with help from the fire department, homicide investigators went to rooftops today searching for a possible murder weapon, searching for evidence. but it didn't stop there. they used special dogs to look for clues and deployed detectives all over the neighborhood with wanted flyers, a full-court press to solve this unusual case of murder. >> i'm scared and i'm still scared. because i never experienced anything like that before in my life. >> reporter: a sightseeing tour of washington for a colorado man ends in death in this northwest d.c. alley. police identified the victim as gary diedricks. he was 66 years old, a nurse from denver. sources say he had been visiting our city for about two weeks, his body discovered yesterday evening in this alley off

emerson street northwest. davon hudson was one of the first on the scene. >> they laid his head on a -- on a fanny pack. >> what do you make of that? >> i thought somebody cared about him. >> reporter: sources say investigators believe that the man was killed where he was found, that he died from severe injuries to his head. today that murder scene is still taped off, still under police guard. this gruesome discovery most disturbing to people who live in this petworth community. >> it's terrible. i'm sorry it happened. and i'm sorry it happened in our neighborhood because we have never had anything like this happen. >> reporter: the reward has been posted. the flairs are out. the investigation continues on. live in northwest, pat collins, news 4. we have developing news out of california. the marine corps has discharged a sergeant for making director

remarks about president barack obama on facebook. sergeant gary stein is a san diego area marine who argued he was exercising his free speech. last month he posted facebook messages calling the president the enemy among other things and said he wouldn't follow orders from him. today stein was given an "other than honorable" discharge for violating a pentagon policy that limits the speech of service members. the military has restricted free speech for its members since the civil war. big news today in the republican presidential race. newt gingrich is suspending his campaign. nbc news has learned that gingrich will make the official announcement here in washington next tuesday. earlier today in north carolina gingrich all but conceded the race in light of mitt romney's sweep of yesterday's primaries. >> i think obviously that i would be a better candidate. but objective pact is the voters didn't think that. i do think it's pretty clear that governor romney is ultimately going to be the nominee. we'll do everything we can to make sure he is, in fact,

effective. >> gingrich is expected to officially endorse romney next week. homeland security secretary janet napolitano called the secret service scandal inexcusable. she also said it posed no risk. napolitano addressed the senate judiciary committee for the first time since the scandal came out involving prostitutes at a colombia hotel. >> let me be clearment we will not let the actions of a few tarnish the proud legacy of the secret service. >> secretary napolitano said all 12 agents involved either faced personnel action or they were cleared of wrongdoing. a dozen military personnel have also been implicated and had their security clearances suspended. top metro officials met most of this day trying to figure out what cause add commercial train derailment last night. news 4's christ gordon has more on the investigation.

chris? >> reporter: this evening's rush hour here at rosalind is moving without any problem. passengers are concerned about last night's derailment, especially because metro has not yet figured out what caused it. normal service on the blue and orange line was restored this morning. shortly after 7:00 p.m. last night, a blue line franconia springfield bound trip leaving the rosalind station derailed. it caused delays as crowded trains single-tracked through the crowded station. crews worked all night making repairs. they rerailed the front wheels of the train and removed it. they tested the track and switch equipment. metro is investigating to determine the cause of the derailment. >> do we know if this is a case of aging equipment or human error or something else? >> that's all going to be a part of the investigation. at this point in time it's too premature to be able to say with any definition what the cause of it was. you can certainly expect that information to come out in the

weeks ahead. >> reporter: metro is calling it a minor derailment because there were no injuries and they were able to quickly offload 1,000 passengers because only two cars were stuck in the tunnel, four remained beside the platform. but some metro riders here in rosalind say they're still affected by this derailment. >> i'm kind of apprehensive today getting back on the train, i really am. i don't think it should have happened in the first place. i really don't. i don't think there should have been a cause for the derailment, as much track work as they do, there should be no cause for derailment. >> reporter: some metro riders say the derailment is another example of what's wrong with the aging rail system. >> i ride the metro rather frequently and i find it to be reliable. on occasion the consistency isn't there as would be helpful and the prices are a bit exorbitant. >> reporter: metro's management team received a detailed briefing today about the derailment here and they say they will make more information public as soon as it's

appropriate. in rosalind, christ gordon, news 4. jerry edwards' defense team is getting its first shot at questioning andrew young, edwards' former aide, former friend. he's the prosecution's star witness. earlier today he testified that his relationship with edwards began to crumble about the time edwards dropped out of the '08 presidential race and rielle hunter gave birth to their child. young also testified he got tired of living with hunter, tired of pretending he was the baby's father. edwards is on trial in north carolina, accused of using campaign money to hide his affair with hunter. the weather is back to feeling like april, folks. >> here come the rains again. meteorologist doug cam her is in the storm center to tell us how long it will last. >> the rest of the evening will be a-okay. there is a storm system to the west that we'll be looking at for rain as early as tomorrow morning's rush hour. let's take a look outside. simply gorgeous conditions, bright blue skies, a few clouds out there. wed ear looking at temperatures

near 70 degrees in most areas. that's where we are at the airport with winds out of the west at 13 miles per hour. what are we seeing temperaturewise? across the rest of the area, 68 in leesburg, 68 in manassas, 71 in fredricksburg 64. as we take a look at the wider view, notice the rain back through portions of ohio and indiana, through portions of kentucky and western portions of west virginia. that's the rain that will be making its way in here overnight tonight and through the day tomorrow. tomorrow could be a fairly wet day. that's not the only wet day in my forecast. a new report from the american lung association shows air quality is the cleanest it has been nationwide since the report started coming out 13 years ago, but there is plenty of bad news in that report. that includes for people in our area. 40% of people living in the u.s., they still live in areas where air pollution is threatening their health. the district, fairfax county, montgomery county, prince

george's county all received the grade of f for the amount of ozone pollution. firefighters and paramedics are going door-to-door today in prince george's county checking carbon monoxide detectors. they want to prevent another tragedy after five people died yesterday in oxon hill. erica gonzalez joins us live for more on the outreach effort and what people are doing to help the victims' families. erica? >> reporter: good evening. take a look behind me. the building or the home, the red brick with the white shutters is where the five people died yesterday. it looks like family members have been allowed back inside today. meanwhile, firefighters, oxon hill firefighters have been through this area and have checked carbon monoxide detectors in nearly about 100 homes. oxon hill firefighters have been going door-to-door in this neighborhood warning people about the dangers of carbon monoxide. >> you want the parts per million to be zero.

>> reporter: yesterday five people were found dead in their home on shelby drive. apparently poisoned by the odorless and colorless gas. >> this is called a cm meter. we're going to take some readings in your house. >> reporter: randy shock says his home has had a detector. >> that old one has been there like ten years. whenever it gets weak, it beeps. >> your reading is actually negative one. >> reporter: the victim's home didn't have a carbon monoxide detect detector. their loved ones including a small but close-knit church community have rallied together. maria garcia spent the afternoon making donation boxes to place in local stores. we're immigrants, most of us barely making minimum wage and can't afford a funeral.

the hope is to raise enough money to send the victims' bodies back to el salvador. it's proving to be expensive. $5,000 to $6,000 to relocate each body. so a non-profit organization that helps salvadoran families in these situations has set up a fund to donate to. if you'd like to make a contribution, go to our website, nbcwashington.com and searching key word "donation". baltimore police say the woman accused of stabbing her 8-month-old daughter yesterday doesn't have custody of the child. she's identified as keneesha thomas. investigators say she was on a supervised visit and got upset when a social worker told her her time was up. she then stabbed the child five times according to police. the baby is expected to be okay. thom mass nou now facing

at all with all the sunshine. high temperatures around 70 degrees across the area. take a look at this shot from our tower cam in northwest washington. a beautiful afternoon. you can still see the cathedral. 70 degrees. winds out of the west at 13 miles an hour. winds gusting to 18 miles an hour. as we look through the next couple days, we'll see the chances of rain increase. 6 in manassas, 67 in martinsburg, 64 in frederick. pax river coming in at 0 degrees. no rain to talk about right now on storm 4 radar. as we widen out here, here is where the rain is. back towards ohio, western portions of west virginia and then back into indiana. this is an area of low pressure that's making its way our way and will make its way our way overnight tonight. nice weather right now with sunshine. but the clouds will be on the increase. here come the showers, right around 6:00, 7:00, 8:00 tomorrow morning, just in time for your morning rush. it may not be everywhere. i do think most of us will have

at least wet roadways to contend with early tomorrow morning. watch out. you may want to leave a little early tomorrow. then the area of low pressure moves by. a secondary trough moves through. that will give us a chance of showers, maybe a thunderstorm. temperatures will actually rise tomorrow, i think up to around 75 degrees in parts of the area. some of you could get close to 80 tomorrow. we'll continue to watch for that. much cooler though on friday. temperatures move back down i think a little bit below average to around 65 degrees. there will be plenty of sunshine. it will also be rather breezy on your friday. this evening, look at this, a few clouds, a nice evening. 57 to about 63 degrees. tomorrow morning, not bad at all. but if you like the rain, that is, you will need the umbrella when you step out. rain likely, moderate showers, a soggy morning rush. sunrise tomorrow at 6:16. tomorrow afternoon, mostly cloudy with rain early. more rain late in the day. a little break and maybe sunshine during the afternoon. 72 to about 77 degrees. as we look toward the next

now it's relaxed. they had the pregame music going. fans aren't in here yet at the td garden. it really is all or nothing for the capitals in game seven of the bruins. this could be the beginning of the stanley cup run. or if they lose it could be the end of the dale hunter era as the coach of the capitals. regardless of the outcome, this morning at the morning skate all the capitals and the coach very relaxed. >> we're just out there having fun. we've got to be loose. we can't be too excited, can't be too nervous about tonight's game because then we start making mistakes. for us, we've been a loose group all year, out there having fun playing hockey. tonight is no different. >> are you looser than normal, or is this normal for a pregame skate today? >> this is normal. this is normal. i think completely normal. are you trying to get in my head or what? >> i'm just asking. you guys seem to be having fun. >> absolutely. think it's important that we don't change a thing.

fast forward through the headlines. d.c. police are trying to figure out who killed a tourist from colorado. detectives say 66-year-old gary diedricks was in town for a two-week visit. his body was found in the petworth area. marines discharged a sergeant gary stein who argued he was exercising his free speech. the marine corps and the military has limited service members' free speech since the civil war. a major development today in the republican race for the white house. newt gingrich is suspending his campaign. nbc news has learned he will make the official announcement

here in washington on tuesday. now let's fast forward to the weather. the weather today beautiful, 70 degrees out there. abundant sunshine. the clouds will get chicker, but so will our temperatures. they'll be on the rise. 70 in washington. look back to the west, 93 in wichita, 88 in st. louis. some of the warmer air is going to try to make its way in here. unfortunately it's not going to be able to try hard enough because i think we're going to get cooler by the end of the week. we'll talk about that plus our rain chances coming up. wendy? >> all right. now to the sex abuse trial of falls church community activist michael gardner. an 11-year-old girl took the stand giving specific details of the alleged abuse. he's accused of molesting three children at his daughter's sleep over. >> julie carey has more on today's court action. >> she was just 10 years old at the time of the incident. today she testified with the maturity and confidence well

beyond her years. in contrast to yesterday's young witness, defense attorneys were able to do little in their cross examination to challenge her version of events. the 11-year-old witness dressed up in her court appearance. she was wearing her monkey pajamas when she says her friend's father, michael gardner, sexually molested her. she became the second to testify at the trial of the well-known community activist. gardner faces charges of aggravated sexual battery for allegedly molesting three girls. the now fifth grader told prosecutor nicole whitman she was fast asleep on an air mattress with six other girls when someone began rearranging her comforter around 4:00 a.m. i'm sure it was mr. gardner, she testified, i could see his face. she says gardner went back upstairs only to return three separate times. he came back downstairs and started touching my vagina

adding his hand was on top of her ba jam mass. she told jurors she initially feigned sleep because she was scared. she said the last time when he began to lift up the waistband on her pants, she began to suddenly wake up. she says gardner asked if she was okay and then left. the girl says she told her father the minute he picked her up. he, too, took the stand and tearfully recalling, as soon as i started down the driveway she leaned over and said, mr. gardner touched my private parts. he said he asked daughter several times if she was sure. i did not believe it was anyway it could be michael gardner. falls church police were soon called. prosecutors also presented their dna evidence today. a state forensic scientist says she found dna on the front pelvic area of the 11-year-old's monkey pajamas for which michael gardner could not be eliminated as a contributor.

she also found three sperm on the pjs, not from gardner but from the girl's father. what does the discovery of the father's sperm on the pajamas mean? prosecutors have yet to address that. prosecutors say they can come from something as simple as doing the laundry together. reporting live from arlington, i'm julie carey, news 4. prince george's county police are trying to find the killer of 18-year-old ronald minor. it happened along addison around 8:00. investigators tell us they're trying to identify a suspect and establish a motive. a scary scenario played out in front of students at glen oak high school. students acted out a deadly crash resulting from drinking and driving or high speed. police and fire units helped to make this demonstration seem real. the school did this to encourage students to make smart decisions over the next few weeks with

prom, graduation and beach week approaching. >> we're trying to keep the school in mind before they make bad decisions. we're trying to make sure they understand what the consequences are and to make it real for them. >> the police department also encouraged students to attend the school-sponsored after prom parties. prince george's county honored several brave men and women who risked their lives to save others in 2011. the county held the 35th annual public safety valor awards in greenbelt. gold, silver and bronze meddles we als were awarded. several were honored for their response to a bank hostage situation in january of last year. the suspect was shot by police after taking a teller hostage at a capital one in takoma park. up next on news 4 at 5:00, several broadway actors coming to d.c. for a summer tour. who came to the rescue when

some cast members from the broadway production "the normal heart, focusing on gay men at the beginning of the aids epidemic. it will run from june 8th through july 29th at the arena stage in southwest. the production will coincide with the international aids 2012 conference happening in d.c. this year. it tease first time the conference has been in the u.s. in more than 20 years.

there many ways to communicate love. this week's wednesday's child shows us a smile can say a lot to those around him. the hope is he will soon have a permanent family that will show him a lot of love in return. barbara harrison introduces us to victor. >> hi. it's so nice to meet you. are you excited about going swimming. >> reporter: swimming is actually the highlight of victor's school days. one of his instructional assistants was there to help victor get to the school. instead of a high five, he likes to touch fingers. with that he was on his way to his favorite things. his expresses show how happy victor is when he knows he's about to go for a swim. that smile is almost ear to ear. everyone who knows him says this is the happiest time of his day. victor is a foster child. at 12 years old, he has spent his whole life so far in temporary care until a permanent

(man) register today for the... and receive $25 off your registration fee. because everyone deserves a lifetime. two dogs behind vicious attacks in a d.c. neighborhoods are no longer a threat. the dogs were caught by police in prince george's county after lunging at police officers. news 4's darcy spencer has more. >> reporter: jim, this tragic story started right here in this neighborhood friday night. it came to a dramatic and unexpected conclusion saturday morning four miles away in prince george's county. those dogs were found, they have been put down. the owner still has not been found.

>> reporter: two american bulldogs seen charging kids in a northeast washington neighborhood friday night were found in she wasly in prince george's county saturday morning. one was shot by police. both ended up being euthanized. >> the dog charged him. he was about right here when he fired one round. >> reporter: sergeant matthew maguire described how a police officer encountered the two dogs near 1:00 a.m. on saturday. >> initially the officer thought they had been fighting and the injuries were a result of them fighting each other. >> pretty bad injuries? >> yes. >> reporter: after the officer shot the dog, the animal jumped in the cruiser. the officer slammed the dog shot. the other dog was laying down nearby. prince george animal control took over. >> we responded and transported them to the emergency hospital right away. due to their injuries, both dogs

were euthanized. >> reporter: the dogs had been observed by neighbors 8:30 friday night. the dog showed up here in cheverly more than four miles away. >> they were very aggressive trying to find the owners. sometimes people get scared and they run. a d.c. police officer says he believes they know who the owner is, but so far, no arrest. >> this man pastors the church near where the dogs should be found. >> reporter: you think whoever did this should be punished? >> i think so. they know what they were doing. it's sad we live in a society like this that people don't want to do the right thing. >> reporter: during my live shot yesterday afternoon i showed you how the streets and sidewalks were virtually empty. that's because people were in fear believing the dogs. >> reporter: still on the loose. we can see people are starting

cincinnati, through portions of central kentucky. all that will make its way our way tonight and through tomorrow morning. i think some of us will be getting wet as we step out the door to head into work or to school, wherever you may be doing. you may want to pack the umbrellas in the kids' backpacks tomorrow. clouds move in overnight. here is 5:30 in the morning. you can see most areas are seeing some rain. even though it doesn't have any rain around washington at 5:30, i wouldn't be surprised the see most of the roadways at least on the wet side. through morning hours, the heaviest rain may stay just to the south of the district. southern portions of virginia, southern portions of maryland. watch out around quantico and fredricksburg, lexington park and calvert county, yea you may see heavy rain in the morning. breaks in the afternoon. the rain will try to return around 9:00, 10:00 tomorrow night around the i-95 corridor. maybe two rounds of rain tomorrow.

both could hold moderate to potentially heavy rain. thinking upwards of half an inch of rain unless we get heavier downpours. as far as temperatures tonight, 49 in gaithersburg, 47 in leesburg, about 54 inside the district. temperatures on the mild side this evening. then tomorrow, they're going to be nice and warm. again, two periods of rain. in between, if we see some sunshine, temperatures are going to be up in the mid to upper 70s, maybe 74 in gaithersburg and 78 in fredricksburg. that's good news there, too. 65 on your friday as we clear out with plenty of sunshine and a cool weekend. only 58 on saturday with a 50% chance of showers. most of those should be early sunday morning, more of the same. a couple more showers on sunday, too. not a washout either day. but it's a good idea to have the umbrellas handy. thank you, doug. the man accused of killing jennifer hudson's family pap peered to cry at his trial. graphic images were shown of

youngest victim, hudson's 7-year-old nephew. today was the first time william balfour showed any emotion in court. balfour has pleaded not guilty to first degree murder in the deaths of husband's mother, brother and nephew. hudson was not in the courtroom when prosecutors showed the pictures. the singer entered the courtroom after that. people in montgomery county are waging a battle against plans for a gas station at the new costco. the wholesale club needs a special permit to add that gas station. neighbors in the wheaton area are worried about the impact it will have. news 4's jane watrel joins us. >> this contentious fight is entering its third year. neighbors creating a legal defense fund to fight the gas station. costco is not backing down. construction is in full swing for brand new costco outside the busy west field wheaton mall. they also want to build a mega gas station, something laura and hundreds of other nearby

residents oppose. >> this will be the largest gas station in montgomery county. 12 million gallons a year pumped, upwards of 50 cars idoling in line, it's 16 pumps. >> reporter: for over two years she and others in the kensington heights civic association have been pooling money to hire environmental experts to fight the gas station. dan lives less than a football field away from the proposed site. he says the location poses a public health risk because of the fumes emitted from cars waiting to gas up. >> they're telling us that citing the busiest gas station in montgomery county right next to a pool, right next to a school for children with special needs and all the single family residences, it can't be a good idea. it takes common sense. >> reporter: costco needs a building exception to build the gas station. a spokesman tells news 4, we've

done our homework. we're good corporate citizens. we can build a gas station that has no adverse impact. eric brawn went on to say costco has built similar with sites similar. residents believe they have science on his floor, please. >> they anticipate they're going to have about 55 cars idling with 16 cars fueling. that on a hot summer day spells disaster to somebody's lungs. >> tonight costco is hosting an open house to make their case to neighbors. among those costco is bringing in are authorities are air quality, architects and costco's gas station consultants. neighbors say they'll be there. the world's largest chocolate bar made a sweet stop at melwood elementary school.

a police officer in connecticut saved this little guy's life in an unusual way. he was responding to a call and the dog's family was frantic. this 10-year-old shih tzu was choking on a raw hide treat. the officer performed a modified

operating their vehicles in construction zones are using cell phones resulting in more accidents. >> work zones are not static. one day they will move the barriers and they will move the lanes. so they change all the time. thinking that you've got this area down pat, that you know it and don't have to pay full-time attention, that's a real problem. >> reporter: while many surrounding jurisdictions have banned all cell phone use while driving, virginia has not, even though a number of government agencies including the national transportation safety board suggests it. >> the ntsb issued a recommendation last december recommending to states that they ban talking or texting on the phone while behind the wheel except for in emergency situations. >> reporter: virginia secretary of transportation says virginia has chosen education over strict penalties and fines. >> we do not have the resources to put somebody in every single car and look and watch everything you're doing 24-7. you've got to get people to start to break some of these bad habits that we've gotten
