it's the same vote split that helped romney win iowa and then new hampshire. >> steve, thank you. republican presidential contender rick perry lost another battle to get his name on the ballot in virginia. a federal appeals court rejected his request for an emergency order to add his name. the fourth circuit court agreed with the federal judge who rejected perry's request last friday, saying the candy wait had every opportunity to challenge the ballot environments, at a time when the challenges would not have disrupted the state's electoral congress. congress reconvenes at 6:30 tonight. and one of the topics is congress's public reception. it's at an all time low. only 11% of americans approve of

the way congress is working. 86% disapprove of the job members of congress are doing. the record number approval rating was set back in august at the end of the bitter debt ceiling debate. members of the occupy movement are fighting to have their voices heard. hundreds turned out on capitol hill. that's where we hear from chris gordon. already there have been several arrests? >> that's correct, one occupier was charged with assault on a police officer earlier in the day. others were charged with minor offenses like disorderly conduct. tonight there could be more arrests, because protesters are on the move. they have taken to the streets of washington. tonight police are keeping a close eye on occupy demonstrators as they march through downtown washington, to

the u.s. supreme court and the white house to express their frustration with government, which they say represents the richest 1% and ignores the other 99%. earlier in the day, congress was their target. ♪ >> reporter: americans from across the country occupied congress on the first day the house of representatives reconvened after returning from their holiday recess. >> we're going to do some legal info. >> the occupiers held this general assembly to show congress, this is what democracy looks like. >> we have a pink slip with the name of every member of congress. you know, our constitution allows us, it actually entitles us to terminate their employment every two years. >> one group of occupiers touring inside the capital rotunda decided to stop and shout that the government has

outside the supreme court today. they were among a group protesting the death penalty in the united states. the supreme court upheld executions in 1976. today's protests were organized to cone side with the 35th anniversary of the first person executed since that ruling. the wild weather swings continue. temperatures climbing into the 60s today. don't get too used to it, though. doug it's coming back. >> don't get used to any there that we have seen out there this winter, we have seen the cold, the very warm weather. we've seen just about everything so far this winter. and that roller coaster is just going to continue the next couple days. out there right now, 58 degrees this is at 6:00 at night. winds out of the southwest at 17 miles an hour. gusting to near 30 miles an hour. we've seen those gusty winds all day. down to the south around fredericksburg, 61 degrees there

too. annapolis coming in at 60 degrees. down to the south, right around fredericksburg, southern staff order county, also down around responsible ilvein ya county, portions of charles county, you will all see showers. take a look at the wider picture, these are showers and a few thunderstorms well down to the south that will stay south. maybe a couple sprinkles later on this evening, but that's about it. we'll call for spotty showers between 9:00 and 11:00. look what happens after the cold front moves through. we wake up to a windy 38 degrees tomorrow morning that will put our windchills in the 20s. it could be a 30 degree temperature drop when you talk about the windchill tomorrow morning. new charges have been filed in a grand jury indictment against the man accused of trying to assassinate president obama. he's now charged with assaulting three federal officers and damaging federal property. he also faces four separate

firearms charges in addition to the attempted assassination charge. he was arrested last november and charged with firing several rifle rounds at the white house. he's being held in jail pending trial. >> new details in the death of an 8-year-old boy killed by a drunk driver in alexandria. his blood alcohol level was nearly two times the legal limit when he slammed into a mother and son just a few blocks from where they lived. >> he won't be on the streets doing that to anyone else. >> reporter: it's the smallest consolation for a family mourning the loss of an 8-year-old. there will be no bond for victor aldana. he's charged with dui manslaughter for killing the boy. the prosecutor revealed he started drinking at 9:30 sunday morning 37 it was around 2:30 that afternoon when he drove his room mates car off the road.

maria chavez was hospitalized with a broken pelvis and broken legs. prosecutors say aldana's blood alcohol level was .15 nearly twice the legal lirmt. >> he's a bad guy for doing that and drinking a lot. martin lopez is the victim's uncle, a big brother figure who picked the third grader up from the bus stop each day. he and the little boy's grandmother are devastated. it's brian's mother who is suffering the most. >> knowing that she lost her son, her only son too, it's hurtful for hire, it's hard. he was only 8, he has so much to live for. and now it's all gone. he's gone. and there's no way to bring him back. >> reporter: the family is now focused on maria's recovery, and getting her husband back from mexico. aldana's roommates say he didn't do any drinking at their apartment sunday.

five more bodies were recovered today from the sunken cruise ship in italy. that brings the death toll to 11. the captain is facing manslaughter charges. >> reporter: it was a day full of activity, there seems to be an army of searchers here on this tiny island. using explosionives, they were able to punch a hole into the hull so they can get better access to kwabens they were searching. unfortunately, there was no sign of life on board. they found four men, one woman believed to be in their 50s and 60s. the captain was in port faces the charging against him of manslaughter. he's now under house arrest. most shocking, i think to people following these developments is

this leaked audio recording, a phone conversation between the captain and the port authority around three hours after he decided to take the ship off court, hitting a rock. repeatedly the port authority orders him to get back aboard the ship. you need to go now. you hear him making excuses, i'm coordinating efforts from here, off the ship. at one point he says, are you aware it's dark and we can't see anything? today after his court appearance, his attorney defended him, saying he saved lives to make a maneuver to beach the ship instead of letting sink as it would have in deeper water. >> the ship's captain defends his actions. 24 people are still missing, aaron? >> how did this disaster unfold? investigators believe the captain made an unauthorized

decision to steer the ship off course. he was trying to give the residence of that tiny island a closer crew of the wluchl uri ship as it came by. instead he hit rock, three hours into this trip. from there as we understand it, the kaptd made a u turn trying to bring the ship closer to the shore of the island. he ended up running aground and beaching the ship. this may have been a stunt so that the head waiter on the ship could see his hometown. it's not uncommon for cruise liners to make a display, get close to land sound the horn so people can see it. take a look at the concordia on a previous run doing exactly that. if convicted the captain of the ship faces up to 15 years in prison. doug's here with a check on our forecast. we've been up and down.

down to the south around the fredericksburg area. we're still seeing showers there. we'll continue to see showers move into southern maryland, they'll be very, very light in the form of showers. here's the storm system itself, and the frontal boundary. notice the strong thunderstorms that were making their way through kentucky and west virginia. literally diaz they make their way over the mountains, a tornado reported. four tornados today around the country. two in mississippi, one in indiana, this one here in kentucky. an ef-1 tornado with winds of 95 miles an hour made its way through that region. this is january, we very seldom see storms this strong this time of year, louisville, kentucky definitely saw one of those earlier today. behind this system the cold air, look at this snow up toward skmaug. we are in for the cold air tomorrow. tomorrow it's the breezy and cool air, i'll cool it cool, but

a lawmaker in maryland is pushing a bill to crackdown on people who abuse animals. it would not only toughen current laws, it would create a

registry of animal abusers. one animal rights group says maryland ranks 36th out of all 50 states when it comes to laws that protect animals from abuse and neglect. the american civil liberties union is suing metro transit police. the lawsuit claims a metro officer violated the rights of lawrence miller. he witnessed a man in the wheelchair being thrown to the ground. he was arrested for asking officers questions about the incident. >> i did not assault anyone. i believe my conduct as any concerned citizen would be, just to say something, if you see something. metro's motto is, if you see something, say something. and i said something, and i was arrested. >> metro says it does not comment on cases currently under litigation. the suit is seeking monetary damages, the amount will be decided by a jury. a growing controversy, new

8-year-old boy was killed by a driver whose blood alcohol level was nearly twice the legal limit. victor aldana was held without bond today. he crashed into the child and his mother as they walked along a foot path along duke street. >> mitt romney is currently in the lead in south carolina ahead of the primary saturday. he's claimed a commanding double-digit lead among republicans in the latest national poll from gallop. the latest washington post abc news poll suggests romney is the only candidate who may win a matchup with president obama. occupy congress protesters say they are taking aim at the influence of corporate money and politics among eother things. the demonstrations were mostly peaceful. bond denied. that's the ruling for a man charged with home invasions

across maryland. >> graphic new details were revealed about the crimes. >> reporter: why did kevin allegedly commit three home invasion robberies and two sexual assaults over a four-day period last week. prosecutors say he admitted to please that he and a partner in crime had been robbing drug dealers in the district when his partner was killed much peter says he claims he started this crime spree because he was on his own now. >> that's a statement he made to the officials here when he was being questioned that he is -- he was out there on his own, because his partner had been killed recently. >> police say he committed the crimes in wheaton, bethesda and temple hills before fleeing to north carolina where he was captured saturday. he appeared before a judge for the first time today. his face bandaged and he's using crutches. he was injured while resisting arrest. >> ordered held without bond on a variety of charges.

>> reporter: prosecutors provided harrowing details of the crimes. the victim was holding her infant child when ray confronted her in the garage. he told her, don't scream, don't make a sound or i'm going to shoot you and your baby. he locked the woman and her baby in a closet, then drove off in her car. prosecutors say he sexually assaulted the victim, a housekeeper in the shower. then turned on the water to wash away his dna. in the temple hills case, he raped the victim two times. as a registered sex offender, his dna is on file. there were threats to kill not only the women who were the primary victims in these cases but also their children. >> reporter: if kevin ray is convicted on all of the charges he faces hundreds of years in prison. prosecutors say they want to make sure this time he doesn't get out on parole. darcie spencer, news 4. >> kevin ray last got out of

prison in september of 2010 after serving time for another armed robbery and sexual assault. d.c.'s police chief is asking for help in the death investigation of a baby girl. the child was found late sunday on concrete steps leading to a house on channing street northeast. the baby was naked, no diaper, wrapped in a towel. the child may have been a newborn or up to a month old. officials need help locating her mother. >> anything dealing with children, especially babies, elderly folks really difficult for us, because per the victims that can't speak for themselves and are truly defenseless. >> d.c. does have a safe haven law. it requires you to leave the baby at a fire station or a hospital. this baby was left out in the cold in front of somebody's house. more fallout tonight from the corruption case of former d.c. councilmember harry thomas,

jr. a second person was charged today with illegally transferring thousands of dollars in government grants to thomas who used the money to fund a lavish lifestyle. >> reporter: prosecutors tuesday filed a formal criminal information felony against james garvin, seen here on his nonprofit group's facebook page. he's accused of receiving tens of thousands of dollars in city grant funds and transferring them to thomas, who used them to fund his lavish lifestyle. his attorney says he'll plead guilty. co face up to three years in prison. last week, 71-year-old marshall banks, who also has run a youth sports nonprofit like garvin pleaded guilty to a similar charge. one felony count of scheming by transferring grants to thomas. the two prosecutions follow the disgraced former councilmember

who bleeded guilty in the two felonies in the theft of city funds intended for youth sports programs. thomas resigned his ward five council seat. >> to certify the office of ward five member vacant. >> also tuesday, the d.c. board of elections formerly declared his seat vacant and scheduled a special election for tuesday may 15th. >> all in favor? i. >> reporter: thomas cleaned out his offices over the weekend. the ward five seat is largely located in northeast washington. the special election could draw a dozen candidates or more. all vying to fill the final three years of thomas's term. local residents are anxious to vote. >> it's the sort of people. hopefully we get a better leader for this ward. >> prosecutors say they're continuing the investigation into who else may have helped thomas steal government money.

the d.c. council passed an emergency bill today limiting where medical marijuana can be grown and sold in the city. to grow it, organizations must contain a cultivation center license. a news 4 investigation found the vast majority of cultivation centers applied to set up in ward five because of its available warehouse space. residents who live near the proposed locations say they don't want to become ground zero for the program. vincent orange introduced the bill which ultimately limited the number of cultivation centers to six per ward. if a ward has five or more, then only one dispensary selling the marijuana can be located there. >> i'm a resident of ward five, the ward is being overburdened with a lot of undesirable projects. you have the cultivation centers and dispensaries at some point it's going to break. >> after some negotiation, the bill passed unanimously.

blue ribbon schools. they've made significant advancements in school assessments. the second blue ribbon school is white hall elementary in buoy. nearly 98% of its students are proficient in reading and math. now to a health mystery in upstate new york, at least a dozen teenaged girls have come down with a strange illness. the health department is investigating. their parents want some answers now. >> sarah sanchez says she isn't the same teenager she was a few months ago. she suffers from uncontrolled body movements, ticks and verbal outbursts. much like tourettes syndrome. things she once loved like going out with friends or cheerleading are now impossible. >> i used to cheer every day.
