raising the approval numbers. i'm steve handelsman, news4. today house republicans filed a lawsuit asking a federal course to enforce a subpoena against attorney general eric holder. that subpoena demands internal documents connected to failed gun tracking operations known as fast and furious. president obama has asserted executive privilege to prevent the forced disclosure of the documents. the house lawsuit asks the court to reject the president's claim and order the attorney general to produce the records. now to a developing store in college station, texas, where three people, including a police officer, where are killed. that shooting was not far from the camp tuesday of texas a&m. news4's darcy spencer is monitoring the situation from our newsroom. darcy? >> we now now a law enforcement officer is dead as well as a 65-year-old man. the shooter himself was killed in a gun battle with police. this is all happened while authorities were attempting to

serve an eviction notice. it happened near the edge of campus near the football stadium. authorities say a police constable identified as brian bachmann was shot as he approached the home. three other officers were hurt and a woman who was currently in surgery. earlier an alert was issued for an active shooter. classes are not expected to start for a couple weeks, so there were very few students there. police are still investigating to tryifigure out what triggeree shooting. a church collapse in leesburg, 20 trusses fell throwing workers three stories to the ground. the heavy beech trapped one man underneath them. a second worker was hurt. a third man on that roof actually survived the fall without my injuries.

they were working on a church under construction on evergreen mills road. this is the scene of a three-alarm fire this afternoon in. at the ft. bill advisory. everyone did make it out safely. police are still trying to figure out what happened with the crash that happened this morning at the intersection of franc franconia road at gum street. jackie has the latest. >> reporter: we're told that the injuries to the civilian driver who died are so severe he will have to be positively identified by the medical examiner. the two mangled vehicles show the force of the collision. it happened around 3:00 a.m. the 5500 belong of francnn ia

road near gum street. a police officer was struck head-on by a westbound -- the impact caused that vehicle, a 2006 infiniti to burst into flames and let the 30-year-old officer trapped in his badly damaged vehicle. >> my understanding is he was unusually trapped in a vehicle, it took some time to get him out of it. >> reporter: the accident investigation caused the road, a major commuter artery, to be shut down for hours. a spokesman says the officer who is involved, who's been with the department for eight years, was responding to a call for service. the spokesman said the call would not have required the officer to activate the vehicle's emergency equipment. >> i believe he was responding to a call, but nottage emergency call. >> residents say this section of

the road is treacherous for drivers and pedestrians. >> nobody don't like to wait. >> reporter: police are looking into whether alcohol or speed played a role in the crash. the officer remains hospitalized with what are described as non-life-threatening injuries. jackie bensen, news4. this afternoon a woman was shot twice, once in the leg, once in the arm. police tell us she was shot in the 3400 block of 13th street southeast. detectives don't have a suspect. a foot fight is likely the motive between a murder in capitol heights. police arrested travis hoskins and charged him with killing his roommate. officers say hoskins and oliver davis argued over food inside their home. the maryland department of health and mental hygiene confirmed its first case of west nile virus in a human over the

the building is under construction. police are working to figure out what caused a deadly crash involving a police officer this morning. it happened here along franconia road. investigators say a car collided with a police cruiser head-on. it burt into flames and the driver was killed. the officer was taken to the hospital with serious injuries, but is expected to be okay. there's a search under way for a man that's accused of sexually assaulting a woman. a woman was walkses when someone came up from behind and groped her. the man ran off. d.c. police want them to give you a call. today police released a sketch in the first for a rapist in montgomery county. this man is considered a possible suspect for a rape that happened in the green farm conservation park. police tell us they're looking

for a man known to visit that area. you there was a hardwarming welcome today for a baseball player paralyzed while vacationing in. nick balancinger was celebrated a state championship with his team a few months ago. now those teammates and others are rallying around him as he begins his recovery. >> it was a homecoming surprise like none other. they swarmed the ambulance that carrying nick on their final leg much the 19-hour journey home. his mom and aunt say the show the support gives nim and the family a huge boost. >> i think just the -- really help. >> to be home and have the support of your family and friends is unbelievable.

the chesapeake bay foundation is urging oyster lovers to recycle their shells. the foundation has played recycle bins all around maryland and virginia's watershed. officials say the save oyster shell program is a good way to help restore the native oyster population, which is in decline. >> it's definitely something worth while. citizens feel like they're doing something to save the bay. if they eat a dozen oysters, then give the shells back, it's just as important as donating to the foundation. >> they use the shells and tanks to farm more oysters, then played in the bay to grow and repopulate. the foundation says this will help the bay's ecosystem and
