hospital. why this man is considered a threat to the public and the police. >> and the minute a tornado touches down in the south. we'll see the damage left behind. but first tonight, crowded emergency rooms, countless people calling in sick and now clinics are running out of flu vaccine. this flu season is already one of the worst in decades. >> 41 states including maryland and virginia have reported widespread flu activity. and tomorrow, the center for disease control will update those numbers to show that the virus is spreading. richard jordan has our report from vienna. richard? >> the flu shot is hard to come by in some places and doctors agr agree, getting the vaccine is the best defense against getting the flu tonight. we went to some of the largest pharmacies out here. wall greens, cvs, rite aid. all of them said their supply of the flu shot is all gone.

>> in. some cases, shot seekers can't get the injection or mist now in high demand. a few big-name pharmacies are all out. >> you don't like the shots very much? >> parents say they're having trouble getting the shot for their children. >> we went to the doctor, not for the flu shot, but we asked for it and they said they're out. i would assume most people are out. >> in an e-mail, the v va dart department of health says i'm not aware of any vaccine shortages. i can't imagine there is steady demand for the vaccine this season is getting. dr. steven teach says the hospit's pediatricians in d.c. and maryland report adequate max scenes still payable available, but it may not always be easy to find. >> we're hearing the facemask seen is out there. it might take a little bit of searching for infants, but we're

encouraging families to do what they can to get it for their children. >> the growing number of flu cases is affecting the church, too. 9 the archdiocese asks anyone who is sick to refrain from shaking hands and take communion. the pappas tors will decide whether to suspend communion. but many are concerned with keeping their kids healthy. >> he's a little weak right now. i thought i would get him taken care of but not yet. pharmacists say they have order more supply and more vaccine. they don't know when it will arri arrive. >> shows of people have been hospitalized nationwide. it's gotten so bad in some places they are restricting visitors. minnesota appears to be the hardest hit so far wf 27 deaths related to the flu. followed by pennsylvania with 22 deaths. and in boston, the situation is

so bad the mayor has declared a public health emergency. >> following a breaking news story out of new york, one person dead there, two others injured in a fire that investigators are now calling suspicious. that fire took almost 200 firefighters to get those flames under control. it happened inside a five-story apartment building in lower manhattan around 6:30 tonight. that fire is out now. we don't know what caused it, but officials are now conducting what they call a criminal investigation. here in maryland, pour people hit by a car this afternoon. two of them are suffering life threatening injuries. it happened in glen burnie while the four were crossings cornerstone road near route 100. the driver stayed on the scene. no word on the names of the victims yet or whether any charges will be filed. >> he carries weapons and has a violent past.

now we know how he was able to escape from a local hospital. how he broke free from the locked ward. >> doreen, a hospital spokesperson tells me he broke down a door. he's very strong. he we've within in this neighborhood all evening long talking to people out here. and they tell me they are concerned. >> i am going to call the police and stay away. >> tonight, neighbors worry that this man is hiding in their t t takoma park neighborhood. he's been very aggressive in the past to police officers. >> this happened across the street from my home. so i'm hoping i won't run into him and the police catch him quickly. he escaped from hospital last night. police have all been told to be on the lookout. >> tonight we demanded more answers. we asked a spokesperson here how

was he able to break out of this place? what type of security procedures do they have here? are they going to review these pro-soed durs? she says yes, and that this incident is rare. >> in a written statement, the hospital spokesperson also tells me, quote, we contacted takoma park police to report him listening after he broke down a door and fled the hospital. the broken door has been replaced and we remain deeply committed to providing the safest, high quality care to our patients. end quote. . >> he has escaped in the past several times. he apparently has a lot of extensive training in martial arts. so keeping him restrained has been a bit of a challenge. >> i talked to police again tonight. they emphasize that you need to stay away from molonov. give him a call if you see him. his past indicates he can be violent and aggressive. news 4. >> thanks. just a few hours ago, a judge in colorado ruled that there is

enough evidence for james holmes to stand trial. police say holmes is the man who open fired inside a movie theatre last july. 12 were killed, dozens were wounded. holmes will be arraigned tomorrow on more than 160 felony counts. prosecutors are still deciding whether they'll seek the death penalty in this case. >> a brave schoolteacher who looked down the barrel of a shotgun is credited with preventing another school massacre today. the student holding that gunshot one of his classmates and tried to shoot another but missed. it happened at a high school in taft, california, this morning. after the teacher started talking to the student, the kid dropped the gun. that's when police swooped in. classmates say the shooter was bullied. the injured student is in critical but stable condition. today's shooting came as vice president biden discussed ideas on how to curb gun violence. proposals include an assault weapons ban, limits on high capacity ammunition magazines

and universal background checks for gun buyers. national rifle association officials who met with the vice president tuds soday say they disagree with those proposals, despite mounting pressure after last month's school shooting in connecticut. biden will submit his recommendations to the president on tuesday. one of washington's biggest murder cases this century, it is one that attracted national attention and took years of investigating, but tonight, news 4 as learned that a new twist could put the conviction in the chandra levy murder case in doubt. we have details now. >> reporter: jim, tonight, sources tell news 4 prosecutors have presented a judge in the case new evidence. that could reportedly taint the testimony of a key witness in the trial. back in 2010, he was convicted of killing 24-year-old chandra levy, a former intern with the

federal bureau of prisons. levy disappeared in the summer of 2001 and her body was found a year later. her murder gained national attention, as you mentioned, when a relationship with former california congressman gary c condit came to light. he was never charged with any wrongdoing. the murderer was in jail and had been linked to a number of assaults on women in rock creek park. there's still a lot we don't know tonight about the new informion in this case. there have reportedly been two secret meetings between the judge and prosecutors. something that is very unusual, according to veteran defense attorney richard finchy. >> the secrecy, it's reported is a result of the judge not wanting there to be public disclosure and apparently to protect witnesses. i get that, but it's exceedingly rare. i have never seen it. >> reporter: he also tells us tonight there's a chance this evidence could lead to a new

trial for guandike. it's still not clear if the evidence had to do with an inmate who testified that he admitted to killing levy. that testimony was a big part of the prosecution's case. jim, doreen? >> thank you, jim. exclusive new details tonight in the secret service prostitution scandal. nbc news has learned two drug enforcement agents are now blamed in one of the encounters. an investigation by the justice department found the agents set up a meeting between a secret service agent and a prostitute in colombia. agents were in the country preparing forresident obama's visit last april. two dozen secret service employees and military service members have been implicated in the scandal. the report says the dea agents should not face criminal charges. >> we know it's going to get warm over the weekend, or at least we're hoping it is. but before that, doug tells us there's something else coming our way that we need, right, doug? 'll. >> that's for sure. something we haven't needed in a couple of weeks.

>> there is a state of emergency declared in louisiana tonight after three tornadoes in 24 hours. security cameras caught this one hitting today. the state has seen a series of strong thunderstorms this week. flash flood warnings are in effect now. another storm system is expected there this weekend. >> just 11 days away from the inaugurati inauguration. up to 800,000 people are expected to attend president obama's swearing in ceremony on january 21. d.c.'s metro system is getting redid for the busy day. 150 additional transit police from other agencies will be on duty to help handle the crowds. metro will also adjust its hours. trains will operate on a rush hour schedule for 17 consecutive

extend the lease by a year fell through. barnes and noble had planned to close last october after turning down a proposal from their landlord to move to another spot there. both sides agree to work on a deal, but now it appears that has fallen through. >> tonight, movie lovers are debating who will go home with oscar this year. >> daniel day lewis is thought to be a lock for best actor as "lincoln" but its two best actress nominees who are getting the headlines. at 85, emanuel riva is the oldest ever and 9-year-old quvenzhane wall lis is the youngest ever. so we have a few weeks to catch up on uh all those movies.

when it does come to griffin's return, there's wide range of predictions. today, the surgeon who performed the first acl surgery back in 2009 weighed in. his name is mark addox. he's close to the griffin family. he spoke with them at length following surgery yesterday. today he chatted with us, revealing new details about the operation. and when he thinks rg3 will put his cape on again. >> this time what happened is her to his lateral collateral ligament and later on ended up tearing his acl as well. i think he had a snaul meniscus tear as well. dr. andrews obviously repaired the lateral collateral ligament and reconstructed his acl. the one thing that makes this a lot more painful, though is he actually took the graft from his good knee, his uninjured knee, but it makes the acl to take a

piece of boep frne if your knee and then a piece of bone from your shinto reconstruct the acl. honestly, with the revision arl reconstruction, i would expect him to recover in six to eight months. i honestly think knowing his work ethic and the kind of athlete that he is and the kind of condition that he's in, i would expect to see him back for the opener. there could be a foral investigation into the redskins handling of a playoff game. meanwhile in fairfax, the mason men taking on conference rival old dominion. the green machine in full effect, playing tonight.
