ray mohr row, the commonwealth's attorney from fairfax county says he doubts he will reach a conclusion by that time whether or not to retry hash for murder. >> i'm investigating the case and i have to look at the investigation, initial investigation as well, so i think that's gonna take some time. i have two of the best detectives on the fairfax county squad. >> reporter: culpepper was shocked by the allegations that there was prosecutorial misconduct in the case. commonweal commonwealth's attorney gary close resign bud sheriff scott jenkins says he didn't do anything wrong. he has nothing to hide and believed it was a weak case from the beginning. >> not to say that he is innocent, just saying that the right thing should be done in the system works its way through the process and that's what i've done for many years. >> reporter: as michael hash left the courthouse, he asks what he looks forward to, he says seeing his family and home cooking. in culpepper, virginia, chris gordon, news4. and we are following a developing story.

there is a verdict in that wrongful death lawsuit against virginia tech. today, the jury found that the school was negligent in its response to the '07 campus shooting that left 33 people dead, specifically, the school delayed a campus warning after the first shots were fired. the verdict came after a 3 1/2-hour deliberation. the parents of two students killed in that attack filed this lawsuit. each family was award $100,000 in damages. virginia tech released a statement saying it is disappointed with today's decision. a spring convenient in the nation's capital will happen here ahead of schedule because of the unseasonably warm weather. the cherry trees will reach their bloom one week earlier than expected. tracee wilkins harmon on on that and how folks are dealing with the summer in spring. >> reporter: some washintonians are dressed for winter, some dressed for summer.

unloaded at the maryland live casino today, but that's just a fraction of what's coming to the casino at the aroundel mills mall. >> while some were hoping the $500 million venture would be generating more money and jobs to the area, others not convinced. news4's melissa mollet has more from hanover. >> reporter: 100 brand-new slot sloth machines but just a fraction of what will soon fill the casino floor here at maryland live, slots and electronic table games like blackjack and roulette. >> we have 4,750 gaming positions here at maryland live. there's not a single facility in -- on the las vegas strip that has over 2500 machines. >> reporter: crews are actually up loading these machines on a loading dock right behind me here. they come up this corridor and each one is then taken right onto the casino floor. they are install and tested. that process takes about ten minutes. >> we have project lists on top of project lists for where we are right now. the slot machines going in is a

if you come out this weekend, you will see some blooming, especially on the other side of the parking lot here. the trees normally bloom the last week of match, the earliest bloom evers was back in 1990, a very warm march then, a warm march now, the second earliest in 2000, march 15th and march 17th respectively, now thinking about this one coming in, maybe march 18th. this could be the third earliest bloom on record here at the tidal basin, just amazing. also the 100th anniversary of the cherry blossoms here in our area. let's take a look, show what you is happening weather-wise. you know it is a fantastic day. the good news it is also going to stay extremely, ex-extremely nice, through the next out confidence days. we will see a chance for thunderstorms out there right now, the tidal baines, you can see a few of the trees starting to bloom and green, some of the deciduous trees out there. the numbers, current late 78 at the airport, with abundant

many people are asking why he was on the street in the first place. the victim, heather lynn mcchoir told the court she feared for her life, a few days later, she was dead. pat collins is at the courthouse in rockville pike. pat? >> reporter: this case is closed, but questions, they linger on. like why did this judge let this guy out? they had him. they had phillip gilberty in custody for violating a protective order. they had him in jail. but monday, judge let him out. tuesday, he kills his estranged wife, shoots her inside her van and then dumps her body out on connecticut avenue in kensington. tuesday night, with police close on his trail, gilberty kills himself at a home in rockville. the murder victim, heather mcgwire, 37 years old, she and

gilberty had children in common. last year, she got a stay away order on gilberty. she said he threatened her. i catch you with another man and i will kill you both. last weekend, she said, he threat and her nened her not on twice. my children believe he is going to kill me if i do anything to upset him. gilberty arrested by police, but then let go by a judge. how did this happen? renee sandler is a prominent attorney. >> we must have stricter bond requirements where there's a

busy day! yes it is! every year for 50 years, women have been having pap smears to test for cervical cancer. in fact, many patients and even health care providers refer to that pap smear as a woman's annual exam. but as erika edwards reports, women may need to find a different name for that test. >> so my sister, she was an amazing sister, mother, friend, she was my best friend. >> reporter: maureen rousseau was just 37 years old when she lost her battle with cervical cancer. >> really hard to watch her slowly go down hill and leave her young kids behind. >> reporter: even though maureen got pap smears to check for cervical cancer, doctors say her case was aggressive and

exception to the rule. >> really does take years to see changes and that is highly unlikely to see changes from year to year when you've had a negative pap smear already. >> reporter: that is why the u.s. preventative services task force issued new guidelines extending the time between pap tests. >> recommending women 21 to 65 undergo screening every three years and not for shorter intervals. >> going to go ahead and use this for the pap tests. >> reporter: guidelines recommend women under age 21 and over 65 with a clean pap smear history not be tested at all. women in their 30s, 40s and 50s have an option to wait every five years if they combine their pap test with an hpv test and both come back negative. dr. wanda nicholson helped create the guidelines and fewer screenings will lead to fewer false positives. >> the issue with false positive tests, it exposes women to further test and also the potential of overtreatment,

student exchange program overseep by the state department. an nbc news investigation has uncovered troubling questions about this question, involving dozens of cases of student abuse. kate snow reports. >> reporter: it's sold as the experience of a lifetime in ads like these on the internet. >> i wanted to play football. i wanted to meet american teenagers. >> reporter: most students have a positive experience in the foreign exchange program, but sometimes, even in a program with lofty goals, bad things can happen. a rock center investigation found dozens of cases over the past decade where host parents were convicted of sexually abusing students. jessica vaughan is director of policy st policy studies, she has been exam ming youth exchange programs for years. >> so many kids, more than you would think, have really suffered. they have suffered horrible trauma. they have suffered abuse.

they have been mistreated. >> reporter: when 16-year-old chris herben from germany moved in with his host father in 2005, he says meyer began molesting him right away. >> said i was very afraid to send him home because my parent once very disappointed. >> so you let him do things that you now can see thing also you department really want to do? >> yes. i can say he touched places he shouldn't have. >> reporter: and there were even more victims when one of them finally reported the abuse, doyle meyer was arrested and pleaded guilty to first degree sexual assault. he served four years of a six-year sentence. >> doyle, can you speak with us a little bill bit? >> reporter: meyer declined "for an interview saying his par roves almost up and he wanted to move on with life. for chris herben, it is difficult to move on. >> this day i find it hard to trust other people, this is a
