full recovery. it is 4:31. time for a look at traffic and weather on the ones. tom kierein is here to tell us about a cooldown to start the day. >> big change. back to autumn. temperatures around the metro area are in the 50s. many of the rural areas are in the 40s. prince gorges county, 50 degrees. much of montgomery county, near 50. the mid 40s right now. much of fairfax county, 50 degrees. closer to the potomac river. generally in the mid 50s as is the district of columbia. we'll have quite a bit of cloudiness with us but no precipitation or rain. it will be cloudy and cool. we'll be in the 50s through 10:00. then getting into the low and mid 60s by noontime. we'll get a little bit of sunshine trying to break out. hometown forecast,

fredericksburg, there by noon in the low to mid 60s. a look at the rest of your tuesday in a few minutes. >> still pretty light volume in our area. a couple of things to look out for on i-95 in virginia. southbound at prince william park way is all to your shoulder lane. travel lanes are open in this area. folks traveling southbound route 1, the shoulder lane is blocked. at one point just the left lane was getting by. looks like they are in the final prosets of picking this up. that's good news. if you're traveling on i-95, looks pretty clear. eun. we are now in week two of the government shutdown and president obama is calling on the house to vote to end it. the house speaker john boehner still hasn't called the vote. let's go live to tracie potts.

>> reporter: boehner doesn't think the votes are there. democrats disagree. our own count shows at least or as many as 21 republicans may actually go with democrats to pass that at least temporarily so they can get the negotiations here to get the government back open. right now there are no real negotiations happening but a lot of talk back and forth especially between president obama and the top republican on the hill. >> if the republicans and speaker boehner are saying there are not enough votes, then they should prove it. >> the president's refusal to talk is hurting our economy and putting the country at risk. >> reporter: president obama says he will only negotiate when he is sure health care is off the table. as of now the only votes we're seeing is to restore the

government piece by piece and a vote for back pay. it looks like they'll sit in the senate until they come to a larger agreement. federal courts may have to start furloughing employees soon if the shutdown doesn't end. the supreme court will begin to hear arguments through the end of the week, but all federal courts will begin furloughs of nonessential employees through the middle of the month. the supreme court building will stay open to the public until the end of the week. today the nation's highest court will dive back into a battle over money and politics. alabama businessman sean mccup chins is challenging how much money a person can spend on election campaigns. $123,000 is the max. he says that violates his free speech. opponents will rally outside the

court today. we are following breaking news right now. 4:35, news 4's megan mcgrath just arrived on the street of a double shooting. >> eun, this shooting happened in the 700 block of somerset praise in northwest washington. we saw them here. they had a canine in the alley down at the end where it meets somerset. the canine sniffing around, looking for evidence. no arrests have been made at this point. not a lot of information has been released. what we can tell you is a call for a shooting came in after 3:00 in the morning. two maels were shot in the legs. they were breathing and conscious at the time. they are expected to be okay. no motive or lookout for the

suspects. we don't know if they left by foot or on feet. reporting live in northwest, megan mcgrath, back to you. >> we're at the live desk with breaking news. >> happening now north korea's military says it is on high alert and sends a warning to the united states and south korea this morning. righters reports north korean state television making the announcement warning of, quote, horrible actions. the u.s. recently moved a group of ships including an aircraft carrier into a south korean port. we are learning the latest threat has not reached any critical level as south korea's mill tear ri6 and is not on high alert. north korea has referrally

turned their threats into actions. right now the u.s. is keeping a suspected al qaeda leader on a navy ship. that's according to two law enforcement leaders. they say they will question anas al liby. they say he helped plan the 1995 bombings. many things in washington has been closed for eight days. while thousands of us may have been ripped off. how calculation error caused many of us to overpay on gas. you will notice a difference when we're walking out the door. >>

welcome back. 4:40. coming up in the next hour or so, the nobel prize in physics will be announced. they'll make the announcement in stockholm. two americans and a german american scientist share this year's prize. they won for their discovery on how substances are transported through cells. if you bought gas in the district last week, it's possible that you paid too much. that's because the d.c. office of tax and revenue said it mistakenly overcharged wholesalers.

it is now 4:47. right now secretary of state john kerry is in indonesia for the apec summit. he'll meet with australia's prime minister later today. president obama was supposed to be at this conference instead of kerry. he postponed his trip because of the government shutdown. more troops could be headed overseas this time to the philippines. marines started three week drills with philippine forces yesterday. they're set to take place every year and they're aimed at strengthening security ties. it has live action fire trainings and attack training. the u.s. forces are there because the philippines are asking for help while tensions in the south china fee. >> cleveland kidnapper ariel castro died by hanging. he died last month just a few weeks into a life sentence for holding three women hostage at his home for a decade. prison medical staff tried

reviving him and that no drugs were found in his system. he was supposed to be checked on every 30 minutes. maryland puts historically black colleges at a disadvantage by duplicating their program at a white school. they ruled the practice is segregated. the coalition for ethnicity and excellence in higher education sued the maryland higher education commission. they have to begin mediation to fix the problem. several counties are preparing for a symbolic vote to secede. they are upset about assault tile weapons and the state's same-sex marriage. >> you'll have enough votes in the government to protect our livelihood as far as water, oil, land, hunting, whatever you want

to do in agriculture related stuff. >> colorado governor john hick kins says he wants to keep the state together. in november several counties will ask their residents if they want to secede. >> it is now 4:49. a situation in chicago shows the child was killed by the grandmother. alfreda gadbois was left with her granddaughter and she took a sledge hammer and knife to the child. she's being charged with the death of the six month old girl. they would not talk about a possible motive. nine people in idaho are recovering this morning after a man drove his car into a crowd outside a funeral home.

boise police say a man was in the car and it accelerated. the crash does not seem intentional and all the injuries seem to be relatively minor. new this morning, more than two decades after the girl known as baby hope was found dead in a cooler along a new york highway, police say they have finally found her mother. they received a tip this summer. the mother's name has not been released. this case remains a murder investigation. no one has been charged. this is a day many of bernie madoff's victims have waited for. five of his employees are going on trial. all five have pled not guilty. the trial could last into next year. right now in new jersey, officials putting together a comprehensive game plan to clean up from the storms. wind gusts of up to 60 miles an hour pummelled the area at some point during yesterday's storm.

brought down trees, knocked out power. no injuries have been reported. it is 4:51. time for weather and traffic on the ones. tom kierein is here with a big change in the weather. it feels completely different. >> suddenly it's autumn and a tough summery humid. yesterday morning in the 70s. we had scattered trees come down. now this morning there's the view from space. a lot of cloudiness now over our region. temperatures, they now have dropped down into the 40s. shenandoah valley into the mountains and many of our northern and western suburbs are down into the mid and upper 40s. closer to washington, low to mid 50s. mid to upper 50s along the chesapeake bay. this is the change in temperatures. 20 to 25 degrees cooler than this same time yesterday morning.
