thursday. >> we believe we have recovered the murder weapon. mr. linwood johnson gave a full verbal confession to detectives just a few hours ago. >> reporter: again, police are co confirming one arrest has been made. the motive in the case was robbery. i was able to speak to a family member of lenny harris today. today is the day they're making funeral arrangements and they were aware that an arrest had been made in this case. i'll have more developments coming up at 6:00. for now, darcie spencer reporting live from palmer park. >> darcie, thank you. a fatal crash is stalling traffic right now on the baltimore/washington parkway. all southbound lanes of route 50 are shutdown.

there are few details of what exactly went wrong, but chopper video does show one vehicle flipped upside down. another one ran off the road. we will bring you more details as they come in to news four. a bill that would legalize same sex marriage in maryland is gaining momentum. last year the marriage equality act passed in the senate. today governor o'malley called on lawmakers to support his bill that would give same sex couples the same protections as husband and wife. chris gordon has more from annapolis. >> reporter: maryland residents for and against the marriage equality act began lining up three hours before the hearing. martin o'malley is sponsoring the bill to legalize same sex marriage and was the first to speak before the committee. >> we all want the same thing for our children, the opportunity to live a loving, caring stable homes. it is not right and it is not

just that the children of gay couples should have lesser protections than the children of other families in our state. >> reporter: monday night opponents of the marriage equality act held a rally in front of the maryland state house, urging lawmakers to reject the bill. at this hearing, they made their objections known. >> we are here because we believe o'malley is wrong on same sex marriage. we believe the children deserve a mom and a dad. this is the only thing that would legalize breaking the family tree. >> i totally oppose it, same sex marriage. >> why? >> because it's not natural and it's totally against nature, it's totally against this planet. >> reporter: supporters held this demonstration in annapolis before the hearing to push for marriage equality. michelle smith and lee norwood have been together for 22 years. >> i retired back in '08, my partner of 20 years is only eligible for half of that, i just started drawing social

security and she's not eligible for any of that because our marriage is not recognized at all. >> we are in our mid-20s, we want to build a life together. that's going to involve finances, children. we want the legal protections that come with marriage. >> reporter: it's likely the same sex bill will have a religious exemption in it. if maryland passes the marriage equality act, a gay couple would have the right to be married in city hall, but a church could refuse to marry them based on religious objections. in annapolis, chris gordon, news 4. same sex marriage opponents say if the measure passes this year, they will try to force a referendum. a chaotic scene at a normally quiet d.c. library in afternoon. a deer smashed through a window causing quite the commotion. it happened at the washington highlands library in southwest d.c. that's whe we find tom sherwood with more on the story.

>> reporter: normally in the late afternoon, this library would be filled with families, today the doors closed because of an unscheduled visitor. just before the normally quiet 1:00 opening of the washington highlands library branch, there was a crash. >> looked down the hall, and i'm like, what is that? a deer was laid out across the floor. he got up, he started charging back here. so we ran into the workroom and closed the door and locked ourselves in the workroom. we were in there the majority of the time, we could hear him banging, running into the walls, the stacks and the chairs. >> reporter: the deer broke through the plate glass window. fortunately no children were there. >> it could have been a disaster. i'm glad it came in when it did. we were in the back area. >> were you calm? >> no. >> reporter: officials say the

deer was badly wounded and animal control officers later euthanized it. workmen began clearing up the mess with hopes the library will reopen wednesday. and again, no one here was injured except the deer. in far southwest washington, i'm tom sherwood for news 4. >> thank you, tom. a confrontation at mcpherson square this afternoon between a d.c. resident and occupy d.c. protesters. [ yelling ] >> the protesters defacing the area, watching park police do nothing about it. so he started cutting the cords that held up the tent of dreams. police intervened taking him away. no word on whether any charges will be filed against him. to the latest in the republican presidential race, the florida primary is underway at this hour. chuck todd joins us now from new york.

give us your thoughts on this 11th hour, where things stand right now for romney and gingrich. >> it seems the curiosity is going to be what is going to be the size of the victory. it would be shocking if it would be anything -- a close race, that somehow gingrich surged on this last day. all of the polls indicate a high single digit or middle teens victory. maybe 12, 13, 14 points. the romney campaign said they hope to get a bigger victim pry in florida than gingrich got in south carolina. gingrich won by 11 or 12 percentage points, they'd like to get over that, and they think that sends the type of signal ta could potentially launch them into becoming the de facto nominee even though we have a long way to go on delegates. >> that's what gingrich is trying to hammer home today. he's in it for the long haul. i heard him on msnbc earlier

talking about the majority of conservatives will not go romney's way. is that how he's going to spin these results tonight? >> it's about the only chance he has. especially if you add up the gingrich and santorum totals and they somehow together get over 50%. i can tell you in our own polling, when you ask santorum supporters their second choice, it was pretty split, 50/50 almost between romney and gingrich. romney got a little bit of a bump if santorum supporters were recalculated in our poll. almost hit 50%. this isn't a perfect one to one ratio or perfect edition that newt gingrich would like voters to believe. >> how much staying power does newt gingrich have? >> the guy's risen and fallen twice now, three times, i guess this is his third fall. he's had two rises. if you were him, what incentive is there to get out? you see how this race has gone.

every time he's been counted out, he's been resurrected. for him, it's all about trying to gloss past february, and somehow get to march super tuesdays and those primaries that are all over in this month of march. that's something he hopes to do. the problem you point out is money. he hasn't raised a lot of money for his own campaign and he's been backed by one wealthy household in nevada. the question,will they keep writing $500 million checks to a super pac. that's the big unknown going into an odd month for newt gingrich where he may not have one place he can win. >> signing day in the sunshine state. chuck todd, thanks so much. chuck and the rest of the nbc news political team will have all the latest developments tonight on nbc nightly news with brian williams right avenues 4 at 6:00. doreen gentzler and aaron

mark during the day today. we set a record of 66 at the airport. right now, 64 degrees at national airport with plenty of sunshine out here, winds out of the southwest at 15 miles per hour, the sun is going down, we're seeing mostly clear skies across the region. around the rest of the area, how about 63 back to the west? 63 in lees burg, 66 in culpepper. 66 in pax river, the one cold spot is annapolis which has been up and down because of the wind. coming in at 48 degrees. as far as the rain is concerned, no rain to show you on storm 4 radar. we're going to be talking about the chances of rain during the day tomorrow and maybe into thursday too. i'll update you on the exact impact of that next storm. one thing you won't have to worry about, look at those temperatures at 11:00, 52 degrees. that's not bad at all for january 31st. >> thanks, doug. coming up at 5:00, an urgent

doctors hope it will give patients peace of mind they'll be able to get the help they'll need. >> all of a sudden your chest gets heavy, there's a lot of pressure there, my jaw started hurting. >> michael winn is all too familiar with what it feels like to have a heart attack, that's because the 67-year-old virginia man had three of them last year. >> that's the way last year went. it seemed like any time i tried to do anything, i had a heart attack. it's a scary thing, because you're really -- you can be feeling fine, and the next minute you're gone. >> reporter: after surviving the trio of heart attacks, they joked he must have nine lives. >> i know eventually i'm going to have one and i'm not going to make it, that's just the way it is. it's family history, smoker, all the odds were against me. >> wouldn't it be nice if winn could get a warning before his next heart attack?

now, doctors are testing a new device called guardian which can alert patients when there are changes in their heart function. >> it's a device that will help our patient decide whether they're having any symptoms, it's a true heart attack or false alarm. >> the device comes in two parts, it's similar to a pacemaker. interventional cardiologist is testing the device here in virginia. >> it can detect any decrease in oxygen or suggestion of changes in blood flow to the heart, which is usually the cause of that heart attack. >> when these changes occur, the device in the chest will vibrate and the pager will beep. if a yellow light is flashing, that means there's been a nonemergency cardiac event and the patient should see a doctor within 48 hours. if the light is red, the patient could be having a heart attack

right now and should immediately go to the emergency room. >> the sooner you get there, the better chance of survival and less damage to your heart. >> i think it helps to kind of take some of the anxiety out of everything that's going on. >> reporter: michael has been using the device for about three months now. so far he hasn't had any heart attacks or problems, but he says wearing the device makes him feel better. >> it gives you peace of mind. maybe i can get some help quick enough, instead of worrying about it all the time. >> the guardian device is already being used in europe and brazil. here in the u.s., doctors are testing on people who have had a heart attack within the last six months. web dirks jim, you can imagine if the testing is successful here -- >> especially the man who said he was doing nothing and had heart attacks. >> it's a scary place to be. he's back indoors and he has a jacket on. imagine that, on a day like this. >> this is like company issued.

>> yeah, it is. >> it's going to be 64 tomorrow? is it really going to be 64? >> 66. today was 65 about we hit 66 at dulles today. that's a new report high temperature. and the actual high is 71. so we're only about 5 to 6 degrees away from that record. it was so nice today that we got out and shot a little video for you. this is in northwest washington, where the kids are lovin' it. this is the day where they come home and you go, yeah, jimmy, where's your jacket. oh, that's right i forgot it at school. that's exactly what happens on a day like today. take a look, just a fantastic afternoon. currently 64 degrees with plenty of sunshine. the sun going down in the next couple minutes here, winds out of the south-southwest at 15 miles per hour, the winds are going to continue to give us nice warm temperatures right on through the night. culpepper down, they were at 70 earlier, down to 64 degrees

right now, 61 in winchester, here's that little area right along the bay. if you're right along the bay, a little bit of a southeasterly wind here, that's cooling you off. what a difference between 64 in washington and 48 degrees right along the water there. storm 4 ray czar, nothing to show you in this area. we're not going to see any rain from tonight's system. notice back to the west, this little band of showers in cincinnati. that's a cold front that's going to try to make its way in here tomorrow. warm out ahead of it, you already know that. we'll stay with the southwesterly winds tomorrow, ahead of this front tomorrow morning there is going to be a chance, at least a shower, maybe a sprinkle early in the morning, then i think that will get out of here, and we'll see partly cloudy skies. another chance of rain coming in, late wednesday night into early thursday, as this area of low pressure moves to our south. most of the rain from this should stay to our south, i wouldn't be surprised to see rain during the day on thursday. not a washout by any means and

you only need a little purse umbrella we talked about from time to time. behind that, we get cooler, but not too cold. 65 in st. louis, 56 in cincinnati. 66 in memphis, we still have a lot of warm air to make its way our way. we're going to stay on the warm side tomorrow. 55 dropping down to 50 degrees with the winds out of the southwest at 10 to 20 miles per hour. tomorrow morning starting off on a mild note. the average high is 44. i think 45 in the district, 39 in some of the suburbs with a possible sprinkle here and there. tomorrow afternoon, partly sunny and mild again. 62 to 63 degrees, there's your next four days at least. 53 on thursday, 52 on friday. temperature around 47 degrees. if you have weekend plans, just stay tuned. this is a tricky weekend forecast here. i think anything that happens would be in the form of rain not snow. don't worry about that.

of dollars. the fbi says it hasn't finalized plans for johnson, he could be heading to the federal prison in north carolina where bernie madoff resides. he's expected to report to prison on february 18th. anger in richmond today as many rallied against a voter i.d. bill. they're expected to cast a provisional ballot if they show up at a polling place without a photo i.d., instances of fraud in virginia are rare. and call the bill an effort to discourage the minorities, the elderly and students from voting. an ominous warning that didn't come soon enough. >> there's a car going the wrong way on 97th. >> the 911 calls from the moments leading up to a crash

police in prince georges county make an arrest in the murder of a local activist. linwood johnson is charged with the death of lenny harris. authorities found harris' body in a well this past weekend. the motive was robbery. a fatal accident creating major gridlock in prince georges county, where all southbound lanes south of route 450 are still shut down at this hour. the crash happened just before 3:00 this afternoon. they're trying to figure out how one vehicle ended up upside down and another ran off the road. governor o'malley called on lawmakers to support his bill that would give couples the same protections as husband and wife. if it passes, gay couples could marry at city hall, but churches could refuse to marry them. the weather out there just about perfect for those of you who are really enjoying the

community. gerrald foltz heard what happened this morning, and he stopped by to see if he could help. >> as a pastor in the united church of christ in centreville, it's an insult to the whole religious establishment, whether it's a church or a mosque or a synagogue. we all feel the hurt. >> reporter: investigators say there's no indication this is a hate crime. nothing was taken from inside the mosque, no graffiti left behind. it is a felony, and there are serious consequences for those responsible. in chantilly, megan mcgrath news 4. martin o'malley wants to implement a 6% tax on gasoline. that means about 6 cents a gallon for the first year, 18 cents or more by year three. what does that mean for you?

the average gas price right now is $3.48 a gallon. so if you have a 15 gallon tank and fill up each week, a 6% tax would mean an extra 150 bucks a year. meanwhile, if gas hits $4 again. that could spell about $190 extra to your bill. o'malley says the plan would include a way to halt the increase if gas prices spike in a particular year, he also wants the extra taxes to go only to transportation. the proposal will be formally introduced after tomorrow's state of the state address. the louden county school board is holding a public hearing tonight on proposed school budgets. 70 people have signed up to speak. right now bus drivers are eligible for benefits after they work three and a half hours a day. the drivers would have to work additional hours under the proposed plan.

about fake traffic tickets targeting drivers. >> if you file your taxes early, you'll likely have to wait longer for your return. there's a new app that's designed to let you take control of the tv in your hotel room. >> no one can figure out the hotel remote any more. it's amazing. the traffic ticket scam comes in the form of an e-mail. this is what the e-mail looks like, it appears to come from the department of motor vehicles, there's a red flag, though, the e-mail's date of offense appears in a european date format. that would be day, month and year. it wants you to click a link to the attached ticket. if you click it, the malicious program automatically installs on your computer. to remind consumers to protect themselves, a lot of

jurisdictions prefer to mail tickets. if you thought you were filing your taxes early to get a fast return, think again. an irs spokesperson says new safeguards installed in an irs computer system to prevent refund fraud. taxpayers who file their returns before january 26th, returns that are accepted on or after that date will not be accepted. steaks and burgers your favorite food? be ready to pay more at the grocery. the department of agriculture saysed u.s. cattle herd is at its lowest in 60 years, that means you may soon see higher beef prices at the grocery store. many ranchers say they thinned their herd last year because of the soaring price of corn. travelers with smart phones can now use them for entertainment other than listening to music and watching

president obama slid behind the wheel of some of america's fastest cars today. it was all part of his visit to the washington auto show. that ride looks good on him. the president got an up close look at eight american made vehicles. he checked out a black corvette that he said was just like his buddy had in high school. the president also -- that is a sweet ride. vance has something similar to that. he also touted the resurgence in sales to chrysler and gm, and shows the kind of turnaround that is possible when you invest

it's been nearly two decades, but finally tonight, justice for a woman who was harassed and stalked by a man since high school. >> shawn monthly was sentenced to more than 36 years in jail. it's the second time he's been jailed since refusing to follow court orders. aditi roy explains. >> reporter: he was an eighth grade misfit, awkward and troubled. tracy felt sorry for him. one day in the library she offered to help shawn with his homework. >> casual conversation, nothing seemed out of the ordinary, and then when the class was over for that period, left and went about my way. >> reporter: for monthly, the

encounter was anything but casual. he started following tracy around school and kept it up the next year when they both went to high school. she asked him to stop, but that just led to phone calls and disturbing letters. in one he writes, my blood will stain your hands forever. tracy suffered through his harassment throughout high school, even after moll was expelled. she went to police and got a restraining order. >> he went to my previous employer, and trying to find my sister at her employer. >> reporter: in 2001 he was sentenced to 8 years for stalking. that didn't stop him. >> at first it was writing to tracy, calling the house, and then it was trying to get magazine subscriptions in her name, and then trying to get other inmates to write. >> upon getting out, went pretty much right back to trying to

track tracy down and found her through her sister jennifer, i believe it was mylife account that jennifer didn't use any more. >> he wrote me a letter saying when he got out he had nowhere else to go, he wanted to come live with us and it would be better if tracy didn't have a boyfriend. that scared the heck out of me. >> reporter: he was quickly convicted and sentenced again this time for 26 and a half years. >> he absolutely tore the family's life apart. >> i would have never thought it would go on for as long as it has. and just the fact that it has, it's not going to end. >> tracy barely knew moll before he became obsessed with her, and ironically prosecutors said if she had gone out on a date with him she would have more legal options to deal with the stalking. isn't that bizarre? >> yeah. that's hard to believe.
