residents say this is a large ventilation shaft in between two buildings. it is several feet wide, certainly large enough for someone to fall through it especially if they don't know it's there. that seems to be what happened here. the police chief says this is all a tragic accident. >> reporter: 23-year-old michael poe was on a rooftop. police say his body was found at the bottom of a ventilation shaft a day after he was first reported missing. poe's family and friends posted flyers. the search for any sign of the virginia tech grad centered around shenanigans's irish pub, where he was last seen alive. blocks away off biltmore street and columbia road northwest is where he was ultimately found. residents there can't believe the new year started with such tragedy. >> i was out at a party, and it seemed quite quiet compared to

other new year's eaves. >> the police chief says the death doesn't seem to be a crime. >> it's very early in the investigation. right now it appears an accidental foul. there's no foul play suspected at this point. >> reporter: poe's father put many of the posters up. wednesday he said he feared for -- >> it's unbelievable the emptyness we feel. >> reporter: but today he declined to speak. those who saw the missing flyers hoped for a different outcome. >> i imagined maybe he had gone to a friend's and they would find him. >> again police still say this is an open and active investigation. poe's father did not want to comment, but he said he is grateful for everyone who came out to try to find his son. reporting live, richard jordan, news4. right now investigators are trying to figure out what led to a crash that sent four teenagers to the hospital. a large truck hid their car.

this chopper 4 video shows the scene about an hour ago. we're told one of the teens is in critical condition. at this point investigators are only say the teenagers turned directly into the path of that truck. now to the breaking news in virginia, a man once a death row for murder came within hours of walking out of prison today, but a short time ago he learned he'll remain behind bars for now. seth lemmon is live with the latest. >> reporter: jim, that's right. the 44th circuit court of appeals just granted a stay that halted the release of justin wolfe. his family was very hopeful he would walk out today as a free man for the first time in ne near -- all the back-and-forth is because prosecutors tried to stop the release of justin wolfe. there were a couple stays and motions across courtrooms in the state of virginia. the district court, the appellate court, even the u.s.

supreme court. that circuit court granted a stay after the judge said prosecutors did not mean the 120-day deadline to retry wolfe after a judge discovered misconduct and vacated the 2002 sentence. now the federal judge ordered that wolfe would be released in ten days. today is the tenth day, but because the stay was granted justin wolfe will remain behind bars tonight. the appellate court plans to hear the entire case at the end of the month. reporting live from prince william county, seth lemmon, news4. the 113th congress is now in session. as required by law, the new congress convened on capitol hill at noon today. ohio congressman john boehner was reelected to a second term as speaker of the house without the embarrassment of a second vote. it was a narrow victory after defections from most conservative members of the republican party. on the senate side, former virginia governor tim kaine just took the oath of office along with 11 new members of the

senate. northern virginia bureau chief julie carey is live on capitol hill with more on senator kane's first day on the job. joules? >> reporter: mostly today was a day of reflection for tim kane. he's taken the oath of office many times before, but as he steps into his new role as virginia senator, tim kaine possibly faces his toughest job yet. for a day anyway, fiscal cliff gloom gave way to cheers as tim kaine supporters welcomed virginia's brand-new senator. minutes earlier on the senate floor, this was the more solemn scene, as former governor kane took his latest oath of office. at his side new york mark warner and outgoing senator jim webb kaine tells news4 he comes armed with great optimism about his

new job. >> yes, it is exciting. maybe even particularly in a tough time. >> reporter: he says he takes heart in the fact that 11 other new senators joan him, all clustered together at the bottom of the capitol steps, and three more will be added, enough new blood, he thinks, to perhaps change the atmosphere. >> in the body, that's a lot of fresh air coming into the situation. i hope it might lead to a more cooperative spirit. that's what virginians want to see, and i think americans do too. >> reporter: the ceremonial swearing in with vice president joe biden came later. his wife, two of his three kids and his parents were there. kaine's supporters, most discouraged by the dysfunction of last congress, have high hopes. >> being a former governor, he knows where those cuts can go and where they can't go and what

would affect the country as a whole, but also what would affect the states. he brings a wealth of expert at this time to the senate, we are so blessed to have him. >> he's already started talking with senators, republicans action and others, and so hopefully he's already got his foot through the door working with others. so let's hope that they can reach compromise and consensus and move a nation ahead. >> reporter: tim kaine is now virginia's junior senator. that means after just four years mark warner is now virginia's senior senator. we'll hear from him coming up on "news4 at 6." no for you julie carey news4. ben cardin is beginning his second term in the senate. the vice president swore him in today. cardin spent 20 years in the house before elected to the senate in 2006. he also served as the youngest elected speaker for maryland delegates. large crowds are expected for president obama's second inauguration here in d.c., but

they won't be as big as the first time around. officials are projecting 600 to 800,000 people on the mall. in '09 the estimate was about 1.8 million. this year's projection is based on past attendancy, hotel reservations and charter bus permits. there's heightened security today for sandy hook teachers and students. more than 400 students returned to class today three weeks after the massacre that left 26 people dead. the new school has been moved to the nearby town of monroe. school officials say they've been working hard to make sure the new location is safe for students, while parents say they've been working to help their children move on. >> trying not to keep talking over and over about the same stuff, and we want her to get back to normal. monroe police have worked very diligently with the newtown police so we can all feel

comfortable and secure. >> connecticut's governor announced a special commission today to focus on legislative reforms to ensure something like this never happens again. and a virginia mother is accused of trying to kit her 3-year-old child. police say 26-year-old julia vasquez gave her daughter cough medicine to make her sleep, and then she started a fire. investigators believe she put on the the fire in her home in triangle when it became too intense. she dropped her daughter off with another family member and then crashed her car. vasquez was not badly hurt. she's charged with attempted murder and arson. the little girl was treated for minor burns. one hour from now, family friends and colleagues will pay their respects for a prince wendt county police officers killed in the line of duty. a wake will be held tonight between 6:00 and 9:00 at the helden memorial chapel. his funeral will be held tomorrow. young died monday afternoon when they collided with a minivan

while responding to an emergency called. he leaves behind a wife and three children. part of wisconsin avenue and chevy chase has reopened today after a big water main break closed the road for hours. the pipe broke last night on wisconsin avenue, and dorsett avenue, but crews were only able to begin working on the break causing a big backup for commuters. leaking water and freezing temperatures created ice on the road, leading to a multicar accident. >> the ice patch right here, did a 180. as you can see my car ended up right here. this guy almost got killed right after my accident. he was behind his truck and this truck him hit. >> officials tell us the broken people was caused by freezing temperatures. they expect similar incidents to continue in all this cold stuff. and the cold weather will get even colder. doug kammerer joins us with the first photograph at 5:00. >> we saw the coldest today so

so the redskins have someone who knows the inside track of the seahawks? >> we're hoping this could be an advantage, and the defense certainly has been playing better. only seven players on this year's roster were on the team the last time the redskins made the playoffs. only one guy on this roster played against the redskins in that playoff game five years ago. that is josh wilson. he was a rookie with the cease hawks fresh out of the university of maryland back in '07, now a wily veteran and part of an improving defense that will have its hands full. >> josh wilson says it's not personal.

from an appeals court means justin wolfe will not walk free today. a prince william county judge had ordered his release, but federal courts overturned -- but when federal courts overturned the 2002 murder conviction, claiming there was misconduct from the prosecution. tonight d.c. police are trying to figure out what caused a young man to fall to his death. michael poe's body was found at the bottom of an apartment ventilation shaft last night. he was last seen alive new year's eve. and that's virginia newest senator tim kane being sworn in today. he took the oath of office along with 11 other new senators. kaine says he hopes to bring a renewed sense of bipartisan ship to the 113th congress. doug? >> cold temperatures not just here, but the entire eastern part of the country. 30 degrees in state college. 34 in philly, the warmest number on the map 41 down in roanoke.

laws, but when it comes to sharing the road, bike leaders tell us it's a two-way street. biking is big in d.c., so much so that the wildly popular bike share program in the city has turned into the largest program in the country, but is everybody playing by the rules? >> do you pay attention to all the traffic rules? you stop at the red lights? >> no. >> reporter: you don't stop? >> not always. >> reporter: our cyclists are technically vehicles obeys traffic signals? a quick sample on the road today shows there's still work to be down. d.c. is plans more bike lanes along roads like illinois avenue that has some neighborhood groups concerned about cyclists obeys traffic laws. here at the washington area bicyclist association there's an understanding that some cyclists do need to do a better job. it's especially important that folks act predictably, and the easiest way is to follow the

traffic lays. >> reporter: bike leaders make the points that drivers often need to do more to share the road. in any event, city leaders are looking for ways to continue to education cyclists, even offering classes. >> we teach adults and children how to bike and teach pedestrian safety in the schools. >> reporter: they also have safety tips on all the capital bike share bikes. >> as one active in the community, i recognize it, try to tell people about it. >> reporter: just how much has it grown in d.c. in recent year? about ten years ago there were three miles of bike lanes in the city. now that number is close to 6 on. recording live in northwest, adam tuss, news4. there was a deadly hunting accident in virginia on new year's dave. it happened on private property in the blue ridge highlands. wildlife officials say a 50-year-old man was hunting with a juvenile on tuesday night.

the younger person mistook the victim for a deer and shot him with a 50 caliber rival. investigators say they don't plan to file any criminal charges. the virginia supreme court has know reversed that judge's ruling on negative reviews online. the state's highest court throughout the issue last month. you may recall that the development sued jane perez on comments she posted. she claims the contractor stole iltemperatures from the home. the contractor claims those reviews were false. what this supreme court ruling means is that the business owners will have to now prove libel in court instead of temporarily getting critical comments about them taken off of a website. coming up on "news4 at 5," tonight the boy who made the wrong click on ebay. >> it was a mistake.
