th would have been his first court appearance since being brought back to virginia. nbc's david koehler. >> repor a packed courtroom at the general district court this morning right here in charlott matthew and hisinside both were supposed to be here to be part ofn two reckless driving charg. instead, those have been continue e were the very first charges fileded in co ed conneh hannah graham's disappearance. he walked into the police station, walked out, after asking for an attorney, and a short time later, police pulled him over for reckless driving. those have been pushed off to december. hearing, along with the more serious abduction with intent to defile charge. police deploying some new tactics, including flying a drone above certain parts of the search areas.

basicall traveled out e did not followuter banks and the orders of the court appoind supervisors, which were to get permission from court to travel out of town. now, we did look at the charging documents in these new charges against him. he faces two felony counts of aggrav sexual battery of a child. th child is under 13 years of age. this alleged incident, two incides happening at the same -- at the same time period. back in 2009. now, gardner was released from prison earlier this year. he is facing a retrial in that case. but, again, michael gardner is not getting out of jail. he is sitting in the adult detentn center right behind me, as we speak. his bond has been revoked on the
