good morning, everyone. welcome to "news4 midday." i'm barbara harrison. it is monday, may 21, 2012. we begin with breaking traffic news. a bus fire. danella sealock joins us with the latest. >> here's what's going on. traveling 395 northbound in the 3 d street tunnel a school bus caught on fire. no passengers are onboard. it looks like the school bus is being towed. and as it is being towed it caught on fire. for now, northbound lanes in the 3rd street tunnel completely shut down at this time. bash remarks we are going to keep watching this for and you will be back with an update. for now back over to you. >> thanks, danella.

now to another breaking news story this morning. the health of former d.c. barry are councilman is hospitalized in las vegas right now. news4's tom sherwood spoke with barry this morning and joins us on the set with the latest his condition. how is he doing? >> short story is he had a blood clot in his leg when he was going out to las vegas. i talked to him this morning. he wanted us to know -- i want to read this quote from him. the blood clot had no impact on my physical feeling or my mental ability. i thank god for that. >> maybe you can tell us why was he in las vegas to begin with? >> yesterday he was flying to viewing vague for a big -- huge international convention of shopping center operators. it is like 20,000 people. mayor brae is there, council members are there. that's to build business in the city, to prosecuting costcos and walmarts and that type of stuff here. p barry was en route. he went through memphis and got

delayed on the flight. sat on the plane and, you know, everyone tells you if you travel get up. he didn't get up. when he got to las vegas, he was at his hotel and said he was eating dinner and didn't feel well. he started feeling pain in his legs and said he's old enough and had enough scares to call the doctors right way. they took him to the hospital in las vegas. where they say they had a blood clot in his leg. >> he realized it himself and did something about it. >> he did. he's had a lot of scare and kidney transplant and other things. he got there and said that -- they took care of him. they gave him blood thinners. he said he will be fine. he just needs to rest. he is 76. he wants to go to the rest of the convention but haven't let him out of the hospital yet. >> it looks like he will be okay and how soon do you think he will get back here. >> he doesn't know. he doesn't know at this point when he will get out of the hospital. he may be able to stay for a couple of days. we just don't know. we will be watching it all day.

>> did you heard his voice and sounded good and able to -- >> yes. the first time i called him, he said he didn't feel like talking and hung up. then he called -- he called back. i know he must be okay. he felt well enough to hang up on me. he called back and he said all these things i just reported. so i hope he's all right. we will find out later today. >> then you keep us posted. we will continue to follow the progress of councilman barry. >> 76. >> i know. tom sherwood, thanks so much. right now a d.c. family is breathing a sigh of relief after finding a 6-year-old missing since sunday afternoon. jayvon brown was found around 8:30 this morning. we are still working on how he was found and who he was with. family members reported him missing noon sunday after he disappeared near his home in the 1300 block of columbia road in northwest washington.

family and friends had been muchimuc searching since. turning to the weather. wet start out there. nothing like we had this time yesterday. we need the rain, i guess, tom. how long are we going to have to have it today? >> well, doesn't look like it will last -- looks like it will last quite a number of days. we have a stalled weather pattern giving us needed rain. it has been abnormally dry now for 2012. we have been running a deficit of four to five inches. this is welcomed rain. and it is coming from a trough of low pressure. all those areas in white, cloudiness, and low pressure extends from the lower part of the chesapeake bay to the atlantic ocean and easterly flow from that has been bringing in the showers and cooler weather. west of us, where the trough is not having any influence, it is almost 80 degrees out in ohio. closer to us, yes, that easterly flow, temperatures almost green areas are still in the 60s. reagan national now at 68. much of northern virginia and much of maryland and now just in the mid to upper 60s. there's the radar over the last hour or so. you can see the flow of those --

showers moving from the southeast and heading towards the north and west. and right around the metro area we just have a few sprinkles, little bit of drizzle where you see the colors where it is rain a little bit. that's around baltimore and up towards the pennsylvania border. and some of the heavier rains, pockets in yellow in washington and frederick counties and maryland. the rest of the afternoon may have a few flashes of lightning. otherwise occasional shower and patchy drizzle. highs reaching the low to mid 70s by mid afternoon with that east-northeasterly wind. how much longer will it last? we will look at that time rest of the week and weekend. four-day forecast and the 7-day outlook in a few minutes. >> okay, thank you, tom. today law enforcement across the country will kick off click it or ticket. police will be looking for drivers and passengers that don't wear seat belts. transportation secretary ray lahood will join officers to help launch a click it or ticket program in southeast d.c.

a prince george's county police officer faces dui charges after crashing his cruiser in bladensburg. police say officer daniel consales was off duty when he ran off the road at route 1 and tanglewood drive. detectives say gonzalez took a breathalyzer test and had a blood alcohol level of .13. the prince george's county police department has a zero tolerance for alcohol use in police vehicles. a fairfax county police officer is on routine administration i have leave after the sheeting death of a man. the officer went to a arrest a man on child pornography charges. police got a tip he was hiding out at chelsea square apartments in springfield. when officers confronted him they say the man swung at them with a sword and police say that's when an officer shot the man and killed him. detectives say the suspect had seven clourt standing warrants for child pornography. a certain much this morning for three men who police say kidnapped and rob ad man near the university of maryland. the police say this man was

driving along university blchd around 1:30 sunday morning when another man on the side of the road flagged him down. when the driver stopped that man pulled a gun and got in a the back seat and then told the driver to go to a couple of -- drive a couple of blocks where two other armed men got into the car and then robbed the driver. the attackers then ran. the victim was not hurt. teachers in maryland have a better idea of their financial future now with the state budget set. the superintendent just announced details of their new contract. news4's derrick ward joins us live now from rockville with the latest now. good morning. >> reporter: good morning, barbara. this is something definitely that will be seen as something good for some school employees, teachers, including there may -- may pay more for some others things as well. overall it looks like a good package. still tentative now as waiting final approval. this is how it goes. this will affect employees involved in three of the major

unions. montgomery county education association and the service employees international local 500 and montgomery county association of administrators and principals. this is regarding the fy 2013 budget. there will be a 3.4% sal are increase for school employees who are hired before february 1. they will have to pay more in the way of co-pays for doctors visits and name brand prescriptions. there will be a $10 increase in cost of not -- co-pay for nongeneric drugs and $5 to $10 increase for doctors visits. now employees haven't seen a cost of living increase in three years. this measure either negotiation was the unions were in limbo because state funding was slashged by the general assembly. but that money was restored during that special session just last week. as the superintendent see this, this is all investment in human capital. >> this is an opportunity for us to compensate our employees. very appropriately given the

hard work they do, given the sacrifice they made over the last few years and fiscal climate and currently exists and know with this package we will really be able to move forward in montgomery county. >> reporter: this isn't was just one-year agreement and who knows where they will be next year. they may have to go back and renegotiate these things again. this whole psych cole start again but things are looking good in terms of this especially in terms of this increase. the increase that these school employees are getting. actually higher than county employees get in general. they are apples and oranges in terms of the compensation packages. it does look good for school employees at this point. in montgomery county, derrick ward, news4. coming up, chicago's getting ready for more demonstrations today on the last day of the nato summit. a look at what's topping today's agenda for world leaders, including president obama. and a special treat for graduates of a high school in joplin, missouri, destroyed by a tornado. stay with us. this was the scene there last night. these protests were far more peaceful than demonstrations earlier in the day when nearly four dozen people were arrested or clashing with police. at least four police officers were also hurt but are expected to be okay. afghanistan is the focus of today's summit. world leaders expected to sign off on president obama's plan to pull troops out of the country by the end of 2014. he's trying on get nato leaders to commit to more. here's nbc's brian mooar. >> reporter: today in chicago, nato officially endorse as plan to wiped down the war in afghanistan by the end of 2014. >> we will make our commitment to long-term partnership. >> reporter: as president obama hosts the final day of the nato summit in his hometown, he's trying to get nato allies to commit money and manpower to not only finish the war but help afghanistan after 2014. appearing with afghan president

karzai conceded the road ahead will not be easy. >> but we are confident that we are on the right track and what this nato summit reflects is that the world that's behind the strategy we have laid out. >> afghanistan is fully aware of the task ahead. and of what afghanistan needs to do to reach the objectives that we all have. >> reporter: as nato leaders held their meetings, protesters demonstrated outside in the streets. from chicago to kabul a diplomatic effort to end a decade long war. the u.s. commander of nato forces in afghanistan says he expects the fight to continue right up until the time of the pullout. brian mooar, nbc news, washington. at least 96 soldiers are dead and more than 200 injured in a suicide attack in yemen this morning. the bombing took place near yemen's presidential palace as soldiers took part in the military parade drill.

the bomber was a soldier, taking part in that zril and was lined up with fellow troops when he detonated the explosives. the blast happened minutes before the defense minister and chief of staff were supposed to arrive. it is one of the deadliest attacks in the country in months. today the man convicted in the bombing of pan am flight 103 is being laid to rest. day after he died. nearly three years after he was released from prison on compassionate grounds. abdel al megrahi passed way from cancer. he was released in 2009 after doctors said that he only had months to live. al megrahi claims he was innocent until 1988 bombing over lockerbie, scotland. all 259 people onboard, mostly americans, died. so did 11 people on the ground. right now john edwards and his family are at the federal courthouse in greensboro, north carolina. this as the jury begins its second day deliberating his

fate. the former presidential candidate is accused of spending nearbily a million dollars of campaign donations to hide his pregnant mistress in 2008. jurors deliberated for about five hours on friday and they requested office supplies and blackboard and specific evidence. they also asked to review exhibits having to do with the $725,000 given by bunny mellon. edwards faces six counts of campaign finance violations. if convicted he could spend up to 30 years in prison. thousands of italians are trying to figure out what's left of their homes a day after a deadly earthquake there. 4,000 people woke up in tents this morning. magnitude 6.0 quake hit northern italy on sunday morning, killing at least four people. the italian officials are trying to determine the exact number of deaths. hours later a 5.1 magnitude aftershock hit the area. the quake's damage destroyed several centuries old buildings.

the italian prime minister cut short his trip to the nato summit. he's planning a cabinet meeting tomorrow to declare a state of emergency for that area. president obama will deliver the commencement speech at joplin high school today p. almost one year to the day after the missouri town was flattened by a deadly tornado. joplin high school was destroyed in that ef-5 twister and this year's seniors took classes at a nearby shopping mall. tomorrow on the anniversary of the town plans to break ground on a new high school. middle school and two elementary schools. the tornado was one of the deadliest and costliest in decades. 161 people were killed and caused $2.8 billion in damage. ♪ >> the ground shook a little for a different reason last night in mineral, virginia. country star alan jackson played to a crowd of 6,000 and benefit concert.

music for mineral. the aftershock of hope. all of mineral's nearly 500 residents got to attend the concert for free and additional tickets helped raise more than $150,000 to help rebuild the county's schools. mineral was just miles from the endstent epicenter wake that hit last august. we felt that when two around here. we still remember it. tom kierein is working that day. and remember what i was doing. i was -- shooting a cooking segment. >> we saw the video of that. that's right. >> plaque fell off the wall. we got rain today and we need. >> it it has been a wet morning. what a change from 2 wonderful weekend. that's all now a distant memory fading into the past. and this morning, we woke up to drizzle and a little bit of fog and passing showers. and it is not going away. that's a live picture from our hd city camera. looking at the jefferson memorial along the banks of the potomac river. and overhead, a gray sky.

and into frederick, maryland. up towards the pennsylvania border. bunt under these clouds elsewhere we have patchy drizzle throughout much of the region. and the temperatures under the low clouds have been just slowly creeping up. only in the low and mid 60s. we have been holding steady here for the last six, seven hours with the same temperatures. now as we go forward, over the next 48 hours, all these areas in green color you see moving around, these are all zones of potential rain street and this is by midnight tonight. still passing showers possible. then around 4:30, 5:00 tomorrow morning, maybe still some low clouds, maybe some patchy drizzle and fog, starting off, tuesday morning, then tuesday by noontime we could have some more numerous showers and maybe some heavier downpours to our west. and we will have this off and on through the day tuesday. this is by tuesday, 8:00 p.m. more showers moving in. how much rain? these are some of the rainfall estimates here that we may get by the time it really tapers off on wednesday. all these areas in blue and lavender, one on two two inches and covers most of northern virginia and here is the panhandle of west virginia.

here's washington and these areas in green generally half inch to inch around the bay and eastern shore. we will get those amounts. certainly will help out our deficit which has been running about four to five inches below average for the year. for the rest of the afternoon, thunder and lightening. some of that drizzle, though, and passing showers and temperatures may creep into the low 70s. perhaps briefly upper 70s in southern maryland, east-northeasterly wind. tonight we will have shower activity and continuing off and on. lit not be constant. we will drop from near 70 sunset at 8:19 and by midnight, mid 60s and by dawn tomorrow, low 60s. and another day lot like today tuesday and perhaps again on wednesday, too. then on thursday and friday, some sunshine returns. it is welcomed as we will head towards the memorial day weekend. just in time. we are time thing just right. looks like it is going to turn like summer weather for memorial day weekend. great beach weather. highs in the 80s. >> that's great to hear. >> let's hope so. it is out there on the fridges

same-sex marriage a civil right. the group's board of directors passed a resolution over the weekend and the leaders just wrapped up a news conference about their landmark decision. and fip's megan mcgrath live outside the naacp's head quarters in baltimore with more for us now. good morning. >> reporter: good morning, barbara. for more than 100 years the naacp has fought for equal rights under the law for all people. and now the historic civil rights organization is weighing in on the debate over gay marriage. now during a board of directors meeting over the weekend, the naacp passed a resolution supporting marriage for same-sex couples. benjamin todd jealous, the president and ceo, says the defense of gay marriage is one of the key civil rights issues of our day, that it is the a legal question, not one of morals. >> it is the responsibility and history of the naacp to speak up on the civil rights issues of our times.

we are both proud of our history and challenged by it. challenged to never allow threats to equality for all people go uncontested. >> while the nature of the struggle may change, our bedrock commitment to equality of all people under the law never will. >> reporter: not everyone, however, agrees with the naacp's decision. there are a number of black clergy groups who say that gay marriage goes against the teachings of the bibles and it is not a civil rights issue. it is one of morals. reporting live from baltimore, megan mcgrath, news4. >> thank you, megan. we have breaking news in the district that we have been reporting. emergency crews are on the scene of a fire in the 3rd street tunnel. >> reporter: how are you doing? >> i'm good. listen, can you tell us what the situation is out there right now? what was the cause of that fire?

>> reporter: don't know the cause. the fire, what happened is we had a -- school bus that was being towed through the tunnel and a fire started on the bus. bus unoccupied and no driver. no children. and at this point both sides of the 3rd street tunnel on blocked and redirecting traffic. folks being evacuated from the vehicle. no injuries tore report. no casualties. just a matter of right now treating traffic hazards. >> are there vehicles still trapped inside the tunnel along with the school bus? >> reporter: they are inside the tunnel, yes. they are still inside the tunnel. people evacuated their cars and are being redirected. >> what about traffic? how are you redirecting traffic around that -- very popular

route? >> we have the -- they are reek directing it. right now i think folks are being evacuated to the other side of 3rd street tunnel. >> and the people who were taken from the tunnel, where are they going? where are those people going who have left their cars there? >> reporter: i don't have details on that right now. en route. but -- they are being evacuated, for sure. getting people out of the tunnel. >> any idea how soon they will be able to get those -- traffic that's stuck there moved out of there and reopen the tunnel? >> reporter: hard to tell. they will have to remove the vehicles and the fire is out. may take a minute to remove the vehicles. and clear things up. it is hard to say how long traffic is going to be affected this way. >> we appreciate your talking to us as you are moving over in the direction that you have to get to. thanks so much and we will continue to follow this story and hope to have more.

thank you so much. >> reporter: we will have more for you hopefully. no injuries, that's main thing. >> thank you for telling us t t that. a look at how it is affecting traffic, let's go to danella sealock for the latest. >> that's great news that there are no injuries. if this is your commute, you are trying to access 3rd street tunnel, again, northbound as well as southbound close at this time. avoid the area to allow crews to work. other issues we are facing in our area, i-95 southbound, this is in maryland. just past 100. disabled tractor trailer. it overheated and you are still seeing just a bit after delay as you pass 100. and then also, very rainy if you are traveling on the beltway, this is in montgomery county past connecticut avenue. traveling on the inner loop starting to hit the brakes. right around 270. and then delays continue to georgia avenue. barbara, back to you. >> all right, thank you, danella. a medical examiner is trying to figure out how a husband and

wife died in what the police are callinging a murder/suicide. the 49-year-old man and 39-year-old wife were found dead in their apartment in silver is spring. both had taum trauma to their bodies. investigators are not saying if a weapon was used or what type of weapon. suicide note was also found. both bodies were taken to baltimore where an autopsy is being conducted. there is new information now tied to the disappearance of that baby, lisa irwin. little girl vanished from her family's missouri home in the middle of the night back in october. her father says a month later someone stole his debit card number. and used it on a website that specializes in changing nails. kansas city police say that they are investigating the charge. but the family's lawyer told the "today" show this morning he believes more could be done. >> from the debt get-go, they pigeonholed them unfortunately. it is right to start with them as suspects but aleveiated other potential and missed massive

opportunities including three witnesses that identified the man holding a baby that matched the description after midnight with just a diaper on. it is inconceivable that wasn't followed up on immediately. >> the irwin family lawyer also says that the night baby lisa disappeared, someone made a phone call to a number the parents did not recognize. the cell phone that that call was made from disappeared that same night. private company will make second attempt to space history or with space history with a rocket launch that will happen tomorrow perhaps. technical problems stopped the falcon 9 from blasting off early saturday morning in florida. the countdown clock at cape canaveral stopped one seconds before the launch. the company named space x says that there was engine trouble. the next possible launch is tomorrow around 3:45 in the morning. falcon 9 is supposed to deliver supplies to the international space station. here's an out of this word site. millions on the west coast and asia will treated to a rare

partial eclipse last night. dubbed the ring of fire. it gets its name from the bright ring left around the edges of the moon as it passes in front of the sun. it is the first time in 18 years that this type of eclipse has been visible over the united states. it happens p been seen in japan since the 1800s. let's check in with tom kierein now and find out about our weather and when we might see the sun again. >> not -- let's just say not going to be real sunny this week. we have an onshore easterly flow. thanks to a drop of low pressure along the atlantic seaboard. over the lower part of the bay. giving us all of these clouds and passing showers, green and yellow on the screen. those are showers and elsewhere just scattered drizzle and clouds across virginia, maryland the district of columbia, and these will be with us here from time to time throughout the rest of the day, tonight and through mid week. 60s to near 07. reagan national at 70 degrees. maybe we will climb another five degreeors so for a high by mid afternoon. maybe a little thunder and

emergency crews are on the scene of a fire in the 3rd street tunnel. the opportunity sell closed to traffic in both directions. officials tell us that the school bus caught fire while it was being towed in side the tunnel. no one was on that bus. d.c. fire and ems tell us that there are no reported injuries at this time. but there are vehicles that had to be evacuated and left in the tunnel. it could be some time before the scene is clear. we have more breaking news now here in the district. we r criminal charges are coming in connected to mayor gray's campaign. tom sherwood joins with us the latest that. >> the campaign has under investigation important more than a year. just this morning criminal charges were filed in federal court against one of the assistant treasure earrs. charged with three counts of using fake names on contribut n contributions and one count of destroying evidence under an

investigation. these are very serious charges. i believe they are misdemeanors. it is important to note this is the first criminal charges in this yearlong investigation into mayor gray's campaign. >> how does this reflect to mayor himself? >> it is his campaign. how much did the mayor know? maybe he doesn't know much about the way the campaign was run. it started late. very fast moving. on the other hand the mayor is very detailed. he wants to know everything about everything he does. the question is did he know about some of these things? that's the overall umbrella of this investigation. but the important thing is that this is his first criminal charge in this investigation. we are will watch and see what happens. the way that information comes in. >> has the mayor had a chance to comment on this? >> the mayor is in las vegas as we talked about at the beginning of the show. this is just breaking. we will be finding out a lot more as we go through day. >> as we learned earlier, mayor

let's talk to tom kierein about our weather. we keep hoping the sun will peek out. another chance. >> keep hope alive. does look like we -- not going the sooe a lot of sun, let us say. for the next several days, we are under the influence of a persistent easterly flow bringing in moisture on off of the atlantic. as a result, we see a lot of clouds and raindrops here on the 7-day outlook. so for today, tonight, tomorrow, tomorrow night, wednesday, and each of those days passing showers. not constant rain but just some showers from time to time. maybe some patchy drizzle as well. and perhaps afternoon thunder and lightning. strong storms. highs in the 70s each day, today, again tomorrow and again on wednesday, morning lows inning the 60s. and then finally does look like maybe thursday we will have a little sun breaking out. still lot of cloudiness around. smaller chance of a shower highs upper 70s. then still a bit of a chance of a shower on friday. maybe a thundershower but just in time for the memorial day weekend.
