the rnc in tampa. a secret service agent made an embarrassing and potentially dangerous mistake while protecting mitt romney. he left a gun in the bathroom of a plane during the candidate's trip from florida to indiana yesterday. a reporter found the weapon, the secret service says the agency is aware of what happened and the matter will be handled internally. the agent involved was not on last night's trip back to tampa. a we're following a developing story in charlottesville, virginia. george hughley is being sentenced for the murder of yardley love. they were both lacrosse players at the university of virginia. their volatile relationship ended with a deadly confrontation in 2010. that's when he beat love to death. he was convicted of murder in february. juror recommended -- a judge has to make a final decision. jack jill benson will join us

live as soon as anything happens. right now a court hearing about the deadly theater massacre in colorado. at issue is the notebook the suspected gunman james holmes allegedly mailed to the psychiatrist. that notebook reportedly contains descriptions of a violent attack. the defense is expected to argue that the book is privileged doctor/patient information and should not be admitted into the case. hot also' attorneys have said he's mentally ill, but prosecutors say he's sane. 12 died, 58 others were wounded. the dulles greenway is back open after a tanker accident. just after 5:00 a.m., virginia state police say about 400 gallons of diesel fuel spilled. they spent hours cleaning up the mess. the driver was taken to the hospital, but is expected to be okay. some parents are concerned about their kids' safety because of a bus stop change in prince

george's county, as news4's tracee wilkins reports, some elementary students now have to walk near a busy road with no sidewalks. >> reporter: things have changed for these students. instead of catching the bus within their peat-friendly subdivision, these little ones have to venture onto washington drive, a road with plenty of traffic and no sidewalks. >> last year the bus stop was up there. it was more safe for the children, because there's a sidewalk and we would sit on the sidewalk and wait for the bus. >> reporter: the stop is now a block outside the subdivision, the cross-section of a major and secondary road. little elementary students standing here is something drivers aren't used to and parents don't want to get used to. >> i think it's terrible. i think something needs to be done fast. >> reporter: these parents aren't alone. there's been a number of

complaints since the school system changed some of the transportation rules and pickup spots. according to the website, the transportation department had to make budget cuts. the cuts have redirected $5 million back into the classrooms. the changes include a maximum walking distance of half a mile. adjusted walk zones of approximately 24 schools, and some middle and high school students are riding the same bus now to save on stops. >> i think putting the safety of the kids in jeopardy over budget cuts is a big risk. >> reporter: she has a kinder guard nen, and has complained to the transportation department about the location, and isn't happy with their response. >> they've sent two people out and they deemed this was safe, although the kids are not walking on a sidewalk. >> reporter: while a number of changes have been made to save money within the transportation department, officials are still looking to hear from parents. if they have concerns, they're asking them to contact them.

murder and larceny recommended a sentence of 26 years. the judge heard arguments for about three hours. arguments were heard from the prosecution. they three former classmates who testified to incidents of violence involves george hughley. the defense presented family members, george's aunt, his uncle, a priest with whom he has shared communion and meetings of week for the last two years testifies he was a spiritual young man, a peace maker, but in the end, the judge considered all that was put before him and recommended that sentence of 23 years. and added one years for the larceny, but recommended it be

served concurrently. so effecttively sentenced for 23 years in prison. there will be additional parole conditions, he'll have to undergo substance, alcohol and drug abuse and counseling when he's paroled. again, they witnessed saying hughley deserved to have his sentence reduced down into the 14 will have year range, something that is apparently rare here in virginia in the end, the judge did deviate, but only by about three years, so again this afternoon, george hughley sentenced to serve 23 years in prison. we're going to talk about our weather now.

another young person's life is fundamentally changed, and that's the life of the perpetrator? what's the right thing to do? we believe the jurors here in charlottesville got it right the judge made some adjustment, and he otherwise nearly without modification, affirmed the judgment of the jurors. i think they have gotten this case right.e appreciate their h work. >> reporter: whether alcohol is too much of an excuse for criminal behavior -- is it -- how dao vu that? >> you know, alcohol is a disinhibiting agent. as the central nervous system

depresses. it doesn't cause people to do things that aren't in them, but it enables them or facilitates them in doing things that are there. this gentleman has an anger problem. he has a violent problems. the human being is respond for that behavior ultimately, whether it's under the influence of alcohol or not, and here with multiple examples of behavior of a similar sort that had potential to be far more serious in terms of the outtim, this young man was on firm notice of the behavior issues he presented, and the circumstances

they would come to the surface. so he can be held appropriately and firmly accountable for all of his behavior in this case. i think that ultimately that's what happened. >> reporter: did he show remorse or contrition, and were you surprised by the family, i'm so sorry for your loss, i hope you find -- >> from doing many cases of this sort, that right of allocution, the differences between people are so great. so many people who come before the court, in fact the routine are just not many people are educated and articulate, and not well positioned to be able to say much that's in their heart. it's a very different circumstance.

so we try not to judge people by what they say. sometimes they are able to convey remorse and you feel it, and other times there are things that might mute the ability to hear remorse that they really do have. we try not to read too much into that. >> do you think you were handicapped by them not taking part in the presentence report? do you think the judge may not have reduced it had he more information? >> conceivably if he had more information, he might have had a base upon which to feel as if an additional reduction could be made or should be made. i think it's very uncommon for someone not to participate so thoroughly in the presentence investigation process. it's entirely different to refrain from giving a firsthand description of the events. that's a very different issue. we have complete respect for the

choice that was made in that regard. it's a right, and that's the way it is, but in relation to making information available by appropriate releases, that's a one of the way we have in a presentence report to have a third-party neutral provide reliability data for the probation office and the court to consider. and you would ordinary want to have that. >> reporter: you thought that they got this case right. did yardley love get justice? >> you know, all i see is loss. it will be that way forever. you know, it's such a rough approximation. we just wish that it didn't happen. >> why do you think those prewake-up calls wen unanswered?

>> it's tick larry difficult with young people to recognize those signs of themselves it's different for people generally. one of the -- there are two things that in our view are important takeaways from these events. one would be to -- to enable young people especially to recognize in their friends problem behaviors like overindulgence in alcohol, especially where it's contributing to behavior that's out of control. and act, act now. and the other would be to recognize in your colleagues

when someone at a mature age, and 21 is a mature age, when they're engaging in violent behavior, that is so wrong. it's so wrong at that age. it's so developmentally appropriate, and act on that. if we can take away from this in a university community or doing a better job with that, our in our community generally doing a better job with that, we'll have taken away a lot that could be put to good use in the future. did they have the right to drin? >> yes, it's a fifth amendment right. >> what did you make of the argument that he had no weapon? >> we see homicides of all sorts year after year.

if its a weapon susceptible, it's a factor chch you can conclude there was malice, but you can exhibit it with your hands and feet and whatever, and to the same degree and to the same extent. it's of no consequence in many ways great bodily harm was done and it caused death. that's the important fact. >> reporter: would it have been better if someone had prosecuted on the earlier offenses? >> whether it's this community or some other community, and we bring this to the work we do in our office, it's never underlooked, never overlook the

significant of comparatively minor behavior. it doesn't mean you have to respond in too harsh a fashion, but it's important for violent behavior committed by a young person of the age of 21 to come to the attention of law enforcement so sensible decisions can be made. it can be an opportunity to intervene. never overlook the opportunity, and it might be something so simple as underage possession of alcohol, which befalls many a student here in this community, and in any community in the commonwealth of virginia. take it seriously. make the kids go through a program that will last some time, it's going to be

inconvenient, and some of them benefit from it, some of them not slow down an iota in their problem behavior, but take it seriously. we do, and it's important to do that. if there's violence especially, take it seriously. it doesn't mean it has to be punished harshly, but you have to look to each arrest and each case as an opportunity to make a difference with that person that could be very important down the road. >> reporter: he gets 85% of what you heard in there today? >> that's correct. >> minus time served already? >> you receive credit for time serv served, and you may receive up to 15% good-time credit. >> in theory, he could be out if he was 40 years old. >> i would have to do the math. i'll take your word -- he'll be a young man when he's released, much life in front him.

>> is there a cultural issue that comes into play -- >> no, i think students here, like students in many, many places. >> reporter: in europe, what is the world missing out on? >> i'm not what you mean. >> what type of future did she have to look forward to? >> oh, my goodness. that's such an important question. when you think of each of the kids who came back to testify, they've got in new york, they're involved in the financial industry, they're involved in some of the them broadcasting t. doing many things. the beginning of what will be important things. that's what. that's what we're missing out on. >> what type of contribution do
