system. news 4 megan mcgrath is live with a look at how this will affect your morning commute. megan? >> well, this project has had a lot of delays. the construction has dragged on for years. we will finally see the levee put in place for the first time later this morning. the potomac down into constitution and beyond. basically what will happen, if you look at the sidewalk and the road, there are metal posts in the ground re. in the event there's a flood or threat of a flood, they will pull the posts up out of the ground and snap panels between the posts. so those flood walls will go from 17th street up into the sidewalk. as you can see here, the concrete walls. so snapped into place creating a barrier across 17th street preventing floodwaters from being funneled down the road into the constitution,

protecting the white house and buildings further down constitution. we will see them practice this for the first time. that means 1st will be closed in between constitution and independence. that closures starts at 7:00 this morning and will remain in effect until 3:00 in the afternoon. back to you in the studio. >> all right. thank you, megan. today we may find out what led to week's midair collision. ntsb could release a preliminary report today. a small plane killed three people last week. both people on the plane survived. investigators are interviewing witnesses, survivors and air traffic controllers to find out what went wrong. in a few hours, one of the fbi's most wanted will be arraigned in court. prosecutors plan to seek the death penalty. eric frein was captured yesterday after seven weeks on the run.

he is accused of opening fire on two state troopers. he is being held in the same police barracks this morning. one of the troopers was killed. the other seriously hurt. the fallen trooper's handcuffs and squad car were you used in the arrest. it was an anonymous tip that led to the capture. he was found hiding in an hangar near an airport. aaron and eun, back over to you guys. >> 4:35. today a judge could decide whether the redskins can sue several native american tribes over the team names. they were responsible for asking the u.s. patent and trademark office to cancel the trademark earlier this year. the native american groups want the lawsuit dismissed. they say the team should sue the trademark office instead. but federal law allows them to sue individuals who sought the trademark cancellation. before you send your child

three feet away from everyone until november 10th. nurses in the district are joining a national fight against ebola. in two weeks, nurses at providence in northeast d.c. will be among thousands to hit the ticket line. this is calling for safer standards for nurses and doctors. the hospital hopes to avoid the strike but will stay open if it happens. all clear following a bizarre scene in montgomery county. a hazmat responds at wheaton mall as a yelled she had ebola. hazmat was called in as a precaution. the woman has no symptoms. it's not clear why she was being served with the original warrant or whether she will face additional charges. the lava on the big island of hawaii is moving closer and closer to homes. it could move over a major road in pahoa any time now.

that's why national guard troops are in the area. they are trying to keep any residents or visitors away from the danger zone. coming from the kilauea volcano. it moves towards the ocean at 5 miles per hour. it has kept its distance from 100 feet from the nearest home there. still people who live in that area are evacuate ating, gathering belongings, getting out of there. also businesses in the area are closing. that's the latest from the live desk. 13 before the hour. new developments from kansas after a small plane crashed seconds after takeoff. they can't get in the building because it is not structurally sound. it is hampering the the investigation and recovery process. the pilot had taken off from the airport yesterday when he reported that he lost an engine. he crashed on the airport property killing himself and

three people inside. five others were injured >> a man charged in the high profile murder of an 8-year-old could eventually walk free. police say gregory murphy stabbed 8-year-old kevin to death when he was playing outside in 2000. since then, every time he has gone to court, murphy has been ruled mentally in competent to stand trial. defense lawyers want the criminal charges dropped and murphy committed. doctors, not the courts, could eventually decide to free him. >> he might be set free. he might be on your street with your child. and same thing might happen. >> a judge is expected to decide soon whether to drop the charges against him. in prince george's county, two police officers are in trouble with the law for attacking teens on surveillance video. the first incident happened in november 2012. officer jerry thomas is accused of hitting a handcuffed 15-year-old who was in lock-up.

a second case happened in november 2013. school resource officer picard assaulted a student at suitland high school. the chief calls it unacceptable. arguing problems with the jury hurt his case. mcdonnell and his wife maureen were convicted on corruption charges in september. lawyers claim they were unfairly swayed by pretrial media coverage. and a juror was dismissed days into the trial. he was dismissed becausee touthe case with his attorney. that attorney says other jurors may have deliberated with each other before they were supposed to. tonight expect thousands of people in georgetown to show off their costumes, go bar hopping. this is video from previous

halloweens. it's friday night, so expected to be even busier. you can't park on k street from 30th northwest. parking will be restricted on m street from 25th to the key bridge. parking restrictions will be in effect until 6:00 a.m. tomorrow morning. be safe out there. popular pub crawls making a come back. a halloween themed crawl will be held tomorrow. they have been on hold six months after a wild scene over the summer. a pub crawler stripped make naked and ran from police. you have to get a special events permit for a crawl. a lot of officers are going to be working a lot of additional patrols because of halloween being on friday night. >> we want to turn to tom kierein. of course everyone wants to know what to do with the kids.
