs, leader and whip. since nancy pelos says she wants to be the leader,here's a fight now over number two between hoyer and south carolina democrat james clyburn who's currently number three. hoyer lined up a few days ago a number of top committee chairs and made their names public. clyburn objected today said, we don't do that when we fight for leadership in the democratic party. he won the black caucus, and that got out. pelosi says she's got a plan to win the fight. >> it's getting complicated. a report just released by the centers for disease control and prevention shows nearly 60 million americans had no health insurance for at least part of last year. in fact, one in six adults aged

18 to 64 was without insurance for more than a year. the study reveals that people without insurance were seven times more likely to skip medical care for reasons of cost. even patients with chronic diseases such as diabetes, asthma or high blood pressure. the study found that all income levels were affected, not just people living in poverty. coming up at 6:00, the fury of mt. merapi is now threatening president obama's trip to the country. >>a luxury cruise ship caught fire off the coast of mexico. it left thousands of people stranded without air conditioning. there's a plan to preserve and restore the national mall. we saw a beautiful day out there today. i think that trend is going to continue. i'll talk about it. plus, i spent the day at a local elementary school. we'll talk about that as well.

mtd merapi is considered indonesia's most destructive volcano. more than 150 people have been killedlready. and although that volcano was 250 miles from jakarta, it appears that president obama may have to shorten his already brief stay in indonesia. there are concerns about the way the ash clouds are affecting flying conditions. the president arrived in jakarta earlier today for a stopover that was already scheduleto last less tn 24 hours. soon after his arrival he and the first lady attended an official state dinner. mr. obama lived in indonesia for several years when he was a child. in his toast he noted that he never would have imagined i would be stepping inside the palace one day. let alone as the president of the united states. tonight the president is scheduled to speak to a crowd of about 6,000 at the univsity of

indonesia. tony hayward is reflecting back on hi actions during the gulf oil disaster. heyward was incharge of british petroleum during the worst oil spill in u.s. history. he said the company was unprepared forhe disaster, and he acknowdged that the company's contingency plan was inadequate and being made up day to day. heyward also said he was not prepared for the intense media scrutiny he faced. still, he doubts he would have done anything differently. yward left his post last month. thousands of passengers and crew members will have to spend at least one more night aboard a carnival cruise ship without any power. the cruise ship lost power early yesterday after a fire broke out on board. they got the fire put out. but the lights are out too, so is the ac and the hot water. >> reporter: it will probably be wednesday night at the earliest

before tugboats can tow the cruise ship into encinada. the ship with mostly amerins on it, has been adrift in the pacific south of san diego since early monday. the ship on a seven-day cruise of the mexan riviera was about 200 miles south of san diego early monday when an engine room fire cut its power and everything onhe ship shut down. >> due to the fire, there still is no propulsion available to the ship. there is no structural damage to the ship. >> some passengers on brd managed to call family back on shore. >> the conditions right now are difficult for the passengers, there are almost 5,000 people on the boat. but we're urging everyone to stay in their cabins and they're just kind of making the best of a badsituation. >> cold food and bottled water are what the crews have been passing ou planes were loaded with over

70,000 pounds of food and supplies to supply out to the aircraft carrier ronald reagan steaming toward thesplendor. what's next to it? helicopters will airlt supplies from the carrier to the cruise ship once the ship's back in port, passengers will be bussed back to long beach, given a free cruise in the future, and a full refund for the cruis that went somewhere, just not very far. chris clackum, nbc news. >> no injuries or ilnesses have been reported aboard that ship. it was an unusual deep water rescue mission in lake michigan recently. th is birdcage corsare. world war ii firebomber that went down during a mission. after spending nearly 70 years on the floor lake michigan. that fighter jet was raised piece by piece.

turned out to be a pretty nice day out there today? >> another great day. this is the kind of weather i'm expecting all week long. tomorrow maybe a little on the cooler side, but still, some fantastic weather today. >> feels great, sunshine, cool temperatures. >> great day for recess. i went out to the cross elementary school in herndon today to speak with the second graders. lindsay kulp one of the teachers out there, and a very good frie of mine asked me to come out to that hool today. a picture as i was introducing one of the local meteorologists. he said, yep, i want to grow up to a meteorologist as well. out there today, one of the questions they asked me is, why do you love being a weatherman? it's a beautiful day across our area today in georgetown. a great day for a run, a bike ride. no matter what you wanted to do. it was gorgeous with nothing but

sunshine. almost no clouds in the sky at all. on a dime the weaer can change. look out toward the west. parts of the northern mountains of that state got 2 feet of snow. if you're a skier, i think this is going to be a great ski season. i think you're looking at a very, very good season for skiing. our season, what are we going to be seeing here? my official winter forecast coming up inbout the next week or so. so you want to stay tuned for that, we'll have it on the 11:00 news one evening next week. 63 degrees the high temperature during the day today. a little on the breezy side. once again today i think we'll see something similar tomorrow, temperature tomorrow maybe about 61. all in all, pretty much a carbon copy of what we saw today. winds out of the north at about 14 miles an hour. still a little on the breezy

side tonight. 50 degrees in frederick right now. 55 in manassas and 57 toward quantico. leonardtown coming in at 46 degrees. we're going to cool off quickly. highs today, 60 in philadelphia. a very cold day yesterday. 2 was a little better for them today. look at the warmth to the south and west. roanoke 73, 73 in ralieg we'd love to see some of that air push even further. wouldn't if be nice to see 70 degrees and sunshine? i don't think that's going to happen, and it's all because of that persistent area of low pressure that's just spinning right now off the coast. it's really cut off from the upper level system yo have a big ridge of high pressure to the west. nice conditions here, nice and warm all the way up toward chicago. our area seeing that cool conditions coming in from the north. we'll see that again during the day tomorrow. even though temperatures are on the average side, just down to the south and west. they're looking at above normal temperatures.

to the day tomorrow. another nice day on your veteran's day as we move through thursday as well. and really intoriday and the weekend. not much going on weatherwise. kind of an easy day to be a meteorologist. 36 to 44 degrees, winds out of the north at about 10 to 15 miles an hour. the northerly wind will bring in slightly cooler air. 57 to 1. another nice one. a few high cirrus clouds. as we move through the next four days, you'll see temperatures around 60 on thursday. 61 on friday. 63 on saturday. plenty of sunshine each and every day. i think that's going to last right on through the day on sunday as well. before things start to get a little unsettled. this week, almost nothing to talk about weatherwise. we have a lot of sunshine, temperatures right around average for this time of year. next week. i think the next two weeks we could have a lot to talk about weatherwise as the pattern is going to shift in a big way. right now i'm kind of relaxing a little bit.

police say sharps had been in some arguments at school, but it's not clear if that had anything to do with the shooting. the pakistani-born u.s. citizen pleaded not guilty today. farouk ahmed ashburn requested a trial by jury. he's accused of conspireing with people he believed were al qaeda members. his trial is set for next april. jerry connolly of northern virginia is goingback for a second term. the race was separated by fewer than 1,000 votes. a recount would not have changed the outcome. emotionsare running high at american university where students and faculty are getting ready to gather in honor of a professor who was murdered. >> sue marcum is her name. she was killed last month in her home in bethesda. jackie benson is on camus now where she left behind a legacy. >> professor sue marcum's roots

runeep at american unersity. the memorial service has been organized by co god school of business. on october 25th, she was found murdered in her bethesda home, just a couple miles from the university. police believe she interrupted a burglary. they say she was beaten to death. her 199 jeep cherokee was stolen from her home. it was recould beered after a lice pursuit and crash in the district some 13 hours after the murder. 18-year-old deandrew hamlin was supposed to be under the department of youth services at the time. he's not been charged with professor marcum's murder. her loss is felt here every day. >> she was everyone's favori professor. she's the one that made students

the video, the sheriff's department would like to hear from you, they're offering a $1,000 reward for information that leads to an arrest and indictment of the suspect. a program that pays commuts to car pool is expanding in our area. the prram started last year, it pays people two a day to car pool in the d.c. region. it started out with 100 people, but is now expanding to more than 700. the commuters are saving time and money by using hov lanes and spending less on gas too. to get involved in the program, can you find a link on our website nbc washington.com. search car pool ca. major upgrade on the national mall is underway. a final plan launched today is going to restore and improve some of the tattered areas of those grounds. tom sherwood has our report. >> the reflecting pool holds about 200,000 people. >> tens of thousands of people gathered on the national mall in

danger. chris berger got a hero's welcome at batefield high school in hey market, virginia. police and fire officials recognized his bravery in front of a huge crowd of h classmates last august. he came upon a burning hummer that had rolled over. the driver was trapped inside and struggling to getout. >> chris grabbed the door handle and pulled it so hard the handle flew off. but thankfully, the door also flew open. >> i just kind of ranford. i guess i thought if i was in there i would want someone to save me. >> after chris pulled the driver to safety and the rescue workers aarrived he headed out of the. he never wanted any attention for his actions. >> good for him. >> looks like he has some enthusiastic supportives at school there, doesn't he? >> good for him. good football action, the

day they make news on the airways. that's the day many of the players have their radio shows. donovan thinks it's hilarious people think he doesn't know the playbook. he's ready to roll again this week against philly. clinton portis said the team has confidence in mcnabb as well as rex grossman and added he wants to be back out thereafter sitting out the past four weeks with his injury. he talked at a community event with his teammates this afternoon. he joined brian arakpo to talk to students about the importance of living healthy, it's part of the redskins play 60 campaign that includespreading the message about 60 minutes of daily physical activity. portis lead kids with different physical activities. the school received 50 grand for the enrollment in the program.

accountable in the offseason. he showed maturity. we know he hasn't done that in the past. other players like albert haynesworth take ben ethlisberger it seems at times haven't grasped the idea of team work. this wasn't the way players responded during his playing days. >> you came in and you were very respectful. you respected yr coaching staff, the older veterans on the team. and u did what you were told. i mean, if you went out early or staying after late. whether the coach said it or a veteran said it, youid it. you didn't mouth back. you didn't think just because -- no, you -- you were respectful in that regard. so i think the nfl has lost its order i guess in the aspect of managing their players.

lots of people have done it before. signed a cell phone or cable contract without reading all the fine print. a lot of that writing protects corporations from lawsuits. now the supreme court is debating wther that's fair. kristen dahlgren has the story. >> reporter: contracts, we sign them for cell phones credit cards, cable. maybe evenemployment. read the fine print and they likely include an arbitration clause in case of dispute. that's how a 30 dollar cell phone bill made its way to the supreme court. a california couple signed a contract with at&t mobility and got a free phone. at&t taxed them 30 bucks. they tried to bring a class action for all those who were improperly charged. the company fought back, claiming they had agreed to arbitration. enter the supreme court. now tasked with deciding the

federal law that favors arbitration. the court heard from their attorney who argued a ruling for at&t would restrict consumers rights. especiallyhose who don't even realize they've been overcharged. >> people have to have some way of leveling the playing field when it comes to small scale fraulike that, across a wide number of consume ares. >> at&tlaims its arbitration process is the fairest way. >> companies that do that like at&t should be able to provide a very strong vble alternative route that gets more money to people injured and less money to companies. >> the case that could affect you the ne time you sign on the dotted line. the court has made some business friendly rulings recently. but didn't seem as willing to side with at&t on this one. the decision is expected sometime next spring. kristen dahlgren nbc news,
