the cruise ship to continue their search for victims. meanwhile, the ship's captain makes his first appearance in court. good afternoon, i'm pat lawson muse. >> and i'm jim handly. the captain told his account of what happened. his attorney says he saved hundreds if not thousands of lives. meanwhile today, crews found five more victims on that sinking shift. 11 people are now confirmed dead. 20 others are still missing this eveni evening. michelle kosinski has the latest. >> reporter: it was a day full of activity. there seems to be an army of searchers here on this tiny island. using explosives, they were able to punch a hole into the hull so they could get better access to the cabins they were searching. unfortunately, there was no sign of life aboard. they did find five bodies of

victims. four men, one woman believed to be in their 50s and 60s. as this search was going on, the captain was in port facing charges of manslaughter, abandoning ship and causing the wreck. most shocking to people following these developments is this leaked audio reporting. a recording about three hours after he decides to take the ship off course. the coast guard orders him immediately back on board. immediately you hear him making excuses, saying the life boats are not working. i'm trying to coordinate efforts. the defendant's attorneys said he likely saved lives by trying

to beach the ship instead of letting sink in deeper water. >> a virginia couple that was on the ship are now back home. the couple was on the ship for hours when they heard a strange noise and sawed power flicker. they were able to get on to a life boat and back to dry land. they managed to get emergency passports so they could return home. the couple says they would go on a cruise again. severe storms rolled through kentucky this morning. strong winds knocked over a tractor-trailer. some businesses had the roofs damaged. trees and power lines were knocked down. the same storm is headed for us. storm 4 meteorologist veronica johnson is in the storm certainer with more. >> lots of wind damage through kentucky. even a tornado reported in kentucky. all part of the same system that's driving this way for us. take a look at the radar.

we have just north of us, after the rain this morning, just a few showers around hagerstown, maryland. let me go ahead and open it up for you. that's not all. we have more moisture with this weather system hanging back, just to the west of us. it's a big long line of thunderstorms extending from petersburg to richwood down to beckley, west virginia. it looks like we're going to get more rain for our southern counties of virginia come this evening. for the most part, though, spotty showers, that line extends all the way down into areas of kentucky, as well as tennessee. kentucky now starting to see most of its rain in the eastern part of the state after the severe weather they've had over the last 12 to 24 hours. 58 our temperature right now. it's gusty out there. the wind at 18 miles per hour with higher gusts. manassas, prince georges county coming in at 58 right now.

the president appointed the council from a broad range of fields, he assured them today that he takes their recommendations seriously. the president spoke of success and streamlining processes to obtain permits and cut regulations. he also noted his own efforts to get more power from congress to try to shrink the cost of government. stocks ended higher today after better than expected global economic news. at last check, the dow jones industrials were up 63 points, the nasdaq up 16 and the s&p 500 had gained 4. the s&p traded briefly above the 1300 level today. kwil energy and health sectors climbed. the supreme court refused to hear a case involving workers who received tips. the case involves 5,000 current and former employees at applebee's.

they should be paid more when do work that doesn't include tips, like opening and closing the restaurant. today the supreme court refused to hear the case. it means tipped employees can sue for more pay in such cases. pat? america's obesity problem isn't bulging. new statistics show the numbers of obese americans in some cases are getting bigger. erica edwards has the latest on our nation's obesity epidemic. >> these are a few ways americans are losing weight. possibly stabilizing our obesity problem. >> walking, doing household chores, enjoying social time with friends. on the move, it helps. >> reporter: dr. howard eisenson is reacting to the numbers. not much has changed in the past decade. nearly 70% of adults in this

the s&p 500 gained 5 points after trading briefly above the 1300 level. >> now, to a health mystery, in upstate new york. >> at least a dozen teenaged girls have come down with a very strange illness. their parents want some answers. >> 17-year-old sara sanchez says she isn't the same teenager she was a few months ago. she suffers from uncontrollable body movements, ticks and verbal outbursts, much like terrets syndrome. things she once loved are now nearly impossible. >> i used to cheer every day. i would go to art class. i used to go to two art classes every day. now i'm not in school. >> this is home video of sarah from october when she says the

symptoms first appeared. barely able to speak. >> i was always so active, and everybody was always happy to be around me. i don't feel like myself any more. >> reporter: and she's not alone. at least 12 teenaged girls at leroy high school in upstate new york say they're suffering from the same symptoms. including sarah's friend katie. >> my days are all different. some days i'll start twitching, won't stop for 10, 15, 20 minutes. >> reporter: both girls have seen their own doctors and are getting treatment, but symptoms continue. the new york state department has been looking into the situation for three months. and the school is not to blame.

walking into a moving propeller. the pilot claims he saw her walkinged wrong way and tried to warn her. the pilot had just taking her on a 20 minute flight to look at christmas flights. he parked the plane with the engine still running. according to the ntsb report, he opened the door on the right side of the airplane expecting a friend to come out and assist the passenger in deplaining. he leaned out of his seat and placed his arm and hand in front of her to divert her from walking to the front of the plane and said she should walk to the back of the airplane. scruggs lost her left hand and left eye, and is still recuperating from her injuries. >> she really 14u7b9 be alived.

there is outrage over a disturbing incident that happened in a florida jail. a man was strapped in a wheelchair stripping in pepper spray. he decide just hours after the photo was taken. his family is suing over the circumstances surrounding his death. >> reporter: it's a photograph snapped in march of 2009. a picture lee county florida jail officials long denied even existed. nick chrissy, naked, tied to what's called the devil's chair, a spit mask wrapped around his neck and mouth. guards told investigators they repeatedly pepper sprayed him because he was combative. 62-year-old nick christie died just hours after the final blast of pepper spray, nearly two days after he was arrested.

nick's wife joyce. >> you've seen that picture. what do you see there? >> torture. this is a man that was probably pleading for his life, that probably knew he was dying. he was a mentally ill guy that was strapped naked in a chair. he didn't deserve to be treated like that. >> reporter: he was arrested for trespassing outside a fast food restaurant next door to his hotel. guards said they had to restrain him because he was antagonistic. his manner of death was homicide. his heart stopped beating after he was restrained and sprayed with pepper spray by law enforcement officers. after an exhaustic internal investigation, and a review by the state attorney's office. no one's been charged in christie's death. the family is suing the lee county sheriff's office. >> once he's restrained in the chair, he's no longer a risk of harm to anyone.

>> so the pepper spray is -- >> excessive. >> malicious? >> unjustifiable. >> attorney nick dicello says he had been arrested just days prior for disorderly conduct. his wife warned them of his mental condition. >> he's manic, he's off his medication. >> reporter: police now admit they had christie's medical file from that rearrest. the second time he was rearrested, it was a friday and the files were not readily available. for joyce christie, she's left wondering what happened before her husband was strapped to the devil's chair, jail officials say security videos on that cell block that might explain what happened do not exist.
