for allegedly kicking a kid who was staying here at a day care inside of, again, this unlicensed day care. neighbors tell nee police were here at this house in the 1306 block of wood amber drive in upper natural bore role neighbors say they knew the family was operating a day care but did not know that it was unlicensed. now, police were called to the home on monday for the report of child abuse. a witness was taping the incident. they told police about t how they found out. police say this is a quiet suburb here around folks who live here reacted to the news. >> i know it's so difficult for, especially single moms and with the economy the way it has been, for people to find really good health care providers. it's just a sad situation. i don't know what to say. i feel bad. i feel bad, for the provider are, for the families, everybody

involved actually. >> reporter: couplings is out on $35,000 bond and an order issuing cease and desist has been place here on this home they are not allowed to operate a day care here any longer. live in upper marlboro, i'm tracee wilkins, news4. another big story we have been following today, a successful knee surgery for robert grinch the third. >> rg3 had two ligaments repaired today and he tweeted out before the surgery, "see you guys next season." straight to dan hellie. let the recovery begin. >> depending on how talk to the recovery process could last anywhere from six to 12 months. the surgery lasted about five hours and took place in pensacola, florida, this morning. doctor james andrews performed the surgery and recently released the following

statement. 4 griffin will remain in florida to start his rehabilitation. doctors say the initial six to eight-week period is crucial and could dictate whether griffin recovers on the short or the long side of the six- to 12-month timeframe. today, we caught up with redskins safety madea williams who has no doubt the team's quarterback will be back on the field. >> i think with his work ethic, he is one of those special guys, just like adrian peterson. robert works hard. obviously, for him to be one of the top quarterbacks in his rookie jeer a test tonight his work ethic and dedication. i don't put anything past him. i expect him to be ready to go within the timeframe that doctors have plans for him. >> now, one interesting part of that statement is they said the 2013 season, the doctor did not

say the start of the 2013 season. so, that's rather wide spectrum. wendy? >> all right, dan. he is out of surgery but a lot of questions remaining about how these injuries are going to impact his ability to play next season. doreen gentzler is here with more details on these types of knee injuries. >> the knee joint has four main ligaments that keep the shin and the thigh bones connected. to injure one of them and you will probably be side lined for a while and that can mean real problem it is you are a star nfl quarterback. say rg3 has tears in his anterior cruciate ligament, his acl. that's the legment that prevent the shin and thigh bones from sliding. doctors say that's common injury and it heals well non-invasive surgery. the stribl also tore his lateral collateral ligament, his lcl, located on the outside of the knee joint and this one prevents the knee from bowing out. doctors tell us that the lcl has to be repaired with an open surgery, which means a long

recovery. it could also have long-term implications on the knee's mobility that's a big concern for a star quarterback like rg3. >> does make things more complex. and it's not the routine acl reconstruction that players have all the time. the wildcard in this is having the late really side done as well. and it's a bit more unpredictable when you add that lateral side. if anybody's gonna get back to full, it would likely be rg3, given what kind of shape he is in preoperatively. >> doctors tell thanks rg3's previous acl surgery, the one he had when he was playing at baylor in 2009, should not impact his recovery this time. rather, it's that tear in the lcl that's really going to play a big role in whether he will be ready for the beginning of next season. wendy, jim? >> thanks, doreen. at least 11 people were seriously hurt this morning in new york when a commuter ferry slammed into a dock. dozens of others were hospitalized for minor injuries. the ferry arrived from new jer bill is 8:45 this morning and it didn't stop, sending people

flying across the boat on impact. paramedics spent hours treating dazed passengers on the pier and the company that ounce the ferry says all crew members tested negative for alcohol. the national transportation safety board is investigating. today, vice president joe biden suggested president obama might take executive action on gun control, but biden said no decision has been made on what that action might be. the comment was made during the meeting with gun safety advocates, one of a series that bind will hold as he considers ways to curb gun violence. he noted that the mass shooting that killed 20 first graders in connecticut last month has profoundly touched the nation. >> [ inaudible ] >> tomorrow, the vice president meets with members of the national rifle association you walmart and other gun rights advocates. several new gun measures are

on the agenda for virginia lawmakers who are back at work today. one of those proposals would allow teachers carry a gun in school. julie carey is at the state house in richmond with these ho hot-button issues. jewels? >> reporter: since the virginia tech shootings five years ago, the virginia general assembly has back battleground with clashes between gun control activist and right supporters. in the wake of the newtown shooting, both sides see a fresh opportunity this year to press their case for new legislation. for years, gun owners with guns at their side have been welcomed on the virginia capitol grounds and inside its buildings, a bill to limit that practice is one of several measures being introduced by lawmakers who believe in the wake of the newtown school shooting, there is fresh call for gun control. >> he know we can't prevent every single tragedy but limit the numbers that occurred and the mass tran that we have seen in the past. >> reporter: northern virginia

lawmakers are pushing bills to place new restriction and conduct more screening on those who want to bring guns into capitol buildings. there is also a bill requiring background checks on all virginia gun sales, even private ones, between individuals. he says right now, 40% of all gun transactions in the commonwealth take place without a background check. >> if you want to get into the market of selling guns, which can be quite dangerous, we want mo make sure we know who you are selling the guns to. >> reporter: yet another bill from state senator evan would require gun owners to report a stolen gun to police within 24 hours but gun rights activists draw a different message from recent mass shootings. they say gun-free zones, like schools, must be better protected. prince william county delegate bob marshall's bill would arm teachers, administrators and even volunteers inside schools if they get special training. >> i got letters, e-mails from, you know, all around the state, from public schooladministrate

people could be forced to use ignition interlock dough sizes on their vehicles are, even on a first event if they are convicted of drunk driving. the city showed off new breastal breathalyzers today. constituent had to throw out drunk driving cases because the machines were not correctly cal baited. tom sherwood will show us what officials are doing to keep drunks off the roads. how far can police go to enforce drunk driving laws? the case went to the supreme court that weighs safety against personal privacy. nbc justice correspondent pete williams is live outside the supreme court now. this is about getting blood tests without a warrant.

give us some of the background on this case. >> this case comes from missouri, a man was pulled over after its police saw him weaving down the highway. he failed the sobriety test. he couldn't walk and turn around. he couldn't stand on one leg. they asked him to take a breathalyzer, he said no they asked him to take a blood test, he said no he was taken to the hospital in handcuffs, subdued him and forced to give a blood sample without a search warrant. the aclu is representing him. they have appealed that to the supreme court here, the lower courts threw it out and the aclu stays is a violation of somebody's right against unreasonable searches to do something as intrusive as a blood test without a search warrant. the state of monsieur very asking the supreme court to rule that police never need a search warrant in the drunk driving cases because the supreme court has made exceptions in the past for police not needing a search warrant in evidence is being destroyed. the classic care you knock on the door, hear the drugs flushed

down the toilet. the same is true here, they say because every minute that passes after the somebody leaves the bar, their body is metabolizing their blood alcohol and their blood alcohol is dropping and that should be enough reason to let the police do these tests without a search warrant. >> the white house has taken a stance on this issue, where does the president stand? >> reporter: right. well, the justice department filed a brief here supporting missouri, saying the police should never have to do this. the supreme court seemed persuaded though, that 26 states ban a police getting these blood tests in run-of-the-mill drunk driving cases without a search warrant. maryland is one of those 26 states and it did seem from the argument today, the supreme court is not going to do what monsieur rained the justice department want them seem very skeptical that the police should have this power. they note that many of the states, those 26 state, don't seem to have a higher -- a lower conviction rate for drunk

driving or any more problem getting drunk drivers are off the road, even though they did require search warrants and note in this day and age, many states, you can get these search warrants pretty quickly, even in the middle of the night. >> all right. a lot of people be following this one for months to come. pete williams, thanks so much. live at the u.s. supreme court. get a check of our forecast. the warm weather hasn't hit just yet. we are anticipating it. >> this was really the next week, really tough forecast. we are going to be right on the line between some very, very warm weather and some really cold weather and today, we were on the coomer side of things from the d.c. area to north and west. down to the south and east, did you get into that warmer air, thinking today, d.c. would get around 57 degrees. we saw a high temperature right around 50. so a little cooler than what i was expecting. down to the south, well above that number. right now sakt 48 degrees, a pretty nice evening, we are starting to clear out and we are actually seeing some sun before the sun went down just a couple of minutes ago. 48 degrees the current number, wind out of the southwest, 3 miles per hour.

the wind not going to be a fact tore here. wither going to see another cool night tonight but really, it's gonna stay a little bit above average once again. take a look at the numbers, 62 in fredericksburg, only 43 in frederick and in gaithersburg, so, a 20-degree temperature difference. look where the warm air was. to 56 degrees today. i thought the warm air would make it up here, i missed it about by 23 miles. mm-hmm. 23 miles. that was about it. i will tell you this, i think everybody is definitely going to get warm air the next couple of days. this evening, cloudy, chilly to the north, mild to the south, 37 to 49 degrees and some of you well south will senate 50s the next couple of hours. the radar seeing this system did thank did move through, shower activity, portions of st. mary's county, that's about t most air zwras see shower activity, the d.c. metro area, portions of maryland this system moving on out. you can see what's happening behind it the clearing skies,

that will allow temperatures to cool overnight tonight. the frontal boundary moves through, the mild air we saw to the south will drift across our area tomorrow. tomorrow, a day similar to what we saw around the metro region, a mixture of sun and clouds. i think temperatures around that 50-degree mark. rather mild this time of year. once again, the afram high temperature is 43. we were well above that even though today was fairly cool. friday, still mild, going to be watching this frontal boundary, this will be a warm front give us a chance of showers late in date on friday, not a big chance of rain, but a chance of rain nonetheless, this warm front will move through overnight on friday and the weekend is looking extremely warm as you move through the next couple of days, we told you about that the jetstream really changing big-time cold air to the west. for us, nice and mild, temperatures get into the 50s and 60s by the weekend. tomorrow morning, a few clouds, chilly, temperatures 28 to 35 degrees. winds out of the northwest 10 to 15. see a little bit in the way of a wind chill tomorrow morning. by tomorrow afternoon now,

compatible. >> they go hand in happened in terms of trying to get to the next level. for basketball star, josh hart, going through wheaton high school to sidwell friends was a massive adjustment. not just on the court but in the classroom. after trials and tribulations that included getting kicked out of school, these kind of things many people wouldn't overcome, hart has and he is thriving at the elite private school and soon be headed to one of the premiere college basketball programs in the country. zachary kiesch has the story. >> reporter: if it's true that the journey is its own reward, sid well friends senior point guard josh hart has a leg up on the competition. when hart arrived on the sid well campus in upper northwest d.c. as a wiry sophomore, his game was well seasoned. unfortunately for hart, his study habits were a little less polished making sid well's rigorous code of conduct and education a stretch, at best.

a 19-year-old day care employee under arrest tonight accused of child sex abuse or abuse after a witness captured an incident on video. jonathan desmond couplings is charged with physical child abuse and second degree assault. that second degree assault police also say the day care center was not licensed and is now shutdown. tonight, doctors are hopeful that robert griffin, iii will be ready to play again next season. he had knee surgery this morning in pensacola, florida and late today, his doctors said that surgery went well. griffin sprained his right knee last month and reinjured it again on sunday.

virginia lawmakers kicked off a new legislative session today. they will tackle several gun bills. one would allow some teachers and school administrators to be specially trained to have a gun in school. another would require background checks on all virginia gun sales, even private ones. now let's fast forward to the weather. doug? >> you look to the north, you stayed on the cool side. down to the south, much warmer. everybody saw the cloud cover. take a look at the temperatures the north. how about 43 in frederick, maryland. 44, hagerstown. those were the high temperatures. and 63 down toward fredericksburg. pax river, 62. washington is 7 above average. above-average temperatures last longer but show you when they may be coming back down. maryland drivers could soon see the first gas tax hike in decades. the general assembly opened its

legislative session today and looking at the increase as a way to pay for it. >> chris gordon is live with details on the gas tax plan. chris? >> reporter: no one likes to raise taxes and there are plenty of lawmakers here in annapolis ready to fight against gas tax or sales tax increases. but the governor today said that maryland and virginia has the worst traffic in the country and something has to be done about it. as the maryland general assembly begins its 90-day legislative session, local leaders pushing their toppriority. >> can i mention transportation twice? would than allowable? the make thing from prince georges, charles, frederick county, month comery. we need to move people so we can grow economiclism. >> reporter: maryland needs hundreds of millions to improve highways and bridges and try to ease traffic congestion. governor martin o'malley says the state has not raised the gas tax since 1992, but a gas tax

hike would be extremely unpopular. >> could you raise the same amount of money by increasing the sales tax broadly by a penny and dedicating that penny, in law, to the transportation trust fund. >> reporter: republicans vow to fight any proposed tax increase. >> reporter: last year, governor o'malley proposed the same one-cent sales tax hike and they were going along discussing it but then he says that lawmakers got distracted by that whole issue over expanded gaming.

now with gambling behind us, he says it is time to be responsible about deciding how we are going to pay for transportation improvements. that's the latest live at the general assembly in annapolis, chris gordon, news4. >> there could soon be extra security at elementary schools in montgomery county. a video intercom system would be installed at all 132 elementary campus. the school board voted for a mesh that frees up $3464,000 to install the system t goes to the county council for approval f approved, those cameras would be installed by july. a high-end heist in chevy chase. police say two men ran into the jimmy choo store on wisconsin avenue this afternoon and grabbed expensive purses. they got away with seven of them. signs are posted on the store's front doors asking customers to use the back entrance now. a similar incident occurred several months ago.

witnesses say four men ran into that store and their arms full of designer handbags. police say it's too early to tell if the incidents are connected. a suspected thief is caught on camera by a montgomery county homeowner and this video is enough to give you the creeps. but police tell us this crime could be preventable. jackie bensen join us live from chevy chase with a look at what these pictures show. jackie? >> reporter: this video is creepy. most people have no idea what guess on in their neighborhood in the overnight hours, prime time for people looking to steal from cars. the security camera images were captured over the new year's holiday. at first glance, the backpack-wearing theft suspect looks like he lives at the house on village park place because he is casually opening the door of the late-model jeep. but police say he was only able to open the door because it was not locked, allowing him to continually rummage through it for valuables.

>> 90% of our theft from oos still unlocked vehicles. >> reporter: the commander of the bethesda police district says crimes were down 17% last year but burglars and people who steal from cars are notoriously hard to catch. >> the most important item i want to stress is if you see something or someone suspicious in your neighborhood, call us immediately. do not wait till the next morning. our last three arrests we have made in the bethesda district from them theft from autos is a direct result of residents calling us a the 2 or 3 in the morning. >> police say the video should serve as a reminder that even the simplest precautions can deter a thief. >> we never leave our cars unlocked, even inside the garage. and we have never had any break-ins. >> i do lock t just to make sure no one goes in. >> reporter: goes without saying that police would like to locate the man seen in that video.

live in chevy chase, news4. eager to file your tax return to get a refund? the irs won't process returns until january 30th, eight days later than originally scheduled. the agency tells us it still needs time to update forms so they reflect the various changes in the tax laws that came with the new fiscal cliff deal. it also means no one will be getting a refund this month. april 15th is still the deadline for returns. news for your health, an older cancer screening method could have a new use. researchers at johns hop crin developing ways to use pap smears to screen for ovarian and endometrial cancers. pap smears have long been the gold standard to detect cervical cancer. now scientists are developing a

the south capital street bridge needs serious repairs. the 63-year-old structure takes drivers from prince georges county in southern maryland to downtown d.c. we got a unique look at that bridge today and live there tonight to explain just how much work it needs what happened it means for commuters. adam? >> reporter: hey, jim, rust, contracts, holes, wouldn't believe what we were able to see as we climb under the bridge here today. think of this, 70 to 80,000 cars a day use this bridge. take a look at the traffic going across the bridge here at nats park and you think nothing of the bridge, but climb underneath the structure and a much different picture quickly comes into focus. this bridge is old and in need of repair. corroded steel beams, some that you can see right through. the heavyweight and sound of traffic right above.

the 63-year-old structure is in bad shape. ddot chief engineer, nick nicholson, took us on a tourer of the britain. >> you see the steel section that has come off? that offers no more structural stability to that beam. >> reporter: this is literally incredible, being underneath the south capital street bridge, as the cars race above us, you can see these beams and girders here shaking. of course, doesn't make me feel too comfortable when you see the corrosion and the rust and some of the contracts underneath this bridge. now it's important to mention that this bridge is safe. if it wasn't, it wouldn't be open to the public. but to use a transportation term, it's near the end of its useful life. so what's the plan you could repair the existing structure but that would only be a patch. >> when we weigh all those things to consider, like the old car, you don't keep replace the transmission, the exhaust, the engine, you think about a new car. >> reporter: mere sheer animation of the new south straight bridge and surrounding streets, part of a plan to make
