change how prosecutors present their opening statements. chris gordon outside the courthouse with the latest. chris? >> their ruling was rendered just moments ago. at issue were 11 graphic photos that the defense didn't want to be shown to the jury during opening arguments. the judge prohibited the prosecution from showing seven of them saying that when he looked at them, he decided the jury would be disturbed, emotional that these are gruesome photographs. if they were used in opening statements, according to the judge, the jury will not listen to anything else after seeing those photographs. he did allow four photos to be used in opening statements by the prosecutor in this case, but these are more general photos of jayna murray's body, without her face being shown. some distinctive marks on her skull and hand and a picture of her during her lifetime. other breaking news at this

hour. it was revealed that six to eight weapons were used in the murder of jayna murray and she suffered 107 wounds. 107 wounds. all of this was revealed tonight as this trial begins. they started monday screening 149 potential jurors. now, that number has been cut to 65. the final selection begins wednesday morning as prosecutors can strike or remove up to ten people. the defense team gets 20 strikes, eliminating people they don't think will be sympathetic to their side. judge robert greenburg says it will take no more than half an hour and then the trial will begin with opening statements, but lawyers disagree over what the jury should see. at the crime scene at the lululemon store last march, victim jayna murray was found with gruesome head wounds

inflicted with a hammer and knife and beaten with a display rack and there was a rope around her neck. lawyers for brittany norwood asked the judge to prohibit prosecutors from using the graphic images in its opening statement to the jury. because the pictures, they argued, would be more prejudicial than probative. lewis simmons has been practicing criminal law for 35 years. >> the prosecutors will say that these pictures corroborate the idea that this was premeditation and they also may argue that it shows a certain motivation with regard to bad feelings or depending upon how savidge the wounds look. >> reporter: jayna murray came to court to watch the proceedings. >> it was a horrible thing what happened and as much as i'm very sad and angry and emotional about it, i've been praying and been thinking that something good will happen. >> now, i'm told that jayna

murray's family is driving here from their home in texas to attend this trial. that's the latest from montgomery county, back to you in the studio. >> chris, thank you. two men have been arrested for murdering a metro bus rider in southeast d.c. 22-year-old demetrius thompson was shot and killed along alabama avenue last week as he was riding on that bus. today, police arrested 21-year-old vincent gray and a man named delron achenson who was 22 years old. they found them in orlando, florida. both men extradited back to d.c. to face the charges. sources tell news 4 somebody identified those suspects in surveillance video that police posted online. attorneys for a former university of alabama lacrosse player accused of murdering his ex-girlfriend. accused of entering yardly love's apartment and slamming her nhead into the wall. she died of trauma to the head

but his attorneys claim she died from an irregular heart beat. his trial will begin in february. may be putting up crime cameras in parts of prince george's county. some people think it may actually hurt some of the crime fighting efforts there. at a hearing in forest heights tonight, residents are weighing in on plans to install six surveillance cameras. pat collins is in the area now with more on this, pat? >> jim, controversial crime cameras. they have them, they pay for them, but will they put them up? welcome to forest heights. population 3,000. one stoplight. five cops. but soon, if the mayor gets her way, six crime cameras.

so, police can track bad guys who come to the town looking for trouble. >> we can hawntmonitor who is g in and out of our town, not the people who are here just visiting, but the people who are here to commit crimes. >> reporter: by the way, did i say how forest heights paid for those crime cameras? with the money they got from their speed cameras. they have three of those, too. now, this is not without controversy. andrea mchutchen is a former mayor. she actually bought the cameras, but she doesn't want them now because she says it will discourage the police from, policing. you think the cameras would encourage officers not to patrol? >> exactly. exactly. encourage them not to get out on the street and hit the streets and patrol. >> reporter: a third opinion now from another former mayor, larry stoner. he says the crime cameras are okay in the business section, but not in the residential areas.

he says it's too much like big brother. >> to put them inside on a normal, residential street, no. it won't make sense. and a lot of people are not going to be for something like that. they don't want you peering through their windows. >> reporter: whether or not to put up these crime cameras that the town has already bought. the people here vote against having the crime cameras, what are you going to do with those crime cameras? >> i guess we'll have a garage sale. >> the crime camera hearing tonight, they'll vote early next month. jim, back to you. >> pat collins, thank you, pat. prince george's county has raked in more than $500,000 in speeding tickets in the past few yeeks. the county issued more than 13,000 citations since putting up the cameras just last month. there were 14 of them. most of them are near school zones. violations, that is carry a $40

fine. prince george's county expects to have 24 speed cameras in place by the end of the year. military veterans in the district got a chance to meet with perspective employers today. the city, along with a number of private companies held a job fair for those who have served. there are nearly 40,000 veterans in d.c. and a large portion of them are unemployed. >> i have been on the service, i did six years and went five ranks. i figured when i got out, it's just a matter of finding a job and climbing the ladder, but it wasn't that easy. >> perspective employers were required to have current job openings that needed to be filled immediately. coming up, the death toll still rising after that earthquake in turkey, but amid all the destruction, an incredible story of survival. the former chief of the international monetary fund puts his georgetown house on the market. i'm julie carey in fairfax county where we have the scoop on the poop scoop case.

an aerial view and a place at the epicenter of the earthquake in turkey offers a glimpse of the challenges facing rescuers there. more than 80 high rise buildings were among the 2,000 structures that collapsed when the earthquake hit on sunday. rescue workers are now into their third night of looking for survivors, but time is running out. more than 500 aftershocks have rattled the survivors there, especially strong one today measured in at 5.7. but amid all the grim news, a moment of real celebration today. they found a 2-week-old baby girl, pulled her from the rubble of an apartment building.

>> search and rescue teams continue to work around the clock. working in the very somewhat where a miraculous recovery took place early today. a little baby, two weeks old, a little baby named ezra pulled from beneath inthe wreckage here. a short time later her mom was pulled out and then her grandmother. three generations giving hope to others that their loved ones may still be alive. hundreds are still missing and thousands displaced from their home. complaints tonight that there aren't enough supplies or blankets or food. aid workers say they're bring working to bring in more of those supplies and tents. >> sheltering, it is very important. >> reporter: the focus now is trying to reach as many as people as they can that can still be alive beneath the

rubble now heading into a third night with freezing temperatures. meantime, family members are also waiti ising for word about their loved ones. in turkey, michelle franzen. the former libyan dictator moammar gadhafi is now buried. his body was removed from their warehouse freezer and taken to a grave site in a desert. a modest islamic ceremony at the grave site. only a few people were allowed to attend. authorities will not reveal the location of the grave because they don't want it to be vandalized or turn into a shrine. one of gadhafi's sons and a former defense minister was also handed over for burial. the former dictator was killed last thursday in his hometown of sirte. dominique strauss-kahn and his wife are selling their wife in georgetown. they bought that home for $4 million back in 2007. the same year that strauss-kahn was named managing director of the international monetary fund.

the property is now on the market for 5.2 mill. the house has three bedrooms, 4 1/2 baths and a backyard swimming pool. strauss-kahn was considered a strong contender for the french presidency until he was accused of sexually assaulting a hotel worker in new york city. those charges were dropped back in august, but they ended his imf career and his immediate political prospects. chuck's here with a look at our forecast. kind of got very unseasonably warm out there this afternoon. >> wasn't it nice, though. normally people are quick to come to the weather department and say, this isn't what i thought it was going to be. everybody came by and said you deliver on a day full of sunshine in october. let's hope we can keep it going for at least one more day befor a little taste of november-like weather comes back into the picture by the weekend. by saturday and sunday, you'll be wishing for days like today. beautiful day out there today.

almost 100% sunshine. the sun is just now going down. officially it goes down at 6:18 this evening. current time about 6:17. so, just the last few rays of sunshine there on the west side of the capital building. beautiful evening for anything you want to get done. 66 degrees. so, very mild out there for now. a light breeze out of the southwest at five miles per hour. little breezy around lunchtime and early afternoon, those breezes are now settling down and those winds will come back around to the south overnight tonight. but it's mild out there. 57 and 66 as you get into capital heights and 61 degrees and 61 degrees out towards leesburg and even out towards the blue ridge, temperatures are still comfortable. 61 down in st. mary's county. radar, nothing to worry about for your evening plans. if you're going out on the high heel drag race on 17th street. crowds usually 12 deep on both sides of the sidewalk.

nothing to worry about. we had some pretty soggy ones. the nearest rain drops to us near cleveland, ohio, many more dry hours coming our way. 62 degrees at 7:00 and generally clear skies for the rest of this evening. clouds will gradually start to increase a little bit overnight tonight as you see the leading edge of the clouds moving into western maryland and clouds sneaking in here first thing tomorrow morning and by afternoon, skies go over to mostly cloudy. high pressure giving way and mostly clear for most of the overnight and wake-up temperatures in the 40s and then clouds on the increase and far western maryland, but even with the clouds, stay on the mild side. back up near 70 degrees again tomorrow, but rain chances increasing as we get towards about this time tomorrow and especially after midnight. little ripple of low pressure coming our way promises scattered showers off and on throughout much of the day on thursday. fall color, near peak now across

skyli skyline drive to shenandoah valley and much of southern pennsylvania, as well. good color now, especially just outside the northwest sides of washington. take it down into southern maryland and still moderate to high color out there. only a couple more days before the leaves really start to change around here and, eventually, the rain chances tomorrow and a breezy day on friday may start to take down a lot of the color, especially up across the higher terrain. so, for this evening, clear skies. on the mild side. the breezes are laying down and that's good news. evening temperatures dropping back into the mid-50s by 11:00. tomorrow start off temperatures in the 40s and sun's up at 7:28 tomorrow and down at 6:15 tomorrow evening after a day we see a little sunshine in the morning and skies going over to mostly cloudy, but at least mild one more day with tomorrow's high up near 71 degrees. 63 with off and on showery weather for thursday and turning breezy and much cooler as we go through thursday and friday on into the weekend, saturday looks down right chilly with a chance of scattered showers around and

marginal candidate for mayor in the last election will face the judge today and pleaded not guilty to traffic charges. suleman brown was pulled over back in october for having a broken headlight and later arrested for not having a valid driver's license. brown claims his license is valid. he wants a trial. he's back in court on november 13th. these traffic charges came as federal authorities are looking into brown's connection with a hiring scandal involving mayor gray. testimony in the case against michael jackson's doctor stopped almost as quickly as it started today when a defense witness became ill and asked for a few minutes to compose herself. stephanie stanton has the latest with all this from los angeles. >> reporter: for the first time

in weeks, janet jackson was back in court after canceling several tour dates in australia to join her family as the defense presents its case. >> i am feeling really, really dizzy. >> reporter: testimony was delayed when cheryln lee told the judge she didn't feel well. >> i'm sorry, my vision became a little blurred. if you can just give me a minute. >> reporter: after a 30-minute break lee testified about how she treated jackson with nutritional supplements to help him sleep, but he begged for propofol. >> he said, i'm telling you, the only thing that will help me to sleep right away is the dipravan. can you help find someone to help me sleep. >> reporter: a prothetic warning she gave jackson two months before he died. >> you indicated to michael jackson, i understand you want a good night's sleep, you want to be "knocked out," but what if you don't wake up, correct?

>> yes. >> reporter: lee says she refused to give propofol and so did defense witness dr. alan metzger a long-time friend of jackson who treated him for 15 years. >> did you ever give michael jackson propofol? >> never. >> reporter: experts say the defense is trying to show jackson had a serious problem with prescription drugs. >> what the defense is doing is trying to make michael jackson appear to be an addict and through that they're making conrad murray look like the victim. >> reporter: but some experts say the defense strategy could backfire as dr. murray appears to be the only physician to administer jackson's request for propofol. the judge has blocked the defense from any questioning about jackson's $40 million contract with aeg live saying it might be too confusing for the jurors. in downtown los angeles, stephanie stanton. >> dr. conrad murray faces up to four years in prissen and the loss of his medical license if he's convicted. he has pleaded not guilty. andy rooney long-time cbs

correspondent is in a hospital tonight. his condition is described as serious, but stable. according to the network, rooney had surgery last week for what was described as a minor condition. but he suffered complications and his condition has taken a turn for the worse. he is 92 years old now and retired as a regular commentator on "60 minutes" earlier this month. that ended a 23-year run on that program. coming up on news 4, a maryland college is forced to move hundreds of students out of their dorms and into concerns for their health. a local dog walker on trial today. the charge was not cleaning up after baxter. that's baxter. a neighborhood dispute that's playing out in a northern virginia courtroom. plus, an explanation now for people who have been seeing the strange red lights in the sky. coming up in sports, peculiar pitching problems plague the world series. and we have the latest on a

what seems like a simple dispute between neighbors wound up going all the way to trial today in fairfax county.

>> two women, sisters, in fact, took their neighbor to court for not cleaning up after the dog she walks. and they went through some pretty elaborate measures to argue their case. julie carey has our report. >> reporter: exhibit a, baxter, exhibit b, baxter's poop. the defend, baxter's dog walker. her accusers, the next door neighbors. the cornell sisters, virginia and christine. in april they went to file a complaint that kim failed to pick up baxter's poop but kim and her lawyers say it wasn't about it at all. they said the sisters had an ax to grind. >> wasn't really about picking up after baxter or not picking up after him, it was, you know, just another charge against me, another, you know, call the police on me to try to cause harm to me and my family. it really, it was a waste of the court system's time. >> reporter: the cornell sisters came to court with photos taken

of kim and baxter and what they claimed was baxter's unscooped poop taken at the penderbrook apartment complex where they all live. some came from a camera they have mounted in their third floor window to keep an eye on the ground below. they said kim didn't scoop baxter's pop on purpose to make them angry. not the first time they accused her of misdeeds. in 2009, kim was acquitted of charges after they claim she tried to run them downpen on the stand today, kim answered the latest charge of failure to scoop. she says she always picked up. >> absolutely, i picked it up. absolutely, i think it's a wonderful law. >> reporter: baxter's owner was a key witness testifying the poop in the sister's photos couldn't possibly belong to her tiny dog, who produces, well, equally tiny poop. >> looks like a horse's poop. no way that came out of my dog. just very straight forward to me. >> reporter: it took the jury just about ten minutes to reach a verdict, not guilty. they, too, thought the sisters

had a vendetta. >> i'm feeling really good. i'm very happy. i'm hoping that maybe now another not guilty, you know, will be the end of it and they'll realize that they can't continue doing this. >> reporter: in fairfax county, julie carey. >> the cornell sisters, the accusers in this case didn't want to talk to reporters after the verdict. police in fairfax county are looking for a man who held up a bank this morning while wearing a halloween mask. it happened at the main street bank in mcclain in the 6800 block of old dominion drive. the suspect walked into the bank just after 10:00 this morning. he implied he had a gun and disclosed an amount of cash from a teller and nobody was hurt in the robbery. lawmakers in montgomery county introduced legislation today that could be a counterproposal to teen curfew plan that has been pretty controversial. the bill targets people who "loiter or prowl on county property regardless of their

age." three council members introduced that bill today. a public hearing to talk about the plan next month, that's when the council could take up the curfew bill which would make it illegal for anyone under the age of 18 to be out late at night. nearly 900 people have now joined the search for a boy who suffers autism. he's missing in hanover, virginia. volunteers lined up this morning at kings dominion for training on how to help look for 9-year-old robby wood jr. tara morgan has our reportrapher after a third, unsuccessful day scouring the rough terrain, dav david hines said search teams would press forward until they find what they are looking for. a little boy who can't verbally communicate and no awareness of his own personal safety. >> there is some speculation that yelling and screaming by a stranger may not be effective at all. may be a deterrent. >> reporter: this is for first

day for troy. in a straight line along vermin road, not far from the entrance of the balt field park him and 50 other professionals stepped off the pavement and on towards a field leading towards the woods. he put his emotions aside and focused on the task of finding robby. >> i'm a coach of little kids. you know, i coached all my life and to know there's a 9-year-old little boy out here is kind of hard for me. >> reporter: robby vanished sunday while on a family outing in the park. bloodhounds tracked his scent there. >> that was tara morgan reporting. that search has now been expanded to cover 2,000 acres. those volunteers will be called to meet at kings dominion at 9:00 tomorrow morning, if they don't find him tonight. a food panttry in prince william county has reopened thanks to an influx of food and cash donations. the services food bank known as

ax was forced to close. ey had seen an increase in demand and a decrease in donations. but once word got out about the trouble, the donations came in. many of the donations are coming from people who have never given to this pantry before. a bethesda man is preparing to race in sunday's marine corps marathon. tom pitsenburger fell from a tree while cutting branches. he suffered a traumatic spinal cord injury that left him without the use of his legs. today was one of his final training session using a specially made hand cycle. he decided to use the marathon as part of his therapy. >> i had always been a runner and i had considered doing the marine marathon and was training for it, kind of acclimating myself before the accident and, so, that was my, well, i could use this bike to do the marathon.

people all over the country reported seeing some weird lights in the sky last night. doug told us and nailed it right away. it was the aurora borealis. that is usually seen at higher latitudes, which means places way farther north than this. but recently seen as far south as tennessee and georgia. experts predict we'll see the light show for several nights to come now. so, for a closer look at this phenomenon. let's hear from chuck bell up in the weather center. this is strange, isn't it? >> very unusual for us to get to see them at our latitude. as you mentioned in the story there. a lot of times you have to go further north, into canada. we're at 39 degrees here in washington. the further north you go, the better your chances are. what causes it is what we call a coronal gas erosion. it sends out a whole lot of

energy, sometimes these explosions on the surface of the sun send out as much as 1 billion tons of matter away from the sun and sometimes several hundred thousand mile per hour. the particles we're looking at here, the bright green colors and the red colors, that's atomic oxygen being excited by the energy arriving at the top of the atmosphere, the darker colors of reds and blues and the purples there, that's what happens when you get energized nitrogen molecules. the reason for the different colors there. we only really get to see the brighter greens here from the oxygen because we're just not high enough up in latitude. charged particles reaching from the sun usually takes about two days after the explosion on the sun before we start to see the colors here. might be able to see them out there flis evening because we still have a clear sky out there, not a guarantee, though. unfortunately, the clouds come back tomorrow and that is the end of our chances. right now temperatures are dropping back down into the mid-50s to low 60s. a nice day tomorrow. becoming mostly cloudy, still quite mild, though, with highs

while. >> you heard that on the road, too. first catch of the game. >> no practs for the redskins and cooley and tim hightower done. the redskins decided to shut him down. he wasn't returning anyway until week 12 or 13 after breaking his hand against the eagles. yeah, it was a big hit. putting him on ir wasn't a huge surprise, but you have to wonder if his career with the redskins is over. during his first five years in washington, he played in all 80 games. the last three seasons, he's only played in 23 and next season he turns 30. with the emergence of fred davis and cooley's high salary and cap number, his future with the team is certainly in question, but these guys are prepared to move on this season without their injured stars. >> i mean, it's part of the nfl.

st. mary's college of maryland is making plans to move students on to a cruise ship after the college forced students to move. about 200 students put up in hotels on solomon's island while the cleanup is under way. the college will soon move a sea voyager cruise liner into the nearby st. mary's river and house the students there temporarily since it's closer to campus than the hotels.

two new studies out that raise questions about how effective the flu shot is for any number of people. concern that patients who are obese or over the age of 65 may not be as protected by the vacci vaccine. erica edwards has our report. >> reporter: the sights and sounds of flu season have arrived. many people are protecting themselves from getting sick by rolling up their sleeves for a flu shot. but they may be surprised by new research that shows in healthy adults the flu shot works only about 60% of the time. >> that's surely a lot better than zero, but not where we need it to be in the 90 plus percent range. >> reporter: he led a review of research on the efficacy of the flu vacvaccine. he said evidence of strong protection was lacking most for the elderly. occur in age 65. the bottom line messages we knew

better vaccines and fast. >> reporter: the centers for disease control recommends the vac even for everyone over age 6 months but even the director of the cdc says his study results are consistent with what she's seen. >> i think the biggest problem is how variable influenza is. it's not one disease. we get new viruses year by year and the viruses could change throughout the year. >> reporter: another new study, this one from the university of north carolina find the flu shot may not be as potent in obese adults over the course of the flu season. >> although the obese and overweight could make a nice anti-body response initially, that response waned. >> reporter: no evidence that a second booster shot might help, but most public health experts might agree one shot is the best shot we have to stay healthy this winter. >> flu vaccines are not perfect and they don't work on every strain but the best way to protect you and your family from the flu.

>>? deed. >> no matter how cold it is. we want to tell you about joel who lives up in a small town in maine. bought himself a used 1990 honda accord back in 1996. when he bought it, it had 76,000 miles on it. he and that car have just passed the 1 million mile mark together. it is the first time that we know about that an accord has hit a million miles. the company, of course, saw an opportunity in that. they threw a surprise party for joe or for mr. la cicero. there was a parade, marching bands, a huge odometer. that's right, the works. a beauty queen. a big one even came by to hand cicero the keys to a 2012 honda accord. it is a gift from honda. he says he will miss, that's the best part right there.
