not the final word. brian mooar, nbc news, washington. 9:00 right now. u.n. secretary general ban ki-moon says he was, quote, relieved when he heard about bin laden's death. ban spoke to reporters in istanbul while taking part in the least developed countries' conference. he said whatever bin laden's beliefs were, his violent acts could never be justified under any circumstance. ban also expressed his concern that despite bin laden's death, al qaeda will continue to plot against america. >> he might have been killed. he might not be here, but what i'm concerned is that his movement may still live on. that is what we have to guard against. that is what international community must fight against international terrorism. >> ban also spoke about the situation in libya, saying that moammar gadhafi has lost legitimacy as a leader and he must talk with his own people to

put it. it can't go anywhere. just sit. >> reporter: actually, it's growing. crews continue to move sandbags into place and build berms where they can. the mississippi is already past major flood stage and on the way to a near record crest. but those who live here are worried about right now. >> my worst fear is that they don't have nowhere for this water to go. going to have to go somewhere, and it's going to flood our house out. >> reporter: jenny garlock is beginning to realize that fear. >> we're expecting the first floor to be flooded. >> reporter: they have moved everything they can out as the water continues to move in. >> i my husband and i, if we cut a little hole in our living room, we could hold our poles right now and do some serious fishing because the water right now is underneath this floor. so it is about ready to pop through. >> reporter: all she can do is joke, about you the reality is very serious. a lower level of her home is already under water, and that water is now pushing at her back

door. so she leaves. through the front, unsure of what will be left when the water is finally gone. >> if the water does recede rather quickly, maybe that will minimize the damage to the inside of the house. >> reporter: it's a hope shared by so many here as the water continues to climb. jay gray, nbc news, memphis. virginia won't be getting any help from the federal government for damage caused by last month's outbreak of tornadoes. fema has denied virginia's request for disaster zaassistan. this tornado spotted in stafford county is one of 29 that touched down in the commonwealth in april. in all 10 people were killed, more than 200 homes were destroyed, and 1,000 other homes were damaged in the outbreak. governor bob mcdonald said he's considering appealing the decision. some of the georgetown restaurants damaged from last month's flooding here are set to reopen for business this morning on mother's day.

nick's riverside grill, tony and joe's, and sequoia were all severely damaged three weeks ago when the potomac river flooded and the flood gates were not raised. the restaurants are still dealing with major flood damage inside but are going to serve customers out on their patios in the sunshined too. tony and joe's and nick's are actually sharing a grill while their interiors are being repaired. there is still a class action lawsuit against the management company of the building for not raising the flood gates. there are currently 58,267 names on the vietnam veterans memorial wall, remembering those who made the ultimate sacrifice. this week five more names will be added to the wall. news 4's derrick ward is at the memorial this morning with more on that. >> reporter: good morning. we are indeed on the grounds of the vietnam veterans memorial. folks are gathered for one of the names added today.

this is army specialist charles sabateer. he was wounded in 1968, but his name is being added today. the story behind that is testimony the costs of war aren't always paid immediately. army specialist charles sabatier is from galveston, texas, and he was severe lly wounded in comba in the ted offensive in 1968. 41 years after the offensive, he died. his death was deemed to be a result of his wounds, and his name is being added to the wall. now, we spoke to a gentleman who's known him for the past 30 years. >> we worked together since early 091970s. both of us were shot in vietnam and came back and working for an organization called paralyzed veterans of america. we don't forget. that's why we're here today. >> reporter: so he led an active life in between the time he came home and the time he died. that is testimony that is

that's thanks to a 15% tumble in oil prices due to an increase in supply and a decrease in demand. this morning the national average stands at $3.96 down a penny from yesterday. in d.c., you're averaging about $4.13 for regular unleaded. the average is $3.98 in maryland. virginia drivers paying $3.87. and the average is $4.12 in west virginia. graduating from college is always a special time in one student's life, but one family got to celebrate graduation in a unique way. michael purcell and his daughter glynnis graduated together from american university. the first time a father and daughter graduated together at au. michael got his master's in creative writing while his daughter got her bachelor's in theater. the two commented on the special moment they shared together. >> i think going through with my dad who's been an adult for so long, to have that connection of we're both in the same place is really cool to me. it does hold a very special

last few weeks. not much in the forecast for mother's day. that's good news. that keeps me out of the dog house with moms for sure. unfortunately, no chances for soaking, cleansing rain showers probably till the end of the week. that means the pollen count will go up each and every day until we get a nice soaking shower from mother nature to clear things back out again. for now, we are getting a reasonably good amount of sunshine here in downtown washington. i can see shadows being cast around the 14th street bridge complex there as the monument stands tall in downtown. our current temperature now made it up to 62 degrees. dewpoints in the low 50s. not much of a humidity factor. humidity 65%. winds light out of the north at only 6 miles per hour. that's going to be the case for the remainder of the day. very light northerly breezes. that northerly breeze is going to be here for the next three to four days. temperatures won't climb too much over the next three to four days. 55 in frederick, maryland.

55 in manassas. 62 in la plata. rundown into leonard town, maryland. few lonesome showers across st. mary's county. northern neck. those are moving down away from the washington area. there's nothing back upstream. as a result, the majority of the day will be dry. still with a little day time heating, you can't completely rule out a pop-up shower that might last all of two or three minutes. that's going to be it. breaks of sunshine will lead to more sunshiny breaks. here's a look at it on our futurecast model. a little chance down across tidewater. and a bubble of high pressure across canada. that's going to set up shop and keep us high and dry for much of the next couple of days. with increasing amounts of sunshine, it's going to be one of the prettier weeks here springtime in washington. for today, still going to call it more clouds than sunshine. we'll have increasing amounts of sunshine as the day goes along. otherwise, a delightful day.

she hit and killed them as they stood on the side of a pris georges county road. they faces decades ahead in prison, but this morning she's not in jail, and the victim's families want to know why. news 4's darcy spencer found out. >> reporter: 32-year-old jenny mate of laurel convicted of killing two men trying to exchange information following a fender bender. >> she did get a guilty verdict for all charges. >> reporter: mate, who's had two prior drunken driving offenses faces 21 years in prison. she's behind bars. a judge remains free after her lawyer discovered she's 4 months pregnant and has an upcoming doctor's appointment. the victim's relatives have been waiting for more than a year for justice. >> it should have been no excuse for her to do it. she should have been right there and then.

>> reporter: authorities say mate's blood alcohol level was twice the legal limit. she was speeding and driving on a suspended license when she plowed into roy lacayo and justo rosario on february 1st of last year. lacayo was a father of five children. the youngest was 5 months old at the time of his death. >> they ask for him all the time, and i have to explain to them daily where he is. why he's not here and why he's not coming back. >> reporter: one of the lawyers representing mate was maryland delegate joseph relario, chairman of the state's powerful house judiciary committee of the mothers against drunk driving has accused him in the past of blocking attempts to strengthen the state's dui laws. >> i don't know how people can represent the state of maryland and represent people like ms. mate. >> reporter: prosecutors say the block box recorder in her cadillac escalade provided crucial information. >> there was no attempt to brake. there was no attempt to brake

once the impact had happened. it gave us the speed at the time when impact occurred. >> reporter: we were not able to reach delegate valario for comment on the story. a judge has ordered mate to turn himself in on may 16th, three days after the prenatal visit. she's scheduled to be sentenced in july. darcy spencer, "news 4 today." a teenager whose body was found in maryland two weeks ago has been laid to rest. a funeral for phylicia barnes was yesterday in georgia where her father lives. the 16-year-old honor student disappeared over christmas while visiting family in baltimore. her body was found in the susquehanna river two weeks ago. at the funeral, barnes' mother was given her high school diploma. a memorial service was set for saturday in baltimore. police in nevada are initiating a renewed search for a missing canadian man after his wife was found alive seven weeks after disappearing. rita chretien managed to survive

on trail mix after her and her husband's van became stuck in snow in mountains near the idaho border. her husband left with the gpa three days after getting stuck in the hopes of finding help. he hasn't been seen since. the forest service says there are a lost gorges in the area that would make it easy to get lost. weather over the past month has included rain, snow, and cold temperatures. on this mother's day, we want to tell you the story of one local mother on a mission, a mission to find her son's killer. five years ago marcus johnson was shot and killed outside his home on 1st street in d.c. his mother has devoted her life to finding the person who pulled the trigger and bring that person to justice. news 4's pat collins has more on her daily struggle. >> reporter: mildred johnson is a mother on a mission. out to find out who killed her son. she goes to the scene and hangs up fliers, and they get torn down, she puts them up again.

she's been doing this since the murder five years ago. >> just left him in the street. pain, that's all i have. that's all i have left is pain. >> reporter: mildred johnson has three sons. maurice a, a former tight end for the philadelphia eagles. he's in the pharmaceutical business today. shawn, a longtime employee for "the washington post." he's been there more than 20 years. but the son she thinks about every day, that's marcus, her baby boy. >> that's the son that looks so much like me. that's the son that, if i'm sick, the other two would back away. not him. >> reporter: marcus didn't have a fast track to success. when he was 16, he got involved selling drugs. he shot a guy who didn't pay up.

he did time, four years time. >> according to the youth center on bladenburg road, i did, because he had to stand up and take responsibility for what he did. >> reporter: when he was 26, marcus got lucky and landed a job at the washington hospital center. he was a patient transporter there. >> when you got there, it seems like he had made peace with the world. he wanted to just be able to be a productive person. >> reporter: marcus johnson worked that hospital job for nine years until the day he died. that may day 2006, he was down in his 1st street neighborhood visiting his aunt. he heard gunshots. he went outside. there were children out there. he went to protect their children, they say, and that's when he was shot himself. shot nine times. >> you didn't just shoot him one time.
