nbcwashington.com. we finally climbed above freezing today, but get ready for another round of winter weather. >> doug kammerer is here with more on the timing of when this will start moving through. >> the timing will be the key and critical aspect. it's not a big storm. the rain and snow out towards the west, making its way our way, but because of the timing, and because of the colder temperatures, we do have freezing rain potential. that's why the national weather service has issued a freezing rain advisory for just about the entire area. in and around d.c., gaithersburg, leesburg, manassas, we do have the advisory in effect through tomorrow morning nothing on the radar right now, but all you have to do is widen a bit this will all come together to give us that area of freezing rain. it's all dependent on the

temperatures 37 in d.c., 34 in ghaithering burg, 34 in manas s manassas, and that's when we'll start to see the -- i'll let you know when you can sxekd to see the worst situation in your area. area prosecutors will have to retry a man charged in connection with a police officer's death, because today the judge declared a mistrial after receiving an e-mail from a juror. it's an unexpected turn of events that has the office's family furious. tracy w tracee wilkins joins us. >> reporter: the prosecutors -- darvita caldwell is the juror responsible. in february she'll be coming back to prince georges court and this time facing a contempt of court hearing. that's just how serious this all

is. in the meantime, prosecutor been will be reparing to retry this case. >> going back through all of this is going to be hard. >> reporter: they were close to a resolution in the trial of her son's death, but now a mistrial means she'll have to do it all again. >> we have to go over it again, and we want to move on. it's been very hard dealing with the situation. >> reporter: he was facing a possible manslaughter conviction. moreries was killed back in 2012 after his police car crashed during a high-speed chase on the beltway. he and his officer were chasing suspects accused of stealing a woman's purse. police say neal was behind the wheel. >> his actions on august 20th contributed to the death of officer morris. >> reporter: but after three days of testimony and a few hours of jury deliberation, one of the jurors asked to be excused from the trial due to

her religious beliefs. >> our understanding is there was an e-mail sent to the judge at about 1:00 in the morning from a juror who said that her religious beliefs would disallow her from sitting in judgment of another human being. >> reporter: the two alternates who could have replaced the juror where are excused before deliberations began, so now new jurors will have to be selected. a lot of time and money for the state attorney's office. >> we spent tremendous resources prosecuting this case, and i believe it was cuss graceful what occurred today in this courthouse. >> reporter: part of the reason this juror will have a contempt trial is evidently after she sent that e-mail overnight, when she was in court this morning talking to the judge and defending why she thought she shouldn't be a juror her store kept changing, so that's going to be what they sort out when she comes back to trial. coming up, how does something like this happen? the state went through a lot to make sure the jurors would be

able to be here throughout the end of this trial. we'll have more. five sailors were in that chopper crash. it went down into 412 degree water some 20 miles from virginia beach. four were rescued from the water, two of them later died. searchers looked for the missing sailor until this afternoon and gave up on an active search. one of the survivors was released from the hospital today. the other may be discharged tomorrow. they were identified as sailors from north carolina and california. we still don't know what caused that chopper to crash. meantime, searchers have now recovered the bodies of four air force crew members killed in a helicopter crash in england. they died tuesday in a low-eight attitude training exercise. today the air force released photos, showing three of the service members. so far we know one is from idaho and the other from vancouver, washington state.

by edward snowden, a classified pentagon report reveals that snowden stole 1.7 million documents, most about u.s. military actions. the report found that the leaks put troops at risk and caused terrorists to change their tactics. congressman holmes says the district is not the federal government and shouldn't be treated that way. she spoke out today about a bill she says would permanently prevent the city from spending local funds on abortion for low-income women. >> in three years of republican control of this house this is the fourth bill considered that would violate the rights of my local government and harm its female citizens. >> even if that big did pass the house, its not expected to gain any traction in the signal. about 90 minutes police

glue the cabdriver accused of shooting officer le boy last year is now mentally fit to stand trial. the judge ruled a trial date can be set for bashir, but as julie carey reports tonight, the defendant's attorney warn his mental stability may not last. it's been almost 11 months sing he was shot in the head while on motorcycle patrol.

into high pressure was arrested soon after when he crashed -- the police chase that followed. near death, he was rushed to medstar and somehow survived. >> i definitely think it's a miracle. it definitely was not his time to go. >> the officer continues to his therapy. in court documents, a forensic psychologist wrote that bashir was deeply and denly delusional. had thought official could communicate telepathically. he was for you mentally unfit to stand trial. the prosecutors told the judge today with medication, he's been judged mentally stable.

the judge ruled that he's competent to stand trial. the commonalty wealth's attorney drined comment, but outside the courtroom, the officer's wife said the ruling is agreed news. despite the warming weather, water crews are still busy. this was a main break at the -- they fixed it earlier today. officials with wsse said crews have remare more than four dozen breaks. they predict more as the river waters make it into the same. >> say that fast. tomorrow morning it will be tricky? >> it really is. it all depends on that critical temperature. at least for the early portion of the day.

more moisture will move in. we will see freezing rain. the advisory -- but the timing is a little different. 3:00 a.m. until 9:00 a.m. that's frederick over towards d.c., culpeper and fredericksburg, back toward the west, though, and up to the north, portions of west virginia, around washington county, that goes until 11:00 a.m. tomorrow. this will be the area that stays freezing rain the longest, back toward the west, the precipitation will start earlier, the freezing rain, maybe around 11:00, so culpeper, winchester, luray. by tomorrow morning this would be over. tomorrow morning, notice this area of pink here, that's the freezing rain coming through. rain down toward the south. as we move through the early morning hours, even around 8:00, we're starting to see that

right here in the storm center we're looking at the radar. nothing around our region yet, but all you have to do is drag the map off to the west, you see that snow. rain down toward the south and kentucky. that's what's moving our way. because of that and the fact we'll see you're temperatures drop overnight, we have a freezing rain advisories, in effect for about the entire viewing area until 9:00 a.m. tomorrow morning. we could see problems on the roadways. you may have ice on your car when you wake up. be prepared to scrape that off tomorrow morning. we'll have the timing of this all coming up in just about ten minutes. thank you, doug. a deadly shooting that was an accident at the home of a prominent pastor, the victim just 23 years of age. tonight we're hearing from the family of that victim. they say he was an aspiring model. this unfolded overnight pat collins has the latest on this.

>> reporter: wendy, they were all friends, just getting together. for some reason they started playing around with a gun, and now, now one of them is dead. in this farmhouse owned by tony and cynthia brazelton, a prominent religious family, a young man shot to death this morning in what police are describing as a tragic accident. the victim identified at 23 years old eric lamar pratt. he was a model, constance wilson is his aunt. >> it's an unexpected tragedy, and we never plan for these things, so we just try to cope as they come and we're asking that the privacy be respected. >> reporter: police say there were five people at the house at the time, three men, two women.

they say they were fooling around with a rifle when it happened. julie parker is with the prince george's county police. >> this group was playing around with a gun. that gun went off. tragically it hit the 23-year-old man in the head. >> reporter: no charges in this case? >> no charges filed at the time. >> reporter: how would you characterize it? >> we would call this a tragic accident. >> reporter: according to real estate records, this home in the 107-acres surrounding it you are owned by tony and cynthia brazeltons. they're well known because of their association with the victory christian church international, a large and popular assembly off st. barn abus road. we attempted to talk to them today. so far, no response. now, this is the first time in recent memory that someone? pring georges county has died as a result of an accidental

shooting. live at headquarters, pat cottens, news 4. within the past few minutes fire officials have released the identity of the 4-year-old boy who died in the apartment fire last night. his name is lancelot quorshi. he died last night. firefighters rescued about 20 people, but the little boy died in that fire. the family tells news 4 the boy's father was badly burned trying to rescue him. the blaze began in a kitchen and has been ruled an doesn't. firefighters tell us the apartment's smoke detectors were working and likely saved other lives. the parents of a missing man featured in a for thea that went viral say they're determined to get their son the help he needs. nicklas simmons went missing on new year's day. an associated press photographers snapped this photo of the 20 years old who looked homeless.

a few days later right here in washington the family saw the picture on facebook. the young man's parents say the family is still not sure why he left. today we learned which communities will get a financial boost from the federal government. president obama revealed the first promise zones. they're going to be in philadelphia, los angeles, san antonio, southeastern kentucky, and the choctaw nation of oklahoma. federal officials will work with local business leaders to expand opportunities for jobs, education and housing. >> anybody in this country who works hard should have a fair shot at success, period. it doesn't matter where they come from, what they look like, what their last name is, they should be able to success. >> reporter: the white house will pick 15 more promise zones. mare yor gray clashed with reporters today who were asking about his troubled 2010 campaign that remains until criminal

investigation. gray made a general apology yesterday for the flawed campaign, but declined to discuss specifics. the mayor plans to kick off his new reelection bid on saturday. tom sherwood has the story. >> jim, the mayor has never explained his role in that 2010 campaign, but questions about it aren't going away. arriving at a library event downtown. the mayor didn't want to comment on the general apology he made wednesday for his troubled 2010 campaign or his statement that he can't apologize for what others did illegally. >> i have nothing further to say, tom. >> reporter: the mayor got irritated when news 4 said we would press all day, if necessary, for an answer. >> i'm look -- >> don't stop me, tom, you know. don't use language lie that. >> vernon hawkins and three others have pled guilty to felonies as part of gray's 2010.

and the health and fitness expo kicks off saturday downtown. >> the excitement is in the air. doreen joins us with some of the free health screenings, you will want to take part in. >> you know we have been working on this event for months. there's a lot going on, including some screenings specifically for men. george washington university hospita hospital. the number of men getting tested for prostate cancer has decreased significantly in recent months. last summer a government panel came out with new guidelines on prostate cancer screening, controversial guidelines have found more risks than benefits in widespread screening. a lot of experts disagree with those guidelines. >> well, it's very concerning to me because the d.c., the district of columbia, has the highest prostate cancer rate in the country. despite that, we have a decrease

will it be confined to certain areas? >> it will be. it will be those areas below 32 degrees or right at 32. most of that will be just to the north and west of i-95. we'll show you what's happening. winds out of the east. we are seeing the winds out of the east eventually out of northeast. that could help drive temperatures down a bit. storm team 4 radar, nothing to show right now, but this is the area we're most worried about for areas of icing tomorrow morning. dc, metro area will be i think okay. i think the road should be okay. gaithersburg, just west of fairfax, down through warrenton, frederick, martins burg, down through winchester and front royal, we are expecting from icing, and secondary roads could be a problem for early tomorrow morning. future weather, cold right now, freezing rain in and around 3:00, 4:00, 5:00 in the morning, rain down toward the south.

by around 8:00, notice d.c. metro area, points to the south mostly rain, with freezing rain continuing back toward the west. that's why we have that freezing rain advisory. then it's all rain throughout the afternoon as temperatures warm above that 40 degrees mark. in many location, the rain continues. on saturday, look what happens. some heavy rain comes in right around 1:00 in the afternoon, so heads up on saturday. if you have plans, expect rain. that's why it's a good idea to head toward the washington convention center. that's where we will be. storm team 4 at saturday on the main stage. we will have a q&a. 62 degrees for a high. 52 on sunday. sunday lots of sunshine, buttesy and a little bit on the cooler side. here's the next seven days. then next month, a high of 53, our next chance of rain after saturday comes on tuesday with a high of 46. over the next five days, guys, 2 to 3 inches of rain.
