bradley of arlington and three of his buddies came up to the couple and started arguing over whose cab it was. a police spokesman picks up the story from there. >> the four individuals, all males, began assaulting the husband and beating him on the ground. the group then walked away. one subject from that group then went back and struck the wife in the face while she was attending to her husband injured on the ground. that blow caused serious injuries to the woman. >> reporter: in fact it was so serious say police that the woman was nearly knocked out. she was taken to george washington hospital where she was admitted and later released for head injuries. now the suspect has been charged with two counts of assault and made an appearance today in d.c. court and will be back in court on monday. in fact, we had a chance to ask him why he did that and you'll hear more coming up at news 4 at 6:00. until then, we are live in southwest. i'm jane watrel, news 4. a 19-year-old is now being charged tonight with making a

bomb threat to a fairfax county high school. his name is marco antonio toledo. he is accused of threatening annandale high school. the school was evacuated this morning while police searched the area. they found a suspicious backpack near a door but nothing threatening was found inside. after a few hours everyone was allowed back inside the building. the mayor of sanford, florida says he overruled police and released the 911 calls in the trayvon martin case. he said he did it because they had nothing to hide. for the first time since the shooting, george zimmerman's brother, roblt, is talking about it defending his actions in the death of 17-year-old trayvon martin. martin's family says there is no evidence supporting zimmerman's claim that he acted in self-defense. but robert zimmerman says the newly released police video offers proof of his brother's injuries including a broken nose. to me his nose looks swollen in that video. we're confident the medical records are going to explain all of george's medical history. >> robert zimmerman says his brother was injured so badly he

was barely conscious and that martin almost got ahold of his gun. the attorney for the u.s. soldier accused of killing 17 afghan civilians says the government is hiding evidence from the defense. staff sergeant robert bales is being held tonight in the military facility in fort leavenworth, kansas. at a news conference today defense attorney john henry brown says he was hoping to speak to witnesses of the shooting at an afghanistan hospital. but brown says by the time he was able to get to that facility, most of the witnesses had been released. >> we are told by the prosecutors to come back the next day, which is fine. you know, we went along with that. then we went back the next day and they had all been released from the hospital and all been scattered throughout afghanistan. >> bales has been charged with 17 counts of premeditated murder and if convicted could face the death penalty. the army is preparing to conduct a psychological evaluation of bales over the next few months. our weather is the coldest

it has been in almost three weeks now and we would certainly like a warm weekend, doug. what you got? >> right now you can see we've started to see at least a little bit of sunshine, some breaks in the clouds helping things feel a little bit warmer out there. but only 52 degrees so far. the official high or the unofficial high right now looks like 54 degrees. that would be the coldest number we've seen in almost three weeks. it is on the cool side. it is very chilly in most of the area. winds right now out of the east about 9 miles an hour. still not a bad day. we've seen a few showers from time to time. that's about it. back to the west. 54 currently in winchester. 51 in martinsburg. down to the south we have seen some sun around fredericksburg a little bit earlier. that helped them get up to a 63-degree temperature right now. gaithersburg coming in at a cool 48. now storm 4 radar showing the showers that did move through a little earlier. they are now moving out of here and behind it, though, look at the thunderstorm activity back into west virginia. you can see a couple rumbles of thunder there. some bolts of lightning. i expect that activity to fall apart but that's just a sign of

things to come overnight tonight and expect a lot of us to see showers overnight. temperatures will not fall down to too much more so waking up to a high or low of about 50 but expect to take the umbrella tomorrow. i'll let you know if you need to cancel any plans due to the rain. that coming up. all right. thanks, doug. there was still no word on what sparked the fire at andrews airforce base. the flames tore through three town homes in a residential section of the base yesterday. 70 people were displaced. military officials say they have since been relocated. a commander on the base says members of the navy, marines, and air force were affected by this. fire investigators think the fire started in the back of one of the town homes and spread. and the race for the white house, the candidates are turning their attention to wisconsin. it is the most competitive of the three primaries happening on tuesday. an nbc marist poll out today shows mitt romney leading rick santorum 40% to 33% in the state. romney received a big endorsement today. wisconsin congressman paul ryan. wisconsin holds its primary tuesday the same day as

primaries in maryland and here in the district. and here in the district the primary race for the at large council seat has largely focused on ethics issues. the voting comes as some of the city's top leaders are under federal investigation. tom sherwood has our report. >> reporter: it was the final face-to-face debate friday for d.c.'s at large council candidates before tuesday's primary. on wamu politics hour, there was a discussion of the city ethics problems which caused key issues for three candidates seating to unseat vincent orange. >> we're seeing people who disrespect each other, people who have no morals. i think we need to change that. >> this is a very, very broken political culture right now when it comes to campaign finance. >> it's clear that residents right now are clamoring for strong ethical leadership to address some of the most pressing issues in the city. >> vincent orange is not under federal investigation, not under

if you have a visa or mastercard in your wallet you better listen up. >> there is a warning tonight about a potential security breach. liz crenshaw is here to tell us about it. >> wendy and jim both visa and mastercard are investigating the complete details are not being provided but here is what we know so far. the potential breach involves the hacking of the third party system that processes visa and

mastercard transactions. "the wall street journal" is reporting that the third party is called global payments. there is no word yet on when the breach happened and we do not know how many customers are affected although it could be millions of card holders. while visa and mastercard say the breach did not compromise their own systems, visa and mastercard say they alerted the banks about certain customer accounts that could be at risk. their credit card banks are looking for suspicious activity on the accounts and at the same time they encourage card holders to monitor their own accounts and see if you see any suspicious activities and they ask you to call your bank. it's important to note if your account has been compromised federal law protects consumers and so card holders have no, have no liability for unauthorized use. so we don't have a lot of data on exactly when this happened, how it happened. we just know it was a third

party not visa or mastercard system directly. we do know account numbers were revealed somehow. keep an eye on your accounts if you see any suspicious activity contact your bank. >> the credit cards or banks aren't contacting people at this point yet? >> we do not have any information that they're contacting folks. we do know that visa and mastercard told the member banks the account numbers that they thought were potentially at risk. so you may be getting a notification from your bank saying we're going to send you a new card. no liability by the way on your part. >> good. >> no liability on regular folks' accounts, etcetera. keep an eye on them. let your bank know if anything weird turns out. >> you just don't want to go use the card and find out it had a stop on it. >> they should inform you in advance if they're going to shut your card down. there has been no talk of that at this point. >> thank you. >> you're welcome. refunds are in store for the passengers aboard the jet blue flight following a pilot's mid air meltdown. everybody on the flight will get a full refund for the one way ticket and a voucher for twice the value of their original

ticket. on tuesday, the captain's erratic behavior prompted another pilot to lock him out of the cockpit. he was restrained by passengers and later charged. the flight had to make an emergency landing in amarillo, texas. right now scientists are inspei inspecting the washington monument to see if last year's earthquake cause today to sink. surveyors are looking for any ground level change around the national mall since the quake hit in august and even a slight bit of sinking that could impact the work to fix the damage to the structure. that earthquake by the way was 5.8 if you don't remember it. the monument has sunk 2 inches since the 1880s. surveying could wrap up next week but it would take much longer for scientists to sort the data. not a good day to do that today. a little chilly. >> a lot chilly. we were at 82 degrees last friday and right now were at 52. that's a difference of 30 degrees and with the cloud cover, you know, definitely felt kind of cool out there. >> damp too. you know, that's the way we'll

see things tomorrow too. i don't think tomorrow is going to be a bad day so do not cancel any plans for your saturday. saturday could be a day very similar to what we've seen out there today with a lot of cloud cover and cooler temperatures although right now you can see on the monument some sunshine out there. we'll continue to see our clouds breaking up a little bit as we make our way through the rest of the evening. temperature right now 52 degrees at the airport. winds out of the east about 9 miles an hour. let's take a view from our tower cam and you can see the cloud cover. you can also see the sun peeking through the clouds. strato cumulus clouds making their way across and even a little plane across the top there. we are starting to see some sunshine and that should help to brighten spirits as you go out this evening. 54 right now in manassas. 63 in fredericksburg. we've gone up 4 degrees over the last hour back toward winchester as a result of the sunshine so numbers here may actually go up just a little. gaithersburg, though, still seeing the cloud cover. just went down 2 degrees from 48. now sitting at 46 at both

gaithersburg and baltimore so very cool in those locations. satellite and radar showing the cloud cover continuing to make its way across the region. this is what i'm talking about now. there goes our chance of showers and then this is the break in the clouds and then behind it guess what? we have more chances for rain and that rain will try to move in overnight. storm 4 radar nothing to show you. clear as far as the rain is concerned. if you're thinking about doing an early dinner out you should have no problems with the rain. this is the next batch right here that's going to try to move through. i expect this to most likely die out in the mountains but if you live in west virginia or western maryland, you may see this come through your area. our rain is going to come from the south and from the north. this is a cold front to the north. this is a lot of moisture coming out of the south. they're going to try to converge on our region but they're going to do so just offshore. that's good news for us because it means it's not going to be -- we're not going to see a lot of rain even though we could use a lot of rain. we just don't want to see it during the weekend. right now 3 inches below average for the year though. as we make our way through the

next 24 hours there goes the area of low pressure. some shower activity tomorrow with the cloud cover but once again not a washout and i really don't expect to see much rain at all from this storm system. sunday, however, we'll see a cold front try to come through. most of the day sunday nice with sunshine but could see rain overnight sunday night and into early monday. this evening mostly cloudy. continued cool. dry early. temperatures 45 to about 52 degrees. and then for tomorrow morning, temperatures a little bit on the cool side but a little bit damp, too. a few showers out there but not many and once again throughout the afternoon tomorrow same deal. mostly cloudy. a few showers. mainly light. temperatures 56 to 61. so not a horrible saturday. sunday is looking better with a high of 65. 68 on monday. right now 70 coming up on tuesday. that with a chance for some showers and thunderstorm activity, too. but once again not a big chance. we do need to see rain. >> better than pouring pollen though. >> a little bit better today.

wants to set up shop in one area of washington, d.c., ward 5. that didn't set well with neighbors who spent the last few months trying to limit how many of the cultivation centers can move into their part of town. today we got the list of the six winning bids and where the marijuana will grow. medical marijuana is about to take root in washington, d.c. d.c.'s department of health has announced who gets to grow the controversial plant. >> out of 90 original people who had a letter of intent we selected six, the very best of the best, they have the best security plan, the best quality assurance plan, the best growing plan. >> reporter: who got a license? hollywood's montel williams. he and a group of investors plan to set up shop on queens chapel road in northeast. other locations include benning road, 24th place, everett street, chang street, fenwick street, all inward 5. >> how safe it's going to be.

>> reporter: safety is this man's number one concern. >> yeah it does have its medical benefits and i would like people to get help who need the help but, again, you need people who live in the area to be safe when they do it. >> reporter: the health department says once they're renovated these buildings will be some of the most secure in the city. many won't even know there's marijuana growing inside. but the health department's dr. mohammed octer says he knows neighbors are worried which is why he only gave out six licenses and put a strict limit to just 95 plants per location. >> this is the most tightly controlled program in our nation. and we are going to keep it that way. if anybody tried to violate it, i wouldn't hesitate for a moment to take away their license and shut them down. >> the health department says it takes 90 days for marijuana to grow. today's licenses only give permission to grow medical marijuana. the health department is still

trying to decide who will get to operate dispensaries, which is where people will actually be able to buy the medical marijuana. the health department says it won't make that decision until june. right about the same time they expect some of the plants will be ready to harvest. if you want to see the exact locations go to our website nbc washington.com and search medical marijuana. jim, wendy? >> when those dispensaries do open who will be able to buy medical marijuana? >> wendy, d.c. is very strict. you must be a d.c. resident. there is a very limited number of serious diseases and conditions which are eligible, things like aids and alzheimer's and you have to have a note from a doctor who is registered with the city's medical marijuana program. wendy, jim? >> thank you. a legal victory for virginia tech in connection with the 2007 shooting rampage there. today a judge overturned a $55,000 federal fine that was imposed on the school after the

massacre. the judge ruled the university actions did not violate any law that requires schools to issue timely warnings of campus threats. the department of education had issued that fine. virginia tech appealed it. the ruling comes two weeks after a jury in a wrongful death lawsuit found the university was negligent in its response and the school may appeal that ruling as well. >> stafford county teenager is under arrest tonight charged with vandalizing the church. the 16-year-old is accused of spray painting a racial slur on the back wall of the bethlehem primitive baptist church on chapel green road in stafford county. earlier this month he is charged with illegally entering a property and damaging a church. academy award winning actor gary sinise was injured this morning in a car crash along the george washington parkway. park police tell us it happened around 9:00 near the memorial bridge. three cars were involved and sinise was in the middle car. he was reportedly in town to visit service members and their

families. the actor was taken to the hospital with minor injuries as a precaution. no one else was injured. the case of the crash is still under investigation. it is a go-to road for getting around in fairfax county but the 32 miles of the fairfax county parkway can be a bumpy ride. now a big stretch of it is going to get a lot smoother because of a repaving project that is scheduled to get under way soon. julie carey has more. >> reporter: cracked, patched, and crumbling. the fairfax county parkway carries tens of thousands of vehicles a day from one end of the county to the other. drivers have noticed it's in desperate need of an asphalt face lift to smooth over the bumps and fill in the pot holes. >> absolutely. i mean, some of them are big enough for the prius to fall in. they're pretty bad. >> you need some care. it's terrible. >> with the new national geospatial agency adding 8500 workers to the corridor the parkway is busier than ever but

there is good news for everyone using the road. 24 of its 32 miles between route 7 in herndon and rolling road in springfield will be repaved. while the work is slated to start in april the majority of it will be done when school is out from june to september with the completion sometime in october. most of the $19 million of work the will be done in the dark and on weekends. >> we'll try do most at night and fin tisch before school starts in september. >> reporter: that comes as a relief to this woman who drives from springfield to the district every morning. >> for anyone who works the night shift. i sit in traffic every morning so to the extent they can avoid rush hour it would be great. >> reporter: the repaving will start first on the northern end of the parkway. a few spots like the fair lakes area that have had recent work done will be excluded from the project. in fairfax county, julie carey, news 4. when we come right back tonight the caped crusader gets

circle. aiming for a neighborhood vibe with a touch of class, black and white photographs of chevy chase in pittsburgh circa the 1920s and 1930s on the walls. the start of the week tends to be slow for a lot of restaurants which is why blue 44 dangles one of america's best loved foods in front of customers on monday night and then only. the joy starts with three pieces of crisp chicken, the hint of the sage, garlic and tobasco they've been marinated in, and continues with their companions on the plate -- homey mashed potatoes with a crater full of gravy that reminds me to call mom. green beans that have some agreeable fight in them, and a baking powder biscuit that is so light and tender it ought to be delivered by the basket full. i can't remember the last time i had fish cooked in parchment paper. the reagan era maybe? it doesn't matter. turner bundles the day's catch, rock fish when i tried it, with lemon slices, julianne carrots, fresh thyme among other flavor boosters.

the family of the maryland woman who was killed by her estranged husband in kensington

is fighting for a state law to be changed. philip gilberti killed heather mcguire earlier this month before turning the gun on himself. police had him in custody just a day before the murder but set him free. derrick ward spoke to family members today. derrick? >> well, you know, this is one of those instances where a series of factors converged to make a bad situation worse. sadly, to the point of being deadly. now the mother of the victim wants to see some changes in the law that won't bring her daughter back but may prevent another tragedy like this one. phillip gilberti was jailed for violating a protective order taken out by his estranged wife heather lynn mcguire. he had been arrested twice for stalking her over the same weekend earlier this month and there were threats and violence in the relationship. from mcguire there was relief when gilberti was arrested. >> he was going to be put away for quite sometime she said and she told me that she felt happy sunday. we spent the day together. >> reporter: but it would be the last weekend mother and daughter

would spend together. by monday heather lynn mcguire would be dead at the hands of phillip gilberti. he had been released on an unsecured bond. police say he sought out and shot his estranged wife in front of terrorized motorists in a busy intersection in kensington. gilberti dumped her body on the connecticut avenue and drove off. >> i want answers as to why phillip gilberti was released. >> reporter: later that same day he would kill himself as police searched for him. today in rockville a handful of protesters gathered to keep the case and the cause alive. in the days following that violent encounter it was learned that on the day gilberti was released the montgomery county district court system's computers were down and that when judge barry hamilton let gilberti go he may not have had access to information such as the threats, assaults, and trespassing charges gilberti had amassed over a lengthy and troubled relationship with mcguire. mcguire's mother says her family was also in the dark. >> she had no idea that he was out on the streets.

>> reporter: other information that wasn't out there, gilberti's attempted murder conviction dating back seven years before mcguire was killed. that conviction stemmed from gilberti trying to kill a girlfriend in nevada. mcguire's mother says that laws here need to be strengthened especially as they pertain to repeat offenders like the man who police say killed her daughter. now, a memorial fund has been set up to help support the children left orphaned by the tragedy. the couple had three children between them. we have information in our website, nbc washington.com, meanwhile, joann kennedy says she is taking her cause for stronger laws to the maryland state senate. back to you. >> all right. derrick, thank you. well, switching gears now, we are starting to see some sun just in time for sunset, doug. >> a lot of sun out there. we have about almost two hours left to see some sunshine and that's what we're seeing right now. we'll call it a mix of sun and clouds across the area. temperatures 52 degrees. i would not be surprised though to see these numbers go up just a little bit over the next hour or so. winds out of the east right now about 9 miles an hour. the clouds and the east wind,

the shower activity kept temperatures fairly cool. only 48 right now in gaithersburg. 49 in rockville. 54 in reston. 51 down toward hunting town. right now warranton coming in at near 60 degrees so we are starting to see temperatures go up just a little bit with that return of the sun. here's what's happening. you can see the shower activity that we saw a little earlier making its way out into the atlantic. now we have a little batch of rain here and then a cold front and a lot of moisture coming up from the south. these two systems are going to meet but they're going to meet just offshore and that means for us less rain and a better weekend although still tomorrow is going to be fairly cloudy and we are going to deal with some shower activity. here is the rain, next batch of rain we will try to see make its way in here. most of this i think should fall apart but if you're going out tonight, you're going to see a pretty nice evening probably until 6:00, 7:00, can 8 tonight. but i would recommend taking the umbrella with you just in case we see one of those showers. overnight tonight 50 in washington. 45 in frederick. 45 in leesburg. 47 in culpepper.

a new movie tackling a childhood epidemic hit the big screen today but it won't be playing at any local theaters. news 4's richard jordan shows us now how some area students are putting on their own performance to spread the movie's message. the film "bully" opens today but don't expect to catch the movie at a theater near you. the debate over the strong language left the project without a rating and without a wide release. it's only playing in new york
