good morning, everybody. welcome to "news4 midday." i am barbara harrison. it's wednesday, november 9th, 2011. we begin with the breaking news, paterno has announced he will retire at the end of the season. his 45 year run as coach as the school has been appended by the sex scandal. paterno just released a statement that reads in part, this is a tragedy, and it's one of the great sorrows of my life. in the benefit of hindsight i wish i would have done more.

my goals are to keep my commitments to players and staff and finish the season with dignity and determination. we will have more about what the school is saying in the next half hour. we are following breaking news in the district where the police are looking for a gunman that shot and killed a man this morning in northeast washington. the victim was found at 8:25 this morning on quarrel street northeast. it appears the man may have been in an apartment building at the time but they are not sure. anybody with information about the shooting are asked to come forward. a uniformed secret service officer accidentally discharged his gun in the 2600 block of ton law road northwest this morning. the gun went off in the officer's car shattering a window but nobody was hurt. right now, one of the two protests are about to begin on the campus of george may sun

university. gun rights activist are gathering, and later students will join together for what they are calling a general assembly where the community can raise concerns about the university. megan mcgrath joins us with more on the protests. what can you tell us? >> reporter: we are expecting them to arrive on campus in half an hour or so and we are expecting two other student groups to participate in this gun rights rally. the students for concealed carry on campus as well as mason liberty. now, if you take a look behind me, you can see all is quite normal here. we are seeing students walking around and going to class. we are seeing the campus police here standing by and waiting for the protest to begin here but

they say they are not expecting any trouble. this is about the gun policy that applies to students, however that policy is a bit different for people visiting the campus. legally registered gun owners can bring their weapons here on campus as long as they are out in the common areas, however they cannot bring those weapons inside any of the campus buildings or to any campus events. we are expecting members or at least some of the members of the virginia citizens defense league to be armed at the rally. it's being billed as the no guns no funds protest. they are asking alumni and others to stop donating money to the university until the gun policy is changed. we spoke to a spokesperson, and he said the university does not plan to change their gun policy. >> we too wants a safe campus. the question is, what is the best way to do that, by allowing everybody to have a weapon on

campus or not, and we feel the answer is not. if they want that regulation to be changed, they have to have the general assembly in rich mupd to do that. we have no plans to change regulations. >> reporter: this protest is expected to get under way in about half an hour. there's another event taking place later this afternoon also on campus. the george may sun general assembly is going to be holding a forum in the general area here, and just kau wince dent they are happening on the same day. two events happening here on campus, but talking to police and university officials, they are expecting everything to go smooth smoothly with no problems, and they expect everybody to get

along here. >> thank you for that report. republicans in virginia are celebrating the rare feat. right now, all eyes are on district 17, the state's senate race which is the fredericksburg area. reeves has an unofficial lead over the incumbent. but since it's too close to call there could be a recount. if the vote holds, the gop would have control since bill bowling, the governor, will have the tie-breaking vote. this is a good preview of next year's presidential race. >> i would say the republicans did very well. big news here out of virginia, and next year when we have a chance to hire a new president of the united states, i think these elections will give us a lot of momentum going into the

next year. >> and republicans swept the board of supervisors in loudoun county, and gop candidate took out the four-term incumbent, simpson. today in prince georges county they will be counting the absentee ballots. only nine votes celebrate the candidates in district one. voters re-elected most other incumbent throughout prince georges county. don't forget for all the decision 2011 coverage, log on to nbc washington.com. turning to the weather now, another beautiful day out there, and we are hoping it will last. tom kierein is coming to see if it will last. >> temperatures are rapidly warming up. yes, it's another dreamy autumn day. there's a live picture from our sky watcher camera.

we have the sun pouring down, and temperatures are quickly climbing. there is a view from space over the last 12 hours. now, beginning to move through central ohio through central kentucky, that's advancing to the east. out ahead of that, we have fog. that really should dissipate quickly as the morning progresses. right now it's in the upper 50s to nearly 60 degrees throughout the much of the region tonight and we will continue to climb in the mid and upper 50s in the afternoon hours, and we will have high clouds beginning to roll in as well ahead of the front. and then we will begin to see the cloud cover thickening up by late afternoon. at that point it will be back down to near 60. a look at changes on the way after that front goes by, and that will be coming up in just a few minutes. >> barbara? >> thank you very much, tom. well, today the maryland

transportation authority is giving the media a tour of the second section of the inner county connecter. it will connect georgia avenue and i-95 and is expected to open november 22nd. the first section opened back in february. let's see how things are moving on the roads out there right now. let's talk to danella sealock. any problems? >> a couple of hiccups, but not too bad. a little bad. 395 north, just as you pass seminary road we have an accident in the right shoulder lane and the lanes are open in both directions on 395. and i-66, we're seeing some delays and those delays start outside the beltway as you make your way inside the beltway on i-66, and as you passover the beltway delays just continue as you make your way towards sycamore street. once you get to sycamore street

you are clear as you continue your commute into the city. and i-270, you are clear. here is a view of falls road. from i-270 to the beltway, you are at 55 miles per hour. not bad. >> yeah, looks like it's breezy. the camera is shaking around. >> i know. >> we will see you shortly. today the federal government will conduct the first nationwide test of the national emergency alert system. at 2:00 this afternoon, it will take over all tv and radio stations in the country for about 30 seconds. you will be advised that it's just a test. federal officials chose to do the test today because it's near the end of the hurricane season but before the start of winter. he nearly lost his life in a horrific house fire seven months ago today. you may remember the story. today one man's road to recovery

begins with a return to work. he is at his first day back on the job. >> reporter: chuck ryan is the definition of a career firefighter. he entered his first firehouse at 16 and moved in while still in high school. 30 years later he is back on the job today after a serious injury that almost took everything away. we were there when he answered his first call. >> it's chuck's ryans first call in 212 days. he says he is ready for what the day may bring. >> reporter: how do you think you are going to feel as moments present? >> no different. just, you know, you thought of it before, and just sometimes, you know, people get injured. you don't want to, but i am just thankful that i am able to come back to work, that my injuries

were not career ending. >> reporter: his injuries covered 40% of his body and he had second and third-degree burns that caused him to lose some fingers. the fire started last april and he was one of five firefighters injured when they ran into the burning home to see if anybody was trapped. ryan's burns were the most expensive. after 49 days in the hospital and a number of surgeries and months of therapy, he is back to work today. >> reporter: how are you feeling? >> great. i do. hopefully this will be the next part, and we need to move on past the injury, so i want to move forward. >> a man plead guilty to starting fires in d.c. during a three-year period, including the fire that injured ryan.

ryan says his focus is not on his future, but thinking of other strangers he has yet to meet and save. >> i am glad he was caught and we don't have to worry about hurting anybody else. but it doesn't personally affect me. like i said, i can't think about it and keep looking forward to tomorrow and not what happened yesterday. >> reporter: ryan says he still has some physical therapy that the doctors want him to do, but he is feeling and looking just fine. in southeast, i am tracee wilki wilkins, news4. coming up, herman cain has to answer more questions as he faces other republican candidates for after a growing

scandal. new today. president obama will sign a new executive order ten minutes from now. it will cut waste and promotor efficient spending. they will reduce spending on travel and electronic devices such as smart phones and he is also putting an end to the cups and caps and t-shirts the agencies give out to promote themselves. the economy is going to be the headline in decision 2012

tonight with the eight leading candidates in the republican presidential race are getting ready for a debate in michigan. it will be in oakland, just outside of detroit. it comes 60 days before the iowa caucuses. a lawyer for one of the women accusing herman cain for sexual harassment wants to know to address the claims. she says cane groped her 14 years ago when he tried to help her find a job. her attorney wants the senate to subpoena cain and all four women for a public hearing. another woman said she got a five-figure settlement in 1999. she filed a complaint against cain. now, they want to go public. >> she feels that she has to get

the facts out there to justify her position. >> today the associated press is reporting she filed a second complaint against a second man in 2003. she accused her manager of generating a sexually charged e-mail. let's look at the forecast. it's good news out there. what is happening with the weather, tom? >> it's like a dream. here we are in november, and we were in the 60s each afternoon the last couple days, and today we will do that, one more day and then reality sets back in. it's november and it will act like that during the day tomorrow. and right now let us relish what we have. and there's the live picture from the city camera. the foliage looking beautiful along the potomac river. a plane coming in for landing at reagan national.

it's 57 degrees with bright sun. we have a light breeze bringing in the balmy weather for november. there is the view from space, and we have had a few high clouds drifting in the west, and we also have a bit of fog lingering in southern maryland, northern neck, and up towards st. michaels, and that area of fog should be dissipating over the next hour or so. and elsewhere, lots of sunshine showing up. further to the west, though, we do have some of the showers now into eastern kentucky, and central ohio. this is along the front. it will be drifting our way bringing in the clouds and the threat of rain here by later tonight, and during the day tomorrow. but right now, it's mild. it's climbing to around 60 throughout much of the region. they have the fog, and easton and cambridge, and it's in the low 50s there, and annapolis has fog around 50 degrees. get away from the fog and it's a

much warmer temperature, and out of the mountains, some locations are climbing into the 60s out of western west virginia, but closer to washington it's cooler in the eastern part of the state. as we go forward here over the next 48 hours, that's tonight, these areas of green, we could have a few sprinkles, otherwise low clouds move in. during the day on thursday in the morning, this area of green is the zone of potential rain and that move in mid to late morning and perhaps early afternoon, and at the same time off to the west out in the mountains, they could have snow showers out in western maryland and west virginia. colder air moves through. the rest of the day on thursday and friday, it will clear up. and out in the mountains, they could have continuing snow showers, and those may pileup a few pinches of snow into western maryland and west virginia. we will have plenty of sunshine on the day in friday but much colder. here is how things are looking for the rest of this wednesday. enjoy the dreamy afternoon. temperatures hitting the mid and

upper 60s by midafternoon, and we will have high clouds beginning to move in from the west, but still quite a bit of sunshine. after sunset, which is today at 5:00, it will turn cooler as the clouds do come in, and it will cool down to around 60 by early evening, and then by midnight it will be in the low 50s. by dawn tomorrow, we should bottom out in the low 40s. occasional showers, and highs reaching the 50s and clearing up thursday night and turning colder, around 30 degrees friday morning. friday afternoon highs only around 50. a huge change from today. saturday, bright and sunny, and great weather for the maryland and notre dame going on. great football weather for high school and college games. and then next we can getting mild for the first couple days. >> sunny days for the weekend. sounds good.

we'll tell you when. right now, gun rights activist are gathering on the campus of george mason university. some of the protesters are carrying registered guns and signs that say gun saves lives. they want to overturn a policy that makes it difficult for gun owners to carry on campus. the school says they have no plans to change their policy. right now legendary joe paterno is announcing his retirement. news of the decision came this morning in the wake of a child abuse probe involving one of his long-time assistant coaches. and nbc's ron allen has more

from the campus. >> reporter: late tuesday, as the clock tower struck an ominous tune, coach paterno supporters gathered as the governing board met. the board issued a statement saying it was outraged by the horrifying details of the grand jury report. promising swift and decisive action. earlier, as paterno returned home from football practice, hundreds of students were there to rally behind their beloved coach. >> thank god for every single one of you. >> he's not just a football coach, he is like a father to us and a symbol of our pride. >> paterno seems to enjoy the add add ration and spoke directly to the students. he did not answer questions and asked for prayers for the victims. >> stay prayers for them. it's a tough life when people do certain things for you.

his family says he wanted to tell his side of the story at the press conference on tuesday. but the universities officials cancelled the event. prosecutors said paterno is not a target of the continuing investigation into his former assistant, jerry sandusky. sandusky and the two school administrators insist they are instant, while some who covered paterno for years said he could have and should have done more. >> the answer is he comes up short on the moral question and that's a huge deal in something like this. >> the mother of a now 24-year-old victim is lashing out the penn state administrators telling a local newspaper to see how we were

portrayed, words cannot tell you. >> that was ron allen reporting. a ninth young man also claims he was sexually abused as a football facility at penn state ten years ago, and coach paterno will announce later today he will retire after the current football season. in a written statement that he put out today, he said with the benefit of hindsight, i wish i had done more. after a six-week trial, curry has been acquitted of corruption charges. he was acquitted of nine charges relating to $245,000 in payments he received from the shopper's food warehouse chain. the senator says he is now speaking out about his trial. >> it has been a rough four years, almost four years, for my wife, my family and i and also

bright sun and the blue sky. temperatures around the region are giping to climb now and it's still cool with some stubborn fog that lingers in parts of charles, calvert, st. mary's and the eastern shore still has fog lingering, but that should be gone in the next hour or so. and clouding up later today, but before then in the later 60s throughout much of the region, and then cloudy and cooler tomorrow, we will have a cool front coming through with a blustery northwest wind, and we will fall in the 50s to down near freezing by dawn on friday. there's a chance of passing light showers tomorrow as the front does come through, but the big story cooler and a blustery wind that will be in place on friday, and it will be a cold day, and even with the sun they will not get up but the 50s for highs. and then it looks like we will warm up monday and tuesday, back in the 60s. that's the way it looks right now, barbara. >> tom, thank you. we'll check again on the

morning. can the wrong diet affect your this christmas, putting up a real tree in your living room could cost you a few cents more. growers requested the tax to help a promotion they are planning to do. they are losing business because so many people now have fake trees in the homes. it's up to tree sellers if they want to pass the tax along to the buyers. stocks are falling sharply in early trading today. we will get more on that and the rest of the day's business headlines.

>> hello, barbara. the markets are sharply lower, although they have recovered off of the some of the lowest levels we saw earlier this morning. the dow down 220 points, and this is the drama in italy and it continues to unfold. the investors are losing faith in the country's ability to repay debt. another recall for toyota. the japanese automaker is calling back 550,000 vehicles. the reason? a problem with the crankshaft which could trigger a steering problem. your tax-free shopping days on the internet may be numbered. a group of senators are introducing legislation that would force-out of state retailers to collect taxes. >> thank you, julia.

thank you so much. have a great day. well, it's common knowledge that a healthy diet can lead to good physical health, but could it improve your mental health? joining us is dr. winer. >> good to be back. missed you over the last couple weeks. >> yeah, you have been gone a while. glad you are back. i was just saying my mother used to make us eat spinach and bruslee sprouts for brain food. >> exactly. there were some studies that looked at the discussion. one was done in australia, and looked at a couple thousand kids. they analyzed whether they were good eaters, and it was somebody that would eat four serving of vegetable and two of fruit a day, and compared that to children that were not good

eaters with processed foods and refined sue gurz, and those with a better diet had better mental health and fewer bouts of depression, and so they were able to do some statistical analysis to show it was the diet that was the main factor contributing to the changes in mood. and one other quick study was one that looked at a number of women and found that women that ate a mediterranean-style diet, one rich in fish and whole foods and olive oil and things like that compared to a western diet, which is higher in fatty acids, and they were more likely to develop depression in the west. pretty significant. >> spell it out for us. what should we be eating to

improve the mental health? >> food rich in owe mega-3 fatty as sids. dha, epa, and laa. >> those are supplements? >> you can take them in the form of supplements. 1,000 milligrams a day of epa. it's better if you can to eat the food that contains the omega-3 fatty acids, and then eat fish and nuts. diets rich in these have been shown to help with mental health. >> that's what we should go for? >> yes, it's amazing. >> and of course, the green leafy vegetables? >> yes. and if you look at the research,

it's helpful for your heart and try fifties ride levels. and people who are on blood-thinning medications or people with a bleeding disorder should be careful with these vitamins, otherwise everybody should be taking these. >> so it's okay to give supplements to the children. >> i give supplements to my kids in a liquid form every night, when i can remember. >> is that cod liver oil? >> yeah, cod liver oil is actually one of the studies that was looked at. it's rich in omega-3 fatty acids. >> i think it's a contributor to be a rise in the mental health of the country is diet. >> it helps to reinforce the things i learned as a child. and next wednesday, the doctor will answer your questions and
