stayed in her condo for days after the murder. in charlotte, north carolina curtis lopez remains in police custody charged in the murder of his wife jane mcquain. he was arrested at a motel, with a woman at the time of the arrest. he did 13 years in a pennsylvania prison. he has a court hearing in the murder case in north carolina on monday. back at the scene today, the victim's brother and co-workers are talking to her neighbors. they are talking to her friends. darren brown, the victims pastor. >> to see someone at this stage, her stage in life to be suddenly taken away is devastating. >> reporter: 51-year-old jane mcquain found murdered in her second floor condo wednesday night. she may have been dead for more than ten days.

still missing, her 11-year-old son, william mcquain. suspect lopez is the boy's stepfather and police believe he may have key clues. >> you think william mcquain is still alive? >> we have to have that hope and i just spoke with a detective who said he has that hope. we are going to continue to operate that way. >> reporter: this is the same man you saw here? >> yeah. >> reporter: he was in miss mcquain's condo? >> yeah. >> reporter: this is sis forward. she saw the arrest picture of curtis lopez and recognized him as the man she had seen at jane mcquain's condo. she remembered seeing him, miss mcquain and william on the balcony friday, september 30th. she remembers seeing lopez loading a tv into miss mcquain's car five days later. >> told me it was her husband and her son william has not been

found yet. oh god, man did i pray last night. >> reporter: two vigils tonight for 11-year-old william mcquain. one at the germantown community center with the football team. the other at his school, the mlk middle school. they start at 7:30. counselors are expected to be at both of the vigils. back to you. >> all right. pat collins, thank you, pat. now to the latest on the severe weather that ripped through our area yesterday. the national weather service confirms a tornado touched down near i-95. the storm caused delays for drivers, many of whom used their cell phones. nobody was hurt by the flying debris. in new kent keown ty virginia, kids were scrambling for safety. students could feel the doors

and windows blowing open and felt the debris blowing through. the tornado damaged 30 homes in the area knocking out power and splitting trees the storm blew think louisa, virginia. children were sent scrambling as the storm headed their way. jane watrel reports. >> reporter: this was strike two for mineral county. the tornado two months after a devastating earthquake. the tornado came up quickly, catching many off guard. as this phone video knows on i-95 near quantico. hundreds of school children were boarding the buses when the tornado warning came down. here is the principal. >> as the leader, i have to stay calm. some children were shaken and upset. i let them know it was bad weather. we didn't want to send them out in bad weather. >> reporter: many thought it was

simply a bad storm, not realizing a tornado touched down nearby ripping the roof off a historic plantation home. >> it started downpouring on us. >> worried about the safety of the kids and i wanted to be done and over with. >> reporter: this is the second traumatic natural disaster for these school kids. in august, an earthquake that registered 5.8 damaging 1300 homes and closing two schools. 37 trailers are home to thomas jefferson elementary students. >> this is our home for the rest of this year. we dubbed it mobile mountain. >> reporter: tonight, the community will come together for a fund-raiser to help the earthquake victims rebuild. >> we are resilient. from the second the earthquake hit, we hit the ground running and developed a plan to get kids back in school. we haven't lost our spirits. >> reporter: in all, the community sustained $80 million worth of damage from the earthquake. folks are counting their

blessings. no one lost their lives in the quake or the tornado. in mineral, virginia, jane watrel, news 4. the storms moved out for now. get ready for more changes. doug kammerer tells us we are about to get our second taste of fall weather. hey, doug. >> if you step outside now, you noticed the changes if you were out earlier. temperatures cooled off a little bit. the winds are picking up. take a look outside. a pretty shot as we make our way across the city. not bad out there at all. the temperatures falling down to 68 degrees. that's not too bad. look at the winds. west-northwest at 17 with gusts of 23 miles per hour. higher gusts across the area. upwards of 30 to 35 miles per hour. no rain. that's the good news. if you are west of the blue ridge, you folks in western portions of virginia and west virginia, the panhandle of west virginia, a few showers there. you may see a few more. this is the rain that came

through earlier today. an abundance of rain. lightning, heavy downpours. itis moved out. behind it, we are going to move down. waking up to temperatures in the low to mid-40s in most locations. low 50s, 52 by 7:00 a.m. in the city. you'll need your jackets and coats. a montgomery county judge made a key ruling considering what evidence will be allowed in a murder trial. jurors will be allowed to hear a taped conversation between britney norwood and her brother. he asked if the victim accused britney of stealing. later in the conversation norwood said murray had plans to talk to a manager. she's acured of killing murray in march. a trial is expected to get under way october 24th.

a d.c. nightclub is in the middle of a suit. mohamed died last october after a fight with the owner and employees. he broke the club's window after being denied entry. that's when he was beaten. the u.s. attorney's office determined there wasn't enough evidence to pursue criminal charges. the father explained the lawsuit would bring closure. >> it's not easy losing -- we loved him. we seek justice. we will not stop anywhere until we get justice from the court. >> they say even if they win the lawsuit, no money could replace their son. in the republican race for the presidential nomination, texas governor rick perry tried to regain lost momentum. he pitched oil as a way to

hundreds of boxes of counterfeit goods were seized by

federal agents in afternoon in northeast washington. the boxes were full of fake louie vi tan, nike, and bootlegged dvds. 11 people were arrested. the market is located d.c. farm market near the university. it remains open during the raids. more clashes on the streets of new york city as the occupy wall street protests rage on for a month. developers backed off from evicting them from the park. then celebrations led to more than a dozen arrests. we have the latest from new york. >> reporter: after overting a shut out to leave the park, protesters went on the march to declare victory. it resulted in just over a dozen arrests.

the owners of the park and the city's mayor asked protesters to clear out sections of the park to be cleaned up. instead, protesters armed with brooms and mops cleaned themselves. >> they said we couldn't return with sleeping bags. that meant we couldn't occupy the park. we could be like regular passer byes in the park. it was an actual evict attempt. >> the protest that began here turned into a nationwide movement with rallies being held in nearly 200 cities. >> reporter: their message of social inequality and what they see as corporate greed gained more supporters each week including political groups like moveon.org. >> they seem determined. >> reporter: others, especially those who work in the financial district say the protests are only getting them so far. >> i think the economy is a

disaster and people need jobs. i don't know how protesting gets jobs. >> protesters see it differently. while they are not moving, sweeping change may not be far away. michelle franzen, nbc news, new york. park owners say they delayed the cleaning of the park. no new date for when they will try to move the demonstrators. schoolteachers will not be required to check the immigration status in alabama for the time being. they blocked the controversial part of the immigration law. they also blocked part of the law that makes it a crime for immigrants not to have the proper documentation. they will detain immigrants suspected of being in the country illegally. alabama's new immigration law is one of the toughest in the country. >> doug has a look at the weather. it's looking good. >> it is looking good.

i was at a charity golf event earlier today. everybody was like we have the meteorologist guy. what do you sigh? >> rain. we got in four holes of golf. we had three glorious holes, then the downpours. that was to benefit pat's family. i wish you all the best. a lot of people willing to play golf even though it was rainy. we have had so much rain it's been ridiculous. we hope to see things change a little bit. maybe a bit of a drier path. still a couple showers back toward winchester and toward the eastern shore a few light showers there. it's going to be it. this is what happened earlier today. i was playing right here in prince george's county. we saw the rain come through. lightning and thunder. everybody had to get under the trees or shelters. all the rain continues to move up to the north and east away

from our area. now, our wind is coming straight out of the west. showers back from frederick county and portions of the panhandle of west virginia rotating around the area of low pressure. this is where the cold air is. we are going to continue to see showers in west virginia this evening. for the rest of us, to the east of the mountains we should be on the dry side. for the record, take a look at this. high temperature 73. low of 63. not a big step there. look at this step. nearly 20 inches of rain since the first of august. it's over 11 inches above average. that, as i mentioned is ridiculous. we need to see drier weather. i think we are going to get it for the weekend. 68 degrees out there now. winds gusting to 23 miles per hour. we are seeing windy conditions. temperatures are coming down. 61 now. 67 in the la play da. what about the winds?

a fighter jet wrash crashed in an air show in china. it burst into flames on impact. one pilot is missing and presumed dead. another pilot ejected from the plane. he suffered minor injuries. nobody on the ground was hurt. the crash is being investigated. it's not clear if mechanical problems or pilot error is to blame. soldiers should be home by tuesday. israel agreed to release more than 1,000 palestinian prisoners for his safe return. it's causing controversy in israel because some of the hostages are being held for terrorist attacks. his abduction is described as a

clerk pleading for his life. it happened sunday in alexandria. two masked men stormed in demanding money. one guy was armed. you can see him rummage through the cash register and jump into the car driving off. the clerk was not hurt. if you recognize the robbers, call police. arlington police arrested two people for saling cooking oil. they were siphoning oil. similar thefts are happening across the region. they believe the oil is sold on the underground market. it's worth $3.50 a gallon thanks to the boom in biodiesel market. >> we are trying to take a waste product and put it back into the market. these criminal activities are impeding our efforts to do that. >> there are six cases of

cooking oil thefts. as many as 200 across the d.c. area. public safety officials are defending their actions after a scary false alarm. they sent out and electronic alert warning them a tornado was about to hit the campus. there was no tornado. derrick ward visited to get the story firsthand from the students. >> reporter: high winds, dark clouds, a sure sign a storm was brewing. a series of e mail notifications said it may be more than a routine storm. the first alert came around 6:30. >> i got a text message saying the tornado hits in 15 minutes, then alarms. what is going on? >> reporter: then another alert saying it was getting closer, ten minutes out. >> i think i was in a safe location.

i kept studying. >> we stopped and stayed there until it was over. >> reporter: safety officials were relying on information from accuweather. often but not always an indication a tornado is formed. a security official tells news 4 they were not going to wait for conformation. they errored on the side of caution. they may have overreacted. several years ago a tornado hit the campus. two students were killed when their car was lifted and dropped down over there. that was before the new notification system was in place. now, it's a mainstay of campus life. students didn't mind how it was used yesterday. >> confirmation. i know i can trust it now. i get five texts at once. >> a lot of people were worried. i didn't think it would scare that many people. >> they kept us informed. i appreciated that. >> derrick ward, news 4. >> yumpt officials say given the

mandela and the walk to freedom. chris gordon, news 4. mandela is 93 years old. after he retired in 1999, the nelson mandela foundation was established. now, the question for you, what kind of weather for the ceremony on sunday morning? >> i think as long as everybody dresses for the weather, it's going to be nice. plenty of sunshine for the 8:00 a.m. dedication. there's going to be a bit of a breeze. it will be cool with a temperature hovering around 50 to 52 degrees. it will be on the cool side with sunshine it will warm up quickly. look for the wind during the day tomorrow. winds could gust on saturday upwards of 30 to 40 miles per hour. sunday, a high, afternoon high of 74 degrees. something else looking good, the redskins game. if you are heading out to the redskins game, dress appropriately early.
