was apparently the moroccan, officials say he's illegally present in the united states. he was charged today by criminal complaint with attempting to use a weapon of mass destruction against the united states. if convicted, he faces a maximum penalty of life in prison. according to the court documents, amine el khalifi told people he thought were members of al qaeda, they were actually fbi and law enforcement agencies, he told them he wanted to blow himself up in the united states capitol building in washington, d.c. he also told them that "he would be happy killing 30 people." again, this is what is mentioned in these court documents that were given to us a short time ago. apparently during this time since december, he told the undercover agents he wanted to bomb a restaurant where military officials gathered. then he changed his mind, eventually setting his sights on

the u.s. capitol. he was arrested near there earlier today. i'm jackie bensen reporting live in alexandria. back to you. investigators tell us undercover agents had been watching him for months. >> rigthe lives on windham circn alexandria. jane watrel was the only reporter who was able to get access to that complex and she's live there with reaction from the neighbors. >> reporter: it's been a scary day for neighbors. they've been rattled about what's been happening right here in their neighborhood. many of them knew who el khalifi was. they said he wasn't particularly friendly, but never thought this homegrown terror was going on. as jackie said, the 29-year-old is facing life in prison after being arrested in an undercover sting operation. that happened at noon on capitol hill. after that, agents came here to

alexandria to start searching his condo. according to the charging documents, we are learning more about this. the alexandria resident wanted to blow himself up and they say "he believed he was working with al qaeda. he devised the plot, the target, and the methods all on his own." this case of homegrown terror has sent chills through people here in the condo complex. agents spent the afternoon searching the alexandria condominium believed to be home to amine el khalifi. neighbors say he had little reaction with them. while others reacted to the news of the foiled terror plot. >> it's quite scary actually. but it's the world we live in, especially post 9/11, you have to be very alert and just thankful to god that no one was hurt. >> reporter: the neighborhood is gated, perhaps giving some here a false sense of security.

>> just the idea that one of the people that lives around here would be involved in something like that is really spooky. >> reporter: government officials believe he was a lone wolf and not a member of al qaeda. he had been monitored for several months. while he expressed the desire toe bomb a military base or synagogue, he later settled for the u.s. capitol's visitor center. it was undercover agents who gained his trust and broke up the plot. >> it's a brand new day here in america post 9/11. it's unfortunate this is what we have to deal with. but this is how many countries live and it's how it is. >> reporter: no one knew how long he has been living in this alexandria condominium complex. federal agents are still behind me, searching his condo. jane watrel, live in alexandria. >> and that last sound bite from that gentleman, he makes a good

point, where we are today. let's go now to erica gonzalez. >> she's live in a south arlington home where agents have been busy this afternoon. what is going on there, erica? >> reporter: as you mentioned, we are in south arlington, located on 1608 south randolph street. it is the house behind me. it's a red brick house. i'm going to move out of the way so you can look at that. the video that we shot a little while ago shoes one man being escorted out of the home. what we are told by authorities is that this particular family is being investigated for a separate case. there is no terror nexus in conjunction with el khalifi and this family. the video shows fbi investigators on scene in coordination with the ncis team, going into a shed into the

backyard of this home. inside the shed, droves of shoeboxes being pulled out by investigators. a few minutes ago, a big blue tarp was placed over the shed so we could not see back inside the yard. it looks like it's being taken down now and investigators are putting those shoeboxes back inside. again, this is a home in south arlington, 1608 south randolph street. authorities say this particular family is being investigated for a separate incident, not in connection with amine el khalifi or the alleged terrorism plot that happened earlier today. again, separate incident. we know that this family apparently did have some type of relationship with el khalifi, but they are not correlated. investigators are putting back what looks to be just droves of shoeboxes back into a shed in

the backyard. live in south arlington, back to you. >> erica, thank you. nbc news chief justice correspondent pete williams has been track thing story all afternoon. >> i understand this guy went to a rock quarry to try to demonstrate how bad he wanted to be. >> the sequence of events, according to the fbi and court documents, starts a year ago when the fbi gets a tip that he's interested in trying to mount an attack against the u.s. he's interested in guns and jihad. then the whole thing ratchets up in december when he begins meeting with people he thinks are al qaeda operatives but who are fbi undercover operatives. according to investigators, he said he wanted to try to blow up a restaurant or some place where military people hang out in the alexandria area. but then it changed in january when he said he wanted to turn his attention to the united states capitol building. but they stay that about a month ago, in mid january, that he

went with these undercovers to a rock quarry in west virginia where they set off some explosives. after looking at the explosives that they said they could provide to him, he said i want a bigger explosion than that. he said he would be happy, according to investigators, to kill at least 30 people. so they continued to talk to him. he continued to refine his plans. it all came down to today. he had chosen this day as the day for the operation. they drove him in a van from virginia to a parking garage here the u.s. capitol a couple blocks away, gave him what he thought was a vest containing a bomb, which turned out to be inert materials and gave him an inoperable gun and then he was arrested. >> why did it take so long? why did they have to go up to this point where he's dressed and walking toward the capitol?

they couldn't have gotten him or busted him any time before that? >> they could have. but they feel it's a better case, if they can show a jury, look at all the steps he was willing to take. you can't emphasize enough that this was a sting operation, that he never had any explosives. so you always ask yourself in a question like this, what if they hadn't had a sting? what if the undercover people hadn't provided him these explosives is, would he have been able to do it on his own? that's an unanswerable question, but he was willing to take these steps and unlike other stings, here was a person who was actually willing to wear the explosives and blow himself up in a suicide operation. so that makes this order of magnitude different. >> we were hearing earlier he's been in this country about 12 years. how much of that was he here

illegally? >> illegally beginning in 1999 when his visa expired -- no, that would have been 12 years. his visa expired several years ago, so he's been here for quite a bit of time on an expired visa. >> do we know if he had family here or do we? >> he came with some family. it's not clear what sort of fam li he still had while he was here. >> what does it say about the fbi that when this guy reached out, does this tell us something about our fbi reach that when this guy reached out to try to find a way to blow us up, the first person he comes in contact with somehow gets into the hands of the fbi, does that make us feel better? >> the fbi is very attuned to this. but i will bet, and in these cases they're never eager to tell us how they get on these things. i would bet that at the end of the day, what we'll find out is that it was people in the community. because the court documents say

it was based on a tip. so the assumption you have here is that when he started talking with people about his interest in jihad, someone thought, you know, this doesn't sound right and notified law enforcement and that's what brought the fbi in. i bet that's what this turns out to be. >> what a day this was leading up to. >> is there anything that his lawyers, when he goes to court, will say this was a setup. is there any way the defense lawyer will be able to say he set him up? >> they'll say that, but the fbi has won a number of convictions at trial in these operations where someone expresses the desire and then the fbi dangles undercovers in front of them. the task for law enforcement always is to show that these people were willing to take the steps on their own, that they suggest these various things and the fbi keeps them under control so they don't go out and try to do it.

we want to update you on the breaking news. a big story we've been following, a man arrested by the fbi for allegedly planning a suicide terror attack on our u.s. capitol visitor's center. police say his name is amine el khalifi. he lives in alexandria. agents raided his home this afternoon. he was arrested blocks from the u.s. capitol today and after he put on what he thought was a vest that was containing explosives. in fact, undercover agents had given him that vest and they arrested him. fbi says they were watching him for months and believe he did

act alone. george huguely's murder trial resumed this morning, but it ended early because a member of his defense team is still sick. he's charged with first degree murder in the beating death of his ex-girlfriend yardley love. he did not want the trial to continue. >> reporter: for a second day, george huguely's defense attorney came to court without co-counsel. her illness has created a setback in an already behind schedule trial. only she's prepared to question the medical experts. the other attorney told the judge he was ready to move ahead with the other remaining witnesses. that's when hughley got his attenti attention. he then told the judge he didn't want to proceed unless his full legal team is present. but the judge ordered lawrence

to move forward. attorneys saying delays could be hurting both sides. >> for the commonwealth, it means their case is further removed from the jury's mindset. on the other hand, some people thought that the last defense witness wasn't terribly strong. so to have that bad taste lingering in the mouth for a while isn't good. >> reporter: george huguely's aunt provided important testimony. she narrated a surveillance video taken at a restaurant. she was there with her teenage daughters at a lacrosse gathering. the videotape recorded a day before yardley love was found dead shows both of them holding hands. she says love approached her and warmly hugged her daughters. prior testimony revealed just days before that event, george huguely sent love an e-mail reading, i should have killed you after he learned of a

romantic rival. >> the commonwealth would paint the picture of an angry, brooding, jealous, vengeful defendant whose anger grew as the week went on. but the defense showed the video, which showed in fact, 24 hours prior to the alleged killing, there was good interaction. >> reporter: the defense has been told to be ready to continue tomorrow morning and to bring a doctor's note for the court record. >> and julie reminds us this case could go to the jury as early as tomorrow. any new developments we'll bring them to you. right now this weekend we are -- >> i'm sorry. i'll put it on vibrate. >> thanks for pointing that out. >> are we getting snow or not? >> and this is my sad face, because i was really hoping for some snow. that's my sad face. i was really hoping that they would get some snow in the area,

but as a weather guy you're not supposed to hope you're going to get something. what are we going to see today? we're going to see more of this kind of weather tomorrow and even warmer, 52 right now. it is simply gorgeous across the area and it's going to continue to stay nice through the evening tonight. a very nice night to get out and ant, a nice evening on this friday, as temperatures sitting at 52 degrees out there at the airport. winds out of the north at 10 miles per hour. around the region, currently we're nice and mild. manassas 56. right now, nothing on storm 4 radar. you can see that very easily. but as we widen out, here's where the storm is, and there's really two storms that have to come together here. here's the first storm down to the south. there's another tiny storm right here. doesn't look like it means a whole lot to this system, but it really does. this is the upper level energy

coming out of the north that would help to grab this one and move it up towards our region. i just don't see that happening. we call that phasing. that phasing is going to happen too late. so the two storms coming together here, but coming together just a little too far offshore, not allowing the storm to make its way up the coast. i think this area of low pressure will be to the south of cape hatteras, meaning the moisture will stay to the south, too. frederick, maryland, nothing for you folks. urbana, maybe nothing for you. howard county, could not see even a flake. and the latest trend is to take that line further down to the south, meaning washington may only see flakes from this before this storm system moves out and more sunshine on monday. some area also still get some snow. once again, this is our first call for the potential for accumulating snow and we have washington and annapolis,

tonight, the fbi again as we've been reporting says they have foiled a terror plot to blow up the u.s. capitol visitor's center. federal agents have arrested a man for allegedly planning a suicide bomb attack. law enforcement officials identify the man as 29-year-old amine el khalifi. >> they say that he's from morocco, but he's been living on windham court in alexandria and been in this country for a few

years. agents say they arrested him this afternoon. he was just blocks from tus capitol. he's been charged with attempting to use a weapon of mass destruction. tourists and residents on capitol hill are just learning of the latest terror arrest. >> the fbi action created quite a stir this afternoon. tom sherwood is live at 1st street and louisiana avenue up on the hill where the raid went down with continuing coverage of this breaking news for us. tom, what happened there this afternoon? >> reporter: jim, i want to tell you, we're a short walk from the capitol building itself. right now, we're here across from the alley where the terror suspect was taken into custody after a plan to blow himself up. a beautiful friday afternoon on capitol hill. but it was shaken by news of the fbi arrest in the alleged terror plot. tourists at first were concerned, and then relieved.

>> pretty intense with what's going on in this country. a lot of people are nervous. it's okay. >> reporter: and congrats maybe to the fbi? >> definitely. they're doing their job. >> reporter: what about that, the fbi tracked this guy for a while. he thought he was going to have a body full of bombs. >> amazing that he -- so naive to think that he was going to strap himself with bombs and go undetected. it's great they were following him. >> reporter: law enforcement officials said the 29-year-old suspect was taken into custody in this garage, where the attendant was stunned by the swarm of fbi agents. where were they? >> everybody was here. >> reporter: were they down there on this floor? >> i don't know. >> reporter: where did you see them? >> here and there. >> reporter: employees of the charlie palmer's restaurant said no one entered the upscale establishment. fbi agents declined to explain to the employees what was happening in the alley. but the busy tourist area was

abuzz with news that the fbi had foiled a suicide bomber right here. what do you think about that and the fbi actions? >> well, it's shocking to hear about it, but it's pleasing to know they were on top of it. >> reporter: now, all the tourists we spoke to today said that this kind of incident, they were glad that the fbi was on it, but this incident wouldn't keep them from visiting the nation's capital. >> what a dramatic day. tom, thank you. the weekend may not be as dramatic as we were hoping, because the snow is going to be here, maybe not, maybe over there. >> which is it, doug? >> that's exactly right. you say it best, the way we were hoping it would, because i know we were hoping for snow. jim, you were talking about snow, too. i don't think this is going to be a big storm, but i do think some area also see some snow from this as the storm is around the texas area. see that other area of low pressure around omaha?

those storms need to come together just right to get the moisture to work its way far enough to the north so that the d.c. area gets snow. i don't see that happening and i do see most of maryland and portions of northern maryland may not see much at all. washington still right on that boundary, though. so we will see something in the washington, d.c. area. the best chance for accumulation has moved to the south. we'll still two days out, but right now looks like most of this will stay to the south. two gunmen are on the run after robbing all-pro check cashing in fredericksburg, virginia. the robbery happened yesterday morning. take a look. the store employee told police when he unlocked the front door, one man grabbed him and placed a gun in his back. both forced the employee open that safe and cash drawers, too. before the men fled, they tied the employee's hands and feet. police are asking anyone with

information to call crime solvers. there's a reported privacy breach for millions of apple users who use the browser safari. >> google is responding to claims that the search giant exploited that security problem. why should this bug us? >> do you have 30 minutes? >> no, because it's not going to snow. >> here's the problem. as you know, if you have safari, if you are an apple user, either on your iphone or browser, safari is the way that you get on the internet if you have an apple computer. google wanted a way to find out if they could use -- if they could put a cookie in there, so that they could get their google plus application up and running and find out if you are a google user. this gets very complicated. the bottom line is, google found a way to get around the software

code and track people who are on safari, without their knowledge. so wherever you went, if you went to go shopping for a dress, if you went on member m.d. and wanted to look up a cure for whatever, hemorrhoids, you name it. so the question is, do you want people or anybody or a computer to know that you've been on web m.d., whatever the case may be? google says it was a glitch. apple is not sure. privacy experts say come on, this is exactly what google and facebook and all the internet advertisers want to do, they want to track your behavior. ever noticed if you look at a pair of boots and for the next three weeks boots pop up wherever you go. >> or say hey, you were looking at these boots, how about these. >> that's all because they're directing advertising directly to you based on where you've

been. if you are on safari, safari has an application that is supposed to give you privacy and most people expect that. the trouble is, google found a way to get around it and now they're paying a price for it. >> what is apple doing about this and what can users do? >> apple is going to address it in the latest edition of safari. there's a complicated way you can go into your settings and change it. but the big question is, this is the brave new world we live in. we live in a world, there are no internet privacy laws on the books, none, zip. we think if you go to your bank online that you're safe. we hope so. there are no guaranties right now. so the question is, what's appropriate, what's not? we're writing the initial chapters of this. >> and this will be on "nightly news the" tonight. but you're right, i always just atossumed they were tracking me. >> that's the best thing to do.

i walked by this place, haven't been in, but a new restaurant in adams morgan is getting a lot of buzz for some unique menu items. >> and our food critic takes us there. >> reporter: if you would like to know why snails hide in hush puppies, keep in mind that the chef previously cooked for celebrity chef michelle rishard downtown. he's top chef of a 128-seat neighborhood restaurant that weaves traditional french accents with american favorites. there's a little bit of something for someone on this menu. some of it is a little esoteric.

a guilty vergtd verdict today in the trial of a man accused of killing a maryland state trooper in 2010. it took jurors about three hours to find the defendant guilty of first degree murder and weapons charges for shooting this off duty trooper who was working as a security guard at a restaurant. derek ward has the latest from prince george's county. >> reporter: the prosecution's close was virtually no holds barred from the beginning, with a profanity laced string of quotes by the defendant. >> i think it was done in a textbook fashion that this could all understand. there were visuals there for the jury to see, as well. and we felt very confident. >> reporter: brown was gunned down just after midnight on june

10 of 2010. he had been moonlighting as security for the restaurant when he escorted the defendant out of the establishment for being unruly. the state maintains that williams exacted revenge for the affront to what the prosecutor called williams' fragile ego. she says williams called a friend, got his gun and came back to the scene to lay in wait for trooper brown before shooting him as brown stepped outside the restaurant to use his cell phone. >> he won't be with us, but the community will miss him and our lives will be forever changed because he's not here. >> reporter: the attorneys maintain the witnesses offered testimony about seeing the defendant at the restaurant and seeing him run away after the shooting. he also cited the absence of dna or fingerprint evidence. even surveillance video was called into question.

williams' attorneys tried toin still reasonable doubt by blaming an accomplice to williams. during the trial, testimony was offered that williams had put out a hit on that same accomplice while in jail and as recently as two weeks ago, williams was bragging about shooting trooper brown. the defense called those witnesses liars. but the judge and jury found enough truth in those witness statements to come back with guilty verdicts. i say judge and jury, because the defendant asked that the judge rule separately on one of the weapons charges because the defendant had a prior felony. they figured that put their client in a bad light. well, apparently it didn't matter, guilty on all counts. he's due to be back in court on may 10 and the prosecutor is expected to ask for life without the possibility of parole. derek ward, news4. >> that should give comfort to that trooper's family.

thank you. he's been web chatting about our weekend weather for the better part of the weekend. you getting an earful? >> we're getting a lot of questions. everybody wants to know how much snow they're going to get. one thing i want you to remember, this form is still two days out. so it's still very tough to pin point exactly how much snow we're going to get. i'm sure we'll have our final call tomorrow. first off, let's take a look at our future weather forecast. two separate forms, one in the northern branch of the jet stream, one in the southern branch. that's the one we need to make its way up the coast. the northern branch jet stream, that area of low pressure hopefully bringing up enough of that area of low pressure in the south that we do get some snow in the washington, d.c. area. it will stay farther south, though, so i'm not anticipating a lot in the way of accumulation. and by monday, this is all just

a memory. right now we're only going with a few flakes around the washington metro area. that doesn't mean you're not going to see accumulation, but that's the area we see, two inches down to front royal, manassas, maybe two to four, maybe four around culpeper and harrisonburg. the snow ends around midnight. some areas will see all snow here, but also a lot of melting. temperatures tomorrow will be close to 60 degrees in many of the same areas that will see the most snow on sunday. so most of that snow will probably melt on contact. another reason why this one is just so hard to forecast. >> what a weekend. thank you, doug. this could be the name of the snow, but akeem is here with sports. >> my favorite time of the week, the george mason patriots play beat the clock.

ice and into frigid pond water. the bigst hero had to bash his way through the ice to save one of the boys. >> i was thinking that i was going to die. >> reporter: 9-year-old ryan dugan was more frightened than he's ever been. >> it was up to my neck. >> reporter: he followed three kids out on the ice they now know was not thick enough to hold them. in a frigid pond that drops off to a depth of four to five deet, double that or more further out. but for the neighbors passing by at the right time, acting on gut instinct, this would have been a very different story to tell. they were panicked? >> absolutely. they were saying, help us, please help us. >> i used the ladder and gave it to one of the parents and helped get towels for the kids who were just getting out. >> reporter: it was the fourth boy who was in the deepest water and biggest trouble.
