system. news 4 megan mcgrath is live with a look at how this will affect your morning commute. megan? >> well, this project has had a lot of delays. the construction has dragged on for years. we will finally see the levee put in place for the first time later this morning. the potomac down into constitution and beyond. basically what will happen, if you look at the sidewalk and the road, there are metal posts in the ground re. in the event there's a flood or threat of a flood, they will pull the posts up out of the ground and snap panels between the posts. so those flood walls will go from 17th street up into the sidewalk. as you can see here, the concrete walls. so snapped into place creating a barrier across 17th street preventing floodwaters from being funneled down the road into the constitution,

protecting the white house and buildings further down constitution. we will see them practice this for the first time. that means 1st will be closed in between constitution and independence. that closures starts at 7:00 this morning and will remain in effect until 3:00 in the afternoon. back to you in the studio. >> all right. thank you, megan. today we may find out what led to week's midair collision. ntsb could release a preliminary report today. a small plane killed three people last week. both people on the plane survived. investigators are interviewing witnesses, survivors and air traffic controllers to find out what went wrong. in a few hours, one of the fbi's most wanted will be arraigned in court. prosecutors plan to seek the death penalty. eric frein was captured yesterday after seven weeks on the run.

three people inside. five others were injured >> a man charged in the high profile murder of an 8-year-old could eventually walk free. police say gregory murphy stabbed 8-year-old kevin to death when he was playing outside in 2000. since then, every time he has gone to court, murphy has been ruled mentally in competent to stand trial. defense lawyers want the criminal charges dropped and murphy committed. doctors, not the courts, could eventually decide to free him. >> he might be set free. he might be on your street with your child. and same thing might happen. >> a judge is expected to decide soon whether to drop the charges against him. in prince george's county, two police officers are in trouble with the law for attacking teens on surveillance video. the first incident happened in november 2012. officer jerry thomas is accused of hitting a handcuffed 15-year-old who was in lock-up.

a second case happened in november 2013. school resource officer picard assaulted a student at suitland high school. the chief calls it unacceptable. arguing problems with the jury hurt his case. mcdonnell and his wife maureen were convicted on corruption charges in september. lawyers claim they were unfairly swayed by pretrial media coverage. and a juror was dismissed days into the trial. he was dismissed becausee touthe case with his attorney. that attorney says other jurors may have deliberated with each other before they were supposed to. tonight expect thousands of people in georgetown to show off their costumes, go bar hopping. this is video from previous
