traffic. today the supreme court will hear a case on whether race should be a factor considered in college admissions. the nine justices will hear the case of abigail fisher. she says she was denied admission to the university of texas austin in 2008 because she's white. among those that will be in the courtroom are relatives of heyman sweat. he sued the same college alleging his admission was blocked to university to texas because he's black. a hearing today to focus on last month's attack at the libyan embassy in benghazi. ambassador chris stevens and three others were killed in the attack. a state department official will be among the witnesses to testify before the oversight committee. he's expected to deny reports the state department denied requests for additional security in libya in the weeks and months before the attack. the man believed to be behind the anti-muslim film that

sparked riots across the middle east is due in court today. a federal judge will decide if mark youssef will be sent back to prison for violating probation. he was convicted of bank fraud in 2010. he lied to his probation officers and used aliases. federal officials say he was behind the 14-minute film called "innocence of muslims," which has led to the violence in the middle east. the buckeye state is the focus of decision 2012 this week. romney has three stops scheduled there today. yesterday the republican presidential candidate spoke to a crowd outside akron with new jersey governor chris christie. no republican has won the election without winning ohio. president obama held a rally outside ohio university. it was his 17th trip to the buckeye state. mitt romney's comments on abortion to a newspaper in iowa also making headlines. he told the "des moines

register" he would not pursue abortion legislation if he became president. afterward, this campaign put out a clarification saying romney will put out legislation providing greater protections for life. romney's campaign alsoreacted, saying the republican challenger is not telling the truth about his position. it cited a 2007 gop debate where romney said he'd support banning all abortions. and the producers of sesame street want the president's camp to stop running an ad featuring big bird. the ad mocks romney's comments to end the debate on federal funding for broadcasting. sesame street says it's a nonprofit organization that does not participate in political campaigns. the obama campaign said the ad is only running on cable during comedy shows. for or against gambling in maryland, the spending is past

any governor's race on record. penn national, which opposes the measure, has spent the most at more than $18 million and still has $3 million more to spend. by comparison, then mayor martin o'malley and incumbent mayor robert ehrlich spent $13 million on the governor's race. a former vincent gray aide who pled guilty to corruption will be sentenced today. howard brooks lied about funneling money to fringe mayoral candidate solomon brown to bash mayor adrian fenty. brooks will be sentenced to probation and not jail time because he has provided assistance to their investigation. brooks is one of three former aides to plead guilty to corruption charges. health officials m florida say a 70-year-old man died in july from the same strain of

fungal meningitis. there have been 119 confirmed cases of meningitis across 23 states. virginia has 24 cases of meningitis, including one death. maryland has eight cases, including one death. the injections came from a massachusetts company. all have been recalled. good morning to you, richard. we are tracking spacex right now. the dragon capsule expected to dock at the international space station any time. the crew at the station is standing by as we take a look at the video that we've been watching all morning long. it's ready to use that robotic arm to grapple the spacecraft once it arrives. once it's on its way, we're hearing that it will be actually docked and then it will have three checks before berthing in a couple of hours. it will then be bolted into place. the astronauts will then get the

lightning hit a tree and burst into flames in naples, florida. a florida woman caught it on video from inside her home. she was recording the storm because she likes the sounds of rain. as you heard the noise startle her. no one was hurt, but the lightning destroyed the neighbor's outdoor lighting unit on the trees. >> she let out one curse word, i think. i would have let out a couple more. >> i like that she liked the sound of rain, but no one likes the sound of lightning. scary. >> a little too close.

i'm angie goff at the news 4 live desk with breaking news. the world's biggest car recall in 16 years. toyota is recalling 7.4 million vehicles due to malfunctioning power window switches. about 2.5 million vehicles are in the u.s. the models include camry, rav4, highlander and many more, made between the years of 2005 and 2010. so far no accidents have been reported because of the window problem. at the news 4 live desk, angie goff, news 4. october is bullying awareness month. for one frederick county, maryland teen, he's all too aware of the problems of

bullying. preston deener was set to do a camera interview about bullying, and three teens came up and attacked him. preston was suspended for fighting against a bully, but the bully was not suspended. his mother said they can't come up with a plan with brunswick county officials, but they can't stop it. >> if preston is at an active, they will support him. there will be people ins clas. all the teachers are now aware of the situation. it's more or less now they're taking precaution, and now they're actually trying to help us the best they can. >> frederick county school officials say they're working on identifying the students who bullied preston. a maryland man accused of killing his wife and 11-year-old son will not face the death penalty. montgomery county prosecutors announced they will not seek the death penalty in the case against curtis lopez.

lopez is accused of murdering jane and william mcquain. she was found beaten to death in her germantown home a year ago, and the boy was found dead in the woods. this morning the mother of a murdered newspaper reporter in fauquier county wants to know who killed her daughter. investigators say sarah libby greenhall died of a gunshot wound to the neck. they found her body in july when her horse caught on fire in upperville, virginia. the sheriff's depu of manassas ruled her death a homicide. >> i feel horrible, devastated. i just never stop thinking about it. i just don't know how to cope with it. >> greenhall wrote for the winchester star newspaper. she reported on frederick county government and covered the local equestrian community. the sheriff's office is working with the fbi to solve the murder mystery. metro blames stolen electronics for a spike in its latest crime report.

the transit agency says crime is up almost 7% between january and now compared to last year. 79% of reported cases involve property damage, such as car break-ins, thefts, and arson. the other 21% include robbery, assault, rape, and homicide. those cases were reported at the anacostia rail spags. that was covered by college park and gallery place. tomorrow the transit agency will hear plans to accommodate the inauguration crowd. metro plans to create a specially priced commemorative smart trip card. riders will have to pay peak time fares despite inauguration falling on the martin luther king holiday. kwame brown will learn his fate next month on felony bank fraud charges. until then, the former d.c. council chairman must follow a

strict sur fcurfew and other st rules. the judge set a curfew of 11:30 p.m. to 6:00 a.m. for brown. brown was ordered to return to court yesterday because he failed to report to authorities by phone three times. brown must follow these rules in order to remain free until his sentencing. a maryland delegate could be allowed to stay in office despite reaching a plea deal on campaign finance and theft charges. tiffany alprince george's county pled no contest to using $3,500 of her campaign's money for her own wedding. prosecutors said that should lead to her suspension from the house of delegates, but alston's attorneys say, if she completes her sentence, which includes community service and paying money back, she could be allowed to keep her office. house leaders are also looking into the matter. a massachusetts man faces charges for bringing a smoke grenade through the los angeles international airport. he was on his way home to boston from japan. federal agents say the 28-year-old man was wearing a bullet-proof vest and flame

retardant pants when he was taken into custody at the airport on friday. they say he had the smoke grenade and other weapons in his luggage. federal officials tell abc news they are not under the impression that harris was a terrorist. he made his first court appearance on tuesday. a detention hearing is set for friday. closer to home, a fairfax man is facing a weapons charges for bringing a loaded gun to reagan national airport. tsa agents found the gun in the man's carry-on bags on friday as he tried to go through the security checkpoint. police confiscated the .9 millimeter semiautomatic pistol, the ammunition, and the magazine. they cited the passenger and allowed him to continue on his flight to dallas. good news for concerned redskins fans. rg3 will be back on the field today, but that is in guarantee he will be able to play on sunday. the rookie quarterback suffered a mild concussion in the third quarter on sunday as he scrambled for the sideline. he's been cleared to take part in practice today without contact and will continue to be evaluated for any symptoms.

the beltway, your lanes are open. not seeing anything really slowing you down in either direction. outside the beltway at 50, clear too. here's a live look at 410 as you make your way inbound as well as outbound. you're issue free. connected to new york avenue, no problems at all. metro silver line may not be ready on time. the transit agency says the new rail line may end up opening a month later than expected. that could cost metro $2 million to $3 million in revenue. the first phase is expected to open next year. the metropolitan airport authority, which is building the silver line, says the project is not running behind. metro is taking several factors into consideration as it drafts its budget the price of gas could go up in montgomery county. a law maker wants the ability to impose a county-wide gas tax. montgomery county council president says the gas tax could fund transportation projects, including the purple line. he says one of the advantages of the county tax is the county would get to keep all of the revenue.
