the clerk has four ceremonies lined up already. maryland is the ninth state to legalize same-sex marriages along with d.c. a live look outside. calm and cold start to this january. it's 37 degrees out there. let check in with meteorologist tom kierein with your forecast. tom, good morning. >> good morning, eun. welcome back. as we get back to work and school this second day of 2013, we have a few scattered flurries now passing right near washington just north and west. but south and east getting a few flurries and where it's a bit warmer, farther south and east. parts of the northern neck. lower eastern shore. virginia tidewater getting a few sprinkles of light rain. farther west, it's cloudy. we have a drying trend. drier air from the midwest that will move in here, it does look like it's going to be perhaps later this morning. we'll get sunshine breaking out. right now, it's a cold morning. temperatures in the mid 30s but above freezing.

miles an hour. e eun? the housa proved legislation that will keep taxes going up for 98% of americans. angie goff is at the live desk to break it down. >> good morning to you. with bipartisan support, the housa proved the fiscal cliff bill. here's a look at the highlights. tax hikes for the wealthiest americans. the bill boost the 35% income tax rate for those making more than $400,000 a year and households pulling in more than $450,000. that's a 15 to 20% tax increase. unemployment benefits remain safe for now. the bill extends jobless benefit for the long-term unemployed for at least another year. that's an estimated 2 million people affected. as for spending cuts, this has been a huge sticking point in this debate. they're delayed for another two months. we're talking $109 billion worth of across the board cuts to the budget of the pentagon and the

number of domestic agencies. >> we can come together as democrats and republicans to cut spending and raise revenue in a way that reduces our deficit, protects our middle class, provides ladders into the middle class for everybody who is willing to washing hard. >> despite this bill, your paycheck is a little smaller because a temporary cut in payroll tax expired. the social security will jump back to 6.2% for 160 million americans. it had been 4.2%. some banks say that could cut consumer spending this year. that's less than the 115 to $125 billion in revenue it cost the government each yoor. at the live desk, angie goff, news 4. angie, thank you for that. new york area lawmakers from both parties are furious with house republican leaders. they are angry the current congressional term will end without a vote on aid for

victims of hurricane sandy. a house committee drafted a measure to allocate $27 billion for recovery efforts. speaker john boehner says the house won't vote on it before this term ends at noon tomorrow. new york congressman elliott ing al tweeted he's never been ainge reer in his 24 years in the house. hillary clinton is on blood thinners to treat a blood clot in her head. she fainted and had a concussion last month. doctors were giving her a checkup this past sunday when an mri revealed a blood clot between her brain and skull. the condition did not cause a stroke for neurological damage. blood thinners are to help shrink the clot. she remains in the hospital for now. teachers, staff and students who survived the shooting in newtown, connecticut, will attend an orientation. the rooms at this school were redone.

they hope a familiar environment will help the kids make a smooth transition to the new school. classes start tomorrow. sandy hook elementary school became a crime scene on december 14th when adam lanza killed 27 pop before killing himself. the connecticut lawyer who filed a $100 million lawsuit hon. behalf of a student has withdrawn that claim. irving penske is evaluating new evidence. it was filed on behalf of a 6-year-old girl saying the state failed to adequately protect her. he may refile in the future. students and parents will see more security at stafford county public schools. the sheriff plans to do daily checks at all public schools in the wake of the newtown, connecticut, school shooting. it's the first time the county called for daily police patrols at schools. the sheriff's office says there is a precautionary measure and not in response o to any threat. the parents of a first grader suspended for pointing his fingers like a gun will meet with school leaders in

montgomery county. the boy is a student at roscoe nix elementary in silver spring. he was suspended after the shootings in connecticut. the 6-year-old was playing with friends, not making any threats. >> evidently, he was pointing his finger at someone and saying pow. keep in mind that a 6-year-old is presumed not to be able to form the intent to commit a crime. >> the school system will not comment on individual disciplinary matters. however, a spokesman tells news 4 generally with younger students they make sure that children and students know about behavior that needs to change and understand the consequences if it does not. 4:36 now. this morning, pennsylvania's governor will file a federal lawsuit challenging the ncaa's stiff sanctions against penn state. they were handed down in the wake of the jerry sandusky child sex abuse scannel. the ncaa penalty includes a $60 million fine against penn state

some good news from the scene of an oil drilling ship that ran aground in alaska. the coast guard says it doesn't appear the ship is leaking fuel or the hull has been breached. the rig is carrying 150,000 gallons of diesel. other fluids as well. it broke away from a tow line and ran aground in an unpopulated island during a storm. all crew members evacuated safely. just about 4:41. time to look at the weather. seems calm out there, aaron. >> 37 chilly degrees outside our studios. tom kierein keeping an eye on the forecast for us. >> we're going to be into this cold pattern for the next couple of days. be prepared for that. there is the view from space. the cloud cover is rather thick over the region. those little areas you see in

new this morning, a paparazzo was hit by a car and killed after taking photos of justin bieber's car in los angeles. detectives say the pop star was not inside the white ferrari at the time of the crash. the sports car was parked on the side of the road and the photographer was crossing the street when he was hit. no charges are expected to be filed against the driver. today, some survivors of a bus crash that killed nine people in oregon are expected to

finish their trip to canada. they collected their passport and other property spread across a rural highway. the tour bus carrying 49 people was headed back to british columbia from las vegas sunday when the bus hit a guardrail and flew some 200 feet down an embankment and rolled over at least once. at least 14 people remain in the hospital. the taliban is comparing america's withdrawal from afghanistan to the pullout of troops from vietnam. the group calls the withdrawal "a declare victory and run strategy." they say the transfer of security to afghans is merely a retreat similar to the pullout from vietnam. nato troops are scheduled to be out of afghanistan by 2014 although the u.s. will keep a small presence there. met with president hugo chavez twice and that the leader has "the same strength as always." .

nicholas ma dur owe offered that in an interview last night. chavez is recovering from cancer surgery in havana. he's suffered several complications since three weeks ago including a respiratory infection and it's unclear when he will return. a death row inmate who spent 11 years in prison for murder could be released. justin wolf is in jail for the 2001 murder for hire of his drug supplier in prince william county. his family and friends created a website about his case. back in july, a judge threw out wolff's conviction saying prosecutors knowingly used false testimony from the actual gunman. the judge ordered a retrial within 120 days but that never happened. prosecutors tried to appeal the ruling but an appeals court upheld the decision. now it's up to a judge in prince william county to decide if wolfe can be released. a prince george's county teacher accused of having a sexual relationship with a i 13-year-old student. he was arrested last month. the student recently came

forward. he taught at the isaac gore dine school. the sexual relationship with the student went on for several months. king is now on administrative leave. 13 now before the top of the hour. this morning, the law enforcement community is coming together to remember one of their own killed in a crash. hundreds attended a candlelight vigil last night for chris young. the 35-year-old worked as a police officer in prince william county. young died on monday in a fiery crash in bristow. he was responding to a call on his department motorcycle when he collided with a minivan. you see that all here. young's brother is also a police officer. he spoke at the vigil last night. >> he's looking down on us right now and just smiling. the two people in the minivan involved in that crash were not hurt. the commonwealth's attorney will decide if charges will be filed in this case. investigators are trying to

determine what caused this massive fire in prince george's county. witnesses sent us these photos showing flames shooting from the roof of the home on student drive in clinton. the fire began just after 6:00 last night. the fire was so intense, firefighters were forced to fight the fire from outside. no one was hurt. the house was vacant at the time. and this morning, investigators will be back on the scene of a church fire in prince george's county. the fire broke out yesterday at the first wesleyan church in oxen hill. there was a power outage on new year's eve that may have contributed to the fire. >> possibility that when the power was reenergized, something could have happened, had a power surge. >> my children has growed up in the church and it's just sad. >> investigators will determine whether the fire was an accident. the fire caused more than $100,000 in damage. the redskins get back to

record 2012 for washington. taking a look at the view from space, we have a lot of cloudiness. this area in gray is a few flurries. they're showing up in northern virginia. our northern, western suburbs. there's a bigger area south and east of washington. the areas in green are sprinkles. the areas in pink, maybe a few sprinkles and flurries from calvert and charles and st. mary's. it's rapidly moving off to the east and a drying trend as the day progresses as much colder air moves in. in pittsburgh, it's only 20 degrees. in ohio, most locations are in the teens as well as indiana. our winds will be coming in out of this direction throughout the day. it's going to continue to pump in the cold air. actually, some of the warmer temperatures of the day will be this morning into early afternoon. lot of clouds around for your morning commute. 6:00 a.m., few flurries, maybe a few sprinkles. mainly south and east of washington by 6:00 a.m. we'll be still generally right near or above freezing in the

morning. it's 150 years since president lincoln signed the document. it freed slaves still in rebelling states and led to the ending of the civil war. the national archives displayed the document for three days until yesterday an estimated 10,000 people waited in long lines to see it. montgomery county wants to have a say in whether pepco gets a proposed rate hike. the county submitted a petition to the maryland public service commission asking that they be allowed to intervene in the rate hike request. leaders say with more than 300,000 pepco customers in the county, they deserve a seat at the table. the county has been part of rate hike discussions before. pepco asked for the more than 60 million d rate increase in november. it would add about $7 to the average monthly bill. a chance flyover lands a stafford virginia man in jail. pilot david zent ner and his wife fly over their house on the way to the airport to look at their property from the sky. this time they spotted something
