good morning, everybody. welcome to "news4 midday." i am barbara harrison. it's tuesday, december 13th, 2011. right now a pennsylvania courthouse is clearing out after a surprise move from former penn state assistant coach, jerry sandusky, who this morning waiving his right for the hearing so he could present his

side of the case at trial. >> we will have the opportunity to present our side. >> i don't want there to be any misunderstanding. we are not in any way conceding guilt. in fact, jerry is more adamant than ever in his innocence and expressing his innocence as trial. >> several victims and witsses were slated to testify about the abuse charges. >> reporter: in a surprise move just as the preliminary hearing was getting under way, jerry sandusky and his attorney asking the judge to waive his right to the preliminary hearing and change the course of today. we were supposed to hear from several alleged witnesses and victims. his alleged abusers now adults say sandusky abused them over the course of the past decade, and in several cases that

occurred on penn state campus and off. in those alleged allegations, many of them say that sandusky sexually assaulted them and fondled them at the time. in the meantime, the preliminary hearing will not go on as planned, and this means the arraignment moves forward in january. >> right now, a senate panel is holding a hearing to examine the state and federal reporting requirements for child abuse. maryland senator says lawmakers are considering adding tougher penalties for those reporting sex abuse cases. and officials are accused of ignoring warning signs and allegatio allegations. new today, a worker has serious injuries after fall into a ditch. firefighters arrived and they had to use a rigging system to remove the man from the 16-foot

deep hole. a bus traveling through the work zone may have caused the man to fall. >> when a bus came through the work area, at some point, this worker did fall into the trench. it's unclear as to whether he did this to avoid it or was struck by the bus. >> the man did suffer severe injuries but firefighters say he is expected to be okay. turning now to the weather, it's sunny but chilly, still. tom kierein joins us. >> it's just past 11:00. our temperatures are well above freezing but it took a while to get above freezing. it was not until 10:00 this morning that most areas got above freezing. right now around the region, we hit the 40s in washington and the nearby suburbs, low to mid-40s. reagan national at 46. just now getting above freezing in the mountains of west virginia and western maryland in most locations, although cumberland is still at 32 degrees. around the bay and the eastern shore and near the waters it's

in the mid-40s in most locations, and we should climb another five or six degrees for the temperatures. over the last 12 hours, we cleared out a few high clouds. and there is rain in indiana and parts of western kentucky that should way well to the west today. and for the afternoon, mostly sunny. just a few high clouds and we will have light breezes out of the north northwest around 5 to 15. and so even the temperature will get around 50 it will feel chillier. and we will look at changes for the weekend coming up in just a couple minutes. this morning, police are enlarging the crime scene after a wild shooting spree in the d.c. area overnight. a man was randomly shooting.

tracee wilkins has more. >> reporter: police extended the crime scene down the hill to where you see the crime tape here. they found bullet holes and shell casings in this area, and this is now included as part of the scene. if you look up there at the hill, you can see police are still investigating and looking for evidence associated with the case. they have more than a block of the street closed down in yellow tape. people that live in the community have been asked to walk around the crime scene, an inconvenience for a lot of people here, but police want to check everything and they have been waiting for daylight since last night to find more evidence here. a suspect was randomly shooting at homes in the 5300 block of clay terrace when they shot him and killed him last night. witnesses reported the suspect appearing to be high on pcp, according to police, after police arrived the suspect

reportedly continued firing his weapon. the chief describes what happened next. >> during the course of officers arriving on the scene, the gunman continued to fire, and officers gave commands for the gunman to drop the gun and he did not. the officers fired their weapons at the suspect, and he went down. they immediately went to where the suspect was, and began to administer cpr, and he was in bad shape when they got on the scene. >> the suspect in this case did die from his wounds. police have not released his name at this point. the good news is nobody else who lives in this community was hurt. in northeast, i am tracee wilkins, news4. a new report out shows crime dropped on metro system wide, and they fell about 1% from july to september. the only increase was in the number of violent robberies. metro says they do expect to

spike in crime during the holiday season and are beefing up the coverage. nine of the top ten stations for crime are in prince georges county. right now the taxicab commission is proposing to raise the rates from $1.50 per mile to $2.75 per mile. it would increase the waiting rate to $25 an hour. the plan does not mandate service improvements like updating cabs so passengers can pay with a credit card. another public hearing would be needed if it's approved before

we have breaking news for you. four service members are dead after a helicopter crash in washington state. both helicopters went down on the training camp outside of tacoma. they were flying in two-seater observation helicopters. it's not clear when they collided or went down separately. the service members have not yet been identified. iranian authorities denied a request from the u.s. to return an american spy drone.

iran's government said it captured the unmanned aircraft last week. iranian officials said the u.s. should apologize for invading the u.s. airspace instead of asking for the drone's return. boehner expects the house to pass their version of the payroll extension. they freeze the pay of federal workers and reducing the amount of long-term unemployment to be given out, and democrats say it will not pass because it forces the president to approve a controversial pipeline. right now, on capitol hill, four occupy d.c. protesters on a hunger strike are demanding district voting rights. the demonstrators say they

refuse to eat until congress grants d.c. full representation instead of a nonvoting house delegate. yesterday they tried to meet with harry reid and rogers. a billionaire that owns the new jersey nets is running for president of russia. he decided to challenge prime minister, vladimir putin, after boycotting the elections. he plans to make current president his prime minister. let's turn our attention to the weather now. we have another chilly day, but warming up, tom tells us. >> thankfully, we have another cold and frosty start. the frost is all melted down. and we have bright sunshine. there's a live picture from the city camera showing the

monuments lit up in the bright december sun. it's 46 at reagan national. we have wind coming out of the north 5 to 10 miles per hour. and occasionally the wind may gust to 25 miles per hour. we have temperatures all around the region getting above freezing. areas generally from the shenandoah valley all the way to the checksapeake pay in the mid-40s. and there is the view from space. we have lots of sunshine, just a few wispy high clouds, and as we go forward over the next 48 hours we will have the high clouds in and out through the evening hours and then by dawn tomorrow we may have a few sprinkles in the mountains, and as we get through the day we

will have cloudiness on wednesday and into wednesday evening, maybe a few sprinkles to the north. on thursday, a great chance of rain moving in, and the areas of green are potential zones of light rain moving through as a front sweeps through on thursday later in the afternoon. this afternoon, plenty of sunshine, and temperatures will be climbing into the upper 40s to perhaps the low 50s briefly by midafternoon, and we will have the breezes out of the north and northwest out of 5 to 15 miles per hour. and the sun sets at 4:47, and then by midnight we will be in the upper 30s with the clouds coming through, and by dawn tomorrow, the upper 20s. and then tomorrow highs reaching around 50 degrees or so and then clouds on wednesday night into thursday, it's an increased chance of rain moving through, especially thursday afternoon and evening and milder on thursday, and then friday, partly sunny, up into the

mid-50s, and a few showers on friday evening just mainly to the south of washington, as an area of weak low pressure passes to the south. and after that goes by, chillier, dry weather moves in for the weekend on saturday and sunday. morning lows and 30s on saturday and afternoon highs, mid-40s. and mid-20s on sunday morning. lots of sun on sunday afternoon, and into the mid-40s. on monday, near 50 degrees. i travelled the vienna elementary school. and these are some of the students that i spoke to, and we had a lot of fun talking about all different types of weather. i want to thank the teacher in the back in the next photo here, that's genie foster, and she gave me the invitation to talk to her students. and they thoroughly enjoyed my

out you were pregnant. >> so when i was pregnant i head to woman's choice, and i been the to the woman's choice office and they provided me many things, and -- >> all the little supplies that the baby needed? >> exactly. the most important was the medical assistance, and month by month i had support witthe hospital and everything, maternity clothes, clothes for my baby. >> tell us about the baby. how old is she? >> eight months old now, and i am very happy also with woman's choice, because they provide us a lot of things. first of all, i am happy because my baby is alive, and they

provide us with cribs and clothes, and milk, and the clinic and basically everything. >> it basically helped your family? >> yes. >> because you were not working? >> i wasn't working and i didn't find a job, and they provide me with support of how i can find a job. and they helped me to make my resume, and they find job for me also, so now we are together because they helped us. they are so nice. >> they helped to keep the family together. tell us what your organization can use this morning? >> the primary thing is we do need financial support. last year we spent over $24,000 on private medical care for pregnant women and their babies. and so that's always our biggest need. besides the financial support, diapers, and once a woman has a

twice before taking a drink. megan, good morning. >> reporter: good morning, barbara. the holiday season, a lot of parties take place. you have the office parties, and you have the christmas holiday concerts and the like. a lot of events people enjoy a few cocktails. police want to make sure if you are drinking you don't get behind the wheel. they will be out in full force looking for drunk drivers this holiday season. the holiday season, it's a festive time filled with parties and family gatherings, and out on area roadways it could be a dangerous time. last year in just a second half of december, 415 people were killed by drunk drivers nationwide. january widthers knows all too well the pain of such a loss. her 15-year-old daughter was killed by a drunk driver. >> my life is forever changed. it's a huge hole in my heart, and time of year especially we

miss her more, and our family has never been the same because there's pain under the surface. >> ray lahood joined law enforcement officials announcing initiatives to catch and prosecute drunk drivers. police from every jurisdiction are pitching in. you can see more officers on the roads as well as sobriety check points. >> and sobriety check points, and more enforcement. >> reporter: the latest statistic show that drunk driving deaths are from 2009 and 2010. experts believe education and enforcement have helped to make the streets safer and they encourage people to plan ahead, not to wait until the end of the party to plan the exit strategy.

>> think about alternative transportation. have a designated driver. you know, use public transportation or taxicabs if they know they are going out. it's an investment well worth their time to do that. >> reporter: police and the experts say that planning is the key here. don't wait until you go to the party and have a couple drinks when you make these important decisions. know how you are getting home before you arrive to the party, and they want to make sure everything is safe out on the roadways this year. back to you. the police released the name of the victim in a deadly shooting. somebody shot 34-year-old colvin morris yesterday afternoon. he died at the hospital. police are looking for three men seen leaving the complex shortly after the shooting. well, today police are still trying to figure out the motive behind the deadly shooting on the virginia tech campus.

friends and family members gathered to say their final good-byes to deriek crouse yesterday. a real estate manager says the day before the shooting, ashley walked into her office and pulled a gun on her and stole her suv. police say they don't know why he did that either. he was a part time student at radford college and had no known connections to virginia tech. frederick city officials say $3 3.5 million gallons of raw sewage spilled. the road near the plant was shut down as well as the plant for several hours. residents should avoid contact with carol creek. drinking water is not affected and is safe to drink. once again, we will check in with tom kierein to bring us up to speed on the forecast for the

rest of the week. >> we have a rapid warm up. we are approaching the noon hour with the bright sun and blue sky. temperatures warmed up from the frosty start. there's a live picture looking off to the west northwest, and we have a few whispy high clouds in the sky. we were down in the low and mid-20s this morning and so it warmed up quite a bit quickly here. over the next couple hours, we may make it into the low 50s. you can see clouds close into west virginia and western pennsylvania, and we will have a few high clouds from that later today. and highs reaching low 50s and then overnight tonight we will be down in the 20s by dawn on wednesday. tomorrow, a little sun in the morning and then cloudy in the afternoon, and highs low 50s. milder on thursday, and a lout of clouds around. it may trigger a few passing showers mainly during the afternoon. on friday, partly sunny. we will have a weak area of low pressure passing to the south that may come close enough to us to give us a few rain showers on

friday evening, and then quickly exiting for the weekends for dry and cold weather for saturday, sunday and monday. that's the way it looks right now. barbara? >> thank you. now to decision 2012. conservative radio host, michael savage is offering newt gingrich to drop out of the presidential race. he says mitt romney is the only candidate with a chance of defeating president obama. and he says gingrich should drop out for the shake of the nation. and meanwhile, gingrich promised fidelity to his wife but did not sign the pledge. he was asked to sign a 14-point plge. gingrich has been married three times, and he did not sign it but he wrote a letter saying

reports of serious problems associated with the use of hcg injections for weight loss. dark circles under the eyes can sometimes be a sign of exhaustion or serious illness and make you feel old and unhealthy, and they make you look tired. and the doctor joins us to talk about what causes them and how we can treat the dark circles under the eyes. good morning. >> you don't have any under your eyes. but i often have had them undermine. what is the cause? it can be no sleep, but what else? >> there are's a number of causes, but the number one are allergies, and eyes can itch and the skin around the eyes can itch, and people can naturally rub the eyes when the eyes itch,

and that can give a darkening dry, leathery excessive lines around the eyes. the solution is to treat the allergy, and we treat the skin, and it gradually gets back to normal. >> some people just think because they have had them for so long, and it's the way they are made, and it's just their coloring, but there is often a cause, right? >> sometimes it is hereditary. you can look at some people and see they have a vas abundance of blood supply under their eye, and that's natural and can occur, and sometimes you can have seepage of the blood cells under the i and that causes darkening. it can give you a brownish discoloration under the eyes. >> with that, you can't do anything. but with allergies, there are things can you do. >> yes.

>> what are they? >> typically, it's an environmental allergy, so taking an antihistamine helps, because the eye itself is itching and the skin around the eye is itching so the first thing you want to do is take an antihistamine. and then there are topical steroids and by logics that we use. and that tends to smooth the skin and get it back to normal, and in the process, you see lightening of the skin. >> what about puffiness or bags under the eyes? >> bags are usually prevalent at the beginning of the day. in the morning, eyes are more puffy, versus at the end of the day, your feet are more puffy. so that fluid in your eye area does travel down south. >> we have heard people say cucumbers in the morning will

they hope to settle on a plan by early next year. and we're going to check in with cnbc's courtney reagan, and she has the day's business headlines. >> stocks are higher today. the dow is up 52 points. we are off the highs of the morning, which we hit shortly after the opening of the bell. we have gotten mixed economic news out of the commerce department this morning. u.s. retail sales did grow two-tenths of a percentage in november, and that's without the sale of autos. the commerce department says the business inventories rose to a

record high which could help to boost fourth quarter economic growth. now congress has reached a tentative deal to fund the government through next year. details on the bill will be unveiled today but it's expected to chip away at the nation's pentagon budget, foreign aid and environmental spending. it boosts funding for veteran's programs and the war in afghanistan. and a temporary spending measure expires on friday. and we have a little good news for the procrastinators out there, myself included. most online stores are dropping their standard rate for gifts to get there by christmas. and the shipping program is available on orders of $25 or more. 90% have set december 20th as
