shopping mall in nairobi. the siege approaches 60 hours. earlier today, kenyan military forces launched a hostage rescue operation. large explosions and gunfire. the kenyan government says at least 62 people have been killed. the terror group claimi ining ct for the attack is bragging saying several americans are among the militants. we'll have more on that at 4:30. new developments revealed in the criminal history of the navy yard shooter. scott macfarlane has more details. >> the navy official released a time line of the past run ins with the law. we are getting a better picture of what the navy knew about alexis and when. before he enlisted, the only run inwas in 2004. no charges filed, but the navy was aware of the incident from a

background check. however, the official report on the navy record says he deflated the tires of a car, no mention of a gun being used. in 2008, a security level secret clearance good for ten years. from 2008 to 2009 punishments for unauthorized absences. drinking charges dismissed. in 2010 arrested for shooting in his apartment. then the navy started processing discharging him. then that process was stopped. four months later, 2011, granted an honorable discharge. he was issued a navy reserve list card through may. we are starting to see what alexis had. nothing that raised a big enough flag to warrant more severe

>> police believe diaz may have known his attacker. so far, no arrests. a teenage driver faces several charges after a deadly crash on routes 29 and 50 in fairfax. police tell us they tried to pull over a vehicle they saw speeding and driven erratically. the 15-year-old driver led them on a wild high speed chase before running a red light and crashing. 14-year-old market bell of washington was a passenger in the vehicle. he died on the scene. the driver is facing charges, including involuntary manslaughter and carjacking. his name is not being released because of his age. it's been a cool monday. the sun finally came out. >> it did. did it warm us up any? how about it? >> i'm glad the sun came out. i promised a lot of people it would and it did. yes. some of you were complaining about the chill. look at the temperatures. 40s in a few locations. some of you started your day in

it's the area that came in for improperly targeting tea party groups. less than two weeks later, she refused to answer questions. learner was placed on paid leave in pay. today, she announced her retirement from the irs. at the live desk, i'm scott macfarlane. getting caught by a traffic camera in the district no longer means blowing through a red light or driving too fast. adam tuss tells us about the new cams that are catching more than speeders. >> reporter: we have been telling you about the automated enforcement cameras going up all over the district. here is one at connecticut and 36th and northwest. you know what this is pointed at? pointed at the crosswalk at the intersection. these cameras are supposed to make getting around the city safer for pedestrians and cyclists and everyone.

i promised them sunshine. i was glad we got sunshine. didn't get out there swinging, but ricky irvins, he always tries to get a golf club in my hand. a great group of people. again, we have sunshine. we are talking now about temperatures that could be lower tomorrow morning. so, if you are bundled up this morning, you are going to be dressing like october again tomorrow morning. temperature currently, we said 68 degrees. sunshine across the area. with the winds dying down here by the evening hours, that will lower the temperatures to really drop and drop fast. 57 by 11:00 p.m. under that clear sky. again, what's going on is this big area of high pressure that will be moving in. as it moves in, it is going to dominate the weather for the rest of the workweek. a bit of a dry pattern, too. mainly clear skies. here we are this evening at 5:00. as we get into early tomorrow

morning, cooler, lower temperatures. by about four or five degrees in the suburbs. a nice warm up for the afternoon. today, the highs in the upper 60s. shy of 70 degrees. most neighborhoods tomorrow we are going to push into the mid-70s. the day after, closer to 80 degrees. so, some cool starts for us. warmer afternoons coming our way. look at the temperatures. potomac, tyson's corner, 39 degrees. kensington, 44. 39 in frederick and martinsburg, too. these are all the locations west and north that will be low and feeling like october tomorrow morning. should hit the mid-60s by 11:00 a.m. mid-70s by 3:00 p.m. it's with sunshine across the area. temperatures down south, alexandria, camp springs, 75 degrees. just a perfect afternoon for us

welcome back. i'm pat lawson muse. >> i'm jim handly. at 4:30, we are tracking that deadly terror attack at the shopping mall in kenya. the somalian terror group, al shabaab is claiming credit and boasting several americans are among the attackers. steve handelsman has more on that part of the coverage. steve? >> reporter: somali's in america, estimated 85,000 are assimilating and prospering like many groups. somali leaders in minnesota condemning what's going on in kenya, admitted a few dozen young somalis have joined the al qaeda affiliated group, al shabaab. u.s. officials say there's no confirmation americans are part of the al shabaab terrorist team. somalis in the u.s. say it's possible. >> yes, they target youth and impressionable kids, lure them into somalia.

>> reporter: starting in 2007, the somalia community in minneapolis/st. paul, men with u.s. passports went to join the jihad and get trained by al shabaab amid the warfare. >> 15 of them have been killed. the other 25, we are not certain if they are over there or came back or what they are doing. >> reporter: despite the fact any american in al shabaab would be fluent in english and able to fit in back here at home. experts guess u.s. malls and the like are not on al shabaab's target list. nairobi is an inspiration to fighters everywhere. >> they demonstrated a highly coordinated attack by a small shell of people can be lethal and deadly. >> reporter: secretary of state kerry sounded a warning. >> whether it's in manhattan or a mall in nairobi or anywhere else in the world, we all have a responsibility to remain

we have new developments now on the dozens of fires set out on the eastern shore. scott macfarlane is at the live desk working the story. a woman is suspected of setting the fire is out of jail. she was released from the county jail on $30,000 bond. a grand jury indicted her on arson and conspiracy charges. she and her fiance were arrested in april after their minivan was stopped. they are accused of setting as many as 77 fires. smith admitted to torching more than 50 buildings. as part of the bond, she is not allowed to leave the county unless it's medically necessary. at the live desk, i'm scott macfarlane. a warning from prince george's county, thieves are targeting drivers at the gas pump. >> they are snatching purses and other valuables.

right now is low. it will remain low. so has the rainfall. despite saturday's big rains, the rainfall, we have a deficit, still, since september 1st. the deficit almost an inch and a half. again, it was with the one inch of rain. most of the area running 51 to 75% below average rainfall. so, classified now as being abnormally dry in a good chunk of the area. prince george's county through northern charles county. southern areas of montgomery county, abnormally dry now. same for fairfax and loudoun county, eastern fauquier county. when i make my travels into work, i see still the sprinklers going off. yeah, you are going to have to water. we have a dry pattern setting up over the next couple days. 68 degrees is the temperature with a light wind at 8 miles per hour. the wind settles and eases up

and decreases. here over the next couple hours, the temperatures get a chance to drop. 51 degrees in the the beltway at 5:00 a.m. the sun is up at 6:58. you'll like that, when it comes up, there's a chance to warm up and take gaithersburg and bethesda. higher by late morning, 40 in burke starting out. fairfax, too. 49 is the morning temperature in camp springs and 48 down to the south in alexandria. these are the warm spots for tomorrow. mid-70s, 76 degrees, king george. leonardtown 75 to 76 degrees. again, sunshine that we'll have. for the first full week of fall, we are going to start warming up, but again, staying fairly dry. if you want to look at it any kind of way, it will be a chance here, an opportunity to store up extra vitamin c. the high temperature for

lawyers representing marathon bomg suspect are asking for more time to save him from a possible death penalty. in court today, they claim they never got key evidence from prosecutors and they have not had enough time to submit their argument that he doesn't deserve the death penalty. eric holder will have the full-time say on whether to seek the death penalty. the bombings at the finish line in april killed three and injured 260 others. the man who led the hunt for the marathon bombers is resigning. boston police commissioner headed the department for seven

years. he's been mentioned as a potential candidate for the homeland security to follow janet napolitano. he will leave in two months. police are looking into a possible hate crime. the victim is a doctor at a hospital and ivy league professor. he says a gang of teens attacked him yelling anti-muslim slurs. he's not muslim and owes his life to bystanders. >> it was a bias related event. >> speaking slowly and not as clearly as usual because of a fractured jaw, he told us how he was attacked by a group of teens. >> i heard get osama, and terrorists then the next thing i felt was somebody on a bike moving past me ripping at my

beard and hitting my chin. i went down and i was kicked a few times and punched. >> reporter: he was with a friend enjoying a quiet post dinner walk at 110th street near central park when the hateful words and punches were unleashed on him until good samaritans came to his aid. >> given how many people there were and it certainly could have been far worse had bystanders not intervened. >> reporter: police are investigating the incident as a hate crime. they can't identify the attackers. that's why he says he talked to us. he hopes the community where he lives and works doesn't tolerate this kind of hate. >> my fear is that they will disappear into the neighborhood, which makes it all the more important to reach out to the neighborhood more deeply and really have the community mobilize to make sure things like this don't happen again.

business after a tank exploded and launched itself through the roof. it happened at the utron company on innovation drive. the blast sent debris into the parking lot and made part of the building uninhabitable. julie carey is live on the scene. >> reporter: fire investigators, building inspectors still on the scene more than five hours after the pressurized capsule blasted off from inside the building causing lots and lots of damage. these pictures taken by chopper 4 give you an idea of the force of what was an explosion of sorts. a large pressurized air cylinder blew through the roof tearing a four foot wide hole before it fell back into the building, hitting a cooler unit causing more damage. they described the booming noise. >> i was sitting in my cubicle and all of a sudden, a loud boom. i thought it was thunder or an
