manhattan? right at the start of the workday, as you mentioned, all unfolding, one of eischens in this city, immediately tremendousering concerns about terrorism, but it quickly became clear that this was the result of a tragic workplace dispute. the gunfire outside the empire state building sent tourists and new yorkers alike literally running for cover. authorities say 58-year-old jeffry johnson, dressed in a business suit, carries a .45 caliber handgun shot his 41-year-old former co-workers at least three times at close range, walked away turning on to busy fifth avenue. police in the area were alerted by a construction worker who saw the whole thing, and when officers went to johnson, he reached against. two officers opened fire, firing an many as 16 shots, as many as seven shots hitting johnson, and nine others were grazed or shot

by ricocheting bullets, but they are all expected to survive. during a downsizing at the company about a year ago, johnson was laid off. in a dispute with one of the former employees of hazan in front of the building, johnson produced a pistol and fired at close range. striking his 41-year-old victim in the head. at the two officers approached johnson, he pulled his semiautomatic pistol from his bag and fired on the officers, who returned fire, killing him. >> it's a terrible thing. our first thoughts are for the murder slim, and then their prayers, thank god nobody else was seriously injured and that they will all recover, and once again there's an awful lot of guns out there. >> reporter: commissioner kelly says that johnson was laid off

from his job about a year ago, traded harassment accusations with the victim identified at steven irkilino. nbc news is told they had? kind of confrontation in the past year. law enforcement says he bought his gun in florida back in 1991. he was not licensed to carry it here on the streets of new york. live in midtown manhattan, jim rosen field, back to you. the security officer hailed as a hero for apprehending a gunman last week, is out of the hospital and we're hearing from him for the first time. the man accused of shooting him just had a hearing. jackie? >> reporter: wendy floyd lee corkins had a backpack containing a gun, ammunition and chick-fil-a sandwiches.

this afternoon he was found mentally competent to stand trial a court-ordered evaluate has determined that corkins is -- the defense attorney responded, not guilty. prosecutors say corkins who volunteered at a gale community organization walked into the lobby of the family research council, a conservative policy group last week and shot security officer leo johnson after stating, quote, i don't like your politics. the group organized a show of support for the fast-food chain after the ceo made statement saying he opposed gj. the security over managed to rescue the gun away from corningens. johnson has released a statement that says -- i am thankfully now
