scalia's clerks. >> i think that's -- >> i don't care whether it's easy for my clerks. i care whether it's easy for me. >> reporter: no question it would be hard on insurers without new payors but with more people to cover. >> that's going to bankrupt the insurance companies if not the states. >> reporter: that worried the swing justice. >> to impose a risk on insurance companies the congress had never intended. >> reporter: if with anthony kennedy a majority does throw out the mandate liberals hope obama health care survives. >> the more conservative approach would be salvage rather than throwing out everything. >> is half a loaf better than no loaf? >> reporter: obama care backers say yes. >> we work our whole lives, pay taxes, follow the rules for decades. all we want to get is the care we need. >> reporter: but opponents claim they smell a supreme court win.

now the justices will read all of the written arguments and confer among themselves before rendering their decision in mid summer. i'm steve handelsman, news 4, live at the supreme court. jim, back to you. >> thanks, steve. we've been on storm watch all evening and, doug, it looks like most of the storms are finally moving out of the region. >> yeah, moving out fairly quickly right now. all of those storms down to the south are going to continue to be down to the south right now. you can see what we're talking about on storm 4 radar behind me. that storm the only real thunderstorms now into portions of west virginia, not even in toward virginia. we're talking about well south of petersburg so you can see what i'm talking about. the area of showers and this is just showers closest to us right now through charles county back through prince william county and then back down through the culpepper county area. that's really about it. most of us will stay dry for the rest of the night tonight. temperature right now, 70 degrees. a beautiful evening. nice day to get out and about across the area today with the nice warm temperatures. take a look at the numbers right

now. 72 in gaithersburg with some sunshine. 73 to the south in fredericksburg. that is the chance to see some storms. the further south you are the better chance you have of seeing the showers and storms throughout the evening. we'll talk much more about those throughout the evening tonight but winds diminishing. tomorrow morning waking up to very mild temperatures. back into the 50s to start off the day. what does that mean for our high temperature tomorrow? what about the forecast for the weekend? we'll talk much more about that coming up in a couple of minutes. >> all right. thanks, doug. a woman attacked a flight attendant onboard a u.s. airways jet. police then arrested the woman in florida. it happened last night onboard flight 1697. it was headed from charlotte, north carolina to ft. myers and nbc reporter on vacation in ft. myers captured pictures from inside the airport. he also spoke to the crew and they said the woman kicked, spat on, and cursed at another crew member after they refused to serve her any more alcohol. a florida sheriff's deputy had to tackle and restrain the woman until the plane landed in

florida. troubles tonight for a manager of the transportation security administration at dulles airport. police say he was running a brothel out of a silver spring hotel room. pat collins in silver spring has details. >> reporter: the charge, five counts of prostitution. the suspect? a tsa airport security manager. the scene? this hotel in silver spring. 39-year-old bryant livingston, a tsa airport security manager. charged with running a prostitution operation out of the crowne plaza hotel in silver spring. according to court documents, when police entered room 506 at the hotel, they observed 11 people to include three naked females, and four males attempting to get dressed. multiple people were laying on

the two beds in the room. others were sitting in chairs. one man told police he paid a hundred bucks to go up in that room and have sex. it was the hotel that tipped off police after a manager there noticed livingston escorting women and men into the same room. when police got to that room, what did they discover? >> the door was opened and they observed males and females in various stages of undress. >> reporter: according to the court documents, the manager says livingston had done the same thing at the hotel on other occasions. and when he was confronted by the police, livingston claimed he runs the airport security at dulles. homeland security said it received a similar complaint about livingston and prostitution back in 2009. it's unclear as to what if anything was done about it then. now according to the court

documents, livingston lives in this house on gent court in manassas. according to the tsa, livingston was a transportation security manager at dulles. they say he joined the agency in 2002. they say the allegations against him are unacceptable. they say he no longer works for tsa. now livingston's out on personal bond. the investigation, well that continues on. live in silver spring, pat collins, news 4. >> thank you, pat. a woman pleaded guilty in federal court today to performing illegal injections in people's back sides. according to courtk kimberly smedly gave people injections in d.c. and other cities. prosecutors say she offered the injections for buttock augmentation but say the silicon was actually meant as a lubricant or polish and they say she put several lives in danger.

smee fa she faces up to five years in prison and a $250,000 fine. a lawmaker was escorted off the floor of the house of representatives this morning because he put on a hoody in support of trayvon martin. the florida teen who was shot and killed by a community watch volunteer last month. representative bobby rush, democrat from illinois, was the one who wore the hoody. he removed his jacket and raised a sweat shirt hood over his head. the speaker told rush he was out of order for violating house rules. >> just because someone wears a hoody does not make them a hoodlum. >> the rules prohibit wearing hats in the chamber when the house is in session. the house speaker determined that hoody fell under that rule. news in the republican presidential race tonight. a spokeswoman for mitt romney says former president george herbert walker bush will endorse romney tomorrow. the former president is expected

to join romney at a campaign event in houston, texas. mr. bush's wife, barbara bush, already supports romney's campaign. the endorsements are a signal the party is beginning to unite behind romney. in maryland's sixth congressional district the race is on in the u.s. house of -- for the seat in the house of u.s. representatives. a democrat could win that seat for the first time in 20 years. the district has been redrawn to include more democratic voters. the republican incumbent is facing a primary challenge from seven candidates in his own party. chris gordon has our report. >> reporter: republican congressman roscoe bartlett was hesitant to declare his intention to run for an 11th term faced with a district that was redrawn to include parts of conservative western maryland and portions of more liberal montgomery county. maryland state senator robert garigiola was the early favorite to win the democratic nomination to challenge bartlett but he now has four challengers in the

democratic primary. they appeared at this candidates forum sponsored by the frederick news post. businessman john delaney says he knows more than any of the other candidates when it comes to job creation. >> we need new people to do it which is why the washington post has endorsed me and why president clinton has endorsed me as well because i've got the right ideas and i'm an independent minded candidate who can make a difference in congress. >> reporter: for charles bailey, unemployment is a top priority. >> when i was at high school these valleys were full of good paying jobs. not anymore. i don't believe any other candidate will make any real change because they all just seem too comfortable. >> reporter: ron little says he would be a citizen legislator. >> someone who is invested in the community to make sure that we have the resources and things that the community needs to thrive and be productive. >> reporter: milad poran says he will never be beholden to special interests. >> i have a record of public service to include 13 years in the air national guard including

tours of duty in iraq and public health work that have prepared me to represent the residents of the sixth district. >> reporter: that brings us back to maryland state senator rob garagiola. he didn't attend the candidates' forum in frederick this week because he is in annapolis attending the legislative session that runs through mid april. he says he will answer all of the questions the candidates were asked posting his answers on his website. chris gordon, news 4. an update now on a rash of ride on bus fires in montgomery county. the bus drivers union has filed a grievance calling for two bus models to be pulled from service. there have been six ride on bus fires in three years. the fires have been linked to circuit breaker problems and problems with the brakes. the union says the contract is being violated because the contract promises a safe working environment. montgomery county officials responded with a statement that says in part it is clear that the reliability of the champion

buses no longer meets ride on standards. that's why we're replacing all of the diesel champion buses over the next six months. coming up tonight in our broadcast a pilot for jet blue airlines suspended after that meltdown in mid air. that could be the least of his problems. children attacked by pit bulls and the first attempt to stop the wild animals failed. some d.c. council members say they are going to accept a pay raise. >> and we're going to show you the creature that is going to help the navy spy on its enemies. and the terms are elite but it's the irish eyes that are smiling. one national proves his worth. plus it's the biggest game of the year and the caps fall flat. an uphill battle now for the playoffs. as

two families who won a wrongful death lawsuit against virginia tech are trying to civic circumvent a $100,000 cap on damages. earlier this month the jury awarded those families $4 million each because school officials did not warn students about a deadly shooting in a dormitory back on april 16th of 2007. two hours later that same gunman killed 30 people on the campus including himself. state officials asked the

judge to enforce the $100,000 cap. this week the family's lawyer filed motions in an effort to recover a total of $2 million in damages from the state's risk management plan. first lady michelle obama will be the commencement speaker at virginia tech this spring. the campus was picked because of its resilience and for coming together during hard times. last year a gunman killed a campus police officer there before turning the gun on himself. that is in addition to the other case earlier. virginia tech's commencement is set for may 11th. senator mark warner will also address the graduating seniors. the first lady has also planned commencement speeches at north carolina a & t and oregon state university. pope benedict is heading back to rome tonight following an historic three-day trip to cuba. the pontiff celebrated mass in havana this morning. he later met with former cuban leader fidel castro. mark potter has our report from havana. >> reporter: this afternoon in

havana pope benedict and fidel castro held a meeting at the vatican embassy. in a video released shortly after that meeting fidel castro could be seen walking carefully, escorted by his two youngest sons alex and antonio and his wife dalia, wearing a black jacket, appeared to be stooped over as he appeared to have a cordial greeting with the pope. we do now have confirmation from the video that this anticipated meeting between the leader of the cuban revolution and pope benedict has occurred in havana, cuba. the morning began with the pope celebrating an open air mass at the pladza of the revolution before several hundred thousand people. in his homily the pope spoke frequently about the need for truth and freedom and called for more opportunity, more freedom for the cuban catholic church here. he also spoke about fanaticism and scolded those who would impose their own truth upon others. in response to the pope's statement at the beginning of his trip, calling for cuba to find aernatives to marxism,

the vice president of cuba responded, saying, that while there will be more economic changes in the future, there will be no changes to cuba's political system. back to you. >> well doug is here with a look at our weather which is improved. it looks a lot better. some areas saw thunderstorms mostly to the west of the washington, d.c. area. now those storms sliding on down to the south. you know what they always leave behind these spring time storms? >> what, doug? >> you want to answer that or do you want me to? >> what they leave behind? >> what do they leave behind? showers come through. sun comes out and you get a -- >> rainbow? >> yeah. a rainbow. as a matter of fact, look at this picture. >> talk to me. >> how about this? >> right along mass avenue. melissa mele shot this earlier, our reporter. vance, you call them the crack reporters and there they go right there getting the beautiful -- actually a double rainbow. take a look at that. awesome picture. right there on massachusetts avenue a little bit earlier as the rain made its way on through the region. temperature today got up to 72 degrees.

sorry i quizzed you there. i feel bad about that pop quiz. >> it's okay. i nailed it. we're okay. >> 72 the high temperature today at d.c. 46 the low this morning. well above average once again and just 0.01 inch of rain at the airport. some did see heavier rain out toward frederick and loudoun county. 70 degrees currently right now with winds out of the southwest about 9 miles an hour. the numbers now nice and warm. 75 in martinsburg. 64 in manassas. they just saw a shower there. la plata has seen the rain. that's why they are in the 60s. fredericksburg right now 73. take a look at the highs today. down to the south. 80 in fredericksburg. 83 in charlottesville. even 80 up toward martinsburg so a very warm afternoon. we saw plenty of sunshine before the rain moved on in and it did move in and now it's moving on out of here. down to the south in through portions of southern maryland just some shower activity right around frederick. that's the area we're seeing some of the heaviest rain back through southern portions of culpepper county back toward madison and orange county, too.

we'll continue to see those showers moving through i-95 around fredericksburg so if you're not seeing it now you'll see it in about the next 15 to 20 minutes once again just a brief, moderate to heavy shower and it will continue to move out. the whole line shifting very slowly to the south now so if you're around the fredericksburg area maybe culpepper and charlottesville you will see more shower activity throughout the rest of the evening tonight. the thunderstorms however dying off as they move to the east although we cannot rule out some thunder and lightning. the frontal boundary will continue to move down to the south and east overnight tonight and by tomorrow morning we're nice and sunny. rather breezy and mild. a lot warmer than we've been over the past couple mornings so you probably will not need the coat tomorrow as i think most of us will start with temperatures in the 50s. then on friday watching some very nice weather. i think we'll see a fantastic friday but look out to the west. a lot of rain out to the west out toward kentucky and indiana and ohio. that rain will move our way during the day on saturday. saturday right now does look like it will see a pretty good chance of shower activity. will it be very early in the day

or will we see some in the afternoon? that is still the question i'm looking to answer. mostly cloudy, showers and storms continuing to move out mostly to the south this evening. 62 to about 68 degrees. tomorrow morning mostly clear. looking good. mild and rather breezy. winds out of the northwest at 10 to 15 miles an hour. maybe some gusts upwards of 20 especially once the sun comes up. then tomorrow afternoon sun and a few clouds. breedsy and mild. 61 to about 66 degrees. winds out of the northwest at 15 to 25 miles an hour. maybe some 30-mile-per-hour wind gusts tomorrow but that will be of the warm wind variety so not a problem there. friday fantastic with a high of 65. 65 on saturday with that 50% chance of rain. i do think it will move out of here on sunday leaving us with a pretty nice sunday afternoon. a high near 70 on sunday and as we move toward the beginning of next week, we could get near 80 on monday and that's only a slight chance of a shower. monday if everything comes into the way i think it could we could get up to 80 degrees with plenty of sunshine. >> we'll take that.

a man who once ran security at dulles airport charged now with running a prostitution business out of a hotel in silver spring. police say bryant livingston rented a room at the crowne plaza and used it as a brothel. the tsa says he has been fired. the fate of the nation's health care law now rests with the nine justices of the supreme court. three days of oral arguments ended this afternoon. a decision is expected in june. a lawmaker escorted from the floor of the house of representatives today because he wore a hood in honor of trayvon martin. representative bobby rush of illinois was protesting the death of that teenager in florida. the neighborhood watch volunteer who shot martin has not yet been arrested. first a breakdown. now the fallout. a jet blue pilot is now facing federal charges after a mid air meltdown. >> it started with erratic behavior in the cockpit and ended with passengers pinning the guy down and the plane having to make an emergency landing.

jane watrel at national airport with our report. >> reporter: it was a shocker at 35,000 feet as passengers wrestle a jet blue pilot to the ground. after he appeared to have a nervous breakdown. >> out of his mind. screaming and saying to the passengers, say your prayers. say your prayers. >> reporter: jet blue flight 191 was flying from new york to las vegas tuesday when captain clayton ogden reportedly began erratically steering the plane, flipping switches, and operating the radio. the copilot was so concerned he persuaded the captain to go to the restroom then asked an off-duty pilot to come into the cockpit and lock the door. witnesses say the captain left the restroom then appeared to lose control when he realized he was locked out of the cockpit. >> it appeared he was trying to open a side door so i wasn't going to let that happen. >> reporter: at dulles international this jet blue passenger hailed the copilot as a hero. >> they're well trained. i'm sure that copilot is feeling pretty good right now. >> reporter: an emergency landing was made in texas with police and medics taking the captain off the plane.

nbc's aviation expert says the crew did everything right in handling this mid flight meltdown. >> in over 40 years of watching and being part of commercial aviation this is the second or maybe third time i've heard of anything like this. it is extremely rare. >> reporter: jet blue's ceo says the captain has apologized for the incident and experts are looking into the pilot's medical history. >> it makes you wonder. i know a lot of them are under stress and the conditions and everything make you wonder when is the last time you got a chance to sleep or whatever. >> reporter: captain ogden is a 12-year veteran of jet blue and now faces charges of interfering with a flight crew. at reagan national airport jane watrel, news 4. >> if he is convicted of interfering with a flight crew that pilot could face 20 years in prison and up to $250,000 in fines. a man is still on the loose after an abduction and robbery overnight in prince george's county. the abduction happened outside a home on the 59th avenue, on 59th

avenue in riverdale. police say two men forced another man to drive them to an atm. at the atm they forced him to withdraw money. the victim's wife, who didn't want to be identified, talked about the terrifying ordeal. >> they say you have to give me the money and they say if you don't give me the money, i don't know where your home, where your family, and i'll do something to your family. so -- >> the abductors took the man back to his house. when they got there police were waiting. one suspect was arrested but the other one got away. police have fined the owner of two pit bulls involved in an attack on two teenagers in gaithersburg last night. family members say a 14-year-old girl was walking to her home on boulder ridge terrace when one of her neighbors' two pit bulls attacked. the dog was not on the leash. the girl's 15-year-old brother ran out to help her and the dog turned on him. both kids suffered serious bites. >> she was bit on her leg really

bad. she has stitches on her arm. i don't know if it was bite marks or scratches on her breasts right here. the dog attempted to attack her on her neck. >> it was probably bound to happen because the guy is a nice guy. he just got two pit bulls and animals are animals. they are unpredictable. >> reporter: police had to shoot one of the dogs after attempts to subdue it failed. the owner is facing $600 in fines because of that attack. those two teenagers are out of the hospital now and said to be doing okay. a high school senior died at school today in prince george's county. 17-year-old takiah rasain collapsed during her physical education class. paramedics rushed her to the hospital but she later passed away. no word on why she collapsed. she attended the high school in clinton. there will be counselors at the school this week to offer support to other students. a pay increase is coming for d.c. council members at a

sensitive time. they are engaged in a new round of budget cuts. some of them are turning money down but some aren't. tom sherwood has the story. >> we also anticipate -- >> reporter: the mayor and council on wednesday were worrying about federal budget cuts to the region's metro system. just this week mayor gray was before the council discussing his new budget and the cuts he's proposing. so in this time of few if any staff pay raises and budget cuts an automatic 3% raise, about $3600 for the council members, is not settling too well. most are rejecting it. >> i think that if our employees are getting the raise or getting a cost of living increase, we shouldn't either. >> the law provides an automatic inflation adjustment. we have put it off several years. my sense is this isn't the right timing. >> i waived mine. i filled out a form and waived it. >> reporter: some members aren't sure yet. are you going to take it? >> i'll have to think about it.

>> reporter: some of the council members -- >> i know i didn't take my cola for the last two years. >> reporter: some are -- >> i work too hard not to get what it is that's due me. simple as that. >> reporter: ward 6 council member tommy wells says he'll accept the approximately $3600 saying he doesn't earn huge sums in the private sector like other council members do. >> i am going to accept it. it seems like there's just been kind of turned into a symbolic game. some council members make more than twice their salary outside of the council. i don't take outside employment. >> reporter: there is some good news for city workers who haven't had a raise. city revenues are up a little and the mayor and the council are canceling four unpaid furlough days that those workers were facing. it's not a raise but it's something. in the district, tom sherwood, news 4. >> christopher bauman of the police union noted today police officers haven't gotten a raise in five years. each council member earns about

$125,000 per year. the council chair earns $190,000. how are we looking, doug? >> looking pretty good. take a look at this picture. a beautiful shot from our city cam with plenty of blue skies. let's take a shot from our tower cam as well. take a look at this. a lot of sunshine out there now. just a few clouds in the sky. look at that. actually a lot of sun out there. that sun will continue throughout the rest of the evening. the shower activity is just down to the south talking about areas just down around the fredericksburg area in through stafford county around the spotsylvania county. also seeing some fairly heavy showers. most of these are moderate to heavy. nothing too strong though and then back toward culpepper county green and orange county. rather madison and orange county. all seeing some very heavy rain right now so we'll continue to watch that rain as it makes its way to our south. it would stay in our southern counties. the counties that are going to be affected are rockingham, green, madison, page, orange, spotsylvania county, including the culpepper area, too. watch out if you're down south of fredericksburg even along the

i-95 cord ooh if you are driving so order along i-95 this evening. you will also be running into some rain there too so just watch out. give yourself a little extra time that way but from washington up to the north and even out to the west and to the east, the rest of us seeing a very nice evening. it is going to be quite pleasant on this wednesday evening. probably one of the best evenings we've seen in the last, probably since friday. about five days. >> we like it like that. thank you, doug. it's been almost a year since restaurants and businesses along the georgetown water front were ravaged by flood waters. but a big comeback could be just a few weeks away. melissa mele with more on what we can expect. >> reporter: the images from last april are hard to forget as some of the flood gates here at washington harbor were left down. the river pushed 12 feet of water into tony and joe's riverside grill, cabanas, and other restaurants and businesses. this is how it looked from above that day. waterlogged cars dragged from

the parking garage. workers in hazmat suits cleaning up. residents and office tenants out until portable generators could be brought in. the prime properties have lost millions of dollars in revenue. they've spent a year rebuilding, cooking what they can on their patio. tony and joe's will have a whole new look and nick's river side grill has been gutted and expanded into the old cabanas restaurant space. >> when we are back full on business we know we'll have a lot of support from our customers that are all asking when are we going to be open? >> construction next door at farmers and fishers is still on hold as they try to renegotiate a lease. they're suing their insurance company for not having flood coverage on the restaurant. but they're not the only ones suing. about 50 workers here at the water front have banded together. they are now suing the management company for lost wages. in addition to the repairs a $20 million renovation is under way at the complex. they're revamping the fountain area which will turn into an ice

rink in the winter. tony sybil whose restaurants are celebrating 25 years at the water front in 2012 hopes this will be their best year ever. >> we're very excited about the renovation. we're going to have two brand new restaurants, different design. same food. same great food. >> the management company now has a crane on site here to pull the walls up as needed. >> i know this is the place where everyone would love to come to, so, i hope that will continue after the renovation. >> reporter: tony and joe's hoping they have just a couple more weeks of work left and are shooting for an early may reopening. at the georgetown water front, melissa mele, news 4. with business down 85%, since that flood, tony says it will be one heck of a party when the restaurants reopen. coming up unexpected funneleding cuts about to hit the metro rail system. we'll tell you about a local invention that could be the

doing. look at these guys playing a little soccer down by the 395 here. perfect soccer weather this evening. really perfect to do whatever you think. 70 degrees with wind out of the southwest about 9 miles an hour. yes we did see some rain come through parts of the area. but it is all gone now for the most part. around washington and leesburg over toward warranton, waldorf and winchester. but down to the south around fredericksburg still dealing with that rain through spotsylvania county, southern portions of stafford county. fredericksburg a little break now but you will see this shower come right on through your region. a moderate shower. light to moderate coming through in about the next half hour to an hour. another one right along 301 as it is about to cross over the potomac into portions of southern maryland. back to the west farther to the west culpepper saw a shower a minute ago. now we're looking just to the west of madison here. there are a few showers here that did have some lightning associated with them but they just have not been able to get across the blue ridge. there is la ray up to the north of your screen. the wider view showing the storm

interesting things revealed by redskins head coach mike shanahan at the owners meeting down in palm beach. the shanahans making it possible, hosting him at the elder shanahan's home in colorado before manning signed with the broncos. the team will likely stay at redskins park for training camp and are trying to sign london fletcher but the aforementioned salary cap issues are hindering that a bit. just like the fans the head coach looking forward to having a franchise quarterback for the first time in a long time most likely robert griffin iii. >> i thought we had a great day and could have performed much better than he did. made the throw very easily. you could see arm strength, quickness and speed. and very impressive. if you want to win the super bowl, i think everybody does, you have to have that guy that gives you a chance to win it year in year out.

tennessee. pat collins sends me an e-mail ten minutes ago. they have a great women's basketball team. he said what time is tennessee playing this weekend? i said they're not. collins said i know. he goes notre dame. >> that sounds like pat. >> not nice at all. >> stick the knife in and twist it. >> that's what he does. one of the best seasons in maryland women's basketball history but last night did not make the loss to notre dame any easier for the terps to take. it was a rough one. alissa thomas voted first team all american yesterday early on she was looking like it. thomas comes up with the steal here and she is taking it all the way. you're not going to stop her. she had a team high 17. after that hoop the irish going on a 16-1 run and then led by 19 at halftime. in the second half, the terps with one of their 20 turnovers. skyler digins had a great game. 22 points. ten assists. ten rebounds. the irish win big, 80-49. so it's notre dame taking on u-conn and baylor against stanford in the final four.

nationals president stan casten. the major league baseball season officially began today in japan. ichiro had four hits making his return home. the mariners beat the as 3-1 and the final four battle between louisville and kentucky has gotten crazy. really crazy. authorities say the rivalry boiled over to kentucky dialysis clinic when one patient punched another during an argument about the teams. one was 68 and the other 71. basically it boiled down to this. they were just talking trash and one gave the other the finger and then it was utter mayhem in the dialysis clinic. one of course a kentucky fan and the other a louisville fan. so that state is going nuts right now. >> age is no determining factor when have you passion for your team. incredible. thank you. >> coming up next no one has hit the megamillions jackpot yet and

too bad. near 80 by monday. >> back to summer. >> we love that. >> thank you. if even half of what you see in spy movies is kind of real, americans have pretty cool high tech toys at their disposal. but there is this new one in the works down at virginia tech. scientists there are working on a robotic jelly fish. it's made of silicon and something called shape memory metal. researchers say they have already perfected the jelly part of the robot. now they're working on making it swim on its own. it's a $6 million project like the man was. remember? and it's funded by the navy and if it works out the robotic jelly fish will be used to help with surveillance. the lead researcher on the project says he sees nonmilitary applications as well. for example, marine scientists could use the jelly fish to blend in with schools of fish in order to monitor their behavior. the fish won't know they are
