tonight the crime tape is up. investigators are combing the

scene for clues after a police involved shooting in a district. we're told an officer was injured during an exchange with a gunman. all of this is unfolding in the trinidad neighborhood in the northeast. >> shomari stone is live with new information just coming in from the police chief. >> reporter: that's right. right now we're in the trinidad neighborhood. the suspect and officer have been transported to hospitals in the area. they haven't told us which specific ones. police have not released their conditions. let me move out of the way. dozens of d.c. police officers are behind the scene search for evidence. let's show you a map of where we are located. i'm in the northeast d.c. at queens street northeast and trinidad avenue. the shooting happened in the 1300 block of queens street. it appears to be in the middle of the block. right now there are a lot of questions but here's what d.c. police chief is telling us. officers from the gun recovery unit were on this block at 9:10

tonight. police won't tell us why. at one point there was an exchange of gunfire between the suspect and the officer. police right now won't tell us what led up to the shooting. we do know the officer is conscious and breathing. again, they haven't told us how the suspect is doing. we're now going to hear from d.c. police chief, kathy lanier. >> you said this was the gun recovery unit. were those officers trying to recover a gun from the suspect? >> that is the mission of the unit. i don't know the circumstances surrounding this contact, but that is the mission of the unit. >> sources also tell me the officer was shot in the leg and transported. >> i don't want to go into details about injuries and treatment right now. >> reporter: you're nowing looking at a live picture of the 1300 block of northeast. police have been out here for several hours. again, there was an exchange of gunfire. they will search for shell casings and they plan to talk to different witnesses and residents in the area. we'll bring you information as

it becomes available on our website at www.nbcwashington.com. live here in the trinidad neighborhood of northeast d.c., i'm shomari stone, news4. >> we're also following breaking news in prince george's county. a man targeted in a drive-by shooting right in front of a day care. erika? >> reporter: jim, really scary moments for neighbors. walk with me a bit. let me show you where this happened. the day care van was parked right over here. the victim sitting behind the wheel of this van when shots rang out in this neighborhood. this is video of just a few hours ago when our cameras witnessed the moment that an individual was being taken into custody for questioning. we are told by police that shots rang out shortly after 6:00 tonight. neighbors say they heard multiple shots in this area. now, this is the corner of shell street and arca dirks a avenue. it's the home of god's little

people day care center. the victim was parked in front sitting behind the wheel of this marked day care van. the man had arrived to pick up a child and it merely grazed him. >> he was waiting inside his vehicle when a red vehicle, unknown make and model at this time, pulled up and opened fire. >> reporter: now, the only information that we have about that vehicle was that it was a red car with tinted windows. as far as the victim is concerned, we are told that he concerned, we are told that he is supposed this evening and fortunately there were no children outside at the time of this incident. live in capital heights, maryland. erika 25- news4. tonight a worldwide search for a teacher accuse of sexually abusing a special needs student in montgomery county. police think she's fled to hong kong. 25-year-old sharon kua taut at the frost school in rockville. she twice went®1#0óx0 t a

the brakes were working fine and alcohol was not a factor. nbc's jay gray has our report. >> the executive director of the employees union says 46-year-old engineer william rockefeller who was injured in the crash said he caught himself nodding off at the controls. rockefeller told police he zoned out and doesn't remember any of the events just before the metro-north commuter train left the tracks. according to transit sources, after years of working the afternoon night shift, his schedule changed to early mornings just two weeks before the accident. rockefeller was on the second day of a five-day workweek. >> every indication he would have had time to get fully restored to sleep. >> when he realized there was a problem he reached for the brakes and they failed. but data recorders pulled from the wreckage show the brakes were applied just five seconds before the sliding and tumbling railcars came to a stop just inches from the harlem river. >> there's no indication that

the brake systems were not functioning properly. >> a union official says rockefeller is, quote, extremely distraught over the loss of life. he's very traumatized. he's trying to put it all together. and that's what investigators are trying to do after the deadliest new york train crash in the last 20 years. jay gray, nbc news, new york. tonight we know a man intentionally set himself on fire before running into an ocean city church and setting the building ablaze. john sterner purchased gasoline before storming into st. paul's by the sea church last tuesday. he was killed and a reverend of the church also died from smoke inhalation. breaking news out of arizona tonight. we're learning that three sky divers collided in midair tonight. this video just coming in to our newsroom. two were killed, a third person was injured. this happened in the town of eloy, 60 miles southeast of phoenix. police say the sky divers collided 200 to 300 feet off the

ground. at that point, the chutes collapsed and the sky divers plummeted to earth. it's not clear what caused the collision. turning now to politics and the d.c. mayor's race, one day after filing for re-election. mayor vincent gray is upset over questions he's getting. this appearance was meant to high lie d.c.'s egg economic development during his term in office. he says he's running on his record and refuses to answer questions into the federal probe that is still on going. tom sherwood was at that news conference and found out that gray didn't like the media crowd leaving the room, either. >> i want to talk about the future of the district of columbia. i am a native washingtonian. i have given virtually my life to this city. this is the washington redskins game? >> gray is a press secretary also argue we'd a reporter from the washington city paper claiming that the mayor has a

stronger record on development than his predecessors. and just moments ago, tom sherwood also confirmed that tomorrow he will form an expl e exploratory committee for a possible run for mayor. he's an independent and has until june to decide to launch a campaign on his own. he's the fifth member of the city council who is in the mayor's race or is considering it. he's been a member of the council since 1997. just hours away now, walmart officially opens its doors in the district tomorrow. the mega retailer will open two stores. one on m street, the other, georgia avenue. we got a sneak peek inside the h street store where workers were busy getting ready. earlier this year walmart threatened to pull of the of the district because of a bill that would have required workers to get paid at least $12.50 an hour. mayor gray veto'd that bill but tonight a possible compromise over a fight for higher pay.

the d.c. council unanimously voted to raise the minimum wage from $8.25 an hour to $11.50 an hour by 2016. the council has to vote on the measure again later this months before it goes to the mayor's desk. prince george's and montgomery counties passed similar measures last week. consider yourself warned, any holiday parties in fairfax county will have to be a little quieter this year. tonight the county's board of supervisors unanimously passed a new measure that makes excessive noise a criminal offense. anyone responsible for loud music, car horns, barking dogs and more could face a fine of up to $500. earlier noise ordinance could not be enforced after a state supreme court ruling in a virginia beach case called it into question. next tonight, cellphone video captures an all out brawl inside a maryland mall. for a woman questioned for shoplifting and forced to pay a hefty fine even though she was

back to the breaking news from the top of our broadcast. a d.c. police officer and

suspect shot tonight on queens street in northeast, both of them in the hospital. officers from the gun recovery unit were out on queens street just after 9:00 tonight. a shootout started with the suspect. it's not clear what led to the gunfire. police are not releasing the officer's condition but they say he is conscious and breathing. the suspect's condition is not known. police hope this cellphone video will lead to an arrest after a black friday brawl here at the annapolis mall. 17-year-old girl says a woman approached her at the victoria's secret store and accused her of assault and the suspect started throwing punches. another person joined in knocking the teen to the ground and hitting her in the head. the victim says she's never seen the two women before. it's a controversial tactic used by some stores to prevent shoplifting, suspected shoplifters held inside the store and then asked to pay a fine to avoid getting sued. lots of stores do it and it's perfectly legal.

a woman says she decided to use an escalator just outside of a macy's in new york because the one inside the store was broken. security stopped her because she left the store and she was forced to pay a $500 fine. eventually her shoplifting charge was dismissed in court but macy's will not return her money. >> i was so humiliated, i couldn't sleep. i felt so bad. >> what would you like from macy's now? >> an apology. >> stores say preventing shoplifting keep costs down but they say no one should have to pay a fine before going before a judge. this week marks the tenth anniversary of one of the most notorious unsolved murders. nancy dunning was a well-known real estate agent and the wife of alexandria sheriff jim dunning. he died in 2012. tomorrow police are holding a news conference to announce that his death does not change the

investigation and a new team of detectives is now on the case. for the first time the victim's son chris is speaking on camera, only to news4. he was the one who discovered her body. >> if there was an arrest, she's still gone. i still have to move on with my life. and so i've had to focus on that. >> friends will remember nancy dunning friday night by placing candles along mt. vernon avenue. >> interesting phenomenon surrounding a piece of september 11th artwork has a lot of people online asking tonight, can you see it? take a look at what's been dubbed the angel of 9/11. a piece of twisted steel from the world trade center is being installed inside the national spl september 11th museum in new york. they can make out a sad looking face on that steel. do you see it? visitors will have a chance to see for themselves when the museum opens next year. >> i can see it. >> you can see it. >> it's close. so, really warm earlier

today, but we're about to be in for another change, huh? >> but first we're going way up. temperatures tomorrow will be about the same and then we go up about ten degrees and then we come crashing down by 20 or 30 degrees. that's the roller coaster with call fall as we head in towards winter and, of course, we are now in december. that's meteorological winter. a great thing that happened earlier today, winter spirit, christmas, the lighting of the christmas tree out there at the capitol today. it's coming from washington state. 88-foot i thingleman spruce. decorate with more than 5,000 homemade ornaments from kids around the country. pretty cool. it will be lit up until 11:00 right on through the holiday season. out there right now looking at a nice night. temperatures around 43 degrees. winds are calm. we are seeing those clouds on the increase but that's really going to be the only thing we're dealing with. temperatures are going to be on the mild side. 39 in gaithersburg. 32 in frederick. 36 leesburg. 36 in culpeper.

i don't expect numbers to go down all that much more as a result of the cloud cover moving in. that is not the case out to the west. here we sit at 43 degrees. denver, colorado, right now at 12. they were at 56 earlier today. it now feels like temperatures in the negative numbers. 60-degree difference in one day, and, yes, they're seeing snow in colorado. the cold air will move our way although it's not going to be quite that cold. satellite and radar making its way right on in across the area. i think we're going to be in with the clouds over the next couple of days. here's future weather. this was 6:00. nice and mild. temperatures in the 50s today. cloudy and mild during the day tomorrow. i do think we will see some sun but mostly cloudy skies through the afternoon. still going to be seeing temperatureses in mid 50s. on thursday, ahead of the front that's making its way our way we'll see a nice southwesterly wind. it will warm things up in the 60s for sure. on friday, the day of transition. we have a lot of days of transition this time of year. warm in the morning to the cold temperatures coming in late in

the afternoon and it will be raining in the afternoon. some of that rain could be moderate to heavy. it will be a cold rain and just to the west this rain will change to snow back towards pittsburgh. that's the cold air. that's what will come in just in time for the weekend. so we are in for one big roller coaster over the next couple of days. 55 tomorrow in washington. 55 in whmanassas. a nice mild afternoon on our wednesday. thursday, warm. 66 with plenty of cloud cover but 66 is a nice temperature. 60 early on friday but then falling temperatures during the day. a good chance for rain on friday but then here comes the cold air. a high of only 41 on saturday. only 36 on sunday. and sunday's a day to watch. the cold air could be in place long enough that as rain moves in we could be seeing that come down as freezing rain, maybe sleet or even some snow early on sunday. it could last for part of the day sunday and into monday. so this is something we're going to watch very, very closely. you notice though on monday we warm up to 48 degrees. so no more of that frozen
