some lawmakers say it's illegal to essentially move on to city property. chris gordon is live at mcpherson square with this story. >> reporter: good evening, occupy d.c., you see the tents behind me, the occupiers have been living on federal land for about 100 days now, but some members of congress want them removed. if they are sleeping rather than protesting. occupy d.c. protesters have been living in tents since october. the national parkses service says it recognizes the protester's first amendment rights to occupy the park. the house oversight and government reform subcommittee called this hearing asking why is camping allowed despite its apparent illegality. >> i need a definition of camping, i need to go back to south carolina and tell everyone who wants to spent the summer in one of our parks, what camping

is and what it is not. >> the distinction is, for a 24 hour vigil, is that they are awake at all times, providing information or signs or whatever associated with their first amendment activities. >> u.s. park police have allowed protesters to sleep in the park. but in december, they moved in and made arrests when occupy d.c. built a permanent wood structure there. now public health and safety concerns have prompted d.c. to ask protesters here to join the occupy d.c. encampment in freedom plaza, so mcpherson square can be cleaned up. >> we are the united states of america, and people are lives in sub optimum conditions where they're putting themselves at risk and the rest of the community at risk. >> reporter: protesters are exercising constitutional rights. >> the district of columbia better watch out, because they could have a real conflagration

only thing that this team does consistently is get blown out. randy whittman will replace saunders for the remainder of the season. the wizards considered replacing saunders prior to the oklahoma city game, but the wizards won. now less than a week later, the players have fallen back into a rut of bad basketball. saunders leads the wizards with a record of 51-130 in just over two seasons. >> i don't know if the players were responding the way we thought they should have been for the first quarter of the season. and we felt like a different voice was needed to do some things a little different. and maybe to play a different style than we had been playing. >> i'm still here today because i believe this team is better than where we are right now. that's all i can say. i'm not -- it's not a popularity contest. if you don't win games, you're

tax records for the last two years. he paid taxes at a rate of about 15%. he also donated more than $7 million to charity. today newt gingrich tried to turn romney's assets into a liability. romney's campaign has more money but he has more people. he said in his words, people power will beat money power in florida. president obama takes center stage tonight with his third state of the union address before congress and the public. nbc chief white house correspondent chuck todd joins us live with a preview. with this being an election year, will the tone and rhetoric be different compared to his previous addresses, do you think? >> the tone won't be, but it will sound -- put it this way, when you look back on the state of the union come september and october of this election year, you'll say to yourself, all of the campaign themes were there, you're going to hear the same things they've been talking about when it comes to middle class pop lichl if you will, where the president sets himself pushing policies that he believes will help the middle

class, whether it's on housing, tax fairness, you're going to hear a lot about that tonight, you'll hear warren buffett, the million air who has been calling for a higher tax rate for multimillionaires, there's some equality there a little bit. and then you're also going to hear a little bit about this idea of beating up, running against institutions, the unpopularity of wall street and congress. the president will call for tougher new regulations, even criminal investigations if necessary, when it comes to wall street. and even getting congress to deal with things like insider trading. you can just see the remnants here of what's going to be the president's re-election message. middle class pop lichl, anti-washington. >> how do you think he's going to be received by the gop members? >> well, look, it's going to be -- we have them sitting together again, it's going to be a little bit of a mixed applause, if you recall what happened a year ago, it was odd,

too. it was fantastic out there. i timed that just about right. snow in the mountains, nice and warm in the plains. as far as our weather is concerned, a lot of you enjoying the day today. temperatures in the low 60s to the south. fredericksburg coming in at 63 today. got a report of a temperature of 68 degrees down there. just spectacular. right now we're sitting at 52 degrees at the airport. what have we seen over the last couple days? you just mentioned this off air. we web from the winger to sprung in two days. you got that right. how about 32 on sunday, monday a high of 44. a 22-degree temperature swing. so, yes, it definitely felt like winter on sunday and over the weekend -- today, though, gorgeous. much more like spring. this is the average temperature in mid-march. current temperatures right now, 48 in gaithers berg, 54 in manassas, cooler along the bay with a little bit of an easterly or southerly flow right off the

two recalls to tell you you about tonight involving insulated lunch boxes and what do others really think of the brand of car that you drive. you can now find girl scout cookies for sale on your phone. liz crenshaw has more for you. >> we begin with two recalls involving insulated food carriers with those freezer gel packs. the recall of nearly 250,000 ci sport expandible lunch boxes. the gel in the freezer pack can leak out if it's damaged and pose a poisoning hazard. a dog reportedly died after chewing and ingesting the gel. the lunch boxes were sold at costco and other stores. the second recall includes a brand sold at walmart. the concern is the gel freezer

>> unbelievable. >> the shooter's friend. >> i talked to him that morning, he seemed fine. >> nobody knows what drove adam to do what he did inside is this laurel apartment. no one knows why he killed the mother of his baby and then turned the gun on himself. the victim 19-year-old ayers was a nursing assistant, the gunman 21-year-old he was an employee at the goddard space center, he was a member of the national guard. they were high school sweethearts, together they had a little boy named dwayne. even though they broke up a year ago, they still remained friends. for police this was an open and shut case, for family members on both sides what happened last weekend will likely haunt them for a long time.

escalators in the sprawling and aging metro system. problems are frequent. passengers at lafont plaza spilled out in panic when escalators speeded up and suddenly stopped. metro has a major effort to now replace 94 of the worst escalators. the south entrance at dupont circle is next. >> these are among the least reliable escalators in the entire system. given their lengths and disability to keep them in service they were made a priority. >> reporter: metro says this fifth busiest station will close february 1st for nearly nine months. better escalators, but a egg inconvenience. >> metro is increasing its fares and it seems like the services are getting worse, it's like a catch 22. >> i look at the other side of the circle where everybody's going to be entering and exiting, i think it's going to be horrible. >> i'll be glad for the improvement, i think it's awful that it takes that much time.

cameras on montgomery county school buses so they can catch and fine drivers who don't obey those school bus signs. darcie spencer is live where there's a debate on this. >> there are signs like these around the county saying you cannot pass a stopped school bus. believe it or not, a lot of people are doing it, and they want to put cameras on buses and catch those drivers, is $250 too much? steven has three children who attend montgomery county schools. every day he sees drivers pass the school bus that's picking up his children. >> you've stopped people yourself? >> yes, i have. >> how do you do that? >> i just stand in front of the bus and tell them to stop. and then they apologizapologize tell them not to do it again. >> he supports a proposal to put cameras on the outside of county school buses. those who don't hit the brakes

when the lights and stop signs are deployed would be fined. >> do you think this is a good idea as a former bus drive summer. >> absolutely, it can't do any harm to try to convince people who are careless about the lives of children that they have to pay if they mess up. >> reporter: some of the buses here in montgomery county are already equipped with cameras on the outside of buses. if someone is caught passing the bus when they're not supposed to, they're sent a letter. there is no enforcement. >> as far as i'm concerned right now, it's not worth the paper it's presented on. >> reporter: bus drivers tell me they see several drivers breaking the law every day. >> it's an accident waiting to happen. >> reporter: a survey was conducted last year, and on just one day right here in montgomery county, more than 1600 drivers kept going even when the stop signs were activated. initially, the county counsel proposal was to fine motorists

do you feel like he knew it was time? >> i don't want to speak on his behalf, nobody ever wants to give up on something. and he's a smart basketball man as i said before, when we hired flip, we had a totally different team than we have today. but we're 2-15, and i think, like i said -- >> in terms of the inmates running the asylum, maybe because the young players knew you didn't have a choice, and had you had to play them, how do you remedy that? >> it's like randy said in the press conference today, the coach has one weapon, it's minutes. the players that are playing hard and earning their minutes will be out there playing more. that's the way we have to do it, and we have to get it through to the players this is a team game, both offensively and defensively. it's a process, it's not going to happen for us overnight.
