good morning. welcome to "news4 today." i am pat lawson in for barbara harrison, on this october 25th, 2011. we begin with the deadly quake int turkey, a newborn bab, and now her mother and grandmother have been pulled from the rubble. the building collapsed when the

7.2 magnitude quake hit on sunday. people gathered and clapped as people rushed in to rescue the baby. and hours later, the infant's mother and grandmother were freed from the rubble, and the death toll stands at 432, and 1,300 have been injured. and then this morning, a convoy arrived in the hard-hit city of ersis. people swarmed the trucks to get their hands on the donations, and donations are pouring in from around the world. back here at home right now, the second day of the murder trial is getting under way, and a maryland circuit court judge is trying to decide whether

crime scene photos can be used for opening statements. megan mcgrath joins us. >> reporter: these are crime scene and autopsy photos. very disturbing images. the prosecutor wants to use them at the start of the trial before they are entered into evidence. the defense, though, says that's not fair to their client and it's now up to the judge to decide. >> it was a gruesome crime. murray was stabbed to death. all indications are that they put up a fight. prosecutors have graphic photos that they want to show to the jury in opening statement, and one is her dead inside the store, and then one of the accused at the scene. while prosecutors argue the photographs are key to the opening statement, the defense says their use at the start of the trial would be prejudicial to their client. as the judge ponders the

arguments, jury selection resumed. the process is taking longer than expected, and the problem is pretrial publicity surrounding the case. the overwhelming majority of prois that correcttive jurors stood up. the judge is bringing in jurors one by one to question them about what they know about the case, whether they have already formed opinions with regard to the innocence or guilt of the defendant's in this case, and this is taking a long time. i watched as one woman went back into chambers, and she did not come back out for 15 minutes. they have 149 jurors they are questioning at this point. the initial statement was that they may see the jury by sometime late this afternoon, but it may go into tomorrow. we will have to wait and see but certainly taking a lot longer than expected. attorneys for a former

university of virginia lacrosse player accused of killing his girlfriend, love, want love's medical records because they say she died from an irregular heartbeat from alcohol and adderall, a prescription drug she was taking. brown was arrested in september after initially pulling him over for a broken headlight. the traffic charges come as investigators investigate brown with a scandal including vincent gray. if you love fall, you will

this hour. donne donnells joins us. >> crews are working to get a car out of the canal. also on the beltway, outer loop at telegraph road, an accident involving a fuel spill. basically all the lanes are blocked in the through lanes, and you have to get on the local lanes to continue on the outer loop of the beltway. i will show you right now, these cars are pretty much standing still, and this is at the 395 and i-95 interchange. police are looking for two different groups wanted for a rash of robberies in northwest over the past 48 hours. the latest happened around 7:30 last night, and that robbery followed a number of robberies over the weekend in the ufrmt street logan circle, dupont circle areas, the victims were

approached by two suspects and they took their wallet before getting away. the second group consist of several youngsters that travel on bikes. now to a news4 exclusive. the folks that run a plastic surgery center say a woman got her botox and left without paying her bill. this happened at the mt. castle surgical center. the woman walked into the practice and got her botox treatment and took off without paying. they discovered the woman provided a fake name, address and social security number. the office did reach the woman and she did eventually agree to pay her $140 bill. shoppers in the district may do double takes when they see who is bagging up their groceries this evening. mayor gray will serve as a celebrity guest bagger. he will bag food to help raise money for breast cancer

to hire new campaign staff in the new hampshire office. they quit without notice. they blame her national campaign staff, calling them, quote, rude, unprofessional, disunest and at times cruel. and they claim they have been working without paychecks since last month. bachmann's campaign manager says they are not responding to those comments and are focussing on iowa. >> the ad on youtube is raising a few eyebrows. >> we can do this. we can take this country back. ♪ that's creating buzz about cain's stance on smoking.

after seeing the ad, several organizations contacted herman cain's campaign thinking it was a spoof, and they contain that the ad is legit. there's a plan to help homeowners under water with their mortgages. he will work with federal agencies to smooth the way for homeowners to refinance at lower rates, and to allow more competition among mortgage lenders. the plan would reduce closing costs and eliminate some refinancing fees to qualify, borrowers must have mortgages owned or guarantee by lenders, fannie mae or freddie mac, and must be current on their payments with no more than one late payment in the last year. later toy, the president will appear on "the tonight show" with jay leno. it will be his second appearance

as president, and fourth overall. you can watch the tonight show at 11:30 tonight here on nbc 4. more than five weeks after the occupy wall street protest began in new york, another movement is sprouting up in washington. organizers of occupy penn avenue, and they want to launch rallies in front of the white house tomorrow. these are aimed specifically at politicians and will be different from the previous occupy d.c. protest because demonstrators won't be camping out. they plan to come back every day for rallies until they see change in d.c. we have seen some nice weather in d.c. in the entire region today. >> it's just a gorgeous day after a very chilly start. we were down in the 40s in most locations this morning, but since then the temperature is warm. still on the cool side.

into the low 60s throughout much of the region. plenty of sunshine powering down, and last evening we had an amazing sight in our sky, something rare. we had the northern lights showing up in red sheets of light. this was taken towards martinsburg, west virginia, and points to the north to the counties in maryland, and many people saw similar scenes in their skies last evening around 10:00. a big solar flare from the sun went off yesterday and directed at the earth, and that's a lot of energy, and as it hit the upper atmosphere of the earth, it turned the sky into a fluorescent light and lit up the sky last night, and very rare for us to see. well, there is a beautiful scene. the potomac river reflecting the beautiful blue sky. right now at reagan national, it's at 61.

dew point down to a dry 42. and then we have a wind around 10 miles per hour. and temperatures have hit the low 60s in much much virginia, and we had some fog but now that fog is gone and in the low 60s. near 60 in montgomery, arlington and fairfax counties. and near the bay near to 60 degrees now on this tuesday morning. this will probably be the warmest day of the week, and maybe the last warm day we will see for quite sometime going forward over the next 24 hours, we will have a clear afternoon for the most part, and maybe just a few high clouds coming in, and then the early part of the evening will be mostly cloud free, and then later in the evening, we will see clouds rolling in, and during the day on wednesday, quite a bit of cloudiness around during the morning and perhaps in the afternoon, even a bit of a sprinkle. for the rest of this afternoon, gorgeous blue sky with lots of

sunshine. light breezes out of the northwest, and maybe guesting around 15 from time to time. and then the autumn foliage, a spectacle to see. and then as we get towards the weekend, we will have the peak color. and then partly cloudy, and then we will be down into the upper 50s by midnight, and we will have a southwesterly wind 5 to 10 on miles per hour. and then by dawn tomorrow down into the upper 40s starting off wednesday morning. wednesday increasing clouds, highs reaching upper 60s. there's a small chance of an isolated sprinkle tomorrow afternoon. and then a likelihood of showers moving in, wednesday, and it looks like after midnight occasional showers all the way into much of thursday, probably ending by late thursday afternoon. and then we will clear out and get cold. friday morning down into the mid-30s in many locations. afternoon highs in the mid-50s. quite a chill in the air and cloudy. over the weekend, remaining

right now, rescuers in turkey found the mother of the infant. the woman was found alive after the baby was rescued. the death toll is more than 400. more than 2,000 buildings have collapsed. the judge in the lemon murder trial is hearing arguments today about whether to allow crime scene photos to be shown to jurors during opening statements. autopsy photos of murray's body are key to the opening statement, and the defense says using the photos would be

prejudicial to norwood. and then 9-year-old robby wood jr. wandered off at the park and was last seen wearing a long-sleeved red shirt and blue pants and blue shoes. they have no new leads in the baby lisa case as the search enters the fourth week now. and we are hearing from the man married to lisa's mother, and it's not the man that has been seen appearing with her. >> she's still married to another man, who we are now hearing from from the first time. shawn bradley didn't want to go on camera but tells nbc news, she has always been a good mom. as for the investigation surrounding his wife's new family, he says i'm confused of what is going on. this is craziness to me. bradley says he has not spoke to

deborah or seen their son in two years. i am concerned about him and want to make sure he is safe, bradley says, and i miss him and would love to have him back. and nbc news was invited inside the irwin home, and it was a home where it shows the children were cared for and loved. >> they are very proud of their child. and they are proud of this baby like picasso, almost, that goes on the wall. this suggests a family unit that cares about this little girl. >> the irwin family is hopeful investigators will continue their search, checking out places like these woods three miles away from the family home and a short distance away from the intersection, where a witness says he saw a man

that's a picture from the sky watcher camera. in the foreground is gluber park. you can see the national cathedral there in the middle distance. we have plenty of sunshine. temperatures are in the low 60s, in most locations now. it will continue to climb in the upper 60s by mid after new and maybe 70 in a few spots, especially in virginia, and then overnight tonight, clear and then a few clouds, and then upper 40s by down on wednesday, and then highs in the upper 60s. there's a small chance of an isolated sprinkle tomorrow afternoon. on tuesday, looks like we will have rain from the morning and off and on into the afternoon, and then we will have highs in the lower 60s. and then clearing out thursday night, 30s on friday morning, partly cloudy on friday afternoon and into the mid-50s. a chilly weekend to follow.

a slight chance of a shower on saturday. and sunny on sunday. that's the way it looks right now. >> let's look at midday traffic. danella sealock is here with the latest. >> it's still looking pretty bad. hate to say it. the outer loop still seeing the accident at telegraph road. there's few on the beltway so you can only get by on the local lanes. i am seeing not only backups on the outer loop, but also troubles on i-95. this is what the interchange looks like. right now they are driving at about 11 miles per hour, and delays on i-95 start at fairfax county parkway and continue as you head towards 395. it is a mess today. >> all right. thanks, danella. prince georges county could rake it more than $500,000 from new speed cameras. the county has issued more than 13,000 citations since putting up 14 cameras last month. most of them are located near

school zones. violations carry $40 fines. prince georges county expect to have 24 speed cameras in place by the end of the year. it's going to be a slow go on metro this weekend. and crews plans to work on the sewer systems and make track repairs. it will start at 10:00 on friday night, and riders should expect delays up to 20 minutes, and they are planning to close four stations on the green line, and they are waterfront, and navy guard and anacostia and heights. and then a lacurfew proposa is losing support. that bill would require teens 17 and under off the spraeds by midnight on the weekends and 11:00 on weekdays.

the county council is expected to discuss both bills on november 17th. well, today the nbc is expected to announce that at least two more weeks of the season are being axed. according to the new york "dailey news," commissioner david stern will cancel one or two more weeks of games at the end of november. they won't come back to nof unless players agree to split revenues 50/50. player representatives call that proposal, quote, unquote, intolerable. >> football coaches here in washington are scrambling to fill the holds after losing five starters to injuries in the last two weeks. tim hightower is done for the season with a torn acl, and moss is out five to seven weeks with a broken hand. coach shanahan says one

business, how are things? >> the markets are under pressure. the europeans after having a plan to resolve their debt crisis now are saying it's going to be taking more time because it's complicated. more signs the housing market needs a fix. in the washington area, prices rose for a third straight month, up from july, about three tenths up from a year ago. national prices in the top ten city fell 3.5% from a year ago. netflix is the disaster of the day, down 40% on dispointing results. al movie rental company losing 8,000 subscribers after the

controversial dvd rental price change. and then coke wants the poster child of bad marketing, if you are old enough to remember that in the '80s, this time keeping the coke formula the same, but changing the look of the can for the next six months. they will feature the polar bears in connection with the world wildlife foundation. i remember going to the press conference about coke saying why are you changing the formula, it's coke and it works? they did not have an answer. >> a lot of people having that question, but at least this time, just changing the can. >> netflix, you should not anger loyal subscribers that way. >> they certainly made their point, haven't they. thank you, bertha. >> see you. halloween is a great holiday. it's a time that allows you to transform yourself into anything

skin? will one day make you break out? >> not necessarily. if you are using an oil-based, yes, that can clog pours, and it's the skin test method, putting it behind the ear to see if they are going to have any reaction. particularly, that doesn't always say that you are not going to have a reaction, because if you are going out at the jolly green giant and putting it all over your body, that's more absorption and reaction that can possibly occur versus you just putting it on your face or a small area on the body. >> you know, as you are talking, i am thinking about all the differences now that we are seeing in makeup, the pigments are stronger, and you are seeing neon colors and sparkles and glitter and all this stuff. >> one must be aware of some of the products that come from china. some are found to have lead in them. that's the only concern.

most of the ones in the u.s. are approved. there's a certain fta classification for certain pigments that they all must abide by. so they are pretty safe. you see them at all the children's parties, so you know that they must be relatively safe. i would frequent stores that commonly dispense or sell these types of products versus stores that may bring them in only for the holiday, because they could be getting them from china, and we don't really know sometimes what is in those products. >> so you go to a dollar store and there is a big sale on makeup that you want to be careful about that? >> look to see where it has come from, yeah. >> so how do you get it off? you mention water-based, so it

could come off easy n? >> yeah, it may take scrubbing and rubbing, but generally it comes of a nicely. the mineral based preparations usually need something that is a little oil based to remove it completely off of the skin, but all of them can be removed off of the skin. the issue is sometimes the mineral base can clog the poure, so you may need to be concerned about that if you have oily skin. >> well, a oil based remover, baby oil or what? >> yeah, mineral oil or baby oil, and then cleanse the skin after that to remove that oil off of the skin. >> that oil that will unclog pores? >> yes. >> and we are seeing strange
