chillham, maryland that happened back in march. he was arrested in las vegas and extradited to prince georges county. he was supposed to be held without bond but authorities say a clerical error at the courthouse brought about his release. he's turned himself in today and is being held on a half million bond. >> the man from gaithersburg suspected in the district attorney of his travel companion in aruba is set to walk free from jail in just a few hours. but the investigation is far from over. >> reporter: gary giordano is expected to board a plane tomorrow morning at 9:50 a.m., a flight from aruba to new york city. the question remains if and when he will return to maryland. the prospect of gary giordano being released from custody in aruba after four months and being allowed to return it his home in gaithersburg leaves

robyn gardner's friends that justice may never be served. >> it makes it touch because he gets to come home and robyn doesn't and where's or friend? >> reporter: lee ann had just gotten off the phone with robyn gardner's cousin when we spoke with her. >> it's brutal to think that she might be lost forever butch it's just -- it's harder on them and us just to not have any answers, to not have any closure and gary has to know some answers. he has to know something. >> reporter: robyn gardner's family issued a statement about giordano's release. "as we deal with our grief privately, we are honored by the strength that robyn's friends have shown by speaking out on her behalf publicly. perhaps the public attention this has generated will result in someone stepping forward with information that will help find her. in the meantime we hope everyone will continue to keep robb nn their prayers." this maryland lawyer is an authority on the law in aruba.

areas into the upper 40s, a little bit of a cool breeze. it is damp outside. a big change out there. it's 52. not too bad right now because most of the rain is now out of the region, at least for now. can you see the rain well off to the east towards the eastern shore but there are a few more showers associated with the upper low that will try to pin wheel their way in here throughout the next couple of hours. a few showers from washington off to the west overnight tonight but that's going to be about it. your good night wake-up forecast showing temperatures falling down to about 42 degrees by the time you wake up and step out the door tomorrow morning. a much chillier start to your wednesday than we had on our tuesday. what's the rest of the week looking like? i'll show you in my full forecast in just a minute. >> in syracuse police are beefing up how they handle sex abuse allegations in the wake of this month's scandal at the university. officers will now formally document all reports of sexual abuse.

that chang comes days after a former assistant basketball coach is accused of abusing boys more than 20 years ago. reports of bernie fine's crimes surfaced if 2002. it's taken nine years to launch a formal investigation. fine, who has been fired, denies the allegations. basketball coach jim bay heim is also battling calls to step down. >> police are looking for a driver who killed a 72-year-old man. it was a hit and run. it happened yesterday on the parkway near powder mill road in beltsville. officials believe the suspects may have been drag racing at the time. darcy? >> reporter: police are continuing to look for the two vehicles that were involved in a street race that led to this fatal hit and run. one was a mercedes-benz, a dark color that now has front edge damage. the other is a silver lexus.

i talked to friends and relatives of the victim today. they're hoping the person sfon turns himself in. >> i'm really going to miss him. he was a real good friends of mine. >> reporter: this is the man friends affectionately cause poteat. he was 72 years old and although retired from the post office, he stayed busy stocking shelves at area food stores. he was heading to work around 2:30 monday morning on the baltimore washington parkway while highs car was struck from behind while he was driving. he died from his injuries. the driver didn't stop. police believe a striking car, a mercedes, may have been streak racing. >> park detectives would like to hear from anybody who may have witnessed this crash. >> reporter: it happened in the northbound lanes of 29 south of the powder mill road exit in beltsville. police say poteat was driving a

chevy equinox. he was struck at a high rate of speed. >> apparently the collision was so hard that he was pushed into the median strip. we believe the vehicle may have rolled and it was found on its side. it was a pretty hard collision. >> reporter: his son tells news 4 the family hopes police catch the driver. he said if you're going to have an accident, just stay at the scene. it's not right, especially when you kill someone. poteat was a loving husband, father, grandfather and friend to many. they say he played golf at langston golf course in d.c. every day. >> louis poteat, i've known him about 20 years. >> reporter: what kind of guy was he? >> very, very nice guy, one of the best guys you ever want to meet. very friendly, very kind, real hard worker. >> reporter: anyone who may have witnessed this incident early yesterday morning or knows where these vehicles are located, you're asked to call us park police. reporting live from laurel, darcy spencer. jim, back to you. >> the family of a florida man

killed in the anthrax attacks has settled a multi-million dollar lawsuit with the federal government. 63-year-old robert steph convenience died in 2001 when a letter containing deadly anthrax supports arrived at the office building where he worked as a tabloid editor. he was the first victim. the fbi learned those supports came from a lab in fort detrick. a lawsuit claims the government did not do enough to keep the anthrax safe. the government has agreed to pay the family $2.5 million to settle the suit. >> coming up in the broadcast tonight, a mob of protesters storm the british embassy in iran today. >> a judge throws the book at michael jackson's doctor. what the singer's family is saying about the sentence. >>and a twice who having three money money jers who came forward to claim a $254 million jackpot. >> and now so mobile phone apps could come with their own rating

a cycle of horrible medicine and madness, those words from a judge today as he sentenced dr. conrad murray to four years in prison for the death of michael jackson. but he may not end of serving most of that time. stephanie stanton has our report from los angeles. >> reporter: dr. conrad murray had no visible reaction as the judge gave him the maximum sentence.

>> the court has determined that the appropriate term is the high term of four years imprisonment. >> reporter: the 58-year-old cardiologist also got a stern reprimand in court when judge michael pastor spoke for about 24 minutes, laying out why he believed murray should get the max. >> he has absolutely no sense of remorse, absolutely no sense of fault and is and remains dangerous. >> reporter: during the hearing a jackson family attorney addressed the court. >> we are not here to seek revenge. there is nothing you can do today that will bring michael back. >> reporter: murray himself did not speak at he is sentencing but his attorney ed chernoff asked for leniency. >> i do wonder, though, to what extent the court considers the entirety of a man's book of life

as opposed to just one chapter. >> reporter: a plea that had no impact on the judge, who threw the book at murray. >> i think the judge was fair. i want to thank the fans for being so loyal and supporting us and i think we got a fair trial. but thanks you, fans. thank you very much. >> reporter: murray remains in a los angeles jail but it's unclear how much time he'll serve due to prison overcrowding in california. the prosecution is also asking for $100 million in restitution and $1.8 million for funeral expenses. those issues will be addressed in a separate hearing january 23rd. in downtown los angeles, stephanie stanton, nbc news. >> the british government is warning iran there will be serious consequences for an attack on two diplomatic posts

in tehran. today harrline students associated with iran's ba siege movement stormed the british embassy. they burned documents and set fires and tore dough a painting of queen elizabeth. six embassy workers were taken hosta hostage. police eventually convinced students to turn over the hostages. the violence came after britain tightened sanctions on iran because of its nuclear program. >> so we woke up this morning to the high for the day, right? >> pretty much. >> and it just went south from there. >> downhill ever since. >> the low normally takes place when you wake up, the high is in the afternoon. today it's exactly the opposite. the high was early this morning, 66 degrees and so far we've been down to 52 and we're going to continue to go down. not all that much more. it's not going to be frigid moving in but it's going to be a lot cooler than it's been the

last couple of days. still dealing with that cloudiness across the area and still a chance for a few showers later this evening but i think most of us should remain on the dry side as we make our way through the night tonight into the day tomorrow. there it, is the high temperature, 66 degrees earlier this morning. the low, 52. that's the current temperature outside. we saw about 0 .4 of rain at the airport and a 20-degree temperature drop from where we were during the day yesterday. 63 the high temperature in gaithersburg, 67 in baltimore. if i just showed you the numbers, you'd say, hey, nice day out there on your tuesday but that's not the case. these are the numbers now, fredericksburg coming in with a temperature of 50 degrees. all of that cool air associated with that area of low pressure is this is now making its way to the north and east. normally a southerly wind is a very warm wind. not today.

that is where the cold air lie, to our south. that's why we're so much cooler right now. still rain out there towards the eastern shore, towards philadelphia and down to the south and west, this is what i'm talking about. more showers trying to move in and even snow into the mountains of west virginia. but a few showers making their way mostly west of i-95 so most of us should stay on the dry side but still a few more showers to go, all of that rotating around that upper level loaf moving overhead right now. behind it we have snow up there towards portions of indiana. winter storm warningsin effect there. last night it was tennessee. they did see snow, a very early snowfall for them. the average first snow in western tennessee a late december in towards january. they did see some accumulating snow there. at least the good news is they'll be warming up, back into the 60s over the next couple of

days. winter storm warnings forward fort wayne and southern portions of virginia, that's where we have a winter weather advisory still in effect. i told you the winds are coming from the south. look at this, 38 in atlanta, 62 in new york city. new york city warmer than jacksonville, florida. a little topsy-turvy storm, cold air moving around. new york, their temperatures are going to be dropping over the next couple of hours but really an mazing storm. here comes the chilly air now. tomorrow we're on the chilly side but not a bad day tomorrow, temperatures about 1 or 2 degrees below average for this time of year. so right around where we should be. more of the same on thurs, still chilly. thursday's looking very nice. friday looking great, temperatures nice and warm

there's turbulence in the air for american airlines, the nation's third largest airline filed for chapter 11 bankruptcy protection today. american says it will cut its flight schedule but that passengers shouldn't notice any big changes. it says it will continue to operate flights, honor tickets and take reservations. the bankruptcy filing, however, is bad news for investors. american airline stock fell more than 80% today to 26 cents a share. >> if you've ever played a video game or seen a commercial for one, you've probably noticed the rating system. there's m for mature, it. for -- t for teen. now they are coming out with a rating system for mobile apps. it would also let you know if an app collects or shares your private information. the cell phone industry is backing the plan but apple,

herman cain told his senior staff today that he is reassessing his campaign. cain's deputy campaign manager said -- later said that a good

businessman looks at the entire landscape, he said, before making decisions. this news comes one day after a woman in georgia came forward and said she had a 13-year affair with cain that ended just before he entered the presidential race. cain says he and the woman were simply friends. >> in just a couple of hours, the man being held for the disappearance of a maryland woman in aruba will be free to leave jail. gary giordano has been held since robyn gardner disappeared nearly four months ago. the judge said there wasn't enough evidence to keep holding him behind bars. prosecutors say their investigation will continue. >> police are looking for the driver of a mercedes that slammed into another car on the bw parkway on monday and then kep going. 72-year-old louis poteat was killed. authorities believe the suspect was racing a third vehicle on the parkway just before the crash. >> a tragic twist in the effort to save two prince georges county women pulled from a

burning home this weekend. >> firefighters say the women have died and now their loved one is struggling to deal with the loss. pat collins reports. >> this has been so devastating. all the three deaths. my grandson, my daughter. >> reporter: merle monroe, the only survivor of a ferocious fire that swept through her home in louisdale and claimed the lives of a three of her relatives. killed by the fire, 6-year-old omai knoll, her grandson. killed by the fire 36-year-old simone monroe, merle's daughter, the mother of omari. killed by the fire 61-year-old janet maclin, merle monroe's sister.

that fire started around 3:45 sunday morning in the living room of miss monroe's home. it's here on griffin street in louisdale. the cause investigators say an overloaded power strip. they say they found no evidence of a working smoke detector. merle monroe says she managed to get out of the house. she said she tried to get back to save her family but the fire was too hot. the smoke too thick. merle monroe so upset she had to sit on the steps to recount what happened that day. >> i was able to get out. i get up and i heard a noise and a siren and i saw smoke. i got out through the kitchen door. tried to go back in to get simone. the smoke was too much. i went by her window and knocked

and wake up! >> reporter: so moved by what happened, prince georges county police and fire departments have set up a monroe family fund at the bank of america. the money will go to help pay for the funeral expenses, the money will go to help this family try to get its life back together. thursday night between 6 and 8 p.m. at the louisdale elementary school, police officers and firefighters will be collecting donations of money and household goods for the monroe family. i'm pat collins, news 4, prince georges county. >> to a wild scene this morning after a three car accident ended with a car crashing into a building. it happened at about 10:00 this morning at the intersection of wisconsin and western avenues. police say the drivers of a taxi cab, mercedes and suv collided. the taxi cab ended up on the

steps of the chevy chase pavilion mall. one person was hurt and had to be taken to the hospital. >> a loophole that let d.c. drivers escape paying for a red light or speeding camera ticket may soon go away. right now you can avoid the ticket by signing a notarized letter saying you weren't the driver, even if it was your car. now the d.c. council is considering legislation to close that loophole. the new law would make the owner of the vehicle responsible for any moving violations caught on camera. it would be similar to parking tickets that are issued against the vehicle. >> an affordable housing cop plex in northwest d.c. has prompted long lines of people looking for a home. hubbard place apartments began accepting applications at 11:00 this morning but people began lining up around that complex last night. applications are for efficiencies, one bedroom and two bedroom amounts. in this tough economy, people say they need all the help they

can get. >> i need it real bad. i sent my daughter home. we've been traveling from house to house. >> all you can do is keep your fingers crossed. hopefully we get called. it's been six months. >> reporter: all the applicants must meet dc housing authorities requirements. the applicants will also be accepted tomorrow from 11:00 in the morning until 3:00 in the afternoon. >> a driver stepped in to help a wounded dog that was wandering the streets in oxen hill. now the search is on to find that animal's owner. but the good samaritan might have made the search much tougher. >> reporter: in a shelter full of kennels, it can be easy to become just another face in the crowd. going on 11 days now, the fairfax county animal shelter is afraid that's what's happening to this little guy. >> the amount of time that we hold them while looking for an owner is over. >> reporter: he's a sheba inou, anywhere from 4 to 6 years of age.

karen calls him foxy for obvious reasons. he was roaming the streets bruised and wounded when a woman thought she was being a good samaritan. >> the untension was great, not to leave him there, get hit by a car or injured any further. >> reporter: picked him up, drove to work more than 20 miles away, kept the dog in the car for several hours and then called animal control. >> he would have had a better chance, i believe, finding his owner if he had said in his own area. >> reporter: it's tempting to put a stray dog in your back seat but are you really doing what's right? first, write down the exact location the animal was found. leave on any and all. >> g. th-- i.d. it may be weari call local police and/or animal control and don't take the animal out of the jurisdiction where you found it. he's more than cute, well trained and seems to like being

around people. all though euthanasia is not entirely out of question, she believes foxy will be placed in an adoption program by weeks end. utah, north carolina, that might seem like a long shot but believe it or not, other animals that have been brought to this shelter came from those very same places and were able to return home. so the fairfax county animal shelter says it has hope for this little guy to be reunited with its family members. >> rich to richer. three money managers claimed a $254 million lotto jackpot but they may not be the real winners after all. >> in old town, alexandria, a plan to redevelop the waterfront is pitting citizens against a

welcome back, everybody. i'm meteorologist doug kammerer. we're right here in storm center4. we're washingtoning the low clouds still hanging around. can you see them right over the capitol building. current temperature 52 degrees. a lot cooler than where we have been over the past couple of days but not all that bad, winds out of the south at about 13

miles per hour. some areas are seeing wind chills in the low 40s. it's going to be a cool evening. storm 4 doppler radar showing the rain way out towards the east and also to the west we're watching an upper level low that's spinning over southern virginia. it will try to move in a few showers into our region. can you see a couple down towards raleigh and north carolina. they'll try to come through later this evening. expect a chance for showers right on through midnight tonight before that storm system begins to exit the area. overnight tonight mostly cloudy skies, low temperatures down to about 42 in the city, 38 back to the west in leesburg and gaithersburg, cull pep ever and around 35 degrees. tomorrow waking up to a cold star. it's going to be a really chilly afternoon, high temperature around 51 in washington, 50 in leesburg. most areas to the north and west staying in the upper 40s just about all day long but we will see some sun in the afternoon so not all that bad for this time of year. coming up on thursday, we'll have our first holiday lights.

so, dan, let's hope this tough guy approach will make a difference, huh? >> you know, the caps taking on the blues tonight, vance. obviously more than just another game because for the first time in for years bruce boudreau's not here, replaced of course by the tough guy you're talking about, dale hunter. he is one of the four greatest players in washington capitals history and they're hoping that he can turn this season around for the capitals. they've been in a november funk. they've only won 3 out of their last 11 games and now dale hunter comes in as the new head coach. he commands immediate respect during practice. he was definitely one of the toughest players in the nhl during his 19-year career and just one of four former capitals to have his number hanging from the rafters. he coached in junior hockey for

the last 11 years in ontario. coaching on the same level he excelled on as a player is a whole new ball game and hunter fully expects to be a little nervous when the puck drops. >> he's up front for the giants all season with his ten and a half sacks. >> all right. moving on this is dale hunter and his head coaching debut in the nhl. he coached juniors which means he has never, ever before coached on the professional level. there are a couple of players on this team who did play for hunt are on the professional level. they do they he is going to have success on the nhl level. >> he was actually -- he's pretty calm most of the time on the bench but, you know, he's not going to -- i don't think he

runs up and down the bench screaming and yelling or anything like that. but when the times comes to lay the hammer down, i'm sure he will. i think he's a motivator, a teacher and he's a guy that when you played with him or you played for him he's a guy you respect so much and you look you don't want to let down. >> any time you get a new coach in there, it really does energize you but especially him, he's a gritty guy. he played hard all the time and i think that will trickle down to us. >> all right. now if you want to hear from dale hunter, we do have that video clip. this is a guy who is, i don't know how you put it, maybe one of the toughest players in the history of this franchise money so it's going to be very interesting to see how that translates into coaching. this is hunter talking about how he's going to be a little nervous before his nhl coaching debut. >> i imagine i'll have some butterflies in my tummy.

championship in juniors, he took the suit in the middle of the locker room and let his players tear it to pieces. maybe if they go to the stanley cup finals, it happens this year. >> whatever he wants to wear as long as he wins. >> exactly, there you go. i like that philosophy. moving on we're talking football are skins had the day off but they did get a piece of good news. fullback deron young who suffered a mile concussion in the seahawks game could play this weekend against the jets. the other new york team absolutely pounded on "monday night football," eli manning and the giants visiting drew brees and the new orleans saints. brees fakes the handoff looking downfield. how good is this guy. jimmy graham, maybe the best tight end in football. a 29-yard touchdown. it graham's second touchdown of the game. brees throws for 368 yards and four touchdowns.

it's no secret childhood obesity is a serious growing epidemic. a summit kicked off today to help fight the problem "building a healthier future." the goal is to come up with ways to help promote healthy eating and physical activity. the event is sponsored in part bit partnership for a healthier america. first lady michelle obama is the honorary chair. >> there's a battle in alexandria, virginia tonight. some people are worried about the impact of more hotels and housing along the pa tomorrow a river. . >> reporter: where this old warehouse now stands, city planners see a boutique hotel. but this citizens group would tear it down for park land instead. signs of opposition to the city's waterfront vision are multiplying as a vote neers on a

plan to redevelop the waterfront. the city's proposal would connecticut and increase the open space and add public piers bu also allow the owner of three warehouses to redevelop the site noose hotels or housing. >> change is going to come. we're trying to control and manage that change in a positiv and legally defensible. >> reporter: community opposition to part of the proposal led the city council to delay a vote slated for last spring and appoint a waterfront work group to iron out differences. then last month a group called citizens for an alternative alexandria waterfront plan put forward a competing idea. its founders say the development permitted in the city's plan would ruin the waterfront's value as an historic resource. >> the city seems not to recognize sufficientlyly or adequately the value of old town as a national historic landmark. >> this is the last chance to hope for, to work toward more
