report coming up on news 4 at 5:00. out of aruba, an appeals court rejected the prosecutors request to put gary giordano back in jail. >> he is back in the u.s. for the first time in four months. authorities say they still suspect him in the disappearance and presumed death of robyn gardner. last week, a judge ruled there was not enough evidence to continue holding g ining giorda. >>itis not clear exactly when giordano will return to maryland. prosecutors will continue the investigation and under dutch law, they have up to three years to press charges against him. a man wanted in a series of carjackings in montgomery county is behind bars this afternoon. >> harry sanders is charged in a crime spree that started last we

understand wednesday in a shopping mall. he abducted three different men in their 60s and 70s on three different days. at knife point, he forced them to drive to atms and withdrawal money. they were all freed and sanders drove away. one man was beaten and cut. he has an extensive criminal record. we'll hear from one man who claims she was a victim tonight at 5:00. metro riders are stepping on to a long awaited development. >> the last of three brand-new escalators began running this morning. it's not the only station where passengers can see escalator improvements. we have the story. >> the more they can keep the escalators working, the happier people are. >> reporter: he works at the top of the foggy bottom stop. he can tell you exactly how the escalators have run every day

for the past year. >> i have seen escalator project begin and seen it to where it is now. >> reporter: metro marking the official opening here at foggy bottom and the seven refurbished escalators. the foggy bottom portion had been delayed but started in january. the first of the escalators was unveiled in july. it cost just over $8 million. >> it's better for the traffic flow. that makes the most difference. you don't have to stand in line trying to find it or trying to get into the train. it's definitely worth it. >> reporter: this is the first time in more than a decade new escalators have been installed at an existing station. the new escalators here aren't that different than those refurbished. they all have new parts. the entire substructure under

the escalators here was replaced. >> we have 144 escalators we are going to rehabilitate. it's going to take a few years but we are making progress. >> reporter: many are hoping today's opening is part of the new era for the ageing system. metro had their share of escalator issues. last february, it buckled, causing a woman to fall. four people were taken to the hospital after an escalator malfunctioned. >> come through foggy bottom quite often. i, you know, it's a busy station. it's been needed for a long time. >> reporter: next up, they are building a can pi to protect people from the elements. over here, a staircase behind the green wall. after that, it's off to dupont circle. the first lawsuit has been

filed in the penn state sex abuse case. he says he was abused more than 100 times by jerry sandusky. it happened during a four-year period beginning when he was ten. he is now 30 years old. he abused him on trips to philadelphia rksz a bowl game and the sandusky home. the suit names sandusky, the university and second mile charity as defendants. the man who filed the suit is not among the eight boys sandusky is accused of abusing over a 15-year period. he acknowledges showering with some of those boys but denies molesting them. people close to herman cain say don't expect him to quit the race anytime soon. cain was defiant today in wake of allegations of a long-term affair. cain's latest struggles come as newt gingrich gains support. steve handelsman has the latest.

>> reporter: on a swing through ohio, herman cain sounded defiant. >> they want you to believe that with enough character assassination on me that i will drop out. >> reporter: cain will not quit anytime soon according to the former party chairman who has been in touch with cain. >> i don't think herman is contemplating getting out of the race at the moment. he doesn't really have a strong reason to do it. >> we want cain! >> reporter: with much support intact, cain can wait until january when the voters in iowa decide about the alleged 13-year affair, the charges of sexual harassment and foreign policy. if cain drops out, the poll finds the rest of the field won't reshuffle much. mitt romney would get cain

26-year-old stephanie schwab was taken into custody this afternoon after crashing her car on old georgetown road here in bethes bethesda. take a look at the shots here. the police began tailing her after she tried to rob a bank in mcclain. 50-year-old henry sanders of landover is accused of abducting three men and forcing them to drive to atms and take out money. the men are in their 60s and 70s. one was badly beaten and cut. pat collins will have more on the criminal history of the suspect coming up at 5:00. >> gary giordano back in the u.s. after four months. they rejected the prosecutors bid to put him back in jail. prosecutors are vowing to continue the investigation. a huge day on wall street.

this huge sinkhole is causing stir in oklahoma. a local farmhand says the hole appeared overnight after an earthquake hit two weeks ago. it measures 40 feet wide and 40 feet deep. it's still growing. scientists say several things could have caused the pit including salt formations or drought. they don't believe the earthquake is related. couples who lost everything from the tsunami in japan are replacing memories. the early pictures were of destruction. today, a different scene. couples gather to re-enact their wedding days. the photo shoot was organized with the goal of replacing

another round of occupy wall street evictions is under way. early this morning, dozens of

protesters were forced to pack up their tents in los angeles and philadelphia and haul out of their camp sights not everyone left willingly. >> reporter: early wednesday, 1400 police officers were used to clear the occupy los angeles camp driving protesters from a camp around city hall. more than 200 were arrested, it was considered peaceful. >> they did a tremendous job out here. they acted with restraint, professionalism. >> i think it's gone smooth. >> reporter: he and others camped out in cities across the country to protest economic disparity and corporate greed wonder what's next. >> i was discouraged we didn't get farther why we were here. so, it will be real interesting to see how the group reforms, the movement reforms. >> reporter: dozens of the occupy philadelphia movement reformed fast enough to stage a
