good call, doug. >> 72 degrees on february 1st? really amazing how warm our weather has been so far this winter and right now, an extremely nice evening. see the fairfax county public courthouse behind me now. look at what is happening across the area. current temperatures, 67 at the airport. let's take a look at some of the other numbers. we are still talking about numbers in the 60s and 70s down toward fredericksburg. see the warm temperatures on through the night tonight but then start to see things change a little bit as we move on through the next 6 to 12 hours. radar showing rain just to our south and west. some of the rain will try to make its way in here overnight tonight, in through the day tomorrow, that storm will move on out, we will see some cooler weather as we end the week and head into the weekend. as far as temperatures go for tonight though, this evening looking very, very good with mostly cloudy skies across the area, temperatures remaining in the 50s even through 11:00 at night on february 1st.

just amazing. by the way that ground hog comes up tomorrow, don't worry about him. >> we are sticking with you. we will be checking back in a bit. elected leaders took the first step toward abandoning a much-criticized plan to offer online gambling in the nation's capital. >> a council committee voted to repeal online gambling after complaints the original process was poisoned by a lack of public scrutiny. tom sher wood is here with the story. tom? >> the lottery brings in a lot of money, online gambling was going to bring in millions more, but for now, it is essentially dead. d.c. lottery officials hoped to be the first in the nation to capitalize in online gambling last year, with tens of millions of dollars to be made in city revenues. after a year of controversy, allegations of secrecy you complaints of no public hearings and critical inspector jeep report, a key d.c. council committee voted to repeal any

online gambling with a full council expected to do the same tuesday. >> really goes took this whole ethics thing. we passed an ethics bill and that's, in my view, talking you the talk what we did today was walk the walk. you know, implement the ethics that you voted for. >> reporter: at-large council member michael brown, who first added online gambling to a budget bill in late 2009, defended the bill and said the city is foolish to give up on so much revenue. >> i have said from the beginnings about revenue and protecting the residents of this city and what i have been doing. >> reporter: but brown and council member marion barry were only to save the gambling law. muriel bowser, committee chairman evans and at-large member david cat tanya voted to kill it, with cat tanya saying the city suffers from worries about ethical behavior and corruption. >> we are operating in an environment that has been poised and poisoned, i should say, with a whole hot of ethical conflicts and issue, including the first time a member has resigned in disgrace, having stolen public money.

a big inconvenience for metro riders and businesses at the south entrance to the due pop the circle station. the entrance is closed for the next eight months while escalators are repaired. news4's angie goff reports. >> reporter: the task, it's huge, taking eight moment, the longest time a station has closed, according to metro.

crews started the process of ripping out three escalators. they have already built a staircase and vent shaft as a way out for workers in case of emergency. from now until october you will have to use the north entrance near q street. this morning, we got mixed emotions from people who use and work around the station. >> definitely a good sign that they are going to repair that i mean, obviously the fact it is going to take eight months it is a long time. >> my business is when the people come out and the way people go. so, look, that's my business. there is not anything. so, i'm like this i don't know how i'm gonna survive. i'm gonna be homeless. >> reporter: very tough for those who work around this station and depend on that rush coming through to support their businesses. meanwhile, we want to let those who use the station know that the farragut north station, the construction there the long-term construction, has been suspended to free up some more space for those wanting to use that station as an alternate. we have also learned that despite there being signs saying the three entrances at farragut north are closed, they are all open.

reporting from du pont circle, angie goff, news4. >> there will also be occasional closings of 19th street northwest, this is all part of metro's multiyear, multimillion dollar plan to improve escalators and elevators. we have had a spectacular day, especially for the first of february and doug is out in fairfax, grew up out there, visiting some friends out there. and telling us if had is going to stick around for a while. >> wendy, you talk about where i grew up, down the street down there is the mcdonald's where i had my fifth birthday party. right there is the fairfax county courthouse at 16 years old, i had to take one of those driving courses with my mother because i got a speeding ticket and right down that road is where i went to preschool. yeah, yeah, this is definitely my hometown, it has grown quite a bit since i was here -- since office baby ten years ago. let's take a look, show what you is happening across the area. first off, here we are in fairfax county today.

yesterday, i was in prince georges county, vanceville elementary school, talking to the kindergarteners there the first graders as well, i want to say hello to all those kids, trying to get those pictures on yesterday, we got them on today. thank you guys for having me out to your school, a great time, talking all about the weather during the day yesterday. temperature-wise outside, first off, moving into february, you know that, february, for you know? lovers, take a look at, this the average snow in the month of february, just over five inches of snow. so there is some hope, if you are hoping for snow. of course, no snow tonight, no snow any time soon. as far as the temperatures go out there right now, currently sitting at 67 at the airport. going to continue on this mild streak through the rest of the night tonight and then a little bit cooler tomorrow. around the region, we are into the 60s in most location, still 70 degrees toward the red ricksburg area. widen out, notice the temperatures across the mid-atlantic. those temperatures, very warm around our area, temperatures in the 70s just to our south. notice what's going on back toward ohio and ken keep, high

temperatures only in the mid-50s there, what you can expect the next couple of dies in our area. so no, we don't have any frigid air coming in, but it will be just a little bit cooler. there is the rain across our area right now, just well down to our south and west, but it is going to continue to move into our area, we move on through the rest of the evening tonight and into the overnight hours through tomorrow morning. tomorrow morning's rush hour could be a little bit on the wet side, although we are not expecting to see a whole lot in the way of rain. as far as what we are going to be seeing this evening, looking very good, temperatures on the mild side, stay nice and mild, partly cloudy to mostly cloudy skies out here, tomorrow morning, wake up to temperatures on the cooler side of things, but not bad at all, really a nice morning, a chance for some shower activity, you may need to take the umbrella, but that is going to be about it. tomorrow afternoon, temperatures a little bit cooler than they were today by about 10 to 15 degrees, maybe even 20 degrees in some location, but that still puts us about 10 degrees above average, where we are going to stay the next couple of days.

the weekend does look like we are going to see temperatures potentially in the 40s, at least for part of the weekend, but not a bad weekend out there i think the rain should hold off until late in the day on saturday -- rather late in the day on sunday and could continue into early on monday, too, so we will continue to watch out for that little storm. it is not going to be a big storm, that next storm will usher in a little bit of cooler air as we head in toward next week. so as far as weather is concerned, really not all that bad. i can tell you this though, right here on 123, main street right here, 123 this way, the traffic was horrible, horrible, about 40 minutes ago. that's just my traffic report. >> and just to clarify, you are not back there to pay that ticket from 16 years old, right? >> jim, it was now up to $1232. i had to write that out today. >> yeah. >> they showed up. came right over. >> i will bet they did. they know where to find you. thank you, doug, see you in a bit. while we are in northern virginia, president obama went there today to announce a new

mortgage refinancing plan that would provide relief for what he describes as the responsible homeowners who make their payments on time. erika gonzalez is here with the details and the reaction from the local realtors. erika? >> reporter: when dirk the president says the make or break moment in this economy for middle class americans lies in their home. obama has a new plan he slays hold banks and lenders accountable for what caused the housing crisis in the first place. >> the president unveiled his program in falls church today. it would save homeowners with no more than one delinquency in six months $3,000 a year. many homeowners aren't flocking to refinance because they can't. >> falling prices lock them out of the market.

they were underwater, made more difficult for them to refinance. then you have got all the fees involved in refinancing. >> reporter: the president's plan includes a noticeably shorter mortgage application. >> simple. not complicated. informative. not confusing. >> reporter: with an estimated price tag of $5 to $10 billion, john waller with the northern virginia association of realtors says he is almost certain the bill will get resistance on capitol hill. >> realtors don't really care whether the democrats or the republicans propose this, we are thankful that the president has decided to take a stand. >> reporter: but he says obama's plan is just what the nation needs to get people over the edge of the housing crisis. >> president reagan said a recession is when your neighbor loses their home. depression is when you lose your home. >> reporter: fairfax county is weathering the storm. in fact, realtors say their biggest problem is a shortage of the homes on inventory. i will have more on that story

not in storm center four today. i mean, how could we be inside, when it is such a beautiful afternoon outside? 72 degrees the high today in the d.c. area. we are, of course in fairfax county right now, right in the middle of fairfax, as a matter of fact, watch sk the nice, warm temperatures, a lot of people out enjoying the weather during the afternoon today, but we will see some changes, look at the changes on storm four radar, see where the rain is down to the south, currently, 67 degrees out there, winds out of the west northwest at 7 miles per hour. that rain right now down toward the roanoke area, but it is moving our way, show you when it moves our way and when it moves out coming up in my forecast.

>> all right. thanks, doug. tonight, we are learning more a murdered community activist and his connection to the man accused of killing him. now the brother of lenny harris says he would like to come face to face with that suspect. news4's darcy spencer is live in alexandria with an exclusive interview. darcy? >> reporter: wendy, i met sherman harris here at the rec center where his brother was last seen alive four months ago and it it's true, he says woe like to meet his brother's accused killer, this man here and talk to him about what happened and y he also says this is one of the many people his brother tried help. >> just to see the love that people just given my brother is amazing and it's given us peace. >> reporter: sherman harris is the brother of lenny harry, the missing alexandria activist who was found dead inside a well in fort washington over the weekend. in an exclusive interview with news4, he said family's faith is holding them together. >> how is the family holding up?

>> well, first, i want to say thank god, because had it not been for god, we don't even want to imagine what it would look like. god's been so good to our family, covering us and we were so grateful. >> reporter: lip wood johnson is the man charged with shooting harris to death. the motive was robbery, police same johnson was hired to sell t-shirts by harris after johnson got out of jail. >> i would like to talk to him and pray for him, i know is a bad spirit in him. >> reporter: harris last seen at this rec center in alexandria in september. his body may have never been found if it weren't for an anonymous 911 caller that caller directed police to the well next to an abandoned home on old fort road. >> whoever called that call in i thank them. i thank them from the bottom of my heart. >> reporter: johnson appeared in court in upper marlboro and order held without bond. court records show he has a criminal history dating back to the 1980s.

children at a los angeles elementary school. he blindfolded and gagged the children and took pictures. some of the kids were covered with cockroaches. he faces a light prison sentence if convicted. in richmond, a bill that would allow home schooled students to play on public school sports teams has cleared a big hurdle in the legislature. the house education committee approved the measure. parents who home schooled argued that they are taxpayers and kids deserve to participate minter school latist sports. public school administrator, teachers and pta supporters say it sun fair. the measure is known as the tebow bill, named after nfl quarterback tim tebow home schooled in florida but played for a public high school team. maryland governor martin o'malley laid out his vision for the future today. he delivered his state of the state address detailing plans to improve the economy, create jobs and improve transportation by increasing taxes. as news4's chris gordon reports, there's mixed reaction in annapolis. >> reporter: governor martin o'malley says the state of the

state is strong but lawmakers must continue to make tough choices in spending cuts to continue to move out of an era of recession by creating more new jobs. the governor says maryland has some of the worst traffic in america. he says a transportation funding plan can no longer be delayed. >> the best remaining option, in my view, is to repeal the current sales tax exemption on a gallon of gasoline, phasing it out by 2% a year, with a braking mechanism to protect consumers in the event that the price of gas spikes. >> reporter: the governor's plan to apply the 6% sales tax to gasoline phased in over three years could many that maryland motorists pay 21 cents a gallop more and republican lawmakers plan to push back against the gas tax increase. >> citizens can't afford to pay their bills right now. when you raise the cost of gas, you raise the cost of food and goods and the services across the board. this governor doesn't seem to

care. >> reporter: montgomery and prince georges county executives gave earth gas tax increase. >> in the long run, this is going to help us create jobs and expand our economy in the county it is a good thing for us. >> we need money to build the road. so i support t. >> reporter: in another controversial proposal, governor o'malley would like to shift the burden of paying teacher pensions from the state to the counties and cities. >> that's the one area i think i disagree with the governor on, a difficult challenge for the state, but i think simply passing it on to the local communities is not something that we can accept in montgomery county. >> reporter: governor o'malley says it is time to pass a civil marriage law that protects civil freedom and civil marriage rights equally but still unclear if he can garner enough votes to legalize same sex marriage n annapolis, maryland, chris gordon, news4. a major drug company a major drug company recalling 1 million packages of [music playing] confidence. available in color.

>> how long have you been driving this? >> i have been with grave digger for 15 years. and i love every minute of t. >> reporter: what jd would really like do is design computer games that include things like monster trucks. he says he wants to go to college to major in graphic and game design. his social worker says jd is doing very well in school. >> he does excellent in school. as, bs. >> reporter: he says jd likes school and someday will make a family very proud of him. >> he has got a big heart. he has got a lot of love to give and he just needs someone to wrap their arms around him and take him in. >> reporter: the computer game jd says he would most like to invent would allow people to create their own virtual world and what would his world be like? >> everything would be in peace and we are not going to be at war, i will have a family in that house. >> reporter: perhaps that virtual world would include a drive in a big monster truck.

drugmaker, pfizer, is recalling 28 lot, nearly a million packages of birth control pills. >> comes after the manufacturer found a packing error that could lead to some unwanted pregnancies. news4's doreen again thes letter joins us with details on this. >> hi, jim and wendy. the first thing women should know is that pfizer says nobody will get sick because of this recall. it involves two products, the first is the brand name lo/ovral 28. a typical packet comes with 21 active and 7 inactive tablets but an error caused packages to include too many or too few of the active form. the main risk associated with this is unexpected pregnancy. we talked with a doctor at george washington medical university what women should do. >> definitely, if you are taking birth control pills that are involved in this recall, for the

information such as the gestational able of the fetus and women would not be required to listen to the heartbeat or look at the image. the bill now moves on to the largely republican house of delegates. if it passes, it is expected to be signed into law by governor bob mcdonnell. the partnership is over between two of the nation's largest organizations that serve women. the susan g. komen foundation will no longer give grants to planned parenthood for breast cancer screenings. the komen foundation says its new policy bans it from funding groups that are under investigation and congress is looking into allegations that planned parenthood misused public money for abortions. planned parenthood accuses komen of cave nothing political pressure from anti-abortion activists. the nation's largest pediatrician group now wants boys, as well as girl, to get the hpv vaccine. the american academy of pediatrics released its new recommendation today. the new data shows giving boys the vaccine could help loosen

the odds of hpv-associated cancer in women and men. it is transmitted sexually and linked to cervical cancer in women but certain strains are also the cause of many head and neck cancers, particularly in men. >> wait until you think you know when they are sexually active, you may miss the opportunity to protect them. >> doctors say the boys could get the vaccine as early as 9 years of able and say the vaccine is most effective at creating hpv antibodies when kids reach age 11 or 12, often before they reach sexual maturity. a bush to legalize marijuana distribution in virginia has failed. state delicate david england from alexandria filed a resolution to reclassify pot as a schedule ii drug that would have put it in the same category as morphine and other strictly regulated drugs that doctors can prescribe but the bill couldn't get house threw a house committee for a vote last night. england is pushing for a study that would look into a revenue potential of selling marijuana in state-run liquor stores.

and we are going to head back out to fairfax county where doug has another check on our forecast. doug? >> another check on the forecast and a great shot right now, looking up main street through fairfax. you could see the sun just going down here in the city of fairfax and on the rest of the area, dusk coming across and really just a gorgeous afternoon. here we are in the middle of fairfax, temperatures still in the upper 60s on february 1st and you don't even need a jacket out here. let's take a look, a lot of people say i don't remember when it was this warm. how about this? this year, we have seen a january of 40.7 degrees, warmer ones the last ten years, how about 2006? that was one of the top ten warmest ever. and in 2002, 41.6 degrees, so we were warmer then as well. and yeah, we have seen a lot of warmer januarys a lot of warmer months over the past couple of years and that's trend that is just going to continue. as we look through our forecast right now, current temperatures, 67 degrees, plenty of clouds across the area, winds out of

after a two-year-long drug and weapons investigation, fbi agents thought they had their man, but a last-minute mixup put them at the wrong door. as victoria block reports, the mistaken raid left a mother and her 3-year-old terrified. >> i took two steps, faced the second door and i heard the click of a gun and saying fbi get down, so i laid down on my living room floor. >> reporter: judy sanchez describing how she was terrorized during an early morning fbi raid in fitchburg. >> i'm screaming, you have the wrong apartment you have the wrong apartment, over 50 times and then i seen the big blade coming down my door. >> reporter: feds chainsaw third way into their second floor apartment before realizing they had hit the wrong spot.
