just a few minutes ago, about five minutes ago, all the police officers left the scene here on perry. this is where they tell me kay nine units tracked a suspect who had earlier attempted to attack one of their officers in his patrol car with an axe. that actual attack happened in the 3800 block of 13th street. just a couple of blocks away and not far from the franciscan monastery. the patrol officer was actually patrolling his beat and in an alley when a man came out of nowhere, police tell me, and hit the officer's car window. the officer was not hurt. not injured in the actual axe attack. but in the struggle with the suspect, the officer injured his shoulder. now, just a little while ago we spoke with a resident who lives on perry where police were out here for about 30 minutes before they left. and here's what she had to sa

to school in temple hills. it happened on brinkley road. he said a car pulled in front of him on his way to the bus stop and a man got out with a gun. a woman in the car told him to get to the back seat. i boy ran away and told his teacher when he got to school. they have a vague description of the suspects and the car. what led to last week's midair collision. the ntsb could release a preliminary report. a small plane and helicopter crashed into frederick municipal airport killing three people last week. the helicopter involved was part of a flight school. both people on the plane survived. >> george mason closed today because of sewer problems. students will not have to make up the last day. even though it is closed, the white house halloween trip is still on for students already approved to go. school officials say the buses will leave and return at their original times. coming up on five minutes after the hour. a judge could decide whether the

6:15, breaking news right now. a d.c. police officer was sitting in this car in northeast washington when a man charged at him with an axe. this happened three hours ago on 13th street. we're told the axe never actually hit the officer. but he did hurt his shoulder while struggling with the suspect. that officer in the hospital right now. in the last 30 minutes we learned there is not a good description of the suspect. we're staying in touch with molette green. we will keep you posted with what we hear. a developing story. in a few hours, a pennsylvania fugitive accused of shooting and killing a state trooper and wounding another will stand in front of a judge for his arraignment. this is new video of eric frein

from overnight. jay gray has more on how this came to an end. jay, good morning. >> reporter: good morning, to you, eun. this is where eric frein was held first after he was captured by police. in the late afternoon hours here yesterday. he is in the county jail now. he was transferred there overnight. as you talked about, he will be arraigned later this morning. his first court appearance long and difficult trial. they have been searching for this man for 48 days. he was a survivalist, somebody they said was a very skilled marksman. there were more than 1,000 officers involve in the seven. federal, state and local officers combing the back woods, rugged terrain here in northeastern pennsylvania. and they happened upon him near an abandoned airport. just a small airport in the pocono mountains.

freed. unacceptable. describing the alleged actions of two officers facing assault cases. the chief announced the charges yesterday. officer jerry thomas is charged with hitting a you you handcuffed 15-year-old in lockup in november 2012. a year later, school resource officer charles picard is accused of assaulting a student at suitland high school. both officers are suspended. now to a developing story in hawaii. the national guard is sending troops to the town of pahoa as lava makes a slow crawl toward a major road and threat especiallies to further isolate the community. more than 80 troops will provide security and help with road blocks. lava from the kilauea volcano has been advancing since june. on average 5 miles per hour. . new this morning, for the first time riches of a passenger

aboard the missing malaysian flight are taking legal action. the sons of a father aboard the missing flight 370 are suing the airline and the malaysian government. the lawsuit aims to find answers to what actually happened on board the plane when it disappeared. the plane was 239 passengers mysteriously vanished eight months ago during a scheduled service between kuala lumpur and beijing. marijuana could be a cash cow for the district. finance officials say sales could bring in $20 million in tax revenue. if the measure passes, congress will not review the bill until next spring. then d.c. officials would take six months to write regulations. stores would not open until sometime in 2016. what do you use your smartphones for? most of us don't use it to make a phone call. halo found the majority of us use it for the alarm clock or to send text messages or e-mail.

6:24. parole officers keeping an eye on sex offenders to keep your children safe. the virginia va department of corrections will monitor from all over the state. they are required to remain at home with lights out and not answer the door for trick or treaters. if offenders are at home they must be at a state-sanctioned meeting. police will also make random home visits. you are looking at the intense moments when a stranger helped save a man's life near l.a. a driver crashed into an above groundwater main. the man passed out behind the wheel, all the while water was gushing in and started to fill his car. a woman saw the whole thing happen and jumped out to help the deputy. >> subway riders in new york city probably thought they were part of an early halloween prank. the train was stopped when all of a sudden a giant drill

pierced the tunnel ceiling. have to take a look at this picture to believe it. the new york transportation official say crews were doing work above the tunnel when a worker mistakenly drilled through the ceiling. you can see number one how large that drill is and how close it was to the side of that train car. can you imagine if you're a passenger right at the window and that's what you see. >> everybody had to get off the train and walk through the item to get back on the platform because of the potential danger there. well, just two days daredevil nik wallenda is upping the ante with his death-defying stupblt. he will attempt a terrifying two-part walk. the walk is up a 15-degree incline. the second park gets even scarier. he will walk from marine tower west to east blindfolded. >> more power to him. be careful.

major road closures in the district. crews will shut down 17th street on the mall. they are getting ready to test a nulevee system. megan mcgrath with a look at how it works and the impact on your commute. megan? >> reporter: well, traffic still moving on 17th. that is not the case much longer. look at the truck over there. those are pieces of the flood wall they will snap in place later on this morning. that meanings they will have to close down between independence and constitution. it will not impact evening rush hour. what they are doing is practicing putting up the brand-new flood wall they have been working on. a series of posts will go across the roadway. they will snap panels into place. it will create a wall that will stretch all the way across 17th street and snap into this concrete wall you see over here to the side. the idea is if there's threat of

flooding, this wall will stop the waters of the potomac from funneling down 17th to constitution to the white house and to the buildings here in this area which is a bit of a low spot here. so this is the first time they have practiced snapping the wall into place. they're going to start at 7:00 and apparently be done by 3:00 in the afternoon. you should be okay for this evening's rush hour. megan mcgrath, news 4. thank you, megan. . a man who murdered a high school student learns how long he will be behind bars. trevon bennett was convicted of murdering ross in 2012. he was walk to go high schoo capital heights ene s killed. the murder happened during an attempted robbery. bennett was convicted of both of those things. he could spend the rest of his life in prison. d.c. police need your help finding a man responsible for robbery and sexual assault yesterday morning on 16th near bladensburg road northeast. the woman was walking along street when a man appacd her, took h bogan sexually assaulted her.

the victim describes the man at 5'6", in his 30s with a css taoon s ghchk. i mother is searching for answers in the murder of her son. her son went to grab a slice of pizza on this day last year. 2:20 in the morning, someone shot and killed him in the 200 block of shepherd street northwest. police are offering a $25,000 reward for information leading to an arrest and conviction in this case. tomorrow friends and family will have a memorial service at the alleyway where he was killed. a locker room choking led to the cancellization of a game don't in loudoun county. their game with north stafford will not be made up. according to the freelance star a student was choked, passed out and his head hit against a

locker last week. school officials say one student has been disciplined. others were counseled. they said it was horse play gone wrong. new questions this morning about the jury in the bob mcdonnell trial. lawyers for the former governor say jurors were unswayed by pretrial media coverage. a juror who was dismissed early said he believes the other jurors may have deliberated with each other before they were supposed to. mcdonnell called for a new trial because of the potential juror problems. parents, now is your chance to weigh in on next year's loudoun county school calendar. several options include starting before labor day, having a longer winter break and ending school june 10th. loudoun county received a winter to start school before labor day because of all the snow days in the last five years. the school board is set to adopt a new calendar december 2nd. . 6:36. you may want to start seeing some new signs as you head out

on the way to work. vdot will start unveiling for the new 95 express lanes. the lanes will open in december. they want to know that e-zpass will be required once the lanes are open for business. transportation officials remind drivers that normal hov restrictions will remain in place until the new lanes are open. well, 7-eleven is taking a bat mini-mart to court for trade morning infringement. a 7-eleven spokeswoman said the company has an obligation t protect its brand. it is challenging operators of this 7-even shop in baltimore. 7-even is using the the same lettering and logo pattern as 7-eleven. the store is even sel slurpee. we called and no one is calling us back. construction slowing down a busy part of the beltway. this morning the new plan to try

window with the axe, striking the car window but not the officer. but the officer was injured, injured his shoulder in the struggle with the suspect. the officer got out of his car and tried to catch the guy. but he was able to get away in the alleyway that is just behind me here at the scene. several officers set up on perry street waiting to see if they could find this guy there was not much of a description. only that the man was wearing a black jump suit. the suspect is still at large this morning and faces felony assault on a police officer while armed once they catch him.

the pentagon security team sent out a memo last night that cautioned employees to be careful about displays credentials in public or social media. there is no specific threat. they want people to be vigilant at home and at work. it came days before increased security at some government buildings. we are learning more about those denver teens accused of trying to join isis. the teens became radicalized and had been talking to an isis recruiter for a year. they made it all the way to swr germany before stopped by authorities. a plane crashed section after takeoff. they can't get into the building because it is not structurally sound. they had just taken off from the airport yesterday when he reported he lost an engine. he crashed into a building on airport property, killing himself and three people inside.
